का.आ. 2778(अ).- यतः नेशनल डेमोक्रेटिक फ्रंट ऑफ बोडोलैंड (जिसे इसमें इसके पश्चात एन. डी. एफ. बी. कहा गया है) का घोषित उद्देश्य पूर्वोत्तर क्षेत्र के अन्य सशस्त्र पृथकतावादी संगठनों से मिलकर "बोडोलैण्ड को मुक्त कराना" और उक्त क्षेत्र को भारत से पृथक करना है जिसमें असम के अधिकतर वे क्षेत्र सम्मिलित हैं जहां बोडो निवास करते हैं;
लगातारः और यतः , केन्द्रीय सरकार की यह राय है कि नेशनल डेमोक्रेटिक फ्रंट ऑफ बोडोलैंड
(i ) पृथक बोडोलैण्ड स्थापित करने के अपने उद्देश्य को पूरा करने के लिए , भारत की संप्रभुता और क्षेत्रीय अखंडता को विच्छिन्न करने वाले या विच्छिन्न करने का आशय रखने वाले अवैध और हिंसात्मक क्रियाकलापों में लिप्त रहा है;
(ii ) पृथक बोडोलैण्ड के सृजन के अपने उद्देश्य को पूरा करने के लिए पूर्वोत्तर क्षेत्र के अन्य भूमिगत संगठनों के साथ संबद्ध रहा है ;
(iii) विधिविरुद्ध और हिंसक क्रियाकलापों में लगा हुआ है, इस प्रकार उसने भारत सरकार तथा असम सरकार के प्राधिकार को कम किया है और जनता में आतंक और संत्रास फैलाया है ;

(iv) अपनी योजनाओं और गतिविधियों के वित्त पोषण और निष्पादन की दृष्टि से समाज के विभिन्न वर्गों से जबरन धन वसूली में संलिप्त रहा है;
(v) अपने आतंकवादी और विद्रोही क्रियाकलापों को जारी रखने के उद्देश्य हेतु नए कॉडरों की भर्ती के लिए व्यवस्थित अभियान चला रहा है ;
(vi ) गैर-बोडो लोगों में डर और असुरक्षा फैलाने के उद्देश्य से हत्याकाण्ड और नृजातीय हिंसा फैला रहा है जिसके परिणामस्वरूप असम के बोडो प्रभुत्व वाले क्षेत्रों में रह रहे गैर- बोडो लोगों की हत्या हुई है , उनकी संपत्ति नष्ट हुई है;
(vii ) अपने पृथकतावादी क्रियाकलापों को चलाने के लिए देश की सीमा से पार कैंपों और छिपने के ठिकानों की स्थापना कर रहा है;
और यतः केन्द्रीय सरकार की यह भी राय है कि एन डी एफ बी की हिंसक गतिविधियों में निम्नलिखित भी शामिल हैं: - 1.
(i) 2011 में हिंसा की छत्तीस घटनाएं हुई जिनमें चौदह आम नागरिक तथा दस सुरक्षा बल कार्मिक मारे गए; तथा
(ii) 2012 (30 सितम्बर तक) में हिंसा की आठ घटनाएं हुई जिनमें एक आम नागरिक मारा गया ।
और यतः, केन्द्रीय सरकार की यह भी राय है कि पूर्वोक्त कारणों से, एन.डी.एफ.बी. के क्रियाकलाप भारत की प्रभुता और अखण्डता के लिए हानिकर हैं और यह एक विधिविरुद्ध संगम है;
और यतः , केन्द्रीय सरकार की यह भी राय है कि यदि एन.डी.एफ.बी. के विधिविरुद्ध क्रियाकलापों पर नियंत्रण नहीं लगाया जाता है तो संगठन पुनर्गठित होकर स्वयं को शस्त्रों से सज्जित कर सकता है, पुनः नई भर्तियां कर सकता है, हिंसा, आतंकवादी और अलगाववादी क्रियाकलापों में लग सकता है , निधि आदि का संचय कर सकता है और निर्दोष नागरिकों तथा सुरक्षा बलों के कार्मिकों के जीवन के लिए खतरा पैदा कर सकता है ; और इसलिए ऐसी परिस्थितियां विद्यमान हैं जिनसे एन.डी.एफ.बी. को तत्काल प्रभाव से , विधिविरुद्ध संगम घोषित किया जाना आवश्यक हो जाता है;
अतः , अब, केन्द्रीय सरकार , विधिविरुद्ध क्रियाकलाप ( निवारण ) अधिनियम, 1967 ( 1967 का 37 ) , जिसे इसमें इसके बाद उक्त अधिनियम कहा गया है, की धारा 3 की उपधारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, एतदद्वारा नेशनल डेमोक्रेटिक फ्रंट ऑफ बोडोलैण्ड को विधिविरुद्ध संगम घोषित करती है;

