सा.का.नि. 70 (अ) . केन्द्रीय सरकार सीमा शुल्क अधिनियम , 1962 ( 1962 का 52 ) की धारा 25 की उप- धारा ( 1 ) द्वारा प्रदत्त शक्तियोंका प्रयोग करते हुए, यह समाधान हो जाने पर कि लोकहित में ऐसा करना आवश्यक है , भारत सरकार के वित्त मंत्रालय ( राजस्व विभाग ) कीअधिसूचना सं. 39/96-सीमा शुल्क, तारीख 23 जुलाई , 1996 , जो भारत के राजपत्र , असाधारण , भाग II, खंड 3 , उप -खंड ( i ) , में सा.का.नि. 291 (अ ) , तारीख 23 जुलाई , 1996 में , को प्रकाशित हुई थी, निम्नलिखित और संशोधन करती है , अर्थात
उक्तअधिसूचना में, सारणी में, क्रम सं 36 और उससे सबंधित प्रविष्टियो के पश्चात् निम्नलिखित क्रम स ओर प्रविष्टियां अंतःस्थापित की जाएंगी , अर्थात:-

यदि,
(क ) उक्त माल का आयात इंटरनेशनल थर्मोन्यूक्लीयर एक्सपेरीमेंटल रिएक्टर ( आईटीईआर ) कार्यक्रम के अधिकृत कर्मशाला केन्द्रों द्वारा , जो किसी ऐसे अधिकारी द्वारा जो भारत सरकार के परमाणु ऊर्जा विभाग में उप- सचिव की पंक्ति से नीचे का न हो , अभिहित की जाएं किया जाता है , और उपस्कर, उपकरण , संघटक , अतिरिक्त पुर्जे, जिग , फिक्चर , डाई , औजार, उपसाधन, 'कम्प्यूटर साफ्टवेयर , कम्प्यूटर हार्डवेयर , कास्टिंग , फोर्जिंग पाइपिंग , ट्यूबिंग , रसायन , जीव रसायन , रेफ्रिजेन्टस , कच्चा माल और उपभोग्य
(ख ) आयातकर्ता आयात के समय हरेक मामले में , सूची में उक्त माल प्रोजेक्ट निदेशक ( आईटीईआर ) इंडिया प्रोजेक्ट से संबंधित है, सीमा- शुल्क उपायुक्त या सीमा- शुल्क सहायुक्त , जेसा भी मामला हो, को प्रस्तुत करेगा
(i ) उक्त सूची में दर्शाया गया माल आईटीईआर- इंडिया प्रोजेक्ट के लिए है; (ii ) उक्त माल उक्त प्रोजेक्ट के लिए ही उपयोग किया जाएगा । "

GS.R. 70(E) . In exercise of the powers conferred by sub -section ( 1 ) of Section 25 ofthe Customs Act, 1962 (52 of 1962), the Central Government on being satisfied that it is necessary in the public interest so to do, hereby makes the following further amendments in the notification of the Government of India in the Ministry of Finance (Department of Revenue) , No. 39/96- Customs , dated the 23rd July, 1996 published in the Gazette of India , Extraordinary, Part II, Section 3, Sub-section ( i) , vide number GS.R. 291 (E) , dated the 23rd July, 1996, namely:-
Inthe said notification , in the Table , after Sl. No. 36 and the entries relating thereto, the following Sl. No. and entries shall be inserted, namely :----

"37 . Machinery, equipment instruments , If,--- components , spares , jigs , fixtures , dies, (a) the said goods are imported by authorised works centres of the tools , accessories , computer software , International Thermonuclear Experimental Reactor (TTER)-India, computer hardware , castings , forgings Institute of Plasma Research, as may be designated by an officer piping, tubing , chemicals , bio- chemicals , not below the rank of Deputy Secretary to the Government of refrigerants , raw materials and consu- India in the Department ofAtomic Energy; and mables .
(b) the importer produces to the Deputy Commissioner of Customs or theAssistant Commissioner of Customs , as the case may be, at the time of import , in each case , a list of the said goods with their relevant description duly certified by the Project Director, ( ITER)-India project, to the effect that-
(i) the goods mentioned in the said list are required for the purposes ofthe ITER-India project:
(ii) the said goods shall be used only for the said project. "
