का.आ. 249 (अ).- यतः केन्द्रीय सरकार ने, भारतीय राष्ट्रीय राजमार्ग प्राधिकरण अधिनियम, 1988 (1988 का 68) की धारा 11 के अधीन जारी की गई भारत सरकार के सड़क परिवहन और राजमार्ग मंत्रालय की अधिसूचना संख्या का.आ. 465 (अ) , तारीख 26 अप्रैल, 2002 द्वारा गुजरात राज्य में राष्ट्रीय राजमार्ग सं . 8 बी के 0.00 कि.मी. से 143.000 कि.मी. और 160.000 कि.मी. से 217.000 कि मी..तक (पोरबंदर से राजकोट से बामनबोर खण्ड) का खण्ड भारतीय राष्ट्रीय राजमार्ग प्राधिकरण (जिसे इसमें इसके बाद "प्राधिकरण " संदर्भित किया गया है ) को सौंपा है ;
अतः अब, केन्द्रीय सरकार, राष्ट्रीय राजमार्ग शुल्क (दरों का अवधारण और संग्रहण) नियम, 2008 (जिसे इसमें इसके बाद " उक्त नियम " कहा गया है) के नियम 3 के साथ पठित राष्ट्रीय राजमार्ग अधिनियम, 1956 (1956 का 48) की धारा 7 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, एतद्वारा गुजरात राज्य में राष्ट्रीय राजमार्ग सं. 8 बी पर 185.000 कि.मी. से 216.800 कि.मी. तक के खण्ड के उपयोग के लिए नीचे सारणी के स्तंभ (1 ) में विनिर्दिष्ट प्रकार के वाहनों पर चार लेन के खण्ड के उपयोग हेतु, निवल सड़क खंड की लम्बाई 31.800 कि.मी. के लिए सारणी के स्तंभ (2) में विनिर्दिष्ट दर पर शुल्क (जिसे इसमें इसके पश्चात् " आधार दर " कहा गया है) लगाती है और प्राधिकरण को अपने अधिकारियों के माध्यम से अथवा संविदाकार के माध्यम से उक्त शुल्क का संग्रह करने हेतु प्राधिकृत करती है, अर्थात:-

टिप्पणियां:
1. नीचे लगाया गया तथा संग्रहीत शुल्क देय और ऐसे टोल प्लाजा के लिए निर्दिष्ट सड़क की निवल लम्बाई हेतु निम्नलिखित टोल प्लाजा पर भुगतानयोग्य होगा :

2. वर्ष 2011-12 के लिए , स्थानीय निजी यातायात के संबंध में मासिरूक पास की दर 190.00 रूपए (एक सौ नब्बे रूपए मात्र) है जो, राष्ट्रीय राजमार्ग शुल्क (दरों का अवधारण और संग्रहण) नियम, 2008 के प्रावधानों के अनुसार, प्रत्येक वर्ष संशोधन के अध्यधीन है ।
3. राजमार्ग खण्ड पर बहुयात्राओं हेतु पास निम्नलिखित दरों पर प्रदान किया जायेगा, अर्थात्:

4. जिस जिले में शुल्क प्लाजा पड़ता है उस जिले में पंजीकृत वाणिज्यिक यान (राष्ट्रीय परमिट के अधीन चल रहे वाहनों को छोड़कर) के लिए शुल्क उस श्रेणी के यान के लिए निर्धारित शुल्क का 50% होगा बशर्ते कि ऐसे वाणिज्यिक यानों के उपयोग के लिए कोई सर्विस रोड अथवा वैकल्पिक रोड उपलब्ध न हो ।

