का.आ. 2839(अ).- केन्द्रीय सरकार ने, भारतीय राष्ट्रीय राजमार्ग प्राधिकरण अधिनियम, 1988 (1988 का 68) कीधारा 11 के अधीन जारी की गई भारत सरकार के तत्कालीन भूतल परिवहन मंत्रालय ( सड़क खंड ) की अधिसूचना संख्या का.आ. 78 (अ) , तारीख 4 फरवरी , 1999 द्वारा राष्ट्रीय राजमार्ग संख्या 60 के 0.000 कि.मी. से 57.000 कि.मी. तक ( बालासोर से उड़ीसा / पश्चिम बंगाल सीमा खंड ) उड़ीसा राज्य में और 68 कि.मी लम्बाई खड़गपुर से उड़ीसा /पश्चिम बंगाल सेक्शन , पश्चिम बंगाल राज्य में, तक का खण्ड भारतीय राष्ट्रीय राजमार्ग प्राधिकरण ( जिसे इसमें इसके पश्चात् "प्राधिकरण" कहा गया है ) को सौंपा है ;
और प्राधिकरण ने उक्त अधिनियम की धारा 14 के उपबंध के अनुसरण में मैसर्स बालेश्वर खड़गपुर एक्सप्रेसवे लिमिटेड, जो 06.03.2012 को प्रस्तुत की गई बोलियों का सफल बोलीदाता है और जिसका पंजीकृत कार्यालय आईएलएंडएफएस फाइनेंशियल सेंटर , प्लॉट नम्बर सी-22 , जी ब्लॉक , बांद्रा कुर्ला काम्पलेक्स , बांद्रा ( पूर्व) मुम्बई 400 051 भारत मे है ( जिसे इसमें इसके पश्चात् " रियायतग्राही " कहा गया है ) के साथ उड़ीसा और पश्चिम बंगाल राज्य में नए पुलों/ संरचनाओं के निर्माण , विद्यमान पुलों की मरम्मत/ पुनरुद्धार और राष्ट्रीय राजमार्ग संख्या 60 के 0.000 कि.मी. से 119.300 कि.मी (बालेश्वर से खड़गपुर सेक्शन ) ( जिसे इसमें इसके पश्चात् उक्त खण्ड कहा गया है ) तक विद्यमान चार लेन के राजमार्ग की मरम्मत तथा उक्त खण्ड के प्रचालन एवं अनुरक्षण के लिए 24 अप्रैल 2012 को करार किया है ( जिसे इसमें इसके पश्चात् उक्त करार कहा गया है ) ।

और केन्द्रीय सरकार ने, राष्ट्रीय राजमार्ग शुल्क (दरों का अवधारण एवं संग्रहण) नियम , 2008 जिसे सा.का.नि. 838 (अ) , दिनांक 5 दिसम्बर 2008 के तहत प्रकाशित किया गया था ( जिसे इसमें इसके (1 ) [PART II-SEC . 3 (ii )] THE GAZETTE OF INDIA : EXTRAORDINARY

