का.आ. 2724(अ).- राष्ट्रीय औषध मूल्य निर्धारण प्राधिकरण , भारत सरकार के रसायन और उर्वरक मंत्रालय द्वारा जारी का० आ ० 637 (अ) तारीख 4 सितम्बर , 1997 के साथ पठित औषध (कीमत नियंत्रण ) आदेश, 1995 के पैरा 9 के उप पैरा ( 1 ) और (2 ) और पैरा ।। द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, नीचे की सारणी -1 के स्तंभ (5 ) मे विनिर्दिष्ट कीमत को उक्त सारणी -1 के स्तंभ (3 ) और (4 ) मे की क्रमशः तत्स्थानी प्रविष्टियों में विनिर्दिष्ट प्रबलता और पैक आकार सहित उस सारणी -1 के स्तंभ (2) में की तत्स्थानी प्रविष्टि में विनिर्दिष्ट अनुसूचित विनिर्मितयों में से प्रत्येक की, उत्पाद शुल्क और स्थानीय कर, यदि कोई है, को छोड़कर अधिकतम कीमत और स्तंभ (6) मे विनिर्दिष्ट कीमत की, उत्पाद शुल्क, शैक्षिक उपकर, बिक्री कर/ वेट, यदि कोई है, को सम्मिलित कर अधिकतम खुदरा कीमत के रुप में नियत करती है ।

सारणी-॥ के स्तंभ (1 ) में दिए गए पैक आकारों के अलावा अन्य पैक आकरों के लिए निकटतम उच्चतर पैक आकार की स्तंभ (2) में उल्लिखित अधिकतम कीमत में से 0.12600 रूपये प्रति मिलि की दर से घटाये जाएं । इन कीमतों की गणना विनिर्माता/विपणन कम्पनी द्वारा की जाए एवं ऐसे गणना की गई कीमत को सारणी के स्तंभ (5) और स्तंभ (6) में की अधिसूचित कीमत की तत्स्थानी अधिकतम कीमत के रूप में अपनायी जाए ।

(ख ) ये कीमतें विनिर्दिष्ट पैक व समान प्रबलता के पैकों पर उत्पाद शुल्क और स्थानीय कर को सम्मिलित कर स्तंभ (6) मे अधिकतम खुदरा कीमत के रुप में नियत की जाती हैं , और कम्पनी किसी छूट का दावा नहीं कर सकती , जब तक उसे छूट के लिये सरकार/ रा.औ.मू.नि.प्रा. से आदेश प्राप्त न हों ।

(ग) कम्पनियाँ/विनिर्माता केवल तभी कर जोड़ सकते हैं यदि उन्होंने स्तंभ ( 5 ) में उल्लिखित मूल्य पर सरकार को वास्तव में भुगतान किया है । यदि अधिकतम खुदरा मूल्य (सभी करों सहित ) में कोई विभिन्नता हो तो वह एनपीपीए को डीपीसीओ, 1995 के फॉर्म- V में सूचित किया जाना चाहिए ।

(घ) वह पैक जिसकी कम्पोजिशन समान है लेकिन आकार में अन्तर है , वह प्रो- राटा प्राइजिंग आदेश का. आ. 83(अ) दिनांक 27.1.1998 के तहत गोलियां और कैपसूल के पत्ता/ ब्लिस्टर के लिए आयेगी ।

(ड. ) उपयोग की गई भिन्न पैकिंग सामग्री या भिन्न औषध वितरण प्रणाली या दावा किए गए किसी अन्य विशेष रूप के लिए , जब तक कम्पनियाँ इनके फॉर्मूलेशनों के लिए विशेषीकृत मूल्य अनुमोदनों हेतु एनपीपीए के पास नहीं जाती , उच्चतम मूल्य जैसे उक्त कॉलम सं. 5 में विशेषीकृत है, लागू होंगे ।

(च) औषध मूल्य नियंत्रण आदेश , 1995 के तहत नियत की गई उक्त कीमतें सभी उत्पादकों/विपणनकर्ताओं द्वारा आवश्यक रूप से लागू करनी होगी जिस तरह से इन विनिर्मिति पैक पर औषध एवं प्रसाधन अधिनियम, 1940 की शर्तें लागू होती हैं ।

(छ) उक्त कथित विनिर्मिति की विनिर्माता/विपणन कम्पनी के लिए अनिवार्य है कि वह उक्त कथित विनिर्मिति के संघटन में किसी भी बदलाव के लिए एनपीपीए को लिखित पूर्व सूचना के साथ सक्षम प्राधिकारी से आवश्यक पूर्व अनुमोदन प्राप्त करें ।

(ज) उक्त के आधार पर निकाली गई अधिकतम कीमत, उत्पाद शुल्क और वेट की वर्तमान दरों के अनुसार 1.0850 के घटक द्वारा अधिकतम कीमत से गुणा करके अधिकतम खुदरा कीमत से अधिक नहीं होगी ।

(झ) उक्त के अनुसार निकाली गई अधिकतम खुदरा कीमत, यथा लागू सरकारी लेवी/ करों के भुगतान की शर्त के अधीन है और 1.0850 के घटक में जरूरी समायोजन , विनिर्माता/विपणन कम्पनी द्वारा किया जाना आवश्यक रूप से जरूरी है , जब कभी उत्पाद शुल्क और या वेट की वर्तमान दर में बदलाव होता है, इस शर्त के अधीन कि इस प्रकार से गणना किए गए उत्पाद शुल्क और या वेट, 1.0850 के घटक के अनुसार विनिर्माता/विपणन कम्पनी या जैसी भी स्थिति हो के द्वारा किसी भी मामले में भुगतान किए गए वास्तविक उत्पाद शुल्क और या वेट से अधिक न हो । विनिर्माता/ विपणन कम्पनी विशेष रूप से इस शर्त का अनुपालन सुनिश्चित करने के लिए दायी होंगे ।

(ट) उक्त सारणी में व्याप्त नहीं होने वाले फॉर्मूलेशन/ प्रबलता(कम्पोजिशन ) जिसमें स्तम्भ 3 के किसी भी अनुसूचित औषध के तत्व मौजूद हो, तो यह सारणी के सम्बन्धित क्रम संख्या के उच्चतम मूल्य के शर्त के अधीन होगा जैसा मामला हो , जब तक कि निर्माता ने इसके पश्चात उस फॉर्मूलेशन के लिए एनपीपीए द्वारा निर्धारित विशेषीकृत मूल्य प्राप्त नहीं किया हो ।

(ट) विनिर्माता या विपणन कम्पनी , उक्त कथित अधिसूचना की तारीख से 15 दिनों के भीतर इसमें दर्शाये उच्चतम मूल्यों और शर्तों का पालन नहीं करती हैं तो , वे आवश्यक वस्तुएँ अधिनियम , 1955 के साथ पठित डीपीसीओ , 1995 के प्रावधानों के अधीन ब्याज सहित अधिप्रभारित राशि को जमा करने के लिए दायी होंगे ।

(ठ) इस आदेश में विनिर्मित पैकों की अधिकतम कीमत नियत होने के परिणाम स्वरुप, आदेश जो कि इस आदेश से पूर्वजारी हुए है, स्वतः ही निरस्त हो जायेंगें ।

S.O. 2724 (E). In exercise of the powers , conferred by sub-paragraphs ( 1 ) and (2 ) of paragraph 9 and paragraph 11 of the Drugs (Prices Control ) Order , 1995 , read with No. S.O. 637 ( E) dated the 4th September, 1997 issued by the Government of India in the Ministry of Chemicals and Fertilizers , the National Pharmaceutical Pricing Authority, hereby fixes the prices as specified in column (5) of the table - I below as ceiling prices exclusive of excise duty and local tax , if any, and in column (6) of the table- I below as Equivalent MRP inclusive of excise duty and education cess , sales tax/VAT of each of the Scheduled formulations specified in the corresponding entry in column ( 2 ) of the said Table- I with the strength and pack size specified respectively in the corresponding entries in columns ( 3 ) and (4) thereof:

(a) In addition to packs specified in column (4) of the strength notified in column (3 ) of the table -I , the following ceiling prices are fixed: -

For pack size other than pack size given in column ( 1) of the table II deduct @ Rs . 0.12600 per ml . from the ceiling price mentioned in column (2 ) of the nearest higher pack size. These prices shall be worked out by manufacturer / marketing company and the price so worksed out shall be adopted as ceiling price corresponding to price notified in column (5) and equivalent MRP notified in column (6) of the table - I.

(b) The prices fixed are the maximum retail prices ( inclusive of excise duty, sales tax/VAT and local taxes if any) in column (6 ) of table - I, for the specified pack and packs of similar strength , and manufacturer/ marketing company cannot claim exemption on any ground therefrom , unless specifically permitted by the Government/NPPA through an order .

(c) The manufacturer/ marketing company may add taxes only if they have actually paid to the Government on the price mentioned in the column (5). If there is any variation in the MRP (inclusive of the taxes) , the same may be intimated to the NPPA in Form - V of DPCO , 1995 .

(d) Pro - rata pricing for packs of same composition but of different sizes will be applicable vide S.O. No. 83 (E) dated 27.1.1998 for tablet( s ) and capsule ( s ) packed in strip/blister .

(e) For different packing material used or , different drug delivery systems or any other special features /forms claimed , the ceiling prices , as specified in Column No. 5 above , shall be applicable unless the companies approaches NPPA for specific price approvals for its formulations .

(f) The prices fixed/ notified hereinabove under the provisions of DPCO , 1995 have to be mandatorily implemented by the manufacturing/marketing company notwithstanding its भारत का राजपत्र असाधारण

status of compliance of conditions for such formulation pack under the Drugs and Cosmetics Act, 1940 .

(g) The manufacturer and marketing company for the above said formulation shall be required to take the requisite prior approval from the Competent Authority for any change in the composition of the above said formulation with written prior intimation to the National Pharmaceutical Pricing Authority .

(h) The ceiling price arrived on the basis of above shall not exceed the MRP by multiplying the ceiling price by a factor of 1.0850 as per the existing rates of excise duty and VAT.

(i) The MRP arrived as above shall be subject to payment of Government levies / taxes as applicable and necessary adjustment in the factor of 1.0850 shall necessarily be required to be made by the manufacturer /marketing company, whenever the existing rate of excise duty and/ or VAT undergoes a change , subject to the condition that the excise duty and/ or VAT so calculated shall in no case exceed the actual excise duty and/or VAT paid by the manufacturer /marketing company or as applicable as per the factor of 1.0850 . The manufacturer /marketing company shall be specifically liable to ensure the compliance of this condition .

(j ) Any other formulation / composition not covered in the above table that has any one of the scheduled drugs in Column No. (3 ) as one of its ingredients , it shall be subject to the price ceiling at respective serial number of the table , as the case may be , unless the manufacturer has got hereafter specific price fixed by the NPPA for that formulation .

