सा.का.नि. 817(अ). - केन्द्रीय सरकार, भारत- तिब्बत सीमा पुलिस बल अधिनियम, 1992(1992 का 35) की धारा 156 की उपधारा (2) के खंड (ख ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और भारत- तिब्बत सीमा पुलिस बल साधारण ड्यूटी काडर (समूह 'ख' और ' ग' पद) भर्ती नियम, 2000 को उन बातों के सिवाय अधिकान्त करते हुए जिन्हे ऐसे अधिकमण से पूर्व किया गया है या करने का लोप किया गया है , भारत - तिब्बत सीमा पुलिस बल में साधारण ड्यूटी काडर में समूह ' ख और ' ग' पदों पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाती है, अर्थातः-

1. संक्षिप्त नाम और प्रारंभ.-(1 ) भारत- तिब्बत सीमा पुलिस बल, साधारण ड्यूटी काडर (समूह 'ख' एवं ' ग' पद) भर्ती नियम, 2012 है ।

(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. पदों की संख्या, वर्गीकरण और वेतन बैंड तथा ग्रेड वेतन या वेतनमान. उक्त पदों की संख्या, उनका वर्गीकरण और उनके वेतन बैंड तथा ग्रेड वेतन या वेतनमान वे होंगे , जो इन नियमों से उपाबद्ध अनुसूची के स्तंभ (2 ) से स्तंभ (4 ) में विनिर्दिष्ट हैं ।

3. भर्ती की पद्धति, आयु- सीमा और अन्य अर्हताएं. उक्त पदों पर भर्ती की पद्धति, आयु सीमा, अर्हताएं और उससे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तंभ (5) से स्तंभ (13 ) में विनिर्दिष्ट हैं ।

4. निरर्हता.- वह व्यक्ति,

(क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है, या

(ख) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है ,

उक्त पदों में से किसी पद पर नियुक्ति का पात्र नहीं होगा :

परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

5. चिकित्सक दृष्टया योग्यता. इन नियमों में अन्तर्विष्ट किसी बात के होते हुए भी, केवल वे व्यक्ति जो केन्द्रीय अर्धसैनिक बल में स्वास्थ्य देखभाल पद्धति में यथाविनिर्दिष्ट शेप -1 में हैं, इन नियमों के उपबंधों के अधीन प्रोन्नति और नियुक्ति, जिसके अन्तर्गत प्रतिनियुक्ति पर नियुक्ति, या पुनर्नियोजन भी है, के लिए पात्र होंगे ।

6. अधिवर्षिता.- ऐसे कार्मिक जो कांस्टेबल (साधारण ड्यूटी) , हैड कांस्टेबल (साधारण एवं ड्यूटी) , सहायक उप- निरीक्षक (साधारण ड्यूटी) , उपनिरीक्षक (साधारण ड्यूटी ) निरीक्षक (साधारण ड्यूटी) का पद धारण किए हुए हैं, उस मास के जिसमें वह सत्तावन वर्ष की आयु प्राप्त करता है , अंतिम दिन के अपराह्न में सेवानिवृत होंगे;

परन्तु कोई अधिकारी जिसके जन्म की तारीख किसी मास की पहली तारीख है, सत्तावन वर्ष की आयु प्राप्त करने के पूर्ववर्ती मास के अंतिम दिन के अपराह्न में सेवानिवृत होगा ।

7. शिथिल करने की शक्ति. जहाँ केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है , वहाँ वह उसके लिए जो कारण हैं उन्हें लेखबग करके, इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी ।

8. व्यावृति.- इन नियमों की कोई बात, ऐसे आरक्षण, आयु सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी , जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय- समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, अन्य पिछडे वर्गो, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग, के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

भूतपूर्व सैनिकों के लिए

प्रतिनियुक्ति/ पुनर्नियोजन

भारत- तिब्बत सीमा पुलिस बल के ऐसे उप-निरीक्षकों ( साधारण ड्यूटी ) में से, जिन्होंने उस श्रेणी में पाँच वर्ष की नियमित सेवा की है, और जिन्होंने यथाविहित पूर्व- प्रोन्नति पाठ्यक्रम/ पाठयक्रमों को सफलतापूर्वक पूरा कर लिया है या कर लिए हैं ।

