का.आ. 259(अ) .- केन्द्रीय सरकार ने भारतीय राष्ट्रीय राजमार्ग प्राधिकरण अधिनियम 1988 (1988 का 68) की धारा 11 के अधीन जारी की गई भारत सरकार के तत्कालीन भूतल परिवहन मंत्रालय ( सड़क खंड ) की अधिसूचना संख्या का.आ. 660 (अ) , तारीख 27 सितम्बर 1996 और का.आ. 78 (अ) , तारीख 4 फरवरी , 1999 द्वारा बिहार और पश्चिमी बंगाल राज्य में राष्ट्रीय राजमार्ग सं . 2 के 398.750 कि.मी. से 441.440 कि.मी. तक ( बारवा अड्डा बारकर सेक्शन ) और 474: 000 कि.मी. से 516.000 कि. मी.तक (रानीगंज पानागढ़ सेक्शन ) तथा 46.00 कि.मी से 398.750 कि.मी तक ( उत्तर प्रदेश / बिहार सीमा- बारवा अड्डा सेक्शन ) और 441.440 कि.मी से 474.000 कि.मी ( बिहार / पश्चिमी बंगाल सीमा रानीगंज सेक्शन ) तक के खण्ड को भारतीय राष्ट्रीय राजमार्ग प्राधिकरण (जिसे इसमें इसके पश्चात् "प्राधिकरण" कहा गया है ) को सौंपा है ;
और प्राधिकरण ने भारतीय राष्ट्रीय राजमार्ग अधिनियम, 1988 ( 1988 का 68 ) की धारा 14 के प्रावधान के अनुसरण में मैसर्स धनबाद दुर्गापुर सुपर कनेक्टिविटी प्राइवेट लिमिटेड, जो 08.03.2011 को प्रस्तुत की गई बोलियों का सफल बोलीदाता है , और जिसका रजिस्ट्रीकृत कार्यालय फ्लैट नम्बर 901 टावर- 3 , पालम अपार्टमेन्टस , सेक्टर 30 साऊथ सिटी I अपोजिट यूनीटेक कंट्री क्लब गुडगाँव 122001 , हरियाणा में है ( जिसे इसमें इसके पश्चात् "रियायतग्राही " कहा गया है ) , के साथ राष्ट्रीय राजमार्ग सं . 2 के 398.240 कि.मी. से 521.120 कि.मी. तक ( जिसे इसमें इसके पश्चात् " उक्त खण्ड " कहा गया है ) बारवा अड्डा पानागढ़ सेक्शन का छः लेन के विभाजित कैरिएजवे के रूप में विकास तथा प्रचालन और अनुरक्षण के लिए करार किया है ( जिसे इसमें इसके पश्चात् " उक्त करार " कहा गया है ) ।

अतः अब, केन्द्रीय सरकार, राष्ट्रीय राजमार्ग शुल्क ( दरों का अवधारण और संग्रहण ) नियम, 2008 ( जिसे इसमें इसके पश्चात् "नियम " कहा गया है ) के नियम 3 के साथ पठित राष्ट्रीय राजमार्ग अधिनियम, 1956 ( 1956 का 48 ) की धारा 8 क द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, उक्त खण्ड के निर्माण, अनुरक्षण , प्रबंध और प्रचालन, निवेशित पूंजी पर ब्याज, उचित लाभ, यातायात का परिमाण तथा प्राधिकरण और रियायतग्राहीं के बीच हुए करार में निहित अवधि को ध्यान में रखते हुए, यह अधिसूचित करती है कि उक्त खण्ड के उपयोग के लिए यांत्रिक यानों पर चार या अधिक लेन के खण्डों के उपयोग हेतु निवल सड़क खण्ड की लम्बाई के लिए सारणी 1 के स्तंभ (2 ) में निर्दिष्ट दर पर शुल्क ( जिसे इसमें इसके बाद "आधार दर" कहा गया है ) उद्गृहीत और संग्रहीत किया जाएगा और बाइपास , जिनकी लागत दस करोड़ रुपये या अधिक है, का उपयोग करने वाले नीचे सारणी 1 में विनिर्दिष्ट प्रकार के यानों पर आधार दरों का डेढ़ गुना शुल्क उद्गृहीत और संग्रहीत किया जाएगा, और वाणिज्यिक प्रचालन या इस अधिसूचना के राजपत्र में प्रकाशन की तारीख से, जो भी पश्चात्वर्ती हो, करार में निर्दिष्ट अवसान की तारीख तक शुल्क का संग्रहण करने तथा उसे प्रतिधारित के लिए उक्त रियायतग्राही को प्राधिकृत करती है :

