सा.का.नि. 860(अ).- केन्द्रीय सरकार, जल प्रदूषण निवारण और नियंत्रण अधिनियम, 1974 ( 1974 का 6 ) की धारा 63 की उपधारा ( 2 ) के खंड (ङ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, केन्द्रीय प्रदूषण नियंत्रण बोर्ड के परामर्श से, केन्द्रीय प्रदूषण नियंत्रण बोर्ड (अध्यक्ष की अर्हताएं और सेवा के अन्य निबंधन तथा शर्तें) नियम, 2011 में निम्नलिखित संशोधन करती है, अर्थात्ः-
ز 1. ( 1 ) इन नियमों का संक्षिप्त नाम केन्द्रीय प्रदूषण नियंत्रण बोर्ड (अध्यक्ष की अर्हताएं और सेवा के अन्य निबंधन तथा शर्तें) संशोधन नियम, 2012 है ।
(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।
2. केन्द्रीय प्रदूषण नियंत्रण बोर्ड ( अध्यक्ष की अर्हताएं और सेवा के अन्य निबंधन तथा शर्तें) नियम, 2011 में,-
(i ) नियम 5 के खंड (क) के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्ः-
"(क) किसी मान्यताप्राप्त विश्वविद्यालय या संस्थान से पर्यावरण संबंधित विज्ञान में स्नातकोत्तर उपाधि या पर्यावरण से संबंधित किसी विद्या में इंजीनियरी में स्नातक उपाधि धारण करता है तथा उसे पर्यावरण संरक्षण से संबंधित विशेष ज्ञान और पंद्रह वर्ष का व्यावहारिक अनुभव है (औद्योगिक प्रदूषण को कम करने, जल उपचार या वायु प्रदूषण नियंत्रण युक्तियों के रूप में सिद्धांत और व्यवहार जिसके अंतर्गत पश्चात्वर्ती विकास भी है) और जिसने पच्चीस वर्ष सेवा की है; या
(ii) नियम 5 का खंड ( ख) के उपखंड ( ii) के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्: -

" (ii ) मूल काडर या विभाग में नियुक्ति के पश्चात् वेतन बैंड-4 में 10,000 रुपए ग्रेड वेतन के साथ 37,400-67,000रुपए के वेतनमान में चार वर्ष की नियमित सेवा की हो; और "
(iii) नियम 6 के पश्चात् निम्नलिखित नियम अंतःस्थापित किया जाएगा, अर्थात्ः-
"6क. भर्ती का ढंग ( 1) अध्यक्ष की नियुक्ति खोज - सह- चयन समिति के द्वारा होगी जो निम्नलिखित से मिलकर बनेगी, अर्थात्:-
अध्यक्ष
(i) मंत्रीमंडल सचिव
सदस्य
(ii) सचिव, पर्यावरण और वन मंत्रालय
सदस्य
(iii ) सचिंव, कार्मिक और प्रशिक्षण विभाग
सदस्य
(iv) सचिव, विज्ञान और तकनीकी मंत्रालय
सदस्य
(v) मंत्रीमंडल सचिव द्वारा मनोनीत कोई विशेषज्ञ

NOTIFICATION
New Delhi , the 29th November, 2012
GS.R. 860(E) . In exercise of the powers conferred by clause ( e ) of sub - section ( 2) of section 63 of the Water (Prevention and Control of Pollution) Act , 1974 ( 6 of 1974) , the Central Government in consultation with the Central Pollution Control Board , hereby makes the following rules to amend the Central Pollution Control Board ( Qualifications and other Terms and Conditions of Service of Chairman ) Rules , 2011 , namely: -
1. (1) These rules may be called the Central Pollution Control Board ( Qualifications and other Terms and Conditions of Service of Chairman ) (Amendment ) Rules , 2012
(2) It shall come into force on the date of its publication in the Official Gazette
2. (1 ) In the Central Pollution Control Board ( Qualifications and other Terms and Conditions of Service of Chairman ) Rules , 2011 , -
(i ) for clause ( a) of rule 5 , the following shall be substituted , namely, : -
" ( a) he possesses Master's Degree in science relating to environment or Bachelor's Degree in engineering in a discipline relating to environment from a recognised University or Institute and has special knowledge and fifteen years' practical experience relating to [ भाग II- खण्ड 3 (i ) ]

environment protection ( including subsequent developments in theory and practice in industrial pollution mitigation , water treatment or air pollution devices ) and has rendered twenty five years ' of service ; or "
( ii ) for sub - clause ( ii ) of clause ( b) of rule 5, the following shall be substituted , namely:-
" ( ii ) has four years ' of regular service in the grade rendered after appointment thereto on regular basis in Pay Band 4 in the Pay Scale of 37,400-67,000 with Grade Pay of ₹10,000 or equivalent in the parent cadre or department ; and "
( iii) After rule 6, the following rule shall be inserted, namely : -
" 6A. Mode of recruitment . (1) The Chairman shall be appointed by a Search - cum- Selection Committee consisting of the following namely: -
Chairman (i ) Cabinet Secretary
Member ( ii ) Secretary , Ministry of Environment and Forests
Member ( iii ) Secretary , Department of Personnel and Training
Member ( iv) Secretary , Ministry of Science and Technology
Member (v) An Expert Member to be nominated by the Cabinet Secretary