टिप्पण 1. ऐसे उप- निरीक्षक (साधारण ड्यूटी) की बावत, जो इन नियमों की अधिसूचना की तारीख को नियमित आधार पर पद धारण किए हुए हैं, प्रोन्नति के लिए पात्रता शर्त तीन वर्ष ही रहेगी ।

टिप्पण 2.- जहां ऐसे कनिष्ठ व्यक्तियों के संबंध में, जिन्होंने अपनी अर्हक / पात्रता सेवा पूरी कर ली है , प्रोन्नति के लिए विचार किया जा रहा हो वहां उनसे ज्येष्ठ व्यक्तियों के संबंध में भी विचार किया जाएगा परंतु यह तब जब कि उनके द्वारा की गई ऐसी अर्हक / पात्रता सेवा, अपेक्षित अर्हक / पात्रता सेवा के आधे से अधिक से या दो वर्ष से, इनमें से जो भी कम हो, कम न हो और उन्होंने अपने ऐसे कनिष्ठ व्यक्तियों THE GAZETTE OF INDIA : EXTRAORDINARY

सहित जिन्होंने ऐसी अर्हक / पात्रता सेवा पहले ही पूरी कर ली है। अगली उच्चतर श्रेणी में प्रोन्नति के लिए अपनी परिवीक्षा की अवधि सफलतापूर्वक पूरी कर ली हो ।

टिप्पण 3.- प्रोन्नति के लिए न्यूनतम अर्हक सेवा की संगणना करने के प्रयोजन के लिए किसी अधिकारी द्वारा 1 जनवरी 2006 से पहले , उस तारीख से जिससे छठे वेतन आयोग की सिफारिशों पर आधारित पुनरीक्षित वेतन संरचना का विस्तार किया गया है, पूर्व नियमित आधार पर की गई सेवा का उक्त आयोग की सिफारिशों पर आधारित तत्स्थानी वेतन बैण्ड और ग्रेड वेतन या वेतनमान पर की गई सेवा समझी जाएगी ।

प्रतिनियुक्ति द्वारा:

अन्य केन्द्रीय सशस्त्र पुलिस बलों या केन्द्रीय पुलिस संगठनों या राज्य सरकार पुलिस संगठनों में सदृश वेतनमान में के निरीक्षक (साधारण ड्यूटी) ।

टिप्पण 1.- प्रोषक प्रवर्ग के ऐसे विभागीय अधिकारी , जो प्रोन्नति की सीधी पंक्ति में है , प्रतिनियुक्ति पर नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे इसी प्रकार प्रतिनियुक्ति व्यक्ति प्रोन्नति द्वारा नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे ।

टिप्पण 2.- प्रतिनियुक्ति की अवधि, जिसके अर्न्तगत केन्द्रीय सरकार के उसी या किसी अन्य संगठन या विभाग में इस नियुक्ति से ठीक पहले धारित किसी अन्य काडर बाह्य पद पर प्रतिनियुक्ति की अवधि है साधारणतया 3 वर्ष से अधिक नही होगी ।

टिप्पण 3.- प्रतिनियुक्ति पर नियुक्ति के लिए अधिकतम आयु सीमा आवेदन प्राप्त करने की अंतिम तारीख का 52 वर्ष से अधिक नही होगी ।

टिप्पण 4.- प्रतिनियुक्ति आधार पर नियुक्ति के प्रयोजन के लिए 1 जनवरी 2006 से पहले, उस तारीख को जिससे छठे वेतन आयोग की सिफारिशों पर आधारित पुनरीक्षित वेतन संरचना का विस्तार किया गया है, पूर्व नियमित आधार पर की गई सेवा को उक्त आयोग की सिफारिशों पर आधारित तत्स्थानी वेतन बैण्ड और ग्रेड वेतन या वेतनमान पर की गई सेवा समझी जाएगी ।

भूतपूर्व सैनिकों के लिए :

प्रतिनियुक्ति/ पुनर्नियोजनः सशस्त्र बल के ऐसे कार्मिक जो सेवानिवृत होने वाले हैं या एक वर्ष के भीतर आरक्षण में स्थानांतरित किए जाने वाले हैं और जो प्रोन्नति के लिए उपर्युक्त यथाविहित चिकित्सा प्रवर्ग शेप-1 में आते हैं , पर भी विचार किया जाएगा, ऐसे व्यक्तियों को उस तारीख तक प्रतिनियुक्ति की अवधि प्रदान की जाएगी जिस तारीख से उन्हे सशस्त्र बल से निर्मुक्त किया जाना है, तत्पश्चात् वे पुनर्नियोजन पर बने रहेंगे ।

