सा.का.नि. 830 (अ) . केंद्रीय सरकार, मध्य प्रदेश पुनर्गठन अधिनियम, 2000 (2000 का 28) की. धारा 58 की उपधारा (3) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , मध्य प्रदेश राज्य भांडागारण निगम (आस्तियों, अधिकारों और दायित्वों का प्रभाजन) आदेश , 2006 का संशोधन करने के लिए निम्नलिखित आदेश करती है , अर्थात् :--
1. (i ) इन नियमों का संक्षिप्त नाम मध्य प्रदेश राज्य भांडागारण निगम ( आस्तियों, अधिकारों और दायित्वों का प्रभाजन) संशोधन आदेश , 2012 है ।
(ii) ये 1 अप्रैल, 2003 से प्रवृत्त हुए समझे जाएंगे ।
2. मध्य प्रदेश राज्य भांडागारण निगम (आस्तियों, अधिकारों और दायित्वों का प्रभाजन) आदेश , 2006 (जिसे इसमें इसके पश्चात् मूल आदेश कहा गया है) में, -
(क) खंड 5 में , उपखंड (2) के पश्चात् अंत में निम्नलिखित अंतःस्थापित किया जाएगा, अर्थात् :--
"उपखंड ( 1 ) के उपबंध, मध्य प्रदेश भांडागारण और संभार तंत्र निगम और छत्तीसगढ़ राज्य भांडागारण निगम के बनाए जाने के पश्चात् प्रभावी किए जाएंगे ।
मध्य प्रदेश राज्य भांडागारण निगम की प्राधिकृत शेयर पूंजी 10.00 करोड़ रुपए, मध्य प्रदेश भांडागारण और संभार तंत्र निगम को प्रभाजित हो जाएंगी 68.35 प्रतिशत 683.50 लाख रुपए और छत्तीसगढ़ भांडागारण निगम 31.65 प्रतिशत 316.50 लाख रुपए । मध्य प्रदेश राज्य भांडागारण निगम की संदत्त शेयर पूंजी 9.60 करोड़ रुपए , मध्य प्रदेश भांडागारण और संभार तंत्र निगम को प्रभाजित हो जाएगी 68.35 प्रतिशत 656.16 लाख रुपए और छत्तीसगढ़ राज्य भांडागारण निगम 31.65 प्रतिशत 303.84 लाख रुपए ;
(ख ) इस प्रकार बनाए गए निगम , नीचे दिए गए के अनुसार साम्या पर शेयर धारकों को 20 प्रतिशत की दर से लाभांश का संदाय करेंगे :-

3. खंड 6 के उपखंड (1 ) के अंत में निम्नलिखित अंतःस्थापित किया जाएगा, अर्थात्:-
उपखंड (1 ) के उपबंध मध्य प्रदेश भांडागारण और संभार तंत्र निगम और छत्तीसगढ़ राज्य भांडागारण निगम के बनाए जाने के पश्चात् प्रभावी किए जाएंगे और 85,42,59,900 रुपए तक की रकम एमपीएसडब्ल्यूसी (साधारण आरक्षिति, पूंजी आरक्षिति और स्वतः क्षतिपूर्ति निधि से मिलकर बनी) खुली आरक्षिति 68.35: 31.65 के अनुपात अर्थात् 58,38,86,642 रूपए और 27,03,73,258 रूपए कमशः एमपीडब्ल्यूसी और सीएसडब्ल्यूसी की खुली आरक्षिति होंगी ।

मध्य प्रदेश पुनर्गठन अधिनियम, 2000 की धारा 58 की उपधारा (3 ) के अधीन तत्कालीन मध्य प्रदेश भांडागारण निगम की आस्तियों, अधिकारों और दायित्वों का प्रभाजन उत्तराधिकारी राज्यों के मध्य ऐसी रीति में किया जाना अपेक्षित था जिस पर निगम के विघटन पर सहमति हो जाती है या यदि सहमति नहीं हो पाती तो ऐसी रीति में किया जाना है, जो केंद्रीय सरकार आदेश द्वारा अवधारित कर । उसी के परिणामस्वरूप केंद्रीय सरकार ने 16.01.2007 को एक आदेश जारी किया था और इसे 01.04.2003 से प्रभावी किया था । अब खंड 5 के उपखंड (1 ) और खंड 6 के उपखंड (1 ) को प्रभाषी करने के लिए केंद्रीय सरकार मध्य प्रदेश पुनर्गठन अधिनियम, 2000 के उपरोक्त उपबंधों को प्रभावी करने के लिए संशोधन आदेश , 2012 जारी कर रही है ।

GS.R. 830 (E) . In exercise of the powers conferred by sub - section (3 ) of section 58 of the Madhya Pradesh Reorganisation Act , 2000 (28 of 2000 ) , the Central Government hereby makes the following Order to amend the Madhya Pradesh State Warehousing Corporation (Apportionment of assets , rights and liabilities ) Order, 2006, namely: -
1. (i) This Order may be called the Madhya Pradesh State Warehousing Corporation (Apportionment of assets , rights and liabilities ) Amendment Order, 2012 .

3 (ii) Itshall be deemed to have come into force on the first day of April , 2003.
2. In the Madhya Pradesh State Warehousing Corporation (Apportionment of assets , rights and liabilities ) Order, 2006 ( hereinafter referred to as the principal Order): -
(a) in clause 5, after sub - clause (2 ) , the following shall be inserted at the end , namely: -
"Provision of sub- clause ( 1 ) shall be given effect to after the formation of Madhya Pradesh Warehousing and Logistics Corporation and Chhattisgarh State Warehousing Corporation .
The authorised share capital of Madhya Pradesh State Warehousing Corporation, Rs . 10.00 crores shall stand apportioned to Madhya Pradesh Warehousing and Logistics Corporation 68.35% Rs . 683.50 lakhs and Chhattisgarh State Warehousing Corporation - 31.65%-Rs . 316.50 lakhs . The paid - up share capital ofMadhya Pradesh State Warehousing Corporation, Rs . 9.60 crores shall stand apportioned to Madhya Pradesh Warehousing and Logistics Corporation -- 68-35% - Rs . 656.16 lakhs and Chhattisgarh State Warehousing Corporation -- 31.65% - Rs . 303.84 lakhs;
(b) The Corporations, thus formed, shall pay dividend @ 20% to the shareholders on the equity given below: -

Corporation , and the free reserves of MPSWC ( comprising of General Reserve , Capital Reserve and Self Indemnity Fund) amounting to Rs . 85,42,59,900 shall be the free reserves of MPWLC and CSWC in the ratio of 68.35 : 31.65 i.e. Rs.58,38,86,642/ - and Rs . 27,03,73,258/- respectively " .

EXPLANATORY MEMORANDUM
Under sub - section (3 ) of section 58 of the Madhya Pradesh Reorganisation Act , 2000 , the assets , rights and liabilities of the erstwhile Madhya Pradesh Warehousing Corporation were required to be apportioned between the successor States , in such manner as may be agreed among them on dissolution of the Corporation or if no agreement is reached , in such manner as the Central Government may by Order determine. In consequence of the same , Central Government had issued an order on 16-01-2007 and made it effective from 01-04-2003 . Now to give effect to sub - clause 1 of clause 5 and sub- clause 1 of clause 6 , Central Government is issuing the Amendment Order , 2012 to give effect to the above provisions of Madhya Pradesh Re- organisation Act, 2000 .
