दूरसंचार उपभोक्ता संरक्षण ( पांचवा संशोधन ) विनियम , 2012 (2012का 25)
सं. 308-05/ 2011 - सेवा गुणवत्ता.-भारतीय दूरसंचार विनियामक प्राधिकरण , 1997 ( 1997 का 24वां ) की धारा ।। की उप- धारा ( 1 ) के खंड ( ख ) के उप - खंड ( i ) और ( v ) के साथ पठित धारा 36 के अंतर्गत प्राधिकरण को प्राप्त शक्तियों का प्रयोग करते हुए , भारतीय दूरसंचार विनियामक प्राधिकरण , दूरसंचार उपभोक्ता संरक्षण विनियम , 2012 ( 2012 का 2 ) में संशोधन करने के लिए एदत्द्वारा निम्नलिखित विनियम बनाता है , नामतः:-
1. ( 1 ) इन विनियमों को " दूरसंचार उपभोक्ता संरक्षण ( पांचवा संशोधन ) , विनियम , 2012 " कहा जाएगा ।
(2 ) दूरसंचार उपभोक्ता संरक्षण ( चतुर्थ संशोधन ) विनियम, 2012 (2012 का 22 ) के उपबंध , इनके राजपत्र में प्रकाशन की तिथि से तीस दिन के उपरांत प्रवृत होंगे ।

व्याख्यात्मक ज्ञापन
1. भारतीय दूरसंचार विनियामक प्राधिकरण द्वारा दिनांक 22 अक्तूबर, 2012 को दूरसंचार उपभोक्ता संरक्षण ( चतुर्थ संशोधन ) विनियम , 2012 (2012 का 22 ) जारी किया गया , जिसमें सेवा प्रदाताओं द्वारा चौथी श्रेणी के वाउचरों अर्थात् कॉम्बो वाउचर की पेशकश करने की अनुमति प्रदान की गई थी । ये विनियम , इनके राजपत्र में प्रकाशन की तिथि से पैंतालीसवें दिन के उपरांत प्रवृत्त होने थे ।
2. इसी दौरान , प्राधिकरण द्वारा उद्योग संघों से विनियमों के क्रियान्वयन की तिथि में संशोधन करने के लिए प्रतिवेदन प्राप्त हुए , ताक़ि उनको इन वाउचरों को यथाशीघ्र लागू करने में सुविधा हो सके । प्राधिकरण ने मामले पर विचार किया तथा तद्नुसार विनियम में संशोधन करने का निर्णय लिया है । इन विनियमों के लागू होने से, सेवा प्रदाता तत्काल कॉम्बो वाउचर निर्गमित करने में समर्थ हो सकेंगे ।

TELECOM CONSUMERS PROTECTION (FIFTH AMENDMENT) REGULATIONS , 2012 ( 25 OF 2012)
No. 308-5/ 2011 - QOS.-In exercise of powers conferred under Section 36, read with sub - clauses (i ) and (v ) of clause (b) and clause (c) of sub - section ( 1 ) of Section 11 of the Telecom Regulatory Authority of India Act , 1997 ( 24 of 1997) , the Telecom Regulatory Authority of India hereby makes the following regulations further to amend the Telecom Consumers Protection Regulations, 2012 (2 of2012) , namely :-
1.(1) These regulations may be called the Telecom Consumers Protection ( Fifth Amendment ) Regulations , 2012;
(2) The provisions of the Telecom Consumers Protection (Fourth Amendment ) Regulations , 2012 (22 of 2012) shall come into force after thirty days from the date of their publication in the Official Gazette .

EXPLANATORY MEMORANDUM
1. TRAI had issued the Telecom Consumers Protection (Fourth Amendment ) Regulations , 2012 (22 of 2012 ) оп 22nd October, 2012 providing for offering of a fourth category of vouchers viz . Combo Voucher by service providers . These regulations will come into effect after forty five days of publication of the regulations in the Official Gazette .
2. Meanwhile , the Authority has received representations from industry associations requesting for revising the date of implemetation of the regulations so as to facilitate them issue of these vouchers at the earliest . The Authority considered the matter and decided to amend the regulations accordingly . With the issue of these regulations , the service providers will be able to issue Combo Vouchers immediately.