1. केन्द्रीय सरकार द्वारा समय- समय पर जारी किए गए आदेशों के अनुसार अनुसूचित जाति या अनुसूचित जन जाति के लिए पाँच वर्ष तक और अन्य पिछड़े वर्गों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए तीन वर्ष तक शिथिल की जा सकती है ।

2. सरकार द्वारा समय समय पर जारी किए गए आदेशों के अनुसार सरकारी सेवकों के लिए पाँच वर्ष. तक शिथिल की जा सकती है ।

टिप्पणः महानिदेशक , भारत- तिब्बत सीमा पुलिस बल, उन कारणों से जो लेखबद्ध किए जाएगें , योग्य व्यक्तियों के मामलों में विशेष उन्मुक्ति के रूप शारीरिक मापदण्ड शिथिल कर सकेगा ।

3. चिकित्सा मापदंड:

(

क) दृष्टि: बिना सुधार, अर्थात बिना चश्मा पहने दोनों आंखों की न्यूनतम दूरी दृश्यता 6/6 और 6/9 होनी चाहिए ।

(

ख ) अभ्यर्थियों को संहत जानु(नॉक- नी), चपटा पॉव, फूली हुई नसें या भैंगी आँखों वाला नहीं होना चाहिए और उच्च रंग दृश्यता वाला होना चाहिए । उन्हें अच्छे मानसिक और शारीरिक स्वास्थ्य का और ऐसे शारीरिक दोष से मुक्त होना चाहिए जिसमें उनके कर्तव्यों के दक्षतापूर्ण पालन में बाधा

आने की संभावना हो ।

4. लिखित परीक्षा, शारीरिक दक्षता परीक्षा , चिकित्सीय परीक्षा साक्षात्कार और व्यक्तित्व परीक्षा में अर्हता प्राप्त करनी होगी ।

प्रोन्नति द्वारा:

(1 ) भारत तिब्बत सीमा पुलिस बल के ऐसे सहायक उप-निरीक्षक (साधारण ड्यूटी) में से, जिन्होंने उस श्रेणी में छह वर्ष नियमित सेवा की है और जिन्होंने यथाविहित पूर्व प्रोन्नति पाठयक्रम या पाठ्यक्रमों को सफलता पूर्वक परा कर लिया है ।

जिसके न मिल सकने पर

(1 ) 50 % प्रोन्नति द्वारा जिसके न मिल सकने पर प्रतिनियुक्ति द्वारा भूतपूर्वसैनिकों के लिएः प्रतिनियुक्ति/ पुनर्नियोजनः (ii ) 33 % सीधी भर्ती द्वारा (कर्मचारी चयन आयोग के माध्यम और उसके लिए केन्द्रीय सरकार द्वारा यथाविहित पाठ्यक्रम होगा)

(iii ) 17 % गृह मंत्रालय द्वारा समय- समय पर विहित स्कीम के अनुसार भारत - तिब्बत सीमा पुलिस बल के लिए सीमित विभागीय प्रतियोगिता परीक्षा के माध्यम से प्रोन्नति द्वारा ।

(ii) जिन्होंने सहायक उप निरीक्षक (साधारण ड्यूटी) और हैड कांस्टेबल (साधारण ड्यूटी) के रूप में दस वर्ष की सम्मिलित नियमित सेवा जिसमें कम से कम एक वर्ष की नियमित सेवा सहायक उप निरीक्षक की श्रेणी में की हो और जिन्होंने यथाविहित पूर्व प्रोन्नति पाठ्यक्रम या पाठ्यक्रमों को सफलता पूर्वक परा किया हो ।

टिप्पण 1.- जहां ऐसे कनिष्ठ व्यक्तियों के संबंध में, जिन्होंने

अपनी अर्हक / पात्रता सेवा पूरी कर ली है, प्रोन्नति के लिए विचार किया जा रहा हो जहां उनसे ज्येष्ठ व्यक्तियों के संबंध में भी विचार किया जाएगा परंतु यह तब जब कि उनके द्वारा की गई ऐसी अर्हक / पात्रता सेवा, अपेक्षित अर्हक / पात्रता सेवा के आधे से अधिक से या दो वर्ष से, इनमें से जो भी कम हो, कम न हो और उन्होंने अपने ऐसे कनिष्ठ व्यक्तियों सहित जिन्होंने ऐसी अर्हक/पात्रता सेवा पहले ही पूरी कर ली है अगली उच्चतर श्रेणी में प्रोन्नति के लिए अपनी परिवीक्षा की अवधि सफलतापूर्वक पूरी कर ली हो ।

