विषय : बासमती चावल के निर्यात से संबंधित निर्यात और आयात मदों के आईटीसी ( एचएस ) वर्गीकरण की अनुसूची-2 के अध्याय 10 में संशोधन ।
का.आ. 304(अ).-विदेश व्यापार नीति, 2009-2014 के पैराग्राफ 2.1 के साथ पठित विदेश व्यापार ( विकास और विनियमन ) अधिनियम, 1992 ( 1992 की संख्या 22 की धारा 3 ( 2 ) के साथ पठित धारा 5 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, केन्द्र सरकार , एतद्वारा निर्यात और आयात मदों के आईटीसी ( एच एस ) वर्गीकरण की अनुसूची-2 में तत्काल प्रभाव से निम्नलिखित संशोधन करती है
2. निर्यात और आयात मदों के आईटीसी ( एच एस ) वर्गीकरण की अनुसूची-2 के अध्याय 10 की क्रम सं. 45कक की मौजूदा प्रविष्टियों को अब निम्नानुसार पढ़ा जाएगा :

(i ) निर्यात की अनुमति, एपीडा, नई दिल्ली के साथ करार के पंजीकरण के अधीन होगी; ( ii ) निर्यात तभी अनुमत होगा जब न्यूनतम निर्यात मूल्य( एमईपी ) पोत पर्यन्त निःशुल्क मूल्य 700 यूएस डालर प्रति टन अथवा समय- समय पर विदेश व्यापार महानिदेशालय द्वारा यथाअधिसूचित हो । न्यूनतम निर्यात मूल्य विदेशी कमीशन को छोड़कर होगा; :
(iii ) निर्यात किए जाने वाले चावल के दाने की लम्बाई 6.61 मिमी. से अधिक और दाने की लम्बाई-चौड़ाई का अनुपात 3 : 5 से अधिक होना चाहिए;.

( iv) बासमती चावल का निर्यात सभी ईडीआई पत्तनों के माध्यम से अनुमत है;
( v ) अधिसूचना के माध्यम से सरकार द्वारा यथा विनिर्दिष्ट पोतलदान पूर्व गुणवत्ता जाँच के अधीन यूरोपीय संघ को निर्यात अनुमत होगा;
(vi ) निम्नलिखित द्वारा जारी पोतलदान पूर्व गुणवत्ता प्रमाणन के अधीन रूसी संघ को निर्यात की. अनुमति होगी :-
( 1 ) इन्सेक्टीसाइड रेसीड्यू टेस्टिंग लेबोरेट्री
(2 ) जिओ कैम लेबोरेट्रीज प्रा लि
(3) रिलाएबल एनालिटिकल लेबोरेट्री
(4) अरब्रो फार्मास्यूटिकल्स लि.
(5 ) श्री राम इस्टीट्यूट फार इण्डस्ट्रियल रिसर्च , दिल्ली
(6 ) श्री राम इंस्टीट्यूट फार इण्डस्ट्रियल रिसर्च , शाखा कार्यालय , बंगलौर
(7 ) दिल्ली टेस्ट हाउस; और
(8 ) विम्तालैब्स
अथवा समय- समय पर यथा अधिसूचित कोई अन्य एजेन्सी । "
( vii ) खाली प्रिन्टेड गनी बैगों कानिर्यात जिसमें कि उत्पाद के तौर पर भारतीय बासमती चावल दर्शाया गया हो , किसी भी रूप में अनुमत नहीं है सिवाय तब कि जब वे बासमती चावल की खेप के साथ निर्यात किए जा रहे हों ऐसे मामलों में भी , निर्यात किए जा रहे बासमती चावल के भरे गनी बैगों की कुल संख्या के 2 % से अधिक नहींहोना चाहिए ।
( viii ) थोक में निर्यात किए जा रहे खुले अथवा 50 किग्रा. अथवा इससे अधिक के बैगों में भारतीय बासमती चावल के मामले में, अंकनों सहित प्रिन्ट किए गए खाली बोरों , जिन पर यह दर्शाया गया हो कि उत्पाद भारतीय बासमती चावल है , का निर्यात खेप की कुल मात्रा और निर्यात किए जा रहे खाली बैगों के आकारों को ध्यान में रखते हुए वास्तविक अपेक्षा के अनुसार अनुमत होगा ।
3. इस अधिसूचना का प्रभाव :
(i ) बासमती चावल का न्यूनतम निर्यात मूल्य घटाकर 700 अमरीकी डालर प्रति मी. टन कर दिया गया है । पहले यह 900 अमरीकी डालर अथवा 41,400 रु. प्रति मी. टन पोत पर्यन्त निःशुल्क मूल्य था । न्यूनतम निर्यात मूल्य केवल अमरीकी डालर में दर्शाया गया है ।
(ii ) निर्यात अब सभी ईडीआई पत्तनों के जरिए अनुमत है । पहले यह केवल छः पत्तनों के जरिए अनुमत था ।
(iii ) बासमती चावल के निर्यात के लिए समय - समय पर यथाअधिसूचित किसी अन्य मौजूदा शर्त में कोई परिवर्तन नहीं है । ये शर्तें पैरा 2 की तालिका में कॉलम " प्रतिबंधों की प्रकृति " में समेकित की गई हैं ।