पश्चात् "उक्त नियम " कहा गया है )के नियम 3 के साथ पठित राष्ट्रीय राजमार्ग अधिनियम, 1956 (1956 का 48) की धारा 7 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, भारत सरकार के सड़क परिवहन और राजमार्ग मंत्रालय की अधिसूचना संख्या का.आ. 1267 (अ) तारीख 1 जून 2012 और का.आ. 1152 (अ) तारीख 22 मई 2012 द्वारा उड़ीसा और पश्चिम बंगाल राज्य में राष्ट्रीय राजमार्ग संख्या 60 के 0.000 कि.मी से 69.450 कि.मी. और 69.450 कि.मी. से 119.737 कि.मी. तक के चार लेन के खण्ड के उपयोग के लिए संबंधित अनुसूचियों में विनिर्दिष्ट दरों पर यांत्रिक वाहनों पर शुल्क उद्ग्रहीत एवं संग्रहीत करनें हेतु भारतीय राष्ट्रीय राजमार्ग प्राधिकरण को प्राधिकृत किया था ।
अतः अब, राष्ट्रीय राजमार्ग शुल्क (दरों का अवधारण एवं संग्रहण) नियम, 2008 जिसे सा.का.नि. संख्या 838 (अ) , दिनांक 5 दिसम्बर 2008 के तहत प्रकाशित किया गया था और जिन्हें सा.का.नि.. 950 (अ),दिनांक 3 दिसम्बर 2010, सा.का.नि. 15 (अ) , दिनांक 12 जनवरी 2011 और सा.का.नि..756 नियम" कहा गया है ) के नियम 3 के साथ पठित राष्ट्रीय राजमार्ग अधिनियम, 1956 (1956 का 48) की धारा 8 क द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , और अधिसूचना संख्या का.आ. 1267 (अ) , दिनांक 1 जून 2012 और अधिसूचना संख्या का.आ. 1152 (अ) , दिनांक 22 मई , 2012 { अधिक्रमण करते हुए , जो नए पुलों / संरचनाओं के निर्माण, विद्यमान पुलों की मरम्मत / पुनरुद्धार और राष्ट्रीय राजमार्ग संख्या 60 के 0.000 कि.मी से 119.300 कि.मी ( बालेश्वर से खड़गपुर सेक्शन ) के विद्यमान चार लेन के राजमार्ग की मरम्मत की परियोजना के वाणिज्यिक प्रचालन की तारीख से प्रभावी होगा । केन्द्रीय सरकार, उक्त खण्ड के निर्माण , अनुरक्षण , प्रबंध और प्रचालन के अन्तर्वलित व्यय , विनिधान की गई पूंजी पर ब्याज, युक्तियुक्त प्रत्यागम , यातायात की मात्रा तथा प्राधिकरण तथा रियायतग्राही के बीच हुए करार की अवधि को ध्यान में रखते हुए एतत्द्वारा यह अधिसूचित करती है कि उक्त खण्ड के उपयोग के लिए सारणी 1 में निर्दिष्ट प्रकार के वाहनों पर चार या अधिक लेन के खण्डों के उपयोग के लिए सड़क की निवल लम्बाई हेतु सारणी 1 के स्तंभ (2) में निर्दिष्ट दरों पर ( जिसे इसमें इसके पश्चात् " आधार दर " कहा गया है ) शुल्क उद्ग्रहीत और संग्रहीत की जाएगी, और वाणिज्यिक प्रचालन या इस अधिसूचना के राजपत्र में प्रकाशन की तारीख से जो भी पश्चातवर्ती हो, करार में विनिर्दिष्ट अवसान की तारीख तक शुल्क का संग्रहण करने और उसे प्रतिधारित करने के लिए उक्त रियायतग्राही को प्राधिकृत करती है ;

टिप्पणी:-
1. नीचे उद्ग्रहीत तथा संग्रहीत शुल्क ऐसे टोल प्लाजा के लिए निर्दिष्ट सड़क की निवल लम्बाई हेतु निम्नलिखित टोल प्लाजा पर शोध्य और संदेय होगा :

2. जिस व्यक्ति का अपना यांत्रिक वाहन गैर वाणिज्यिक प्रयोजनों के लिए पंजीकृत हुआ हो और वह टोल प्लाजा से 20 कि.मी. तक की दूरी में रहता हो उसके लिए वर्ष 2012-13 के लिए, मासिक पास की दर 200.00 रूपए (दो सौ रुपए मात्र) प्रतिमाह होगी और राष्ट्रीय राजमार्ग शुल्क ( दरों का अवधारण औरं संग्रहण) नियम, 2008 के उपबंधों के अनुसार, उसमें प्रत्येक वर्ष संशोधन किया जायेगा ।
3. राजमार्ग खण्ड पर बहुयात्राओं हेतु पास निम्नलिखित दरों पर प्रदान किया जायेगा, अर्थात्:
विधिमान्यता की अवधि
संदेय धनराशि
अनुज्ञात एकतरफा यात्राओं
की अधिकतम संख्या
संदाय के समय से चौबीस घंटे

