और अतः केन्द्रीय सरकार का यह भी मत है कि उक्त कारणों से एच एन एल सी इसके गुटों, विंगों अथवा प्रमुख संगठनों सहित विधिविरुद्ध संगम है;

का.आ. 2718 (अ).-केन्द्रीय सरकार की राय है कि मेघालय की हन्नीवट्रेप नेशनल काउंसिल ( जिसे इसमें इसके बाद एच एन एल सी कहा गया है ) मेघालय राज्य के उन क्षेत्रों ( जहां मुख्यतः खासी और जैंतिया जनजाति के लोग निवास करते हैं ) को भारत संघ से अलग करने के अपने उद्देश्य की खुलेआम घोषणा करती रही है; और यतः , केन्द्रीय सरकार की पुनः राय है कि एच एन एल सी,-
और यतः केन्द्रीय सरकार का यह भी मत है कि एच एन एल सीकी उपर्युक्त गतिविधियाँ भारत की प्रभुसत्ता और अखंडता के लिए हानिकारक हैं और यदि इन पर तत्काल नियंत्रण न किया गया तो उक्त एच एन एल सी पुनर्संगठित होगा , पुनः शस्त्रों से लैस होगा , अपने कार्यकर्ताओं की संख्या बढ़ाएगा , अत्याधुनिक हथियार प्राप्त करेगा , नागरिकों और सुरक्षा बलों की हत्या करेगा और राष्ट्र-विरोधी गतिविधियों को तेज करेगा;
(क ) ने मेघालय राज्य को भारत संघ से अलग करने के अपने उद्देश्य की खुलेआम घोषणा कर दी है;
(ख) अपने इस उद्देश्य को प्राप्त करने हेतु वह सशस्त्र साधनों का प्रयोग करती रही है तथा उनमें लिप्त रही है; और
अतः , अब , विधिविरुद्ध क्रियाकलाप ( निवारण ) अधिनियम, 1967 ( 1967 का 37 ) जिसे इसके बाद उक्त अधिनियम कहा गया है, की धारा 3 की उप - धारा ( 1 ) के तहत प्रदत्त शक्तियों का प्रयोग करते हुए , केन्द्रीय सरकार , एतदद्वारा हन्नीवट्रेप नेशनल लिब्रेशन काउंसिल ( एच एन एल सी ) को इसके सभी गुटों , विंगों और मुख्य संगठनों सहित विधिविरुद्ध संगम घोषित करती है;
(ग ) अपने संगठन के लिए निधियां एकत्रित करने के उद्देश्य से डराने - धमकाने तथा जबरन धन वसूली की कार्रवाईयों में लिप्त रही है;
और यतः केन्द्रीय सरकार का यह भी मत है कि एच एन एल सी,
(i ) अपने संगठन के लिए धन जुटाने हेतु आम जनता को डराने - धमकाने , जबरन धन वसूली करने तथा लूटमार के कृत्यों में संलिप्त रही है;
केन्द्रीय सरकार का यह भी मत है कि एच एन एल सी को इसके सभी गुटों, विंगों और मुख्य संगठनों सहित तत्काल प्रभाव से विधिविरुद्ध संगम घोषित करना आवश्यक है , और तदनुसार , उक्त अधिनियम की धारा 3 की उप - धारा ( 3 ) के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए केन्द्रीय सरकार, एतद्वारा निदेश देती है कि यह अधिसूचना उक्त अधिनियम की धारा 4 के अधीन किए जा सकने वाले किसी आदेश के अध्यधीन सरकारी राजपत्र में इसके प्रकाशित होने की तारीख से प्रभावी होगी ।
( ii ) जबरन धन वसूली तथा डराने - धमकाने की कार्रवाईयों को अंजाम देने के लिए पूर्वोतर क्षेत्र के अन्य विद्रोही गुटों के साथ संपर्क बनाए हुए है ; और

शंभु सिंह , संयुक्त सचिव (iii ) अपने काडरों को शरण स्थल मुहैया कराने तथा प्रशिक्षण के प्रयोजन से पड़ोसी देशों में शिविर स्थापित किए हुए हैं;

NOTIFICATION
New Delhi , the 16th November , 2012
Andwhereas , the Central Government is also of the opinion that for the reasons aforesaid , the HNLC together with its factions, wings or front organizations , is an unlawful association;
S.O. 2718 ( E) .-Whereas the Central Government is of the opinion that the Hynniewtrep National Liberation Council (hereinafter referred to as the HNLC ) of Meghalaya has been openly declaring as its objective the secession of the areas in the State of Meghalaya ( largely inhabited by Khasi and Jaintia tribals ) from the Indian Union;
And whereas , the Central Government is further of the opinion that the HNLC,--
Andwhereas , the Central Government is also of the opinion that the aforesaid activities of the HNLC are detrimental to the sovereignty and integrity of India , and if these are not immediately curbed and controlled , the said HNLC would regroup and rearm itself, expand its cadres , procure sophisticated weapons , cause loss of lives of civilians and Security Forces , and accelerate its anti - national activities ;
(a) has openly declared as their objective the secession of the State of Meghalaya from the Indian Union;
(b) has been employing and engaging in armed means to achieve their objective; and
Now, therefore, in exercise of the powers conferred by sub-section ( 1 ) of Section 3 of the Unlawful Activities (Prevention)Act , 1967 (37 of 1967) , hereinafter referredto as the said Act, the Central Government hereby declares theHynniewtrep National Liberation Council (HNLC) along with all its factions , wings and front organizations as unlawful association;
(c) has been indulging in acts of intimidation and extortion for collection of funds for their organization;
And whereas , the Central Government is also of the opinion that HNLC has been ,-
(i) indulging in acts of intimidation , extortion and looting ofcivilian population for collection of funds for their organization;
(ii) maintaining links with other insurgent groups of the North Eastern Region for carrying out acts of extortion and intimidation;
The Central Government is of further opinion that it is necessary to declare the HNLC along with all its factions , wings and front organizations as unlawful associations with immediate effect and accordingly, in exercise of the powers conferred by the proviso to sub - section (3 ) of Section 3 of the said Act, the Central Government hereby directs that this notification shall , subject to any order that may be made under Section 4 of the said Act, have effect from the date of its publication in the Official Gazette.