केन्द्रीय सरकार की यह भी राय है कि नेशनल डेमोक्रेटिक फ्रंट ऑफ बोडोलैंड को तत्काल प्रभाव से विधिविरुद्ध संगम घोषित किया जाना आवश्यक है और तदनुसार , केन्द्रीय सरकार , उक्त अधिनियम की धारा 3 की उपधारा (3 ) के परंतुक द्वारा प्रदत्त शक्तियों का उपयोग करते हुए , यह निदेश देती है कि यह अधिसूचना किसी ऐसे आदेश के अधीन रहते हुए, जो उक्त अधिनियम की धारा 4 के अधीन किया जा सकेगा , सरकारी राजपत्र में इसके प्रकाशन की तारीख से प्रभावी होगी।

NOTIFICATION
New Delhi , the 23rd November, 2012
S.O. 2778 ( E) .- Whereas the National Democratic Front of Boroland [ hereinafter referred to as NDFB ] has its professed aim , the "Liberation of Boroland" consisting largely of Bodo inhabited areas of Assam and to bring the secession of the said areas from India, in alliance with other armed secessionist organizations of the North East Region;
And whereas , the Central Government is of the opinion that the NDFB , has been:
(i) indulging in illegal and violent activities intended to disrupt, or which may disrupt , the sovereignty and territorial integrity of India in furtherance of its objective of achieving a separate Boroland;
(ii) aligning itself with other undergrounds outfits of the North Eastern Region in furtherance of its objectives to create a separate Boroland;
(iii) engaging in unlawful and violent activities thereby undermining the authority of the Government of India and the Government of Assam and spreading terror and panic among the people;
(iv) indulging in extortion of money from various sections of the society with a view to financing and executing its plans and activities;
(v) embarking on a systematic drive for recruitment of fresh cadres with a view to continuing its terrorist and insurgency activities ;

( vi ) creating carnage and ethnic violence resulting in killings , destruction of property of non- Bodos inhabiting in Bodo dominated areas in Assam with a view to spreading panic and insecurity among non -Bodos ;
(vii) establish camps and hideouts across the Country's border to carry out its secessionist activities ;
And whereas , the Central Government is of the further opinion that the violent activities of the NDFB include -
(i) killing of fourteen persons including ten security forces personnel in thirty six incidents of violence in 2011 ; and (ii) killing of one civilian in eight incidents of violence in 2012 (upto 30th September ) .
And whereas , the Central Government is also of the opinion that for the reasons aforesaid , the activities of the NDFB are detrimental to the sovereignty and integrity of India and that it is an unlawful association ; And whereas , the Central Government is also of the opinion that unless the unlawful activities of the NDFB are kept under control, the organization may re- group and re-arm itself, make fresh recruitments , indulge in violent, terrorist and secessionist activities , collect funds and endanger the lives of innocent citizens and security forces personnel ; and therefore, circumstances do exist which render it necessary to declare the NDFB as an unlawful association with immediate effect ;
NOW , THEREFORE , in exercise of the powers conferred by sub- section ( 1 ) of section 3 of the Unlawful Activities ( Prevention) Act , 1967 (37 of 1967) , hereinafter referred to as the said Act, the Central Government hereby declares the National Democratic Front of Boroland as an unlawful association;
The Central Government, is of further opinion that it is necessary to declare the NDFB to be an unlawful association with immediate effect and accordingly , in exercise of powers conferred by the proviso to sub- section (3 ) of section 3 of the said Act, the Central Government hereby directs that this notification shall , subject to any order that may be made under section 4 of the said Act, have effect from the date of its publication in the Official Gazette .