(1) Consequent to the issue of ceiling price of the formulation pack ( s ) in this notification , the price order( s ) issued prior to this date of notification stand withdrawn .

सारणी- ॥ के स्तंभ ( 1 ) में दिए गए पैक आकारों के अलावा अन्य पैक आकरों के लिए निकटतम उच्चतर पैक आकार की स्तंभ (2 ) में उल्लिखित अधिकतम कीमत में से 0.13200 रूपये प्रति मिलि की दर से घटाये जाएं । इन कीमतों की गणना विनिर्माता/ विपणन कम्पनी द्वारा की जाए एवं ऐसे गणना की गई कीमत को सारणी के स्तंभ ( 5) और स्तंभ (6 ) में की अधिसूचित कीमत की तत्स्थानी अधिकतम कीमत के रूप में अपनायी जाए ।

(ख ) ये कीमतें विनिर्दिष्ट पैक व समान प्रबलता के पैकों पर उत्पाद शुल्क और रश्थानीय कर को सम्मिलित कर स्तंभ (6 ) मे अधिकतम खुदरा कीमत के रुप में नियत की जाती हैं , और कम्पनी किसी छूट का दावा नहीं कर सकती , जब तक उसे छूट के लिये सरकार/रा.औ.मू.नि.प्रा . से आदेश प्राप्त न हों ।

(ग) कम्पनियाँ/विनिर्माता केवल तभी कर जोड़ सकते हैं यदि उन्होंने स्तंभ ( 5 ) में उल्लिखित मूल्य पर सरकार को वास्तव में भुगतान किया है । यदि अधिकतम खुदरा मूल्य (सभी करों सहित ) में कोई विभिन्नता हो तो वह एनपीपीए को डीपीसीओ , 1995 के फॉर्म-V में सूचित किया जाना चाहिए ।

(ड.) उपयोग की गई भिन्न पैकिंग सामग्री या भिन्न औषध वितरण प्रणाली या दावा किए गए किसी अन्य विशेष रूप के लिए , जब तक कम्पनियाँ इनके फॉर्मूलेशनों के लिए विशेषीकृत मूल्य अनुमोदनों हेतु एनपीपीए के पास नहीं जाती, उच्चतम मूल्य जैसे उक्त कॉलम सं. 5 में विशेषीकृत है, लागू होंगे ।

(च) औषध मूल्य नियंत्रण आदेश, 1995 के तहत नियत की गई उक्त कीमतें सभी उत्पादकों/विपणनकर्ताओं द्वारा आवश्यक रूप से लागू करनी होगी जिस तरह से इन विनिर्मिति पैक पर औषध एवं प्रसाधन अधिनियम, 1940 की शर्तें लागू होती हैं ।

(छ) उक्त कथित विनिर्मिति की विनिर्माता/विपणन कम्पनी के लिए अनिवार्य है कि वह उक्त कथित विनिर्मिति के संघटन में किसी भी बदलाव के लिए एनपीपीए को लिखित पूर्व सूचना के सार्थ सक्षम प्राधिकारी से आवश्यक पूर्वअनुमोदन प्राप्त करें ।

(ज) उक्त के आधार पर निकाली गई अधिकतम कीमत , उत्पाद शुल्क और वेट की वर्तमान दरों के अनुसार 1.0850 के घटक द्वारा अधिकतम कीमत से गुणा करके अधिकतम खुदरा कीमत से अधिक नहीं होगी ।

(झ) उक्त के अनुसार निकाली गई अधिकतम खुदरा कीमत, यथा लागू सरकारी लेवी/ करों के भुगतान की शर्त के अधीन है और 1.0850 के घटक में जरूरी समायोजन, विनिर्माता/विपणन कम्पनी द्वारा किया जाना आवश्यक रूप से जरूरी है, जब कभी उत्पाद शुल्क और या वेट की वर्तमान दर में बदलाव होता है, इस शर्त के अधीन कि इस प्रकार से गणना किए गए उत्पाद शुल्क और या वेट, 1.0850 के घटक के अनुसार विनिर्माता/विपणन कम्पनी या जैसी भी स्थिति हो के द्वारा किसी भी मामले में भुगतान किए गए वास्तविक उत्पाद शुल्क और या वेट से अधिक न हो । विनिर्माता/विपणन कम्पनी विशेष रूप से इस शर्त का अनुपालन सुनिश्चित करने के लिए दायी होंगे ।

(ट) उक्त सारणी में व्याप्त नहीं होने वाले फॉर्मूलेशन/प्रबलता (कम्पोजिशन ) जिसमें स्तम्भ 3 के किसी भी अनुसूचित औषध के तत्व मौजूद हो , तो यह सारणी के सम्बन्धित क्रम संख्या के उच्चतम मूल्य के शर्त के अधीन होगा जैसा मामला हो, जब तक कि निर्माता ने इसके पश्चात उस फॉर्मूलेशन के लिए एनपीपीए द्वारा निर्धारित विशेषीकृत मूल्य प्राप्त नहीं किया हो ।

(ट) विनिर्माता या विपणन कम्पनी, उक्त कथित अधिसूचना की तारीख से 15 दिनों के भीतर इसमें दर्शाये उच्चतम मूल्योंऔर शर्तों का पालन नहीं करती हैं तो , वे आवश्यक वस्तुएँ अधिनियम, 1955 के साथ पठित डीपीसीओ, 1995 के प्रावधानों के अधीन ब्याज सहित अधिप्रभारित राशि को जमा करने के लिए दायी होंगे ।

S.O. 2725 (E) .-- In exercise of the powers , conferred by sub - paragraphs ( 1 ) and ( 2 ) of paragraph 9 and paragraph 11 of the Drugs (Prices Control ) Order , 1995 , read with No. S.O. 637 (E) dated the 4th September , 1997 issued by the Government of India in the Ministry of Chemicals and Fertilizers , the National Pharmaceutical Pricing Authority , hereby fixes the prices as specified in column (5 ) of the table - I below as ceiling prices exclusive of excise duty and local tax , if any , and in column (6 ) of the table- I below as Equivalent MRP inclusive of excise duty and education cess , sales tax /VAT of each of the Scheduled formulations specified in the corresponding entry in column (2 ) of the said Table- I with the strength and pack size specified respectively in the corresponding entries in columns (3 ) and (4 ) thereof:

so worksed out shall be adopted as ceiling price corresponding to price notified in column (5) and equivalent MRP notified in column (6) of the table - I.

(b) The prices fixed are the maximum retail prices ( inclusive of excise duty, sales tax/VAT and local taxes if any) in column (6) of table-I , for the specified pack and packs of similar strength , and manufacturer/marketing company cannot claim exemption on any ground therefrom, unless specifically permitted by the Government/NPPA through an order .

(c) The manufacturer/marketing company may add taxes only if they have actually paid to the Government on the price mentioned in the column (5) . If there is any variation in the MRP (inclusive of the taxes) , the same may be intimated to the NPPA in Form-V of DPCO, 1995 .

(d) Pro- rata pricing for packs of same composition but of different sizes will be applicable vide S.O. No. 83 (E) dated 27.1.1998 for tablet(s ) and capsule(s) packed in strip/blister .

(e) For different packing material used or , different drug delivery systems or any other special features /forms claimed, the ceiling prices , as specified in Column No. 5 above , shall be applicable unless the companies approaches NPPA for specific price approvals for its formulations.

(f) The prices fixed/notified hereinabove under the provisions of DPCO , 1995 have to be mandatorily implemented by the manufacturing/marketing company notwithstanding its status of compliance of conditions for such formulation pack under the Drugs and Cosmetics Act, 1940.

(h) The ceiling price arrived on the basis of above shall not exceed the MRP by multiplying the ceiling price by a factor of 1.0850 as per the existing rates of excise duty and VAT.

(i) The MRP arrived as above shall be subject to payment of Government levies / taxes as applicable and necessary adjustment in the factor of 1.0850 shall necessarily be required to be made by the manufacturer/ marketing company, whenever the existing rate of excise duty and/ or VAT undergoes a change , subject to the condition that the excise duty and/ or VAT so calculated shall in no case exceed the actual excise duty and/ or VAT paid by the manufacturer /marketing company or as applicable as per the factor of 1.0850 . The manufacturer /marketing company shall be specifically liable to ensure the compliance of this condition .

(1) Consequent to the issue of ceiling price of the formulation pack( s ) in this notification , the price order( s ) issued prior to this date of notification stand withdrawn.

सारणी-॥ के स्तंभ ( 1 ) में दिए गए पैक आकारों के अलावा अन्य पैक आकरों के लिए निकटतम उच्चतर पैक आकार की स्तंभ (2) में उल्लिखित अधिकतम कीमत में से 0.16400 रूपये प्रति मिलि की दर से घटाये जाएं । इन कीमतों की गणना विनिर्माता/विपणन कम्पनी द्वारा की जाए एवं ऐसे गणना की गई कीमत को सारणी के स्तंभ ( 5 ) और स्तंभ (6) में की अधिसूचित कीमत की तत्स्थानी अधिकतम कीमत के रूप में अपनायी जाए ।

(ख ) ये कीमतें विनिर्दिष्ट पैक व समान प्रबलता के पैकों पर उत्पाद शुल्क और स्थानीय कर को सम्मिलित कर स्तंभ (6 ) मे अधिकतम खुदरा कीमत के रुप में नियत की जाती हैं , और कम्पनी किसी छूट का दावा नहीं कर सकती , जब तक उसे छूट के लिये सरकार/रा.औ.मू.नि.प्रा. से आदेश प्राप्त न हों ।

(ग) कम्पनियाँ /विनिर्माता केवल तभी कर जोड़ सकते हैं यदि उन्होंने स्तंभ ( 5) में उल्लिखित मूल्य पर सरकार को वास्तव में भुगतान किया है । यदि अधिकतम खुदरा मूल्य (सभी करों सहित ) में कोई विभिन्नता हो तो वह एनपीपीए को डीपीसीओ , 1995 के फॉर्म में सूचित किया जाना चाहिए ।

(घ) वह पैक जिसकी कम्पोजिशन समान है लेकिन आकार में अन्तर है, वह प्रो- राटा प्राइजिंग आदेश का. आ. 83(अ) दिनांक 27.1.1998 के तहत गोलियां और कैपसूल के पत्ता/ ब्लिस्टर के लिए आयेगी ।

(ड.) उपयोग की गई भिन्न पैकिंग सामग्री या भिन्न औषध वितरण प्रणाली या दावा किए गए किसी अन्य विशेष रूप के लिए , जब तक कम्पनियाँ इनके फॉर्मूलेशनों के लिए विशेषीकृत मूल्य अनुमोदनों हेतु एनपीपीए के पास नहीं जाती , उच्चतम मूल्य जैसे उक्त कॉलम सं. 5 में विशेषीकृत है, लागू होंगे ।