5. जो यांत्रिक यान नियमों के अधीन अपने प्रवर्ग के लिए निर्धारित अनुमत्य भार की अपेक्षा अधिक भार से लदे हुए होंगे उन्हें उन दरों पर शुल्क का संदाय करना होगा जो उनसे अगली उच्च श्रेणी के यानों के लिए लागू होता है और उन्हें तब तक राजमार्ग खण्ड का उपयोग करने का अधिकार नहीं होगा जब तक कि ऐसे यांत्रिक यान से अधिक भार को हटा न दिया जाए ।
6. यांत्रिक यानों के प्रवर्ग, उनके लिए अनुमत्य भार, छूटप्राप्त यानों के प्रवर्ग , सर्विस रोड, वैकल्पिक सड़क आदि सहित सभी परिभाषाएं नियमों में विनिर्दिष्ट परिभाषाओं के अनुसार होंगी ।
7. उक्त नियमों के नियम 12 के अनुसार, उपयोगकर्ताओं की जानकारी के लिए शुल्क की दरों को प्रदर्शित किया जाएगा ।
8. उक्त नियमों के नियम 5 के अनुसार, शुल्क की दरों में वार्षिक रूप से संशोधन किया जाएगा बशर्ते कि छह महीनें के अन्दर कोई संशोधन नहीं किया जाएगा ।
9. परियोजना की अनुमानित पूंजीगत लागत 115 करोड़ रूपए है । प्राधिकरण द्वारा उपयोगकर्ताओं से वसूल किए गए शुल्क के जरिए पूंजीगत लागत की वसूली का रिकार्ड रखा जाएगा और पूंजीगत लागत की वसूली हो जाने के बाद लगाए गए शुल्क की दरों को घटाकर 40 % कर दिया जाएगा और उक्त नियमों के अनुसार इनमें वार्षिक रूप से संशोधन किया जाएगा ।

S.O. 249 (E ). Whereas by notification of the Government of India in the Ministry of Road Transport and Highways number S.O 465 (E) dated 26/04/2002 issued under section 11 of the National Highways Authority of India Act , 1988 (68 of 1988 ) , the Central Government has entrusted the stretch from kilometer 0.000 to kilometer 143.000 and 160.000 kilometer to 217.000 kilometer ( Porbandar to Rajkot to Bamanbore section) of National Highway No. 8B in the State of Gujarat to the National Highways Authority of India ( hereinafter referred to as the " Authority") ;
Now, therefore , in exercise of the powers conferred by section 7 of the- National Highways Act , 1956 (48 of 1956) , read with Rule 3 of the National Highways Fee (Determination of Rates and Collection ) Rules , 2008 ( hereinafter referred to as the " said Rules " ) , the Central Government hereby levies the fee at the base rate specified in columns (2) of the Table for net road section length 31.800 KM ( hereinafter referred to as " base rate" ) for the use of four lane section on the Type of Vehicles specified in column (1 ) of Table below, for the use of the section from kilometer 185.000 to kilometer 216.800 on the National Highway No. 8B in the State of Gujarat and authorises the Authority to collect , either through its officials or through a contractor , the said fee, namely: - THE GAZETTE OF INDIA : EXTRAORDINARY

1. The fee levied and collected hereunder shall be due and payable at the following Toll Plaza for net road length specified for such Toll Plaza:

2. The rate of monthly pass for local personal traffic is Rs . 190.00 (Rupees One Hundred Ninety only) for the year 2011-12 which is subject to revision every year as per the provisions of the National Highways Fee (Determination of Rates and Collection) Rules , 2008 .
3. For multiple journey on the highway section , passes shall be issued at the following rates , namely:

4. Fee for commercial vehicle ( excluding vehicles plying under National permit) registered in the district where the fee plaza falls shall be 50% of the prescribed rate for that category of vehicle provided no service भारत का राजपत्र असाधारण

road or alternative road is available for use of such commercial vehicles .
5. Mechanical vehicles which is loaded in excess of permissible load specified for its category under the rules , shall be liable to pay fee at such rates which is applicable for the next higher category of the vehicles and shall not be entitled to make use of the highway section unless the excess load has been removed from such mechanical vehicle .
6. All definitions including category of mechanical vehicles , its permissible load , category of exempted vehicles , service road , alternative road etc. shall be as per definitions specified in the rules .
7. The fee rates shall be displayed for information of the users in accordance with rules 12 of the said rules .
8. The fee rates shall be revised annually in accordance with the rule 5 of the said rules provided that no revision shall be effected within six months .
9. The estimated capital cost of the project is Rupees 115 Crores . The Authority shall maintain a record of the recovery of capital cost through user fee realised and after recovery of the capital cost, the fee. leviable shall be reduced to 40 % of the rates and shall be revised annually in accordance with the said rules .