3. उपर्युक्त के अतिरिक्त, निम्नलिखित बाईपास के उपयोग के लिए, निम्नलिखित फीस ऐसे टोल प्लाजा के लिए विनिर्दिष्ट बाईपास की लम्बाई के लिए आधार दर की डेढ़ गुना भी शोध्य और संदेय होगी :

4. उन करारों में जिसमें शुल्क के उदग्रहण का अधिकार नियत तारीख से दिया गया है , करार रियायत के प्रावधानों के अनुसार नए बाईपास और पुल/सुरंग / संरचना के लिए अतिरिक्त शुल्क की दरें संरचनाओं और परियोजनाओं के पूरा होने के प्रमाण- पत्र जारी होने के बाद लागू होंगें ।
5. वर्ष 2011-12 के लिए , स्थानीय निजी यातायात के संबंध में मासिक पास की दर 190.00 रूपये (एक सौ नब्बे रूपये मात्र) है जो, राष्ट्रीय राजमार्ग शुल्क (दरों का अवधारण और संग्रहण) नियम, 2008 के प्रावधानों के अनुसार, प्रत्येक वर्ष पुनरीक्षण के अध्यधीन है ।
6. राजमार्ग सेक्शन पर बहुयात्राओं हेतु पास निम्नलिखित दरों पर प्रदान किये जाएंगे , अर्थात्: -

7. जिस जिले में फीस प्लाजा पड़ता है वहां रजिस्टर किए गए वाणिज्यिक यानों ( राष्ट्रीय परमिट के अधीन चल रहे यानों को छोड़कर ) के लिए फीस उस श्रेणी के यानों के लिए विहित दर का 50 % होगा परन्तु यह कि ऐसे वाणिज्यिक यानों के उपयोग के लिए कोई उपमार्ग अथवा वैकल्पिक सड़क उपलब्ध न हो ।
8. जो यांत्रिक यान नियमों के अधीन अपने प्रवर्ग के लिए निर्धारित अनुज्ञेय भार की अपेक्षा अधिक भार से लदे हुए होंगे उन्हें उन दरों पर शुल्क का संदाय करना होगा जो उनसे अगली उच्च श्रेणी के यानों के लिए लागू होता है और उन्हें तब तक राजमार्ग खण्ड का उपयोग करने का अधिकार नहीं होगा जब तक कि ऐसे यांत्रिक यान से अधिक भार को हटा न दिया जाए ।

[PART II-SEC . 3 (ii) ] 9. यांत्रिक यानों के प्रवर्ग, उनके लिए अनुज्ञेय भार, छूटप्राप्त यानों के प्रवर्ग, सर्विस रोड, वैकल्पिक सड़क आदि सहित सभी परिभाषाएं नियमों में विनिर्दिष्ट परिभाषाओं के अनुसार होंगी ।
10. उक्त नियम के नियम 12 के अनुसार, उपयोगकर्ताओं की जानकारी के लिए शुल्क की दरों को प्रदर्शित किया जाएगा ।
11. फीस का पुनरीक्षण उक्त नियमों के नियम 5 के अनुसार वार्षिक रूप से किया जाएगा परंतु वह पूर्ववर्ती पुनरीक्षण की तारीख से छः मास की अवधि के भीतर नही किया जायेगा ।

टिप्पण : यह भारत सरकार के तत्कालीन पोत परिवहनं , सड़क परिवहन और राजमार्ग मंत्रालय ( सड़क परिवहन और राजमार्ग विभाग) की अधिसूचना संख्यांक का.आ. 57 (अ) , तारीख 8-1-2008 को, उन बातों के सिवाय अधिक्रांत करते हुए जिन्हें ऐसे अधिक्रमण से पहले किया गया है या करने का लोप किया गया है ।