केन्द्रीय सरकार द्वारा विहित स्कीम के अनुसार

प्रतिनियुक्तिद्वारा:

अन्य केन्द्रीय सशस्त्र पुलिस बलों या केन्द्रीय पुलिस संगठनों या राज्य सरकार पुलिस संगठनों के सदृश पद में के उप- निरीक्षक (साधारण ड्यूटी) ।

टिप्पण 1. प्रोषक प्रवर्ग के ऐसे विभागीय अधिकारी , जो प्रोन्नति की सीधी पंक्ति में है , प्रतिनियुक्ति पर नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे इसी प्रकार प्रतिनियुक्ति व्यक्ति प्रोन्नति द्वारा नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे ।

टिप्पण 2.- प्रतिनियुक्ति की अवधि, जिसके अन्र्तगत केन्द्रीय सरकार के उसी या किसी अन्य संगठन या विभाग में इस नियुक्ति से ठीक पहले धारित किसी अन्य काडर बाह्य पद पर प्रतिनियुक्ति की अवधि है साधारणतया 3 वर्ष से अधिक नही होगी ।

भूतपूर्व सैनिकों के लिए :

प्रतिनियुक्ति/ पुनर्नियोजनः सशस्त्र बल के ऐसे कार्मिक जो एक वर्ष की अवधि के भीतर सेवानिवृत होने वाले हैं या रिजर्व में स्थानांतरित किए जाने वाले हैं और जिनके पास प्रोन्नति के लिए पूर्वोक्त विहित अर्हताएं हैं और जो चिकित्सीय प्रवर्ग शेप -1 में आते हैं । ऐसे व्यक्तियों को उस तारीख तक प्रतिनियुक्ति के निर्बंधनों पर रखा जाएगा जिस तारीख से उन्हें सशस्त्र बल से निर्मुक्त किया जाना है ; तत्पश्चात उन्हें पुनर्नियोजन पर बने रहने दिया जा सकता है ।

प्रोन्नति और पुष्टिकरण के लिए समूह ' ख ' विभागीय प्रोन्नति समिति, निम्नलिखित से मिलकर बनेगी:-

1. उप- महानिरीक्षक, भारत - तिब्बत सीमा पुलिस बल

2. कमांडेंट, भारत - तिब्बत सीमा पुलिस बल

भारत तिब्बत सीमा पुलिस बल के ऐसे हेड कांस्टेबल (साधारण ड्यूटी) में से, जिन्होंने उस श्रेणी में पांच वर्ष नियमित सेवा की हो और जिन्होंने यथाविहित पूर्व- प्रोन्नति पाठयक्रम या पाठयक्रमों को सफलता पूर्वक किया हो ।

अधिक से या दो वर्ष से, इनमें से जो भी कम हो, कम न हो और उन्होंने अपने ऐसे कनिष्ठ व्यक्तियों सहित जिन्होंने ऐसी अर्हक / पात्रता सेवा पहले ही पूरी कर ली है अगली उच्चतर श्रेणी में प्रोन्नति के लिए अपनी परिवीक्षा की अवधि सफलतापूर्वक पूरी कर ली हो ।

टिप्पण 2.- प्रोन्नति के लिए न्यूनतम अर्हक सेवा की संगणना

करने के प्रयोजन के लिए किसी अधिकारी द्वारा 1 जनवरी 2006 से पहले, उस तारीख से जिससे छठे वेतन आयोग की सिफारिशों पर आधारित पुनरीक्षित वेतन संरचना का विस्तार किया गया है, पूर्व नियमित आधार पर की गई सेवा का उक्त आयोग की सिफारिशों पर आधारित तत्स्थानी वेतन बैण्ड और ग्रेड वेतन या वेतनमान पर की गई सेवा समझी जाएगी ।

प्रतिनियुक्तिद्वारा:

अन्य केन्द्रीय सशस्त्र पुलिस बलों या केन्द्रीय पुलिस संगठनों या राज्य सरकार पुलिस संगठनों के सदृश पद में के सहायक उप- निरीक्षक (साधारण ड्यूटी) ।