(च) औषध मूल्य नियंत्रण आदेश, 1995 के तहत नियत की गई उक्त कीमतें सभी उत्पादकों/विपणनकर्ताओं द्वारा आवश्यक रूप से लागू करनी होगी जिस तरह से इन विनिर्मिति पैक पर औषध एवं प्रसाधन अधिनियम, 1940 की शर्ते लागू होती हैं ।

(छ) उक्त कथित विनिर्मिति की विनिर्माता/ विपणन कम्पनी के लिए अनिवार्य है कि वह उक्त कथित विनिर्मिति के संघटन में किसी भी बदलाव के लिए एनपीपीए को लिखित पूर्व सूचना के साथ सक्षम प्राधिकारी से आवश्यक पूर्व अनुमोदन प्राप्त करें ।

(ज) उक्त के आधार पर निकाली गई अधिकतम कीमत , उत्पाद शुल्क और वेट की वर्तमान दरों के अनुसार 1.0850 के घटक द्वारा अधिकतम कीमत से गुणा करके अधिकतम खुदरा कीमत से अधिक नहीं होगी ।

(झ) उक्त के अनुसार निकाली गई अधिकतम खुदरा कीमत, यथा लागू सरकारी लेवी/ करों के भुगतान की शर्त के अधीन है और 1.0850 के घटक में जरूरी समायोजन , विनिर्माता/ विपणन कम्पनी द्वारा किया जाना आवश्यक रूप से जरूरी है , जब कभी उत्पाद शुल्क और या वेट की वर्तमान दर में बदलाव होता है, इस शर्त के अधीन कि इस प्रकार से गणना किए गए उत्पाद शुल्क और या वेट, 1.0850 के घटक के अनुसार विनिर्माता/विपणन कम्पनी या जैसी भी स्थिति हो के द्वारा किसी भी मामले में भुगतान किए गए वास्तविक उत्पाद शुल्क और या वेट से अधिक न हो । विनिर्माता/ विपणन कम्पनी विशेष रूप से इस शर्त का अनुपालन सुनिश्चित करने के लिए दायी होंगे ।

(ट) उक्त सारणी में व्याप्त नहीं होने वाले फॉर्मूलेशन/प्रबलता(कम्पोजिशन) जिसमें स्तम्भ 3 के किसी भी अनुसूचित औषध के तत्व मौजूद हो , तो यह सारणी के सम्बन्धित क्रम संख्या के उच्चतम मूल्य के शर्त के अधीन होगा जैसा मामला हो , जब तक कि निर्माता ने इसके पश्चात उस फॉर्मूलेशन के लिए एनपीपीए द्वारा निर्धारित विशेषीकृत मूल्य प्राप्त नहीं किया हो ।

(ट) विनिर्माता या विपणन कम्पनी , उक्त कथित अधिसूचना की तारीख से 15 दिनों के भीतर इसमें दर्शाये उच्चतम मूल्यों और शर्तों का पालन नहीं करती हैं तो , वे आवश्यक वस्तुएँ अधिनियम, 1955 के साथ पठित डीपीसीओ , 1995 के प्रावधानों के अधीन ब्याज सहित अधिप्रभारित राशि को जमा करने के लिए दायी होंगे ।

(ठ) इस आदेश में विनिर्मित पैकों की अधिकतम कीमत नियत होने के परिणाम स्वरुप , आदेश जो कि इस आदेश से पूर्व जारी हुए है, स्वतः ही निरस्त हो जायेंगें ।

(छ) उक्त कथित विनिर्मिति की विनिर्माता/ विपणन कम्पनी के लिए अनिवार्य है कि वह उक्त कथित विनिर्मिति के संघटन में किसी भी बदलाव के लिए एनपीपीए को लिखित पूर्व सूचना के साथ सक्षम प्राधिकारी से आवश्यक पूर्व अनुमोदन प्राप्त करें ।

(ज) उक्त के आधार पर निकाली गई अधिकतम कीमत , उत्पाद शुल्क और वेट की वर्तमान दरों के अनुसार 1.0850 के घटक द्वारा अधिकतम कीमत से गुणा करके अधिकतम खुदरा कीमत से अधिक नहीं होगी ।

(झ) उक्त के अनुसार निकाली गई अधिकतम खुदरा कीमत, यथा लागू सरकारी लेवी/ करों के भुगतान की शर्त के अधीन है और 1.0850 के घटक में जरूरी समायोजन, विनिर्माता/ विपणन कम्पनी द्वारा किया जाना आवश्यक रूप से जरूरी है, जब कभी उत्पाद शुल्क और या वेट की वर्तमान दर में बदलाव होता है , इस शर्त के अधीन कि इस प्रकार से गणना किए गए उत्पाद शुल्क और या वेट, 1.0850 के घटक के अनुसार् विनिर्माता/विपणन कम्पनी या जैसी भी स्थिति हो के द्वारा किसी भी मामले में भुगतान किए गए वास्तविक उत्पाद शुल्क और या वेट से अधिक न हो । विनिर्माता/ विपणन कम्पनी विशेष रूप से इस शर्त का अनुपालन सुनिश्चित करने के लिए दायी होंगे ।

(ट) विनिर्माता या विपणन कम्पनी, उक्त कथित अधिसूचना की तारीख से 15 दिनों के भीतर इसमें दर्शाये उच्चतम मूल्यों और शर्तों का पालन नहीं करती हैं तो , वे आवश्यक वस्तुएँ अधिनियम , 1955 के साथ पठित डीपीसीओ , 1995 के प्रावधानों के अधीन ब्याज सहित अधिप्रभारित राशि को जमा करने के लिए दायी होंगे ।

For pack size other than pack size given in column ( 1 ) of the table - II deduct @ Rs . 0.11800 per ml . from the ceiling price mentioned in column (2) of the nearest higher pack size . These prices shall be worked out by manufacturer / marketing company and the price so worksed out shall be adopted as ceiling price corresponding to price notified in column (5) and equivalent MRP notified in column (6) of the table - I.

(b) The prices fixed are the maximum retail prices ( inclusive of excise duty , sales tax/VAT and local taxes if any) in column (6) of table -I , for the specified pack and packs of similar strength, and manufacturer/marketing company cannot claim exemption on any ground therefrom, unless specifically permitted by the Government/NPPA through an order .

(c) The manufacturer/ marketing company may add taxes only if they have actually paid to the Government on the price mentioned in the column ( 5 ) . If there is any variation in the MRP (inclusive of the taxes) , the same may be intimated to the NPPA in Form - V of DPCO , 1995 .

(d) Pro - rata pricing for packs of same composition but of different sizes will be applicable vide S.O. No. 83 (E) dated 27.1.1998 for tablet (s ) and capsule (s) packed in strip/blister .

(e) Fordifferent packing material used or , different drug delivery systems or any other special features /forms claimed, the ceiling prices , as specified in Column No. 5 above , shall be applicable unless the companies approaches NPPA for specific price approvals for its formulations .

(f) The prices fixed/ notified hereinabove under the provisions of DPCO, 1995 have to be mandatorily implemented by the manufacturing/ marketing comparty notwithstanding its status of compliance of conditions for such formulation pack under the Drugs and Cosmetics Act, 1940.

(h) The ceiling price arrived on the basis of above shall not exceed the MRP by multiplying the ceiling price by a factor of 1.0850 as per the existing rates of excise duty and VAT.

(1) The MRP arrived as above shall be subject to payment of Government levies / taxes as applicable and necessary adjustment in the factor of 1.0850 shall necessarily be required to be made by the manufacturer/marketing company , whenever the existing rate of excise duty and/ or VAT undergoes a change , subject to the condition that the excise duty and/orMAT so calculated shall in no case exceed the actual excise duty and/ or VAT paid by the manufacturer/marketing company or as applicable as per the factor of 1.0850. The manufacturer/marketing company shall be specifically liable to ensure the compliance of this condition.

(j ) Any other formulation / composition not covered in the above table that has any one of the scheduled drugs in Column No. ( 3 ) as one of its ingredients , it shall be subject to the price ceiling at respective serial number of in table , as the case may be , unless the manufacturer has got hereafter specific price fixed by the NPPA for that formulation.

(k) The manufacturer or marketing compons not complying with the ceiling prices and conditions specified in notes hereinabove within 15 days from the date of above said notification, shall be liable to deposit overcharged amount along with the interest under the provisions of the DPCO , 1995 read with the EC Act , 1955 .

(1) Consequent to the issue of ceiling price of the formulation pack ( s ) in this notification, the price order ( s ) issued prior to this date of notification stand withdrawn.

सारणी- ॥ के स्तंभ ( 1 ) में दिए गए पैक आकारों के अलावा अन्य पैक आकरों के लिए निकटतम उच्चतर पैक आकार की स्तंभ (2) में उल्लिखित अधिकतम कीमत में से 0.21000 रूपये प्रति मिलि की दर से घटाये जाएं । इन कीमतों की गणना विनिर्माता/ विपणन कम्पनी द्वारा की जाए एवं ऐसे गणना की गई कीमत को सारणी । के स्तंभ (5 ) और स्तंभ (6) में की अधिसूचित कीमत की तत्स्थानी अधिकतम कीमत के रूप में अपनायी जाए ।

(ख) ये कीमतें विनिर्दिष्ट पैक व समान प्रबलता के पैकों पर उत्पाद शुल्क और स्थानीय कर को सम्मिलित कर स्तंभ (6) मे अधिकतम खुदरा कीमत के रुप में नियत की जाती हैं, और कम्पनी किसी छूट का दावा नहीं कर सकती , जब तक उसे छूट के लिये सरकार/रा.औ.मू.नि.प्रा. से आदेश प्राप्त न हों ।

(ग) कम्पनियाँ/विनिर्माता केवल तभी कर जोड़ सकते हैं यदि उन्होंने स्तंभ ( 5 ) में उल्लिखित मूल्य पर सरकार को वास्तव में भुगतान किया है । यदि अधिकतम खुदरा मूल्य (सभी करों सहित ) में कोई विभिन्नता हो तो वह एनपीपीए को डीपीसीओ , 1995 के फॉर्म में सूचित किया जाना चाहिए ।

(घ) वह पैक जिसकी कम्पोजिशन समान है लेकिन आकार में अन्तर है, वह प्रो- राटा प्राइजिंग आदेश का. आ. 83(अ) दिनांक 27.1.1998 के तहत गोलियां और कैपसूल के पत्ता/ ब्लिस्टर के लिए आयेगी ।