Subject : Amendment in Chapter 10 of Schedule 2 of ITC(HS) Classification of Export and Import Items relating to export ofBasmati Rice .
S.O. 304 (E). In exercise of the powers conferred by Section 5 read with Section 3(2 ) of the Foreign Trade (Development and Regulation) Act, 1992 (No. 22 of 1992) and also read with Para 2.1 ofthe Foreign Trade Policy, 2009-2014, the Central Government hereby notifies the following amendment in Schedule 2 of ITC (HS) Classification of Export and Import Items, with immediate effect.
2. The existing entries at Sl . No. 45 AA in Chapter 10 of Schedule 2 of ITC( HS ) Classification of Export and Import Items will now read as under:

(i) Exports allowed subject to registration of contracts with the APEDA , New Delhi ;
Basmati Rice (Dehusked ( Brown) , semi milled , milled both ineither parboiled or raw condition) .
(ii) Export will be subject to Minimum Export Price (MEP ) of US $ 700 per ton FOB or as notified by DGFT from time to time. MEP shall be exclusive of foreign commission;
(iii) Grain of rice to be exported shall be more than 6.61 mm of length and ratio of length to breadth of the grain shall be more than 3.5;
( iv) Export ofBasmati Rice is permitted through all EDI ports;
(v) Exports to European Union permitted subject to pre- shipment quality inspection as may be specified by the Government through a notification;
(vi) Exports to Russian Federation permitted subject to pre -shipment quality certification issued by
(1) Insecticide Residue Testing Laboratory.
(2) Geo- Chem Laboratories Pvt . Ltd.
(3) Reliable Analytical Laboratory
(4) Arbro Pharmaceuticals Ltd.
(5) Shri Ram Institute for Industrial Research, Delhi
(6) Shri Ram Institute for Industrial Research , Branch Office Bangalore
(7) Delhi Test House ; and
(8) Vimta Labs .
or any other agency as may be notified from time to time ."

(vii) Exports of empty printed gunny bags with Markings indicating the product being Indian Basmati Rice , in whatever manner, are not permitted except when exported along with the consignments of Basmati Rice , in which cases also , the same shall not exceed 2% of the total number of filled gunny bags ofBasmati Rice being exported;
(viii) In case of un -bagged Indian Basmati Rice being exported in bulk or in bags of50 kgs . or above , the exports of empty printed gunny bags with Markings indicating the product being Indian Basmati Rice , in. whatever manner, shall also be permitted to the extent ofactual requirements considering the total quantity of the consignment and the sizes of the empty bags being exported.
3. Effect ofthis notification :
(1) Minimum Export Price of Basmati Rice has been reduced to US $ 700 per MT. Earlier it was US $ 900 or Rs . 41,400 per MT FOB . MEP is expressed only in terms of US Dollar:
(u) Export is now permitted through all EDI ports . Earlier it was allowed only through six ports .
(iii) There is no change in any of the other existing conditions for export of basmati rice as have been notified from time to time . These conditions have been consolidated in the column " Nature of Restrictions " in the table ofpara2.
