नई दिल्ली, 23 अक्तूबर , 2012
का.आ. 2603(अ).-केन्द्रीय सरकार ने , पेट्रोलियम और खनिज पाइपलाइन्स ( भूमि में उपयोग के अधिकार का अर्जन ) अधिनियम , 1962 ( 1962 का 50 ) ( जिसे इसमें इसके पश्चात् उक्त अधिनियम कहा गया है ) की धारा 3 की उप - धारा ( 1 ) के अधीन जारी की गई , भारत सरकार के पेट्रोलियम और प्राकृतिक गैस मंत्रालय की अधिसूचना संख्या का.आ. 2790 , दिनांक 28 सितम्बर , 2011 , जिसका प्रकाशन भारत के राजपत्र संख्या 41 , भाग II , खण्ड 3 , उप- खण्ड ( ii ) , दिनांक अक्तूबर 2-अक्तूबर 8 , 2011 में किया गया है। इस अधिसूचना से संलग्न अनुसूची में विनिर्दिष्ट राजस्थान राज्य की तहसील मारवाड़ जंक्शन , जिला पाली की भूमि में, गुजरात राज्य में सलाया से उत्तर प्रदेश राज्य में मथुरा तक पेट्रोलियम क्रूड के परिवहन के लिए इंडियन ऑयल कॉर्पोरेशन लिमिटेड द्वारा क्रियान्वित किए जा रहे " सलाया- मथुरा पाइपलाइन के अन्तर्गत डी- बॉटलनेकिंग परियोजना " के सम्बन्ध में पाइपलाइन बिछाने के प्रयोजन के लिए उपयोग के अधिकार का अर्जन करने के अपने आशय की घोषणा की थी;
और , उक्त राजपत्र अधिसूचना की प्रतियां जनता को दिनांक3-1-2012 से उपलब्ध करा दी गई थीं;
और, उक्त अधिनियम की धारा 6 की उप - धारा ( 1 ) के अनुसरण में सक्षम प्राधिकारी ने केन्द्रीय सरकार को अपनी रिपोर्ट दे दी है ;
और , केन्द्रीय सरकार ने , उक्त रिपोर्ट पर विचार करने के पश्चात् इस अधिसूचना से संलग्न अनुसूची में विनिर्दिष्ट भूमि में उपयोग का अधिकार अर्जित करने का विनिश्चय किया है;
अतः , अब, केन्द्रीय सरकार उक्त अधिनियम की धारा 6 की उप - धारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, एतद्वारा यह घोषणा करती है कि इस अधिसूचना से संलग्न अनुसूची में विनिर्दिष्ट भूमि में पाइपलाइन बिछाने के उपयोग का अधिकार अर्जित किया जाता है;
और केन्द्रीय सरकार , उक्त अधिनियम की धारा 6 की उप- धारा ( 4 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, यह निर्देश देती है कि उक्त भूमि में उपयोग का अधिकार इस घोषणा के प्रकाशन की दिनांक से केन्द्रीय सरकार में निहित होने की बजाए सभी विल्लंगमों से मुक्त होकर इंडियन ऑयल कॉर्पोरेशन लिमिटेड में निहित होगा ।

NOTIFICATION
New Delhi , the 23rd October, 2012
S.O. 2603 (E) . Whereas by the notification of the Government of India in the Ministry of Petroleum and Natural Gas, published in the Gazette of India No. 41 , Part II , Section 3 , Sub - section (ii ) dated October 2-October 8 , 2011 vide S.O. number 2790, dated 28th September, 2011 , issued under sub- section ( 1 ) of Section 3 of the Petroleum and Minerals Pipelines (Acquisition of Right of User in Land) Act , 1962 (50 of 1962) , (hereinafter referred to as the said Act) , the Central Government declared its intention to acquire the right of user in the land situated in Tehsil Marwar Junction , District Pali in Rajasthan State, specified in the Schedule appended to that notification for the purpose of laying pipeline for the transportation of petroleum crude from Salaya in the State of Gujarat to Mathura in the State of Uttar Pradesh by the Indian Oil Corporation Limited for implementing the " De - Bottlenecking Project under Salaya - Mathura Crude Pipeline ;
And whereas , the copies of the said Gazette notification were made available to the public on 3-1-2012;
And whereas , the Competent Authority has under sub - section ( 1 ) of Section 6 of the said Act, has submitted his report to the Central Government;
Andwhereas , the Central Government after considering the said report is satisfied that the right of user in the land specified in the Schedule appended to this notification should be acquired;
Now, therefore, in exercise of the powers conferred by sub- section ( 1 ) of Section 6 of the said Act , the Central Government hereby declares that the right of user in the land specified in the Schedule appended to this notification is hereby acquired;
And further, in exercise of the powers conferred by sub - section (4 ) of Section 6 of the said Act, the Central Government hereby directs that the right of user in the said land shall instead of vesting in the Central Government, vests in the Indian Oil Corporation Limited , free from all encumbrances , from the date of publication of this declaration.