(ड.) उपयोग की गई भिन्न पैकिंग सामग्री या भिन्न औषध वितरण प्रणाली या दावा किए गए किसी अन्य विशेष रूप के लिए , जब तक कम्पनियाँ इनके फॉर्मूलेशनों के लिए विशेषीकृत मूल्य अनुमोदनों हेतु एनपीपीए के पास नहीं जाती, उच्चतम मूल्य जैसे उक्त कॉलम सं. 5 में विशेषीकृत है, लागू होंगे ।

(छ) उक्त कथित विनिर्मिति की विनिर्माता/विपणन कम्पनी के लिए अनिवार्य है कि वह उक्त कथित विनिर्मिति के संघटन में किसी भी बदलाव के लिए एनपीपीए को लिखित पूर्व सूचना के साथ सक्षम प्राधिकारी से आवश्यक पूर्वअनुमोदन प्राप्त करें ।

सारणी- ॥ के स्तंभ (1 ) में दिए गए पैक आकारों के अलावा अन्य पैक आकरों के लिए निकटतम उच्चतर पैक आकार की स्तंभ (2) में उल्लिखित अधिकतम कीमत में से 0.16800 रूपये प्रति मिलि की दर से घटाये जाएं । इन कीमतों की गणना विनिर्माता/विपणन कम्पनी द्वारा की जाए एवं ऐसे गणना की गई कीमत को सारणी के स्तंभ (5 ) और स्तंभ (6) में की अधिसूचित कीमत की तत्स्थानी अधिकतम कीमत के रूप में अपनायी जाए ।

(ख) ये कीमतें विनिर्दिष्ट पैक व समान प्रबलता के पैकों पर उत्पाद शुल्क और स्थानीय कर को सम्मिलित कर स्तंभ (6) मे अधिकतम खुदरा कीमत के रुप में नियत की जाती हैं, और कम्पनी किसी छूट का दावा नहीं कर सकती, जब तक उसे छूट के लिये सरकार/ रा.औ.मू.नि.प्रा . से आदेश प्राप्त न हों ।

(ग) कम्पनियाँ/विनिर्माता केवल तभी कर जोड़ सकते हैं यदि उन्होंने स्तंभ ( 5 ) में उल्लिखित मूल्य पर सरकार को वास्तव में भुगतान किया है । यदि अधिकतम खुदरा मूल्य (सभी करों सहित) में कोई विभिन्नता हो तो वह एनपीपीए को डीपीसीओ , 1995 के फॉर्म में सूचित किया जाना चाहिए ।

(घ) वह पैक जिसकी कम्पोजिशन समान है लेकिन आकार में अन्तर है, वह प्रो - राटा प्राइजिंग आदेश का. आ. 83 (अ) दिनांक 27.1.1998 के तहत गोलियां और कैपसूल के पत्ता/ ब्लिस्टर के लिए आयेगी ।

(ड.) उपयोग की गई भिन्न पैकिंग सामग्री या भिन्न औषध वितरण प्रणाली या दावा किए गए किसी अन्य विशेष रूप के लिए , जब तक कम्पनियाँ इनके फॉर्मूलेशनों के लिए विशेषीकृत मूल्य अनुमोदनों हेतु एनपीपीए के पास नहीं जाती, उच्चतम मूल्य जैसे उक्त कॉलम सं. 5 में विशेषीकृत है, लागू होंगे ।

(झ) उक्त के अनुसार निकाली गई अधिकतम खुदरा कीमत, यथा लागू सरकारी लेवी/ करों के भुगतान की शर्त के अधीन है और 1.0850 के घटक में जरूरी समायोजन , विनिर्माता/विपणन कम्पनी द्वारा किया जाना आवश्यक रूप से जरूरी है , जब कभी उत्पाद शुल्क और या वेट की वर्तमान दर में बदलाव होता है , इस शर्त के अधीन कि इस प्रकार से गणना किए गए उत्पाद शुल्क और या वेट , 1.0850 के घटक के अनुसार विनिर्माता/विपणन कम्पनी या जैसी भी स्थिति हो के द्वारा किसी भी मामले में भुगतान किए गए वास्तविक उत्पाद शुल्क और या वेट से अधिक न हो । विनिर्माता/ विपणन कम्पनी विशेष रूप से इस शर्त का अनुपालन सुनिश्चित करने के लिए दायी होंगे ।

(८) उक्त सारणी में व्याप्त नहीं होने वाले फॉर्मूलेशन/प्रबलता (कम्पोजिशन) जिसमें स्तम्भ 3 के किसी भी अनुसूचित औषध के तत्व मौजूद हो , तो यह सारणी के सम्बन्धित क्रम संख्या के उच्चतम मूल्य के शर्त के अधीन होगा जैसा मामला हो , जब तक कि र्माता ने इसके पश्चात उस फॉर्मूलेशन के लिए एनपीपीए द्वारा निर्धारित विशेषीकृत मूल्य प्राप्त नहीं किया ।

(ट) बिनिर्माता या विपणन कम्पनी , उक्त कथित अधिसूचना की तारीख से 15 दिनों के भीतर इसमें दर्शाये उच्चतम मूल्यों और शर्तों का पालन नहीं करती हैं तो, वे आवश्यक वस्तुएँ अधिनियम, 1955 के साथ पठित डीपीसीओ, 1995 के प्रावधानों के अधीन ब्याज सहित अधिप्रभारित राशि को जमा करने के लिए दायी होंगे ।

(ठ) इस आदेश में विनिर्मित पैकों की अधिकतम कीमत नियत होने के परिणाम स्वरुप, आदेश जो कि इस आदेश से पूर्वजारी हुए है , स्वतः ही निरस्त हो जायेंगें ।

S.O. 2729 (E). In exercise of the powers , conferred by sub - paragraphs ( 1 ) and ( 2 ) of paragraph 9 and paragraph 11 of the Drugs (Prices Control ) Order , 1995, read with No. S.O. 637 (E) dated the 4th September, 1997 issued by the Government of India in the Ministry of Chemicals and Fertilizers , the National Pharmaceutical Pricing Authority , hereby fixes the prices as specified in coluran (5) of the table - I below as ceiling prices exclusive of excise duty and local tax, if any, and in column (6) of the table - I below as Equivalent MRP inclusive of excise duty and education cess , sales tax/ VAT of each of the Scheduled formulations specified in the corresponding entry in column (2 ) of the said Table- I with the strength and pack size specified respectively in the corresponding entries in columns (3 ) and (4 ) thereof:

For pack size other than pack size given in column ( 1 ) of the table II deduct @ Rs . 0.16800 per ml . from the ceiling price mentioned in column (2) of the nearest higher pack size . These prices shall be worked out by manufacturer / marketing company and the price so wosed out shall be adopted as ceiling price corresponding to price notified in column (5 ) and equivalent MRP notified in column (6) of the table - I.

(b) The prices fixed are the maximum retail prices ( inclusive of excise duty , sales tax/VAT and loca ' taxes if any) in column (6) of table - I , for the specified pack and packs of similar sirength , and manufacturer/marketing company cannot claim exemption on any ground therefrom, unless specifically permitted by the Government/NPPA through an order .

(c) The manufacturer/marketing company may add taxes only if they have actually paid to the Government on the price mentioned in the column (5 ) . If there is any variation in the MRP (inclusive of the taxes ) , the same may be intimated to the NPPA in Form - V of DPСО , 1995 .

(d) Pro - rata pricing for packs of same composition but of different sizes will be applicable vide S.O. No. 83 (E) dated 27.1.1998 for tablet ( s ) and capsule(s ) packed in strip/blister .

(e) Fordifferent packing material used or, different drug delivery systems or any other special features/forms claimed, the ceiling prices , as specified in Column No. 5 above , shall be applicable unless the companies approaches NPPA for specific price approvals for its formulations .

(f) The prices fixed/notified hereinabove under the provisions of DPCO, 1995 have to be mandatorily implemented by the manufacturing/marketing company notwithstanding its status of compliance of conditions for such formulation pack under the Drugs and Cosmetics Act , 1940 .

(h) The ceiling price arrived on the basis of above shall not exceed the MRP by multiplying the ceiling price by a factor of 1.0850 as per the existing rates of excise duty and VAT.

(1) The MRP arrived as above shall be subject to payment of Government levies / taxes as applicable and necessary adjustment in the factor of 1.0850 shall necessarily be required to be made by the manufacturer/marketing company, whenever the existing rate of excise duty and / or VAT undergoes a change , subject to the condition that the excise duty and/or VAT so calculated shall in no case exceed the actual excise duty and/ or VAT paid by the manufacturer/marketing company or as applicable as per the factor of 1.0850 . The manufacturer/marketing company shall be specifically liable to ensure the compliance of this condition .

(j ) Any other formulation / comp... scheduled drugs in Column No. ! covered in the above table that has any one of the ceiling at respective serial nut one of its ingredients , it shall be subject to the price table , as the case may be, unless the manufacturer has got hereafter specific price fit hy dre NPPA for that formulation .

(k) The manufacturer or marketi mrmy not complying with the ceiling prices and conditions specified in notes hereinabove within 15 days from the date of above said notification, shall be liable to dejas overcharged amount along with the interest under the provisions of the DPCO , 1995 rond with the EC Act , 1955.

(1) Consequent to the issue of ceilice of the formulation pack ( s) in this notification, the price order( s) issued prior to th of notification stand witadrwn .

