सा.का.नि. 76(अ).औषधि और प्रसाधन सामग्री नियम, 1945 का और संशोधन करने के लिए कतिपय प्रारूप नियम औषधि और प्रसाधन अधिनियम , 1940 ( 1940 का 23 ) की धारा 12 और धारा 33 की अपेक्षानुसार भारत के राजपत्र , असाधारण , भाग II , खंड 3 , उप- खंड ( i ) , तारीख 21 दिसम्बर , 2010 में भारत सरकार, स्वास्थ्यऔर परिवार कल्याण मंत्रालय ( स्वास्थ्य विभाग ) की अधिसूचना संख्यांक सा.का.नि. 988 ( अ ) , तारीख 21 दिसम्बर , 2010 द्वारा प्रकाशित किए गए थे. जिसमें उस अधिसूचना के प्रकाशन की तारीख से पैंतालीस दिन की अवधि की समाप्ति के पूर्व उन व्यक्तियों से जिनके उनसे प्रभावित होने की संभावना है , आक्षेप और सुझाव आमंत्रित किए गए थे;
और राजपत्र की प्रतियां जन साधारण को तारीख 23 दिसम्बर, 2010 को उपलब्ध करा दी गई थीं;
और विनिर्दिष्ट अवधि के भीतर उक्त प्रारूप नियमों पर किसी व्यक्तिसे कोई आक्षेप या सुझाव प्राप्त नहीं हुआ है ;
अतः अब , केन्द्रीय सरकार , औषधि और प्रसाधन अधिनियम , 1940 (1940 का 23 ) की धारा 12 और धारा 33 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , औषधि तकनीकी सलाह बोर्ड से परामर्श के पश्चात्, औषधि और प्रसाधन सामग्री नियम , 1945 का और संशोधन करने के लिए निम्नलिखित नियम बनाती है , अर्थात्:-

1. ( 1 ) इन नियमों का संक्षिप्त नाम औषधि और प्रसाधन सामग्री ( दूसरा संशोधन ) नियम , 2012 है ।
(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।
2. औषधि और प्रसाधन सामग्री नियम , 1945 में, नियम 127 के उप - नियम ( 1 ) में, --
(i ) ' प्राकृतिक रंग ' से संबंधित शीर्ष ( 1 ) नीचे ' ब्लैक ऑक्साइड ऑफ आयरन ' प्रविष्टि के पश्चात्, निम्नलिखित अंतःस्थापित किया जाएगा , अर्थात्:-
" टाइटेनियम डाइआक्साइड लेपित अभ्रक पर्लीसेंट वर्णक ";
( ii ) ' लेक्स ' से संबंधित शीर्ष ( 4 ) के पश्चात्, निम्नलिखित परन्तुक अंतःस्थापित किया जाएगा , अर्थात्:-
परन्तु अनुसूची थ के अधीन विनिर्दिष्ट कतिपय रंग विसंक्रमारी हो सकेंगे जो गैर अभिरंजक होंगे ।

टिप्पण:-मूल नियम शासकीय राजपत्र में अधिसूचना सं. एफ. 28-10/45- एच ( 1 ) , दिनांक 21 दिसम्बर , 1945 में प्रकाशित किए गए थे और अंतिम बार अधिसूचना संख्यांक सा.का.नि. 28 ( अ ) , दिनांक 17 जनवरी , 2012 द्वारा संशोधन किए गए थे ।

NOTIFICATION
New Delhi , the 8th February, 2012
GS.R. 76(F) . Whereas thedraft of certain rules further to amend the Drugs and Cosmetics Rules , 1945, was published, as required by Sections 12 and 33 of the Drugs and CosmeticsAct, 1940 (23 of 1940) , vide notification oftheGovernment of India, Ministry ofHealth and Family Welfare (Department of Health ) , number G.S.R. 988 (E) , dated the 21st December, 2010 , in the Gazette of India, Extraordinary, Part II, Section 3, Sub -section ( i) , dated the 21st December, 2010, inviting objections and suggestions from all persons likely to be affected thereby before the expiry of a period of forty five days from the date on which the copies of the Official Gazette containing the said notification were made available to the public;
And whereas copies of the Gazette were made available to the public on the 23rd December, 2010 ;
Andwhereas , no objections or suggestions received from the public within the specified period on the saiddraft rules.
Now, therefore, in exercise of the powers conferred by Sections 12 and 33 of the Drugs and Cosmetics Act, 1940 (23 of 1940) , the Central Govemment, after consultation with the Drugs Technical Advisory Board, hereby makes

the following rules further to amend the Drugs and Cosmetics Rules , 1945, namely:-
1. ( 1 ) These rules may be called the Drugs and Cosmetics (2ndAmendment) Rules , 2012.
(2) They shall come into force on the date of their publication in the Official Gazette .
2. In the Drugs and Cosmetics Rules , 1945, in rule 127, in sub- rule ( 1 ) ,----
(i) under the heading ( 1 ) relatingto 'Natural colours' , after the entry ' Black oxide of iron ' , the following shall be inserted , namely :-
"Titanium dioxide coated mica pearlescent pigments" ;
(ii) after the heading (4) relating to 'Lakes' , the following proviso shall be inserted , namely :-- "Provided that disinfectants may also contain colours specified under Schedule Q, which are non-staining.".

Note : The principal rules were published in the Official Gazette vide notification No. F. 28-10/45-H ( 1 ) dated 21st December; 1945 and last amended vide notification number G.S.R. 28 (E) , dated the 17th January, 2012 .