S.O. 259 (E).- Whereas by notification of the Government of India in the erstwhile Ministry of Surface Transport ( Roads Wing) number S.O. 660 (E) , dated the 27th September , 1996 and S.O. 78 ( E) , dated the 4th February , 1999 , issued under section 11 of the National Highways Authority of India Act , 1988 ( 68 of 1988) , the Central Government has entrusted the stretch from kilometer 398.750 to kilometer 441.440 ( Barwa Adda - Barkar section) and kilometer 474.000 to kilometer 516.000 ( Raniganj - Panagarh section) of National Highway No. 2 in the State of Bihar and West Bengal , and from kilometer 46.000 to kilometer 398.750 ( Uttar Pradesh/ Bihar border Barwaadda aection) and kilometer 441.440 to kilometer 474.000 (Bihar / West Bengal border - Raniganj section) of National Highway No. 2 in the State of Bihar and West Bengal to the National Highways Authority ofIndia (hereinafter referred to as the "Authority") ;
And whereas , pursuant to the provision of section 14 of the National Highways Authority of India Act 1988 , ( 68 of 1988) the Authority has entered into an Agreement (hereinafter referred to as said agreement) with M/ s Dhanbad- Durgapur Super Connectivity Private Limited, having its registered office at Flat No. 901 , Tower- 3 , Palm Apartments , Sector-30 , South City- I , Opp . Unitech Country Club , Gurgaon - 122001 , Haryana, India (hereinafter referred to as the " Concessionaire ") , the successful bidder for bids submitted on 08.03.2011 for the development of Barwa Adda - Panagarh section from Km 398.240 to Km 521.120 on National Highway No. 2 (hereinafter referred to as the " said section") to six lane and operation and maintenance of the said section.

Now, therefore, in exercise of the powers conferred by section 8A of the National Highways Act , 1956 (48 of 1956) , read with rule 3 of the National Highways Fee ( Determination of Rates and Collection) Rules , 2008 ( hereinafter referred to as the " Rules") , the Central Government, having regard to the expenditure involved in building , maintenance , management and operation of the said section , interest on the capital invested , reasonable return , the volume of traffic and the period of the agreement entered into between the authority and the concessionaire , hereby notifies that there shall be levied and collected fees on mechanical vehicles for the use of the said section at the rate specified in columns (2) of the Table 1 for net road section length for use of the four and more lane sections ((hereinafter referred to as " base rate " ) and at one and half times the base rate for bypasses costing Rupees ten crores or more on the Type of Vehicles specified in Table 1 below, and authorizes the said'Concessionaire to collect and retain the fee on and from the date of commercial operation or publication of this notification in the Official Gazette, whichever is later , till the termination date as specified in the agreement ;

4. In case of contracts in which tolling rights have been given from the Appointed date , the additional rate of fee for new bypasses and bridge/Tunnel/Structure shall be made applicable only after completion of such bypasses and structures and the project and completion certificates are issued in accordance with the provisions of the concession agreement .
5. The rate of monthly pass for local personal traffic is Rs . 190.00 ( rupees One Hundred Ninety only) for the year 2011-12 which is subject to revision every year as per the provisions of the National Highways Fee (Determination of Rates and Collection) Rules , 2008 .
6. Formultiple journey on the highway section , passes shall be issued at the following rates, namely.

7 . Fee for commercial vehicle (excluding vehicles plying under national permit ) registered in the district where the fee plaza falls shall be 50 % of the prescribed rate for that category of vehicle provided no service road or alternative road is available for use of such commercial vehicles .
8. Mechanical vehicle which is loaded in excess of permissible load specified for its category under the Rules , shall be liable to pay fee at such rates which is applicable for the next higher category of the vehicles and shall not be entitled to make use of the highway section unless the excess load has been removed from such mechanical vehicle .
9. All definitions including category of mechanical vehicles , its permissible load , category of exempted vehicles , service road, alternative road etc. shall be as per definitions specified in the Rules .
10. The fee rates shall be displayed for information of the users in accordance with rules 12 of the said Rules .

11. The fee rates shall be revised annually in accordance with the Rule 5 of the said rules provided that no revision shall be effected within six months .