सारणी- ॥ के स्तंभ ( 1 ) में दिए गए पैक आकारों के अलावा अन्य पैक आकरों के लिए निकटतम उच्चतर पैक आकार की स्तंभ (2 ) में उल्लिखित अधिकतम कीमत में से 0.09324 रूपये प्रति मिलि की दर से घटाये जाएं, इसके अतिरिक्त 251 मिलि से 500 मिलि के बीच के पैक आकारों के लिए ऐसे गणना की गई कीमत में से 0.06 रूपये प्रति 5 मिलि घटाये जाएं । इन कीमतों की गणना विनिर्माता/विपणन कम्पनी द्वारा की जाए एवं ऐसे गणना की गई कीमत को सारणी के स्तंभ (5 ) और स्तंभ (6) में की अधिसूचित कीमत की तत्स्थानी अधिकतम कीमत के रूप में अपनायी जाए ।

(ख) ये कीमतें विनिर्दिष्ट पैक व समान प्रबलता के पैकों पर उत्पाद शुल्क और स्थानीय कर को सम्मिलित कर स्तंभ (6) मे अधिकतम खुदरा कीमत के रुप में नियत की जाती हैं, और कम्पनी किसी छूट्टु का दावा नहीं कर सकती, जब तक उसे छूट के लिये सरकार/रा.औ.मू.नि.प्रा. से आदेश प्राप्त न हों ।

(च) औषध मूल्य नियंत्रण आदेश , 1995 के तहत नियत की गई उक्त कीमतें सभी उत्पादकों/ विपणनकर्ताओं द्वारा आवश्यक रूप से लागू करनी होगी जिस तरह से इन विनिर्मिति पैक पर औषध एवं प्रसाधन अधिनियम, 1940 की शर्ते लागू होती हैं ।

(छ) उक्त कथित विनिर्मिति की विनिर्माता/ विपणन कम्पनी के लिए अनिवार्य है कि वह उक्त कथित विनिर्मिति के संघटन में किसी भी बदलाव के लिए एनपीपीए को लिखित पूर्व सूचना के साथ सक्षम प्राधिकारी से आवश्यक पूर्वअनुमोदन प्राप्त करें ।

(झ) उक्त के अनुसार निकाली गई अधिकतम खुदरा कीमत, यथा लागू सरकारी लेवी/ करों के भुगतान की शर्त के अधीन है और 1.0850 के घटक जरूरी समायोजन , विनिर्माता/ विपणन कम्पनी द्वारा किया जाना आवश्यक रूप से जरूरी है, जब कभी याद शुल्क और या वेट की वर्तमान दर में बदलाव होता है , इस शर्त के अधीन कि इस प्रकार से गणना किए गए उत्पाद शुल्क और या वेट, 1.0850 के घटक के अनुसार विनिर्माता/विपणन कम्पनी या जैसीथति हो के द्वारा किसी भी मामले में भुगतान किए गए वास्तविक उत्पाद शुल्क और या वेट से अधिक न हो। विनिर्माता/ विपणन कम्पनी विशेष रूप से इस शर्त का अनुपालन सुनिश्चित करने के लिए दायी होंगे ।

1 (च) उक्त सारणी में व्याप्त नहीं होनॉर्मूलेशन/ प्रबलता (कम्पोजिशन ) जिसमें स्तम्भ 3 के किसी भी

अनुसूचित औषध के तत्व मौजूद हो, तो वह सारणी के सम्बन्धित क्रम संख्या के उच्चतम मूल्य के शर्त के अधीन होगा जैसा मामला हो. जब तक कि निर्माता ने इसके पश्चात उस फॉर्मूलेशन के लिए एनपीपीए द्वारा निधारित विशेषीकृत मूल्य प्राप्त नहीं या हो ।

(द) विनिर्माता या विपणन कम्पनी, उक्त कथित अधिसूचना की तारीख से 15 दिनों के भीतर इसमें दर्शाये उच्चतम मूल्यों और शर्तों का पालन नहीं करती हैं तो, वे आवश्यक वस्तुएँ अधिनियम, 1965 के साथ पठित डीपीसीओ , 1995 के प्रावधानों के अधीन ब्याज सहित अधिप्रभारित राशि को जमा करने के लिए दायी होंगे ।

The ceiling price arrived on the basis of above shall not exceed the MRP by multiplying the ceiling price by a factor of 1.0850 as per the existing rates of excise duty and VAT. (h)

(i) The MRP arrived as above shall be subject to payment of Government ! ovies / taxes as applicable and necessary adjustment in the factor of 1.0850 shail necessarily be required to be made by the manufacturer/ marketing company whenever the existing rate of excise duty and/ or VAT undergoes a change , subject to the condition that the excise uuty and/ or VAT so calculated shall in no case exceed the actual excise duty and/or VAT paid by the manufacturer /marketing company or as applicable as per the factor of 1.0850 . The manufacturer/marketing company shall be specifically liable to ensure the compliance of this condition .

(j) Any other formulation / composition not covered in the above table that has any one of the scheduled drugs in Column No. (3 ) as one of its ingredients , it shall be subject to the price ceiling at respective serial number of the table , as the case may be , unless the manufacturer has got hereafter specific price fixed by the NPPA for that formulation .

(1) Consequent to the issue of ceiling price of the formulation pack( s ) in it is potification , the price order ( s ) issued prior to this date of notification stand withdrawn .

सारणी- ॥ के स्तंभ ( 1 ) में दिए गए पैक आकारों के अलावा अन्य पैक आकरों के लिए निकटतम उच्चतर पैक आकार की स्तभ (2) में उल्लिखित अधिकतम कीमत में से 0.17888 रूपये प्रति मिलि की दर से घटाये जाएं, इसके अतिरिक्त 251 मिलि से 500 मिलि के बीच के पैक आकारों के लिए ऐसे गणना की गई कीमत में से 0.06 रूपये प्रति 5 मिलि घटाये जाएं । इन कीमतों की गणना विनिर्माता/विपणन कम्पनी द्वारा की जाए एवं ऐसे गणना की गई कीमत को सारणी के स्तंभ (5 ) और स्तंभ (6) में की अधिसूचित कीमत की तत्स्थानी अधिकतम कीमत के रूप में अपनायी जाए ।

(ख) ये कीमतें विनिर्दिष्ट पैक व समान प्रबलता के पैकों पर उत्पाद शुल्क और स्थानीय कर को सम्मिलित कर स्तंभ (6) मे अधिकतम खुदरा कीमत के रुप में नियत की जाती हैं, और कम्पनी किसी छूट का दावा नहीं कर सकती , जब तक उसे छूट के लिये सरकार/ रा.औ.मू.नि.प्रा. से आदेश प्राप्त न हों ।

(ग) कम्पनियाँ/विनिर्माता केवल तभी कर जोड़ सकते हैं यदि उन्होंने स्तंभ (5 ) में उल्लिखित मूल्य पर सरकार को वास्तव में भुगतान किया है । यदि अधिकतम खुदरा मूल्य (सभी करों सहित ) में कोई विभिन्नता हो तो वह एनपीपीए को डीपीसीओ, 1995 के फॉर्म- में सूचित किया जाना चाहिए ।

(घ) वह पैक जिसकी कम्पोजिशन समान है लेकिन आकार में अन्तर है, वह प्रो - राटा प्राइजिंग आदेश का. आ. 83(अ) दिनांक 27.1.1998 के तहत गोलियां और कैपसूल के पत्ता/ब्लिस्टर के लिए आयेगी ।

(ड. ) उपयोग की गई भिन्न पैकिंग सामग्री या भिन्न औषध वितरण प्रणाली या दावा किए गए किसी अन्य विशेष रूप के लिए , जब तक कम्पनियाँ इनके फॉर शनों के लिए विशेषीकृत मूल्य अनुमोदनों हेतु एनपीपीए के पास नहीं जाती , उच्चतम मूल्य जैसे उक्त कॉलम एवं 5 में विशेषीकृत है, लागू होंगे ।

(च) औषध मूल्य नियंत्रण आदेश, 1995 के तहत नियत की गई उक्त कीमतें सभी उत्पादकों/विपणनकर्ताओं द्वारा आवश्यक रूप से लागू करनी होगी जिस दरह से इन विनिर्मिति पैक पर औषध एवं प्रसाधन अधिनियम , 1940 की शर्ते लागू होती हैं ।

(छ) उक्त कथित विनिर्मिति की विनिर्माता/विपणन कम्पनी के लिए अनिवार्य है कि वह उक्त कथित विनिर्मिति के संघटन में किसी भी बदलाव के लिए एनपीए को लिखित पूर्व सूचना के साथ सक्षम प्राधिकारी से आवश्यदः पूर्व अनुमोदन प्राप्त करें ।

(ज ) उक्त के आधार पर निकाली गई अधिकार कोगत , उत्पाद शुल्क और वेट की वर्तमान दरों के अनुसार 1.0850 के घटक द्वारा अधिकतम कीमत से गुणा करके अधिकतम खुदरा कीमत से अधिक नहीं होगी ।

(स) उक्त के अनुसार निकाली गई अधिकतम खुदरा कीमत, यथा लागू सरकारी लेवी/ करों के भुगतान की शर्त के अधीन है और 1.0850 के घटक में जरूरी समायोजन , विनिर्माता/विपणन कम्पनी द्वारा किया जाना आवश्यक रूप से जरूरी है, जब कभी एक और या वेट की वर्तमान दर में बदलाव होता है, इस शर्त के अधीन कि इस प्रकार से गणना किर गए उत्पाद शुल्क और या वेट, 1.0850 के घटक के अनुसार विनिर्माता/ विपणन कम्पनी या जैसी भी यति हो के द्वारा किसी भी मामले में भुगतान किए गए वास्तविक उत्पाद शुल्क और या वेट से अधिक न हो । विनिर्माता/ विपणन कम्पनी विशेष रूप से इस शर्त का अनुपालन सुनिश्चित करने के लिए दायी होंगे ।

(ट) उक्त सारणी में व्याप्त नहीं होने वाले फॉलेशन, 'प्रबलता (कम्पोजिशन) जिसमें स्तम्भ के किसी भी अनुसूचित औषध के तत्व मौजूद हो, को यह सारणी के सम्बन्धित क्रम संख्या के उच्चतम मूल्य के शर्त के अधीन होगा जैसा मामला हो , जब तक कि ने इसके पश्चात उस फार्मूलेशन के लिए एनपीपीए द्वारा निर्धारित विशेषीकृत मूल्य प्राप्त नहीं किया हो ।

(ट) विनिर्माता या विपणन कम्पनी , उक्त कथित अधिसूचना की तारीख से 15 दिनों के भी इसमें दर्शाये उच्चतम मूल्यों और शर्तों का पालन नहीं करती हैं तो , वे आवश्यक वस्तुएँ अधिनियम, 1955 के साथ पठित डपीसीओ, 1995 के प्रावधानों के अधीन ब्याज सहित अधिप्रभारित राशि को जमा करने के लिए दायी होंगे ।

(ठ) इस आदेश में विनिर्मित पैकों की अधिकतम नेयत होने के परिणाम स्वरुप , आदेश कहा कि इस आदेश से पूर्वजारी हुए है, स्वतः ही निरस्त हो जायें ।

S.O. 2731 (E).- In exercise of the powers , conferred by sub -paragraphs ( 1 ) and (2) of paragraph 9 and paragraph 11 of the Drugs (Prices Control ) Order , 1995 , read with No. S.O. 637 ( E) dated the 4th September , 1997 issued by the Government of India in the Ministry of Chemicals and Fertilizers , the National Pharmaceutical Pricing Authority, hereby fixes the prices as specified in column (5) of the table- I below as ceiling prices exclusive of excise duty and local tax, if any, and in column (6) of the table- I below as Equivalent MRP inclusive of excise duty and education cess, sales tax/VAT of each of the Scheduled formulations specified in the corresponding entry in column (2) of the said Table- I with the strength and pack size specified respectively in the corresponding entries in columns (3 ) and (4) thereof:

For pack size other than pack size given in column ( 1 ) of the table - II deduct @ Rs . 0.17888 per ml . from the ceiling price mentioned in column (2) of the nearest higher pack size, further , Rs . 0.06 per 5 ml . shall be deducted from price so worked out for pack size between 251 to 500 ml . These prices shall be worked out by manufacturer / marketing company and the price so worked out shall be adopted as ceiling price corresponding to price notified in column ( 5) and equivalent MRP notified in column (6) of the table - I.

