3. आयात लाइसेसिंग टिप्पणी ( 1 ) को संशोधन के उपरांत निम्नलिखित रूप से पढ़ा जाएगा :

" हथियारों (जिसमें उनके हिस्से भी सम्मिलित हैं ) और गोला बारूद का आयात निम्नलिखित खिलाडियों/खेल निकायों के लिए मुक्त रूप से अनुमत है:
सं. 95 ( आरई -2010 )/2009-2014
विषय : विशिष्ट खिलाड़ियों /खेल निकायों हेतु हथियार और गोला बारूद की आयात नीति में संशोधन ।
भारतीय राष्ट्रीय राइफल संघ (एनआरएई ) की सिफारिश पर सुविख्यात निशानेबाजों ( जैसा कि आयात लाइसेसिंग टिप्पणी 3 में परिभाषित है ) ; भारतीय राष्ट्रीय राइफल संघ ( एनआरएई ) के स्व-प्रयोग हेतु तथा अपने राज्य/जिले , जोकि भारतीय खेल प्राधिकरण द्वारा प्रमाणीकृत हो, को अंतरण हेतु, भारतीय खेल प्राधिकरण (एसएई ) अथवा संबंधित राज्य द्वारा स्व-प्रमाणीकृत राज्य खेल प्रमाणीकृत राज्यखेल प्राधिकरण तथा सर्विसेज स्पोर्टस कंट्रोल बोर्ड ( एसएससीबी) , रक्षा मंत्रालय आवश्यक रिकार्ड प्रमाणीकरण करने वाले अथवा सिफारिश करने वाले निकाय रखेंगे । "
का.आ. 256(अ) . विदेश व्यापार नीति, 2009-2014 के पैराग्राफ 2.1 के साथ पठित विदेश व्यापार ( विकास और विनियमन ) अधिनियम, 1992 की धारा 5 के तहत प्रदत्त शक्तियों का प्रयोग करते हुए , केन्द्र सरकार , निर्यात और आयात मदों के आईटीसी ( एच एस ) वर्गीकरण की अनुसूची -1 ( आयात ) में , एतद्द्वारा निम्नलिखित संशोधन करती है:
4. निर्यात और आयात मदों के आईटीसी ( एचएस ) वर्गीकरण के अध्याय 93 की वर्तमान आयात लाइसेंसिंग टिप्पणी ( 3 ) के पश्चात्निम्नलिखित टिप्पणी (4 ) को जोड़ा गया है:
2. इस संशोधन से पहले आयात एवं निर्यात मदों के आईटीसी ( एच एस) वर्गीकरण के अध्याय 93 में मौजूदा आयात लाइसेंसिंग टिप्पणी ( 1 ) नीचे उद्धृत है:
" टिप्पणी ( 4 ) एयर गन पिलेट्स ' के आयात की नीति मुक्तहै । "
" युवा मामलों और खेल विभाग , भारत सरकार की अनुशंसा पर सुविख्यात निशानेबाजों ( शूटर्स ) /राइफल क्लबों को उनके अपने प्रयोग के लिए हथियारों के आयात की अनुमति लाइसेंस के मद्दे दी जायेगी । तथापि , राइफल , क्लबों अथवा जिला/राज्य/राष्ट्रीय राइफल एसोसिएशन द्वारा पंजीकृत निशानेबाजों ( शूटर्स ) के लिए 0.177 बोर एअर गनों और एअर पिस्टलों का आयात मुक्त होगा । पात्र राज्य राइफल संघ/क्लबों और पात्र शूटरों को प्रदान करने के लिए 0.177 बोर एयर गन्स और एयर पिस्टल्स के मुक्त आयात की अनुमति, भारतीय राष्ट्रीय राइफल संघ ( एनआरएआई ) को भी होगी। एनआरएआई को आयातित हथियारों का उपयुक्त हिसाब रखना होगा । "
5. इस अधिसूचना का प्रभाव विशिष्ट खिलाड़ियों/ खेल निकायों द्वारा हथियार और गोला बारूद के आयात के लिए आयात लाइसेंस/प्राधिकार- पत्र जारी करने की प्रक्रिया को छूट प्रदान की गई है । एनआरएआई , एसएआई और एसएससीबी अपने स्वयं के अथवा अपने संबद्धों के लिए मुक्त रूप से हथियार और गोला बारूद आयात कर सकते हैं। विख्यात निशानेबाज अपने प्रयोग के लिए मुक्त रूप से हथियार और गोला बारूद का आयात कर सकते हैं। ' एयर गन पिलेट्स ' के लिए आयात नीति व्यवस्था ' मुक्त' रहेगी । यह अधिसूचना हथियार अधिनियम , 1959 अथवा उसके तहत नियमों से 426G1/2012

3. After amendment the Import Licensing Note ( 1 ) would read as below :
विशिष्ट खिलाड़ियों/खेल निकायों को छूट प्रदान नहीं करती है; अपितु केवल आयातकों के लिए विशिष्ट वर्गों के लिए आयात नीति व्यवस्था में संशोधन करती है ।
"Import of arms ( including parts thereof) & ammunition is permitted freely to the following sports persons /sports bodies:

Renowned shooters (as defined in Import Licensing Note 3 ) on the recommendation of National Rifle Association of India (NRAI) ; National Rifle Association of India (NRAI) for its own use and for transfer to its State/district affiliates by due certification by Sports Authority of India Sports Authority of India (SAI ) or State Sport Authorities of concerned State by self- certification and Services Sports Control Board (SSCB) , Ministry of Defence . Respective recommending or certifying Bodies will maintain the required records ." Subject : Import policy of arms and ammunition for Specified Sportspersons / Sport Bodies , amendment thereof.
4.After the existing Import Licensing Note (3 ) in Chapter 93 of ITC (HS ) Classificatins ofExport and Import Items , Note (4) is added as under:

5. The Effect of this notification :
S.O. 256 (E) . In exercise of the powers conferred by Section 5 of the Foreign Trade (Development and Regulation) Act , 1992 read with Para 2.1 of the Foreign Trade Policy, 2009-2014, the Central Government hereby makes the following amendment in the Schedule 1 (Imports) of the ITC (HS ) Classifications of Export and Import Items:
2. Existing Import Licensing Note (1 ) in Chapter 93 ofITC (HS) Classifications of Export and Import Items prior to this amendment is extracted below:
The procedure for issue of import license/ authorization for import of arms & ammunition by specified sports persons/ sport bodies has been dispensed with . NRAI , SAI and SSCB can freely import arms and ammunition for their own use or their affiliates . Renowned Shooter can freely import arms and ammunition for their own use. Import Policy Regime for ' Air Gun Pellets ' continues to be ' free ' . This notification does not exempt the specified sports persons/ sports bodies from the Arms Act, 1959 or Rules thereunder, but merely makes amendments in the Import Policy regime for the specified categories of Importers .

PUJARI , Director General ofForeignTrade "Import of arms is permitted against a license to renowned shooter/rifle clubs for their own use on the recommendation of Department of Youth Affairs and Sports , Government of India . However, Import of 0.177 bore air guns and air pistols will be free for shooters registered with Rifle Clubs or District/ State/National Rifle Association . Free import of 0.177 bore air guns and air pistols will also be allowed to National Rifle Association of India (NRAI ) for supplying the same to the eligible State Rifle Association/Clubs and to the eligible shooters . NRAI shall be required to keep appropriate account ofthe imported weapons."
