सं. ए-10/178/2012- पीपीसी. प्रसार भारती ( भारतीय प्रसारण निगम ) अधिनियम 1990 (1990 का 25 ) की धारा 33 के साथ पठित धारा 11 की उप धारा ( 4 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए निगम निम्नलिखित नियम बनाता है, अर्थात : -
1. संक्षिप्त नाम और प्रारंभ ( 1 ) इन विनियमों का नाम प्रसार भारती ( भारतीय प्रसारण निगम ) , अनुशासनात्मक कार्यवाही के लिए प्राधिकारी विनियम , 2012 कहा जाएगा।
2 (2 ) ये राजपत्र में प्रकाशन की तारीख से लागू होंगे ।
2. अनुशासनात्मक कार्यवाही : केंद्रीय सिविल सेवा (आचरण ) नियम , 1964 और केंद्रीय सिविल सेवा ( वर्गीकरण , नियंत्रण और अपील ) नियम , 1965 में दिए गए प्रावधान प्रसार भारती अधिनियम, 1990 की धारा 11 की उप धारा ( 1 ) और उप धारा ( 2 ) में संदर्भित अधिकारियों और कर्मचारियों के विरुद्ध अनुशासनात्मक कार्यवाही के संबंध में लागू होंगे।
3. अनुशासनात्मक कार्यवाही के लिए प्राधिकारी : निम्नलिखित तालिका के स्तंभ ( 3 ) में विनिर्दिष्ट अनुशासन प्राधिकारी , उक्त तालिका के स्तंभ ( 4 ) की संबंधित प्रविष्टि में विनिर्दिष्ट अपील प्राधिकारी और तालिका के स्तंभ ( 5 ) की संबंधित प्रविष्टिः में विनिर्दिष्ट समीक्षा

प्राधिकारी, अनुशासनात्मक कार्यवाही के लिए प्राधिकारी होंगे और उक्त तालिका के स्तंभ ( 2 ) के अंतर्गत वर्गीकृत पदों के संबंधों में लघु और मुख्य दंडो (अनिवार्य सेवा निवृत्ति , सेवा से हटाया जाना तथा सेवा से बर्खास्तगी को छोड़कर ) को लागू करने से संबंधित शक्तियों का प्रयोग कर सकेंगे।

प्रसार भारती बोर्ड जिनमें अध्यक्ष, की समिति सदस्य (वित्त) और सदस्य (कार्मिक ) होंगे आकाशवाणी, दूरदर्शन और प्रसार भारती बोर्ड सचिवालय में पदस्थ अधिकारियों और कर्मचारियों के लिए महानिदेशक (आकाशवाणी ) या महानिदेशक ( दूरदर्शन ) या प्रसार भारती बोर्ड के सदस्य (कार्मिक ) , जैसा भी मामला हो ।
3. समूह ' ग' और समूह 'घ'
( i ) स्टेशनों /केंद्रों में पदस्थ कर्मचारियों के मामलों में सीनियर टाइम स्केल या उससे ऊपर स्तर के स्टेशनों / केंद्रों के केंद्राध्यक्ष ।
(ii ) प्रसार भारती के अन्य सभी स्थापनाओं के मामलों में सीनियर टाइम स्केल या उससे ऊपर स्तर का अधिकारी।
(i ) स्टेशनों/केंद्रों में पदस्थ कर्मचारियों के मामलों में संबंधित क्षेत्रीय अपर महानिदेशक (ii ) प्रसार भारती के अन्य सभी स्थापनाओं के मामलों में अपर
आकाशवाणी या दूरदर्शन में पदस्थ कर्मचारियों के लिए महानिदेशक (आकाशवाणी) या महानिदेशक ( दूरदर्शन ) , जैसा भी मामला हो। प्रसार भारती सचिवालय में [ भाग III-खण्ड 4 ]

महानिदेशक स्तर का संबंधित अधिकारी ।
पदस्थ कर्मचारियों के मामलों में सदस्य (कार्मिक) ।
4. लंबित कार्यवाहियों के लिए इन विनियमों को लागू करना : ये विनियम किसी भी अनुशासनात्मक , अपील या समीक्षा कार्यवाहियों के लिए लागू होने की तारीख से प्रवृत्त होंगे और जिनपर तदनुसार निर्णय लिया जाएगा ।

NOTIFICATION
New Delhi , the 19th November , 2012
No. A- 10/178 /2012- PPC.-- In exercise of the powers conferred by Section 33 read with sub- section ( 4) of section 11 of the Prasar Bharati (Broadcasting Corporation of India ) Act, 1990 ( 25 of 1990) , the Corporation hereby makes the following regulations , namely: -
1. Short Title and Commencement : ( 1 ) These regulations may be called the Prasar Bharati ( Broadcasting Corporation of India ) , Authorities for Disciplinary Proceedings Regulations , 2012 .
(2) They shall come into force on the date of their publication in the Official
Gazette.
2. Disciplinary Proceedings : The provisions of the Central Civil Services ( Conduct ) Rules , 1964 and the Central Civil Services (Classifications, Control and Appeal ) Rules , 1965 shall be applicable in respect of disciplinary proceedings against the officers and employees referred to in sub-section ( 1 ) and sub- section (2 ) of section 11 of the Prasar Bharati Act , 1990 .

3. Authorities for disciplinary proceedings : The Disciplinary Authority specified in column ( 3 ) of the table given below , the Appellate Authority specified in the corresponding entry in column (4) of the said table , and the Reviewing Authority specified in the corresponding entry in column (5 ) thereof shall be the authorities for disciplinary proceedings and shall exercise their respective powers to impose minor and major penalties , except the power to impose major penalty of compulsory retirement , or removal , or dismissal from service in respect of the classification of posts specified against corresponding entries under column ( 2 ) of the said table.

(ii ) Concerned officer of the level of Additional Director General in case of all other establishments of Prasar Bharati .
4. Application of these regulations to pending proceedings . These regulations shall be applicable to any disciplinary, appellate or review proceedings as on the date on which these regulations come into force and shall be decided accordingly.