(b) The prices fixed are the maximum retail prices ( inclusive of excise duty, sales tax/VAT and local taxes if any) in column (6) of table -I , for the specified pack and packs of similar strength, and manufacturer/ marketing company cannot claim exemption on any ground therefrom, unless specifically permitted by the Government/NPPA through an order .

(c) The manufacturer/marketing company may add taxes only if they have actually paid to the Government on the price mentioned in the column (5 ) . If there is any variation in the MRP (inclusive ofthe taxes ) , the same may be intimated to the NPPA in Form - V of DPCO , 1995 .

(d) Pro -rata pricing for packs of same composition but of different sizes will be applicable vide S.O. No. 83 (E) dated 27.1.1998 for tablet(s) and capsule(s) packed in strip/blister .

(e) For different packing material used or, different drug delivery systems or any other special features /forms claimed, the ceiling prices , as specified in Column No. 5 above, shall be applicable unless the companies approaches NPPA for specific price approvals for its formulations .

(च) औषध मूल्य नियंत्रण आदेश , 1995 के तहत नियत की गई उक्त कीमतें सभी उत्पादकों/ विपणनकर्ताओं द्वारा आवश्यक रूप से लागू करनी होगी जिस तरह से इन विनिर्मिति पैक पर औषध एवं प्रसाधन अधिनियम , 1940 की शर्ते लागू होती हैं ।

(ज) उक्त के आधार पर निकाली गई अधिकतम कीमत , उत्पाद शुल्क और वेट की वर्तमान दरों के अनुसार 1.0850 के घटक द्वारा अधिकतम कीमत से गुणा करके अधिकतम खुदरा कीमत से अधिक नहीं होगी ।

(झ) उक्त के अनुसार निकाली गई अधिकतम खुदरा कीमत, यथा लागू सरकारी लेवी/करों के भुगतान की शर्त के अधीन है और 1.0850 के घटक में जरूरी समायोजन, विनिर्माता/विपणन कम्पनी द्वारा किया जाना आवश्यक रूप से जरूरी है, जब कभी उत्पाद शुल्क और या वेट की वर्तमान दर में बदलाव होता है , इस शर्त के अधीन कि इस प्रकार से गणना किए गए उत्पाद शुल्क और या वेट, 1.0850 के घटक के अनुसार विनिर्माता/ विपणन कम्पनी या जैसी भी स्थिति हो के द्वारा किसी भी मामले में भुगतान किए गए वास्तविक उत्पाद शुल्क और या वेट से अधिक न हो । विनिर्माता/विपणन कम्पनी विशेष रूप से इस शर्त का अनुपालन सुनिश्चित करने के लिए दायी होंगे ।

(ट) उक्त सारणी में व्याप्त नहीं होने वाले फॉर्मूलेशन/प्रबलता (कम्पोजिशन) जिसमें स्तम्भ 3 के किसी भी अनुसूचित औषध के तत्व मौजूद हो , तो यह सारणी के सम्बन्धित क्रम संख्या के उच्चतम मूल्य के शर्त के अधीन होगा जैसा मामला हो , जब तक कि निर्माता ने इसके पश्चात उस फॉर्मूलेशन के लिए एनपीपीए द्वारा निर्धारित विशेषीकृत मूल्य प्राप्त नहीं किया हो ।

(ट) विनिर्माता या विपणन कम्पनी, उक्त कथित अधिसूचना की तारीख से 15 दिनों के भीतर इसमें दर्शाये उच्चतम मूल्यों और शर्तों का पालन नहीं करती हैं तो, वे आवश्यक वस्तुएँ अधिनियम, 1955 के साथ पठित डीपीसीओ , 1995 के प्रावधानों के अधीन ब्याज सहित अधिप्रभारित राशि को जमा करने के लिए दायी होंगे ।

(ठ) इस आदेश में विनिर्मित पैकों की अधिकतम कीमत नियत होने के परिणाम स्वरुप , आदेश जो कि इस आदेश से पूर्व जारी हुए है, स्वतः ही निरस्त हो जायेंगें ।

For pack size other than pack size given in column ( 1 ) of the table II deduct @ Rs . 0.10538 per ml . from the ceiling price mentioned in column (2 ) of the nearest higher pack size, further, Rs . 0.06 per 5 ml . shall be deducted from price so worked out for pack size between 251 to 500 ml . These prices shall be worked out by manufacturer / marketing company and the price so worked out shall be adopted as ceiling price corresponding to price notified in column (5) and equivalent MRP notified in column ( 6 ) of the table - I.

(b) The prices fixed are the maximum retail prices (inclusive of excise duty , sales tax /VAT and local taxes if any) in column (6 ) of table - I , for the specified pack and packs of similar strength, and manufacturer /marketing company cannot claim exemption on any ground therefrom, unless specifically permitted by the Government /NIPA through an order .

(c) The manufacturer/ marketing company may add taxes only if they have actually paid to the Government on the price mentioned in the column (5). If there is any variation in the MRP (inclusive ofthe taxes), the same may be intimated to the NPPA in Form - V of DPCO, 1995 .

(d) Pro- rata pricing for packs of same composition but of different sizes will be applicable vide S.O. No. 83 (E) dated 27.1.1998 for tablet(s) and capsule(s) packed in strip/blister .

(e) For different packing material used or, different drug delivery systems or any other special features/forms claimed, the ceiling prices, as specified in Column No. 5 above , shall be applicable unless the companies approaches NPPA for specific price approvals for its formulations .

(f) The prices fixed/ notified hereinabove under the provisions of DPCO, 1995 have to be mandatorily implemented by the manufacturing/marketing company notwithstanding its status of compliance of conditions for such formulation pack under the Drugs and Cosmetics Act, 1940.

(h) The ceiling price arrived on the basis of above shall not exceed the MRP by multiplying the ceiling price by a factor of 1.0850 as per the existing rates of excise duty and VAT .

(i) The MRP arrived as above shall be subject to payment of Government levies / taxes as applicable and necessary adjustment in the factor of 1.0850 shall necessarily be required to be made by the manufacturer / marketing company, whenever the existing rate of excise duty and/or VAT undergoes a change , subject to the condition that the excise duty and/or VAT so calculated shall in no case exceed the actual excise duty and/or VAT paid by the manufacturer/marketing company or as applicable as per the factor of 1.0850 . The manufacturer/marketing company shall be specifically liable to ensure the compliance of thiscondition.

(k) The manufacturer or marketing company not complying with the ceiling prices and conditions specified in notes hereinabove within 15 days from the date of above said notification, shall be liable to deposit overcharged amount along with the interest under the (1) provisions of the DPCO , 1995 read with the EC Act , 1955 . Consequent to the issue of ceiling price of the formulation pack(s) in this notification, the price order(s) issued prior to this date of notification stand withdrawn.

सारणी-॥ के स्तंभ ( 1 ) में दिए गए पैक आकारों के अलावा अन्य पैक आकरों के लिए निकटतम उच्चतर पैक आकार की स्तंभ (2 ) में उल्लिखित अधिकतम कीमत में से 0.11845 रूपये प्रति मिलि की दर से घटाये जाएं , इसके अतिरिक्त 251 मिलि से 500 मिलि के बीच के पैक आकारों के लिए ऐसे गणना की गई कीमत में से [ भाग II-खण्ड 3 ( ii) ]

0.06 रूपये प्रति 5 मिलि घटाये जाएं । इन कीमतों की गणना विनिर्माता/विपणन कम्पनी द्वारा की जाए एवं ऐसे गणना की गई कीमत को सारणी । के स्तंभ (5) और स्तंभ (6) में की अधिसूचित कीमत की तत्स्थानी अधिकतम कीमत के रूप में अपनायी जाए ।

(ख) ये कीमतें विनिर्दिष्ट पैक व समान प्रबलता के पैकों पर उत्पाद शुल्क और स्थानीय कर को सम्मिलित कर स्तंभ (6) मे अधिकतम खुदरा कीमत के रुप में नियत की जाती हैं, और कम्पनी किसी छूट का दावा नहीं कर सकती , जब तक उसे छूट के लिये सरकार/रा.औ.मू.नि.प्रा. से आदेश प्राप्त न हों ।

(ग ) कम्पनियाँ /विनिर्माता केवल तभी कर जोड़ सकते हैं यदि उन्होंने स्तंभ (5 ) में उल्लिखित मूल्य पर सरकार को वास्तव में भुगतान किया है । यदि अधिकतम खुदरा मूल्य (सभी करों सहित) में कोई विभिन्नता हो तो वह एनपीपीए को डीपीसीओ , 1995 के फॉर्म- V में सूचित किया जाना चाहिए ।

(ड.) उपयोग की गई भिन्न पैकिंग सामग्री या भिन्न औषध वितरण प्रणाली या दावा किए गए किसी अन्य विशेष रूप के लिए, जब तक कम्पनियाँ इनके फॉर्मूलेशनों के लिए विशेषीकृत मूल्य अनुमोदनों हेतु एनपीपीए के पास नहीं जाती, उच्चतम मूल्य जैसे उक्त कॉलम सं. 5 में विशेषीकृत है, लागू होंगे ।

(च) औषध मूल्य नियंत्रण आदेश, 1995 के तहत नियत की गई उक्त कीमतें सभी उत्पादकों/ विपणनकर्ताओं द्वारा आवश्यक रूप से लागू करनी होगी जिस तरह से इन विनिर्मिति पैक पर औषध एवं प्रसाधन अधिनियम, 1940 की शर्तें लागू होती हैं ।

(छ) उक्त कथित विनिर्मिति की विनिर्माता/ विपणन कम्पनी के लिए अनिवार्य है कि वह उक्त कथित विनिर्मिति के संघटन में किसी भी बदलाव के लिए एनपीपीए को लिखित पूर्व सूचना के साथ सक्षम प्राधिकारी से आवश्यक पूर्व अनुमोदन प्राप्त करें ।

(ज) उक्त के आधार पर निकाली गई अधिकतम कीमत , उत्पाद शुल्क और वेट की वर्तमान दरों के अनुसार 1.0850 के घटक द्वारा अधिकतम कीमत से गुणा करके अधिकतम खुदरा कीमत से अधिक नहीं होगी ।