4. जिस जिले में शुल्क प्लाजा पड़ता है उस जिले में पंजीकृत वाणिज्यिक वाहन ( राष्ट्रीय परमिट के अधीन चल रहे वाहनों को छोड़कर) के लिए शुल्क उस श्रेणी के वाहन के लिए निर्धारित शुल्क का 50% होगा बशर्ते कि ऐसे वाणिज्यिक वाहनों के उपयोग के लिए कोई सर्विस रोड अथवा वैकल्पिक सड़क उपलब्ध न हो ।
5. जो यांत्रिक वाहन नियमों के अधीन अपने प्रवर्ग के लिए निर्धारित अनुज्ञेय भार की अपेक्षा अधिक भार से लदे हुए होंगे उन्हें उन दरों पर शुल्क का संदाय करना होगा जो उनसे अगली उच्च श्रेणी के वाहनों के लिए लागू होता है और उन्हें तब तक राजमार्ग खण्ड का उपयोग करने का अधिकार नहीं होगा जब तक कि ऐसे यांत्रिक वाहन से अधिक भार को हटा न दिया जाए ।
6. यांत्रिक वाहनों के प्रवर्ग, उनके लिए अनुज्ञेय भार, छूटप्राप्त वाहनों के प्रवर्ग , सर्विस रोड, वैकल्पिक सड़क आदि सहित सभी परिभाषाएं नियमों में विनिर्दिष्ट परिभाषाओं के अनुसार होंगी ।
7. उक्त नियमों के नियम 12 के अनुसार, उपयोगकर्ताओं की जानकारी के लिए शुल्क की दरों को प्रदर्शित किया जाएगा ।

8. ऊपर सारणी 1 में यथा उल्लिखित , आधार वर्ष 2007-08 के लिए प्रति कि.मी. की आधार दरों के आधार पर , यांत्रिक वाहनों से लिए जानेवाले वास्तविक शुल्क और कटौतियों की गणना प्राधिकरण द्वारा की जाएगी और उसमें उक्त नियमों के नियम 5 के अनुसार वार्षिक तौर पर संशोधन किया जायेगा तथा उसे, तदनुसार, कम से कम अंग्रेजी और स्थानीय भाषा के एक एक समाचारपत्र में प्रकाशित किया जाएगा ।
9. फीस का पुनरीक्षण उक्त नियमों के नियम 5 के अनुसार वार्षिक रूप से किया जाएगा परंतु वह कि पूर्ववर्ती पुनरीक्षण की तारीख से छः मास की अवधि के भीतर नही किया जायेगा ।
10. शुल्क की दरों में वृद्धि किसी भी दशा में इससे ठीक पहले के वर्ष में लागू शुल्क की दरों से पच्चीस प्रतिशत से अधिक नहीं होगी ।

S.O. 2839 (E ).- Whereas by notification of the Government of India in the erstwhile Ministry of Surface Transport ( Roads Wing ) no . S.O.78 (E ) dated 4th February , 1999 , issued under section 11 of the National Highways Authority of India Act , 1988 ( 68 of 1988 ) , the Central Government entrusted the stretches from kilometer 0.00 to kilometer 57.000 ( Balasore to Orissa/West Bengal Border section) of National Highway No. 60 in the State of Orissa and 68 Km length from Kharagpur to Orissa/West Bengal Border section of National Highway No. 60 in the State of West Bengal , to the National Highways Authority of India (hereinafter referred to as the " Authority" ) ;
And whereas , pursuant to the provision of section 14 of the said Act, the Authority has entered into an Agreement on 24th April , 2012 (hereinafter referred to as said agreement ) with M/ s Baleshwar Kharagpur Expressway Limited , having its registered office at IL & FS Financial Centre , Plot No. C - 22 , G - Block , Bandra- Kurla Complex , Bandra (East) , Mumbai- 400 051 , India, (hereinafter referred to as the " Concessionaire " ) , the successful bidder for bids submitted on 06.03.2012 , for the Construction of new bridges/structures , repair /rehabilitation of the existing bridges and repair of existing four lane highway from Km 0.000 to Km 119.300 ( Baleshwar to Kharagpur section ) of NH - 60 ( hereinafter referred to as the " said section " ) in the States of Orissa and West Bengal and operation and maintenance of the said section.
And whereas , in exercise of the powers conferred by section 7 of the National Highway Act 1956 (48 of 1956) read with rule 3 of the National Highways Fee (Determination of Rates and Collection ) Rules , 2008 published vide G.S.R. 838 (E ) dated 5th December , 2008 (hereinafter referred to as the " Rules " ) , the Central Government by notification of the Government of India in the Ministry of Road Transport and Highways number S.O. 1267 (E) , dated 15 June , 2012 and S.O. 1152(E) dated 22nd May, 2012 authorised the Authority for levying and collecting fee on mechanical vehicles for the use of four - laned stretch from km 0.000 to km 69.450 and from Km 69.450 to Km 119.737 of National Highway No. 60 respectively in the State of Orissa and West Bengal at the rates specified in their schedules .

