सा.का.नि. 811 (अ).-महापत्तन न्यास अधिनियम , 1963 ( 1963 का 38 ) की धारा 132 की उप- धारा ( 1 ) के साथ पठित धारा 124 की उप - धारा ( 1 ) द्वारा दी गई शक्तियों का प्रयोग करते हुए केन्द्र सरकार जवाहरलाल नेहरू पत्तन न्यास के न्यासी मंडल द्वारा बनाई गई और इस अधिसूचना के साथ संलग्न अनुसूची में दी गई जवाहरलाल नेहरू पत्तन न्यास कर्मचारी ( सेवा निवृत्ति ) तृतीय संशोधन विनियमावली , 2012 को अनुमोदन देती है ।
उक्त संशोधन विनियमावली 30 सितम्बर , 2007 से लागू मानी जाएगी ।

जवाहरलाल नेहरुपत्तन न्यास कर्मचारी ( सेवा निवृत्ति ) संशोधन विनियमावली, 2012
महापत्तन न्यास अधिनियम, 1963 ( 1963 का 38 ) की धारा 28 के द्वारा दी गई शक्तियों का प्रयोग करते हुए जवाहरलाल नेहरुपत्तन न्यास का न्यासी मंडल जवाहरलाल नेहरुपत्तन कर्मचारी ( सेवा निवृत्ति) विनियमावली , 1995 को फिर से संशोधित करने के लिए निम्नलिखित विनियम बनाता है, यथा:
1. संक्षिप्त नाम और उपयोजन
( 1 ) इस विनियमावली को जवाहरलाल नेहरु पत्तन न्यास कर्मचारी (सेवा निवृत्ति ) तृतीय संशोधन विनियमावली 2012 कहा जाएगा ।
2. सेवा निवृत्ति
(क) विनियम 3 में उप-विनियम ( 1 ) के स्थान पर निम्नलिखित को प्रतिस्थापित किया जाएगा :
(i) इस विनियमावली में जैसा उपबंधित है उसके सिवाय प्रत्येक कर्मचारी महीने की जिस तारीख को भी साठ वर्ष की आयु पूरी करेगा उस महिने की अंतिम तारीख की दोपहर को वह सेवा से निवृत्त हो जाएगा ।
2.2 विनियम 3 कें उप-विनियम 4 के नीचे वाली टिप्पणी में-
(i) खण्ड 4 में शब्द " अट्ठावन " को " साठ " द्वारा प्रतिस्थापित किया जाएगा ।
पाद टिप्पणी : ( i ) मूल विनियमावली भारत के राजपत्र ( असाधारण ) में दि. 17 जुलाई, 1995 को सा. का.नि. सं. 550 ( स्था. ) द्वारा प्रकाशित की गई थी ।
(ii ) जनेप न्यास कर्मचारी ( सेवा निवृत्ति) प्रथम संशोधन विनियमावली, 1998 भारत के राजपत्र में दि.23 जून, 1998 के सा. का.नि. सं.354 ( स्था. ) द्वारा प्रकाशित की गई थी ।
( iii ) जनेप कर्मचारी ( सेवा निवृत्ति ) द्वितीय संशोधन विनियमावली, 2001 भारत के राजपत्र में दि. 13 मार्च, 2001 के सा. का.नि. सं. 179 ( स्था. ) द्वारा प्रकाशित की गई थी ।

GS.R. 811 (E) . In exercise of the Powers conferred by sub - section ( 1 ) of Section 124 , read with sub - section ( 1 ) of Section 132 of the Major Port Trusts Act , 1963 (38 of 1963 ), the Central Government hereby approves the Jawaharlal Nehru Port Trust Employees ( Retirement) 3rd Amendment Regulations , 2012 made by the Board of Trustees for the Port of Jawaharlal Nehru and set out in the Schedule annexed to this Notification .

2. The said Amendment Regulations shall be deemed to have come into force on the 30thSeptember, 2007 .

SCHEDULE
Jawaharlal Nehru Port Trust Employees ( Retirement) Amendment Regulations , 2012 .
In exercise of the powers conferred by section 28 of the Major Port Trusts Act , 1963 ( 38 of 1963 ) , the Board of Trustees of the Jawaharlal Nehru Port Trust hereby makes the following regulations further to amend the Jawaharlal Nehru Port Trust Employees ( Retirement ) Regulations , 1995 namely : -
1. Short Title & Application
These Regulations may be called the Jawaharlal Nehru Port Trust Employees ( Retirement ) Third Amendment Regulations 2012 .
Retirement 2.
a . InRegulation 3 , for sub- regulation ( 1 ) , the following sub- regulation shall be substituted , namely : -
( i ) Except as otherwise provided in these regulations , every employee shall retire from service on the afternoon of the last date of the month in which he attains the age of sixty years .
2.2
In the note under sub - regulation 4 of the regulation 3 :
(1) Inclause 4 the words " fifty eight" shall be substituted by the words " sixty" .
FOOT NOTE : ( i) The Principal regulations were published vide GSR No. 550 ( E ) published in the Gazette of India Extraordinary dated 17th July, 1995 .
(ii ) The JNP Employees ( Retirement) First Amendment Regulations , 2001 were published in the Gazette of India vide GSR No. 354 ( E) dated 23rd June , 1998 .
( iii ) The JNP Employees ( Retirement ) Second Amendment Regulations , 1998 were published in the Gazette of India vide GSR No. 179 ( E ) dated 13th March , 2001 .