(झ) उक्त के अनुसार निकाली गई अधिकतम खुदरा कीमत, यथा लागू सरकारी लेवी/करों के भुगतान की शर्त के अधीन है और 1.0850 के घटक में जरूरी समायोजन, विनिर्माता/विपणन कम्पनी द्वारा किया जाना आवश्यक रूप से जरूरी है , जब कभी उत्पाद शुल्क और या वेट की वर्तमान दर में बदलाव होता है , इस शर्त के अधीन कि इस प्रकार से गणना किए गए उत्पाद शुल्क और या वेट, 1.0850 के घटक के अनुसार विनिर्माता/विपणन कम्पनी या जैसी भी स्थिति हो के द्वारा किसी भी मामले में भुगतान किए गए वास्तविक उत्पाद शुल्क और या वेट से अधिक न हो । विनिर्माता/ विपणन कम्पनी विशेष रूप से इस शर्त का अनुपालन सुनिश्चित करने के लिए दायी होंगे ।

एनपीपीए ने प्राधिकरण की 127 वी आयोजित बैठक जो दिनांक 06.11.2012 में विधिवत पूर्वोक्त मूल्य निर्धारण आदेश पर ह्यूमन इन्सुलिन इन्जैक्शन स्वदेशी उत्पादित विनिर्मितियों के मूल्य किये है । तद्नुसार ह्यूमन इन्सुलिन इन्जैक्शन स्वदेशी उत्पादितवि निर्मितियों से संबंधित आदेशों के मूल्यों को " जनहित" में डीपीसीओ , 1995 के विभिन्न प्रावधानों के अनुसार अनुमोदित किया गया जिसके फलस्वरूप उपभोक्ताओं एवं जनमानस को सस्ती/उचित एवं युक्तियुक्त मूल्य मिल सकें ।

(ख) कम्पनियाँ /विनिर्माता केवल तभी कर जोड़ सकते हैं यदि उन्होंने स्तंभ ( 5) में उल्लिखित मूल्य पर सरकार को वास्तव में भुगतान किया है । यदि अधिकतम खुदरा मूल्य (सभी करों सहित ) में कोई विभिन्नता हो तो वह एनपीपीए को डीपीसीओ , 1995 के फॉर्म-V में सूचित किया जाना चाहिए ।

(ग) उपयोग की गई भिन्न पैकिंग सामग्री या भिन्न औषध वितरण प्रणाली या दावा किए गए किसी अन्य विशेष रूप के लिए , जब तक कम्पनियाँ इनके फॉर्मूलेशनों के लिए विशेषीकृत मूल्य अनुमोदनों हेतु एनपीपीए के पास नहीं जाती, उच्चतम मूल्य जैसे उक्त कॉलम सं. 5 में विशेषीकृत है, लागू होंगे ।

(घ) औषध मूल्य नियंत्रण आदेश , 1995 के तहत नियत की गई उक्त कीमतें सभी उत्पादकों/विपणनकर्ताओं द्वारा आवश्यक रूप से लागू करनी होगी जिस तरह से इन विनिर्मिति पैक पर औषध एवं प्रसाधन अधिनियम, 1940 की शर्तें लागू होती हैं ।

(ड.) उक्त कथित विनिर्मिति की विनिर्माता/विपणन कम्पनी के लिए अनिवार्य है कि वह उक्त कथित विनिर्मिति के संघटन में किसी भी बदलाव के लिए एनपीपीए को लिखित पूर्व सूचना के साथ सक्षम प्राधिकारी से आवश्यक पूर्व अनुमोदन प्राप्त करें ।

(च) उक्त के आधार पर निकाली गई अधिकतम कीमत , उत्पाद शुल्क और वेट की वर्तमान दरों के अनुसार 1.04 के घटक द्वारा अधिकतम कीमत से गुणा करके अधिकतम खुदरा कीमत से अधिक नहीं होगी ।

(छ) उक्त के अनुसार निकाली गई अधिकतम खुदरा कीमत , यथा लागू सरकारी लेवी/ करों के भुगतान की शर्त के अधीन है और 1.04 के घटक में जरूरी समायोजन, विनिर्माता/विपणन कम्पनी द्वारा किया जाना आवश्यक रूप से जरूरी है , जब कभी उत्पाद शुल्क और या वेट की वर्तमान दर में बदलाव होता है , इस शर्त के अध् पीन कि इस प्रकार से गणना किए गए उत्पाद शुल्क और या वेट, 1.04 के घटक के अनुसार विनिर्माता/विपणन कम्पनी या जैसी भी स्थिति हो के द्वारा किसी भी मामले में भुगतान किए गए वास्तविक उत्पाद शुल्क और या वेट से अधिक न हो । विनिर्माता/ विपणन कम्पनी विशेष रूप से इस शर्त का अनुपालन सुनिश्चित करने के लिए दायी होंगे ।

(ज) उक्त सारणी में व्याप्त नहीं होने वाले फॉर्मूलेशन/प्रबलता(कम्पोजिशन) जिसमें स्तम्भ 3 के किसी भी अनुसूचित औषध के तत्व मौजूद हो , तो यह सारणी के सम्बन्धित क्रम संख्या के उच्चतम मूल्य के शर्त के अधीन होगा जैसा मामला हो , जब तक कि निर्माता ने इसके पश्चात उस फॉर्मूलेशन के लिए एनपीपीए द्वारा निर्धारित विशेषीकृत मूल्य प्राप्त नहीं किया हो ।

(झ) विनिर्माता या विपणन कम्पनी , उक्त कथित अधिसूचना की तारीख से 15 दिनों के भीतर इसमें दर्शाये उच्चतम मूल्यों और शर्तों का पालन नहीं करती हैं तो , वे आवश्यक वस्तुएँ अधिनियम, 1955 के साथ पठित डीपीसीओ , 1995 के प्रावधानों के अधीन ब्याज सहित अधिप्रभारित राशि को जमा करने के लिए दायी होंगे ।

(ट) इस आदेश में विनिर्मित पैकों की अधिकतम कीमत नियत होने के परिणाम स्वरुप , आदेश जो कि इस आदेश से पूर्व जारी हुए है, स्वतः ही निरस्त हो जायेंगें ।

NPPA in its 127th Authority Meeting held on 06.11.2012 duly considered the aforesaid price fixation order and approved the prices of Human Insulin Injection produced domestically . Accordingly, prices for Human Insulin Injection produced domestically were approved in " public interest " under various provisions of the DPCO , 1995 , in order to ensure fair and affordable/ reasonable price to consumer public .

Note :

(a) The prices fixed are the maximum retail prices in column (6) ( inclusive of excise duty and local taxes if any) for the specified pack and packs of similar strength, and companies cannot claim exemption on any ground therefrom , unless specifically permitted by the Government/NPPA through an order .

(b) The companies / manufacturers may added taxes only if they have paid actually to the Government on the price mentioned in the column (5 ) . If there is any variation in the MRP (inclusive of the taxes ) , the same may be intimated to the NPPA in the Form- V of DPCO , 1995.

(c) Fordifferent packing material used or , different drug delivery systems or any other special features /forms claimed, the ceiling prices , as specified in Column No. 5 above, shall be applicable unless the companies approaches NPPA for specific price approvals for its formulations .

(d) The prices fixed/notified hereinabove under the provisions of DPCO, 1995 have to be mandatorily implemented by the manufacturing /marketing company notwithstanding its status of compliance of conditions for such formulation pack under the Drugs and Cosmetics Act, 1940.

(e) The manufacturer and marketing company for the above said formulation shall be required to take the requisite prior approval from the competent Authority for any change in the composition of the above said formulation with written prior intimation to the National Pharmaceutical Pricing Authority.

(f) The ceiling price arrived on the basis of above shall not exceed the MRP by multiplying the ceiling price by a factor of 1.04 as per the existing rates of excise duty and VAT .

(g) The MRP arrived as above shall be subject to payment of Government levies / taxes as applicable and necessary adjustment in the factor of 1.04 shall necessarily be required to be made by the manufacturer /marketing company , whenever the existing rate of excise duty and/or VAT undergoes a change , subject to the condition that the excise duty and/ or VAT so calculated shall in no case exceed the actual excise duty and/or VAT paid by the manufacturer /marketing company or as applicable as per the factor of 1.04. The manufacturer /marketing company shall be specifically liable to ensure the compliance of this condition .

(h) Any other formulation / composition not covered in the above table that has any one of the scheduled drugs in Column No. (3 ) as one of its ingredients , it shall be subject to the price ceiling at respective serial number of the table, as the case may be, unless the manufacturer has got hereafter specific price fixed by the NPPA for that formulation.

(i) The manufacturer or marketing company not complying with the ceiling prices and conditions specified in notes hereinabove within 15 days from the date of above said notification, shall be liable to deposit overcharged amount along with the interest under the provisions of the DPCO , 1995 read with the EC Act, 1955 .

(j ) Consequent to the issue of ceiling price of the formulation pack(s) in this notification, the price order ( s ) issued prior to this date of notification stand automatically withdrawn.

एनपीपीए ने प्राधिकरण की 127वी आयोजित बैठक जो दिनांक 06.11.2012 में विधिवत पूर्वोक्त मूल्य निर्धारण आदेश पर ह्यूमन इन्सुलिन इन्जैक्शन आयातित तैयार फॉर्म विनिर्मितियों के मूल्य स्वदेशी/ विदेशी विकल्पित आयतित विनिर्मितियों के संबंध में 121 वीं प्राधिकरण की बैठक दिनांक 22.7.2011 में अनुमोदित दिशानिर्देश पर किये है । तद्नुसार ह्यूमन इन्सुलिन इन्जैक्शन आयातित तैयार फॉर्म विनिर्मितियों से संबंधित आदेशों के मूल्यों को " जनहित" में डीपीसीओ , 1995 के विभिन्न प्रावधानों के अनुसार अनुमोदित किया गया जिसके फलस्वरूप उपभोक्ताओं एवं जनमानस को सस्ती/उचित एवं युक्तियुक्त मूल्य मिल सकें ।

नोट:

(क) ये कीमतें विनिर्दिष्ट पैक व समान प्रबलता के पैकों पर उत्पाद शुल्क और स्थानीय कर को सम्मिलित कर स्तंभ (6) मे अधिकतम खुदरा कीमत के रुप में नियत की जाती हैं , और कम्पनी किसी छूट का दावा नहीं कर सकती, जब तक उसे छूट के लिये सरकार/ रा.औ.मू.नि.प्रा. से आदेश प्राप्त न हों ।

(ड. ) उक्त कथित विनिर्मिति की विनिर्माता/ विपणन कम्पनी के लिए अनिवार्य है कि वह उक्त कथित विनिर्मिति के संघटन में किसी भी बदलाव के लिए एनपीपीए को लिखित पूर्व सूचना के साथ सक्षम प्राधिकारी से आवश्यक पूर्वअनुमोदन प्राप्त करें ।