Now, therefore , in exercise of the powers conferred by section 8A of the National Highways Act, 1956 (48 of 1956) , read with rule 3 of the National Highways Fee (Determination of Rates and Collection) Rules , 2008 published vide G.S.R. 838 ( E ) dated 5th December , 2008 and amended vide G.S.R.950 (E) dated 03.12.10 ; G.S.R. 15 (E) dated 12.01.11 and G.S.R. 756(E) dated 12.10.11 (hereinafter referred to as the " Rules " ) , and in supersession of the notifications bearing numbers S.O. 1267 ( E) , dated 1st June , 2012 and S.O. 1152 (E ) dated 22nd May, 2012 { supersession to be effective from the Commercial Operation Date for the project of Construction of new bridges / structures , repair /rehabilitation of the existing bridges and repair of existing four lane highway from Km 0.000 to Km 119.300 ( Baleshwar to Kharagpur section ) of NH - 60 } the Central Government , having regard to the expenditure involved in building , maintenance , management and operation of the said section, interest on the capital invested, reasonable return, the volume of traffic and the period of the agreement entered into between the authority and the concessionaire , hereby notifies that there shall be levied and collected fees on mechanical vehicles for the use of the said section at the rate specified in columns (2) of the Table 1 for net road section length for use of the four and more lane sections ( hereinafter referred to as " base rate " ) on the Type of Vehicles specified in Table 1 , and authorizes the said Concessionaire to collect and retain the fee on and from the date of commercial operation or publication of this notification in the Official Gazette , whichever is later, till the termination date as specified in the agreement;

2. The rate of monthly pass for a person who owns a mechanical vehicle Tegistered for non- commercial purposes and resides within a distance of twenty kilometers from the toll plaza is Rs. 200.00 ( Rupees Two Hundred only) for the year 2012-13 and is subject to revision every year as per the provisions of the National Highways Fee ( Determination of Rates and Collection) Rules , 2008 .
3. Formultiple journey on the highway section, passes shall be issued at the following rates , namely:

4. Fee for commercial vehicle ( excluding vehicles plying under National Permit) registered in the district where the fee plaza falls shall be 50 % of the prescribed rate for that category of vehicle provided no service road or alternative road is available for use of such commercial vehicles .
5. Mechanical vehicle which is loaded in excess of permissible load specified for its category under the rules , shall be liable to pay fee at such rates which is applicable for the next higher category of the vehicles and shall not be entitled to make use of the highway section unless the excess load has been removed from such mechanical vehicle .
6. All definitions including category of mechanical vehicles , its permissible load , category of exempted vehicles , service road , alternative road etc. shall be as per definitions specified in the said rules .
7 . The fee rates shall be displayed for information of the users in accordance with rule 12 of the said rules .
8. Based on the Base rate of fee per km for the base year 2007-08 as mentioned in Table- 1 , the actual amount of fee to be charged from the mechanical vehicles and the discounts will be calculated by the Authority and revised annually in accordance with the rule 5 of the said rules and the same shall be published in at least one newspaper , each in English and vernacular language accordingly.
9. The fee rates shall be revised annually in accordance with the rule 5 of the said rules provided that no revision shall be effected until a period of six months has elapsed from Commercial Operation Date .
10. The increase in the rates of fee shall in no case be more than twenty - five percent of the rates of fee applicable in the immediately preceding year .