टिप्पण 1. प्रोषक प्रवर्ग के ऐसे विभागीय अधिकारी , जो प्रोन्नति की सीधी पंक्ति में है, प्रतिनियुक्ति पर नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे इसी प्रकार प्रतिनियुक्ति व्यक्ति प्रोन्नति द्वारा नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे ।

टिप्पण 2.- प्रतिनियुक्ति की अवधि, जिसके अन्र्तगत केन्द्रीय सरकार के उसी या किसी अन्य संगठन या विभाग में इस नियुक्ति से ठीक पहले धारित किसी अन्य काडर बाह्य पद पर प्रतिनियुक्ति की अवधि है साधारणतया तीन वर्ष से अधिक नही होगी ।

विचार किया जाएगा जो एक वर्ष की अवधि के भीतर सेवानिवृत होने वाले हैं या रिजर्व में स्थानांतरित किए जाने वाले हैं और जिनके पास प्रोन्नति के लिए पूर्वोक्त विहित अर्हताएं हैं और जो चिकित्सीय प्रवर्ग शेप 1 में आते हैं । ऐसे व्यक्तियों को उस तारीख तक प्रतिनियुक्ति के निर्बंधनों पर रखा जाएगा जिस तारीख से उन्हें 426261/12-3 [PART II-SEC . 3 ( i ) ]

टिप्पण 1.- जहां ऐसे कनिष्ठ व्यक्तियों के संबंध में, जिन्होंने अपनी अर्हक / पात्रता सेवा पूरी कर ली है , प्रोन्नति के लिए विचार किया जा रहा हो वहां उनसे ज्येष्ठ व्यक्तियों के संबंध में भी विचार किया जाएगा परंतु यह तब जब कि उनके द्वारा की गई ऐसी अर्हक / पात्रता सेवा, अपेक्षित अर्हक / पात्रता सेवा के आधे से अधिक से या दो वर्ष से, इनमें से जो भी कम हो , कम न हो और उन्होंने अपने ऐसे कनिष्ठ व्यक्तियों सहित जिन्होंने ऐसी अर्हक / पात्रता सेवा पहले ही पूरी कर ली है अगली उच्चतर श्रेणी में प्रोन्नति के लिए अपनी परिवीक्षा की अवधि सफलतापूर्वक पूरी कर ली हो ।

टिप्पणः महानिदेशक, भारत- तिब्बत सीमा पुलिस बल , उन कारणों से जो लेखबद्ध किए जाएगें , योग्य व्यक्तियों के मामलों में विशेष उन्मुक्ति के रूप शारीरिक मापदण्ड शिथिल कर सकेगा ।

3. चिकित्सा मापदंड :

(क) दृष्टि: बिना सुधार , अर्थात बिना चश्मा पहने दोनों आंखों की न्यूनतम दूरी दृश्यता 6/6 और 6/9 होनी चाहिए ।

(ख) अभ्यर्थियों को संहत जानु (नॉक- नी) , चपटा पॉव , फूली हुई

नसें या भैंगी ऑखों वाला नहीं होना चाहिए और उच्च रंग दृश्यता वाला होना चाहिए । उन्हें अच्छे मानसिक और शारीरिक स्वास्थ्य का और ऐसे शारीरिक दोष से मुक्त होना चाहिए जिसमें उनके कर्तव्यों के दक्षतापूर्ण पालन में बाधा आने की संभावना हो ।

4. लिखित परीक्षा , शारीरिक दक्षता परीक्षा , चिकित्सीय परीक्षा साक्षात्कार और व्यक्तित्व परीक्षा में अर्हता प्राप्त करनी होगी ।

कांस्टेबल अनुचर समूह ' ग' (योधक) की पुनः भर्ती द्वाराः

भारत - तिब्बत सीमा पुलिस बल के ऐसे कांस्टेबल अनुचर (योधक) समूह ' ग ' के पाँच प्रतिशत पद के लिए स्थानान्तरण द्वारा जिन्होंने उक्त बल में तीन वर्ष की नियमित सेवा की है और जो निम्नलिखित अर्हताएं रखते हैं:-

सीधी भर्ती द्वारा -95 % अनुचर समूह ' ग' (योधक) की पुनः भर्ती द्वारा जिसके न मिल सकने पर प्रतिनियुक्ति द्वारा, इन दोनों के न मिल सकने पर सीधी भर्ती द्वारा -5%