(ख ) कम्पनियाँ/विनिर्माता केवल तभी कर जोड़ सकते हैं यदि उन्होंने स्तंभ ( 5 ) में उल्लिखित मूल्य पर सरकार को वास्तव में भुगतान किया है । यदि अधिकतम खुदरा मूल्य (सभी करों सहित ) में कोई विभिन्नता हो तो वह एनपीपीए को डीपीसीओ , 1995 के फॉर्म में सूचित किया जाना चाहिए ।

(ग) उपयोग की गई भिन्न पैकिंग सामग्री या भिन्न औषध वितरण प्रणाली या दावा किए गए किसी अन्य विशेष रूप के लिए , जब तक कम्पनियाँ इनके फॉर्मूलेशनों के लिए विशेषीकृत मूल्य अनुमोदनों हेतु एनपीपीए के पास नहीं जाती, उच्चतम मूल्य जैसे उक्त कॉलम सं . 5 में विशेषीकृत है, लागू होंगे ।

(घ ) उक्त कथित विनिर्मिति की विनिर्माता/विपणन कम्पनी के लिए अनिवार्य है कि वह उक्त कथित विनिर्मिति के संघटन में किसी भी बदलाव के लिए एनपीपीए को लिखित पूर्व सूचना के साथ सक्षम प्राधिकारी से आवश्यक पूर्वअनुमोदन प्राप्त करें ।

(ड.) ये कीमतें/परिशोधित कीमतें औषध (कीमत नियंत्रण ) आदेश , 1995 के पैरा , 14 उप पैरा ( 1 ) के तहत इस आदेश की तिथि के 15 दिन के अन्दर लागू होगी । औषध ( कीमत नियंत्रण ) 1995 के पैरा 14 के उप पैरा (3 ) के तहत कीमत सूची भी जारी की जाएगी ।

(छ) विनिर्माता या विपणन कम्पनी, उक्त कथित अधिसूचना की तारीख से 15 दिनों के भीतर इसमें दर्शाये उच्चतम मूल्यों और शर्तों का पालन नहीं करती हैं तो, वे आवश्यक वस्तुएँ अधिनियम , 1955 के साथ पठित डीपीसीओ , 1995 के प्रावधानों के अधीन ब्याज सहित अधिप्रभारित राशि को जमा करने के लिए दायी होंगे ।

S.O. 2736 (E). In exercise of the powers , conferred by sub - paragraph ( 1 )/ ( 2 )/( 4 ) of paragraph 8 of the Drugs(Prices Control) Order , 1995 , read with No. S.O. 637 (E) dated the 4th September , 1997 issued by the Government of India in the Ministry of Chemicals and Fertilizers , the National Pharmaceutical Pricing Authority, hereby fixes/revises the prices as specified in column (5) of the table hereto annexed as the retail price/revised retail price , exclusive of excise duty , Sales Taxes /VAT and local taxes , if any, and in column (6) as equivalent MRP inclusive of excise duty, education cess , Sales Tax/VAT in relation to each of the formulation specified in the corresponding entry in column (2) of the said table with the pack size specified in the corresponding entries in column (3 ) thereof; manufactured/ imported by M/ s Allergan India Pvt . Ltd.

NPPA in its 127th Authority Meeting held on 06.11.2012 duly considered the aforesaid price fixation order and approved the prices of imported formulations having domestic / indigenous substitute as per the guidelines approved in 121st Authority Meeting held on 22.7.2011 for such imported formulations . Accordingly, prices for concerned imported formulations were approved in public interest under various provisions of the DPCO , 1995 , in order to ensure fair and reasonable price to consumer public.

Note:

(a) The prices fixed are the maximum retail prices in column no . ( 6) ( inclusive of excise duty , sales tax/VAT and local taxes if any ) for the specified pack and packs of similar strength , and companies cannot claim exemption on any ground there from , unless specifically permitted by the Government/NPPA through an order .

(b) The companies / manufacturers may added taxes only if they have paid actually to the Government on the price mentioned in the column (5) . If there is any variation in the MRP (inclusive of the taxes ) , the same may be intimated to the NPPA in the Form - V of DPCO , 1995 .

(c) For different packing material used or , different drug delivery systems or any other special features / forms claimed , the retail prices , as specified in Column No. 5 above , shall be applicable unless the companies approaches NPPA for specific price approvals for its formulations .

(d) The manufacturer and marketing company for the above said formulation shall be required to take the requisite prior approval from the competent . Authority for any change in the composition of the above said formulation with written prior intimation to the National Pharmaceutical Pricing Authority.

(e) These prices / revised prices shall be made effective within 15 days of receipt of this order as required under sub para 14( 1 ) of DPCO , 1995. The necessary price - list should also be issued as required under sub - paragraph (3 ) of paragraph 14 of the Drugs ( Prices Control ) Order , 1995.

(f) These prices fixed/notified hereinabove under the provisions of DPCO , 1995 have to be mandatorily implemented by the manufacturing/marketing company notwithstanding its status of compliance of conditions for such formulation pack under the Drugs and Cosmetics Act, 1940 .

(g) The manufacturer or marketing company not complying with the ceiling prices and conditions specified in notes hereinabove within 15 days from the date of above said notification , shall be liable to deposit overcharged amount along with the interest under the provisions of the DPCO . 1995 read with the EC Act , 1955 .

NPPA in its 127th Authority Meeting held on 06.11.2012 duly considered the prices for concerned imported formulations and approved in public interest under various provisions of the DPCO , 1995 , in order to ensure fair and reasonable price to consumer public .

Note:

(a) The prices fixed are the maximum retail prices in column no . ( 6 ) ( inclusive of excise duty, sales tax/VAT and local taxes if any) for the specified pack and packs of similar strength , and companies cannot claim exemption on any ground there from, unless specifically permitted by the Government/NPPA through an order .

(b) The companies / manufacturers may added taxes only if they have paid actually to the Government on the price mentioned in the column (5). If there is any variation in the MRP (inclusive of the taxes ) , the same may be intimated to the NPPA in the Form - V of DPCO , 1995 .

(f) These prices fixed/notified hereinabove under the provisions of DPCO , 1995 have to be mandatorily implemented by the manufacturing/ marketing company notwithstanding its status of compliance of conditions for such formulation pack under the Drugs and Cosmetics Act, 1940.

(g) The manufacturer or marketing company not complying with the ceiling prices and conditions specified in notes hereinabove within 15 days from the date of above said notification, shall be liable to deposit overcharged amount along with the interest under the provisions of the DPCO , 1995 read with the EC Act , 1955 .

नोट:

(घ) उक्त कथित विनिर्मिति की विनिर्माता/ विपणन कम्पनी के लिए अनिवार्य है कि वह उक्त कथित विनिर्मिति के संघटन में किसी भी बदलाव के लिए एनपीपीए को लिखित पूर्व सूचना के साथ सक्षम प्राधिकारी से आवश्यक पूर्वअनुमोदन प्राप्त करें ।

(ड.) ये कीमतें/ परिशोधित कीमतें औषध (कीमत नियंत्रण ) आदेश , 1995 के पैरा 14 उप पैरा ( 1 ) के तहत इस आदेश की तिथि के 15 दिन के अन्दर लागू होगी । औषध (कीमत नियंत्रण ) 1995 के पैरा 14 के उप पैरा (3 ) के तहत कीमत सूची भी जारी की जाएगी ।

(च) औषध मूल्य नियंत्रण आदेश , 1995 के तहत नियत की गई उक्त कीमतें सभी उत्पादकों/ विपणनकर्ताओं द्वारा आवश्यक रूप से लागू करनी होगी जिस तरह से इन विनिर्मिति पैक पर औषध एवं प्रसाधन अधिनियम, 1940 की शर्ते लागू होती हैं ।

(छ) विनिर्माता या विपणन कम्पनी , उक्त कथित अधिसूचना की तारीख से 15 दिनों के भीतर इसमें दर्शाये उच्चतम मूल्यों और शर्तों का पालन नहीं करती हैं तो, वे आवश्यक वस्तुएँ अधिनियम , 1955 के साथ पठित डीपीसीओ , 1995 के प्रावधानों के अधीन ब्याज सहित अधिप्रभारित राशि को जमा करने के लिए दायी होंगे ।

New Delhi , the 16th November, 2012

S.O. 2740 (E) . In exercise of the powers , conferred by sub- paragraph ( 1 ) /( 2 ) / ( 4 ) of paragraph 8 of the Drugs (Prices Control) Order, 1995, read with No. S.O. 637 (E) dated the 4th September , 1997 issued by the Government of India in the Ministry of Chemicals and Fertilizers , the National Pharmaceutical Pricing Authority , hereby fixes/revises the prices as specified in column (5) of the table hereto annexed as the retail price/revised retail price, exclusive of excise duty , Sales Taxes /VAT and local taxes , if any, and in column (6) as equivalent MRP inclusive of excise duty, education cess , Sales Tax/VAT in relation to each of the formulation specified in the corresponding entry in column (2) of the said table with the pack size specified in the corresponding entries in column (3 ) thereof; manufactured/ imported by M/ s Eli - Lilly and Company ( I ) Pvt . Ltd.

NPPA in its 127th Authority Meeting held on 06.11.2012 duly considered the aforesaid price fixation order and approved the prices of imported formulations having domestic / indigenous substitute as per the guidelines approved in 121st Authority Meeting held on 22.7.2011 for such imported formulations . Accordingly , prices for concerned imported formulations were approved in public interest under various provisions of the DPCO , 1995 , in order to ensure fair and reasonable price to consumer public .

Note :

(a) The prices fixed are the maximum retail prices in column no . (6) ( inclusive of excise duty, sales tax/VAT and local taxes if any) for the specified pack and packs of similar strength , and companies cannot claim exemption on any ground there from , unless specifically permitted by the Government/NPPA through an order .

(b) The companies / manufacturers may added taxes only if they have paid actually to the Government on the price mentioned in the column (5) . If there is any variation in the MRP (inclusive of the taxes ) , the same may be intimated to the NPPA in the Form - V of DPСО, 1995 .

(c) For different packing material used or, different drug delivery systems or any other special features/ forms claimed , the retail prices , as specified in Column No. 5 above , shall be applicable unless the companies approaches NPPA for specific price approvals for its formulations .

(e) These prices/ revised prices shall be made effective within 15 days of receipt of this order as required under sub para 14 ( 1 ) of DPCO , 1995. The necessary price - list should also be issued as required under sub- paragraph ( 3 ) of paragraph 14 of the Drugs ( Prices Control ) Order, 1995.

(f) These prices fixed/notified hereinabove under the provisions of DPCO , 1995 have to be mandatorily implemented by the manufacturing/ marketing company notwithstanding its status of compliance of conditions for such formulation pack under the Drugs and Cosmetics Act, 1940.
