सा.का.नि. 844(अ).-ओषधि और प्रसाधन सामग्री नियम, 1945 का और संशोधन करने के लिए कतिपय नियम भारत सरकार की स्वास्थ्य और परिवार कल्याण मंत्रालय की अधिसूचना संख्या सा.का.नि. 249 (अ) तारीख 22 मार्च , 2012 द्वारा भारत के राजपत्र में प्रकाशित किए गए थे, उन सभी व्यक्तियों, जिनके उनसे प्रभावित होने की सम्भावना है, से उक्त अधिसूचना की राजपत्र की प्रतियां जनता को उपलब्ध होने की तारीख से पैतालिस दिनों की अवधि के भीतर आक्षेप और सुझाव आमंत्रित किए गए थे ;
और उक्त राजपत्र की प्रतियां जनता को 22 मार्च, 2012 को उपलब्ध करा दी गई थीं ;
और उक्त प्रारूप नियम के संबंध में प्राप्त आक्षेपों और सुझावों पर केंद्रीय सरकार द्वारा विचार कर लिया गया है ;
अतः , अब केंद्रीय सरकार, ओषधि और प्रसाधन सामग्री अधिनियम, 1940 ( 1940 का 23) की धारा 33 ढ़ द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, ओषधि और प्रसाधन सामग्री नियम , 1945 का और संशोधन करने के लिए निम्नलिखित नियम बनाती है, अर्थात्ः-
1. ( 1 ) इन नियमों का संक्षिप्त नाम ओषधि और प्रसाधन सामग्री ( पांचवा संशोधन) नियम, 2012 है ।
( 2) ये उनके राजपत्र में अंतिम प्रकाशन की तारीख को प्रवृत्त होंगे।

2. ओषधि और प्रसाधन सामग्री नियम, 1945 , के नियम 161 में, -
(क) उप- नियम ( 1 ) में, -
(i ) "सभी घटकों की सत्य सूची" शब्द के पश्चात् निम्नलिखित शब्द अंतः स्थापित किए जाएंगे , नामतः : - "पादप के भाग और घटकों का प्रारूप जिसमें वे हैं के साथ पादप आधारित घटकों के वनस्पति नामों की सत्य सूची" ;
(ii ) नामतः : - "अधिनियम की पहली अनुसूची" शब्दों के पश्चात् निम्नलिखित अंतः स्थापित किया जाएगा ,
"और पेटेंट या एकायत आयुर्वेद, सिद्ध या यूनानी औषधों के मामले में , पादप आधारित घटकों के वनस्पति नामों के साथ सभी घटकों की सत्य सूची व पादप के भाग और मात्रा सहित घटकों का प्ररूप जिसमें इन्हें औषधयोग में उपयोग किया गया है:
परन्तु यह कि यदि आवश्यक हो तो लेबल पर आधिकारिक आयुर्वेद, सिद्ध और यूनानी भेषजमानकों और विनिर्मितियों के भागों और प्ररूप के लिए मानकीकृत संक्षेपण का उपयोग किया जा सकेगा" ;
(ख) उप-नियम (3) में, -
(i ) "आयुर्वेदिक ( सिद्ध सहित ) या यूनानी औषधि" शब्दों एवं कोष्ठकों के पश्चात् " और पेटेंट या एकायत आयुर्वेदिक, सिद्ध या यूनानी औषधि " अंतः स्थापित किया जाएगा ;
(ii) मद (i ) में , "इसके लिए " शब्दों के पश्चात् "आयुर्वेद, सिद्ध या यूनानी औषधि" रखा जाएगा ।

NOTIFICATION
New Delhi , the 26th November, 2012
GS.R. 844 (E) .- Whereas the draft of certain rules further to amend the Drugs and Cosmetics Rules , 1945 was published , vide notification G.S.R. 249 (E) , dated 22nd March 2012, of the Government of India in the Ministry of Health and Family Welfare , in the Gazette of India, Extraordinary , inviting objections and suggestions from persons likely to be affected thereby before the expiry of a period of forty - five days from the date on which copies of the Official Gazette containing the said notification were made available to the public;
2012; And whereas , the said Gazette was made available to the public on the 22nd March
And whereas , objections and suggestions received from the public on the said draft rules have been considered by the Central Government ;
Now, therefore , in exercise of the powers conferred by section 33 - N of the Drugs and Cosmetics Act, 1940 (23 of 1940 ) the Central Government, hereby makes the following rules further to amend the Drugs and Cosmetics Rules , 1945 , namely: -
RULES
1. ( 1 ) These rules may be called the Drugs and Cosmetics ( 5th Amendment) Rules , 2012 .
(2) They shall come in to force after one year from the date of their final publication in the Official Gazette .
2. In The Drugs and Cosmetics Rules, 1945, in rule 161 , -
(a) in sub - rule ( 1 ) , -
(i ) after the words " true list of all ingredients " the following shall be inserted namely: - "with the botanical names of plant based ingredients along with plant part (s ) and form of ingredients , in which , these are " ;
(ii ) after the words " First Schedule of the Act " the following shall be inserted namely: - " and in respect of Patent or Proprietary Ayurveda , Siddha or Unani drugs , the true list of all the ingredients with the botanical names of plant based ingredients along with plant part (s ) and form of ingredients , in which, these are used in the formulation , with their quantity:

PROVIDED that if needed , standardized abbreviations prescribed for part (s ) and form of Ingredient ( s) in the official Ayurveda, Siddha and Unani Pharmacopoeias and Formularies , may be used on the label;
(b) in sub -rule (3 ) , -
(i ) after the words and brackets " Ayurvedic ( including Siddha ) or Unani drug " the words " and Patent or Proprietary Ayurveda , Siddha or Unani drugs " shall be inserted;
(ii ) in item ( i), for the words " For this " , the words " For Ayurveda , Siddha or Unani Drug " shall be substituted .