(क) किसी मान्यताप्राप्त बोर्ड / विश्वविद्यालय से मैट्रिककुलेशन या समतुल्य

(ख) सीधी भर्ती के लिए अनुमोदित स्कीम में यथाविहित शारीरिक मापदण्डों को पूरा करना होगा ।

(ग) 35 वर्ष की आयु प्राप्त करने तक ।

केन्द्रीय सरकार द्वारा समय- समय पर जारी किए गए आदेशों के अनुसार अनुसूचित जाति या अनुसूचित जन जाति के लिए पाँच वर्ष और अन्य पिछड़े वर्गों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए तीन वर्ष तक शिथिल की जा सकती है ।

प्रतिनियुक्ति द्वारा : केन्द्रीय सशस्त्र पुलिस बलों या राज्यों के पुलिस संगठनों के सदृश वेतनमान में के कांस्टेबल (साधारण ड्यूटी) में से कार्यपेक्षा के आधार पर ।

टिप्पण 1.- प्रतिनियुक्ति की अवधि, जिसके अन्र्तगत केन्द्रीय सरकार के उसी या किसी अन्य संगठन या विभाग में इस नियुक्ति [ भाग II-खण्ड 3 ( i) ]

G.S.R. 817 ( E ) . In exercise of the powers conferred by clause ( b ) of sub - section ( 2 ) of section 156 of the Indo - Tibetan Border Police Force Act , 1992 ( 35 of 1992 ) , and in supersession of the Indo - Tibetan Border Police Force , General Duty Cadre , ( Group 'B ' and ' C ' posts ) Recruitment Rules , 2000 , except as respects things done or omitted to be done before such supersession , the Central Government hereby makes the following rules regulating the method of recruitment to the posts of General Duty Cadre , Group ' B ' and Group ' C ' posts in the Indo - Tibetan Border Police Force , namely :-

1. Short title and commencement . - ( 1 ) These rules may be called the Indo - Tibetan Border Police Force , General Duty Cadre (Group ' B ' and Group ' C ' Posts ) , Recruitment Rules , 2012 .

( 2) They shall come into force on the date of their publication in the Official Gazette .

2. Number of posts , classification and pay band and grade pay or scale of pay . The number of said posts , their classification and the pay band and grade pay or pay scale attached thereto shall be as specified in columns (2 ) to ( 4 ) of the Schedule annexed to these rules .

3. Method of recruitment , age limit and other qualifications , etc .. The method of recruitment to the said posts , age limit , qualifications and other matters relating thereto shall be as specified in columns ( 5) to ( 13 ) of the said Schedule .

4. Disqualification.- No person ,-

(a) who has entered into or contracted a marriage with a person having a spouse living ; or

(b ) who , having a spouse living , has entered into or contracted a marriage with any person ,

shall be eligible for appointment to the said post :

Provided that the Central Government may , if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing , exempt any person from the operation of this rule.

5. Medical Fitness.- Not withstanding anything contained in these rules , only those persons who are in medical category SHAPE - I , as specified in Health Care System in Central Para - Military Forces , be eligible for promotion and appointment and including appointment by deputation or re - employment under the provisions of the rules .

6. Superannuation . Personnel holding the rank of CT ( GD ) , HC ( GD ) , ASI ( GD ) , SI ( GD ) and Inspector ( GD) shall retire from service in the afternoon of the last day of the month in which they attain the age of fifty - seven years :

Provided that an officer whose date of birth is on the first of a month shall retiré from service in the afternoon of the last day of the preceding month on attaining the age of fifty - seven years " .

7. Power to relax . Where the Central Government is of the

opinion that it is necessary or expedient so to do , it may , by order , for reasons to be recorded in writing , relax any of the provisions of these rules with respect of any class or category of persons .

8. Saving . Nothing in these rules shall affect reservations , relaxation of age limit and other concessions required to be provided for the Scheduled Castes , the Scheduled Tribes , Other Backward Classes , Ex - servicemen and other special categories of persons in accordance with the orders issued by the Central Governmentfrom time to time in this regard .

Where juniors who have completed their qualifying or eligibility service are being considered for promotion their seniors would also be considered provided they are not short of the requisite qualifying or eligibility service by more than half of such qualifying or eligibility service or two years , whichever is less , and have successfully completed their probation period for promotion to the next nigher grade along with their juniors who have already completed such qualifying or eligibility service .
