फा. सं. पी. 15014/1 / 2011 - पीएफए /एफएसएसएआई.-खाद्य सुरक्षा और मानक ( खाद्य उत्पाद मानक और खाद्य सहयोज्य ) विनियम , 2011 का और संशोधन करने के लिए कतिपय विनियम का निम्नलिखित प्रारूप , जिसे भारतीय खाद्य सुरक्षा और मानक प्राधिकरण केन्द्रीय सरकार के पूर्व अनुमोदन से खाद्य सुरक्षा और मानक अधिनियम , 2006 ( 2006 का 34 ) की धारा 92 की उप - धारा ( 2 ) के खंड ( ङ ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , बनाने का प्रस्ताव करती है , उन व्यक्तियों की जानकारी के लिए, जिनके उससे प्रभावित होने की संभावना है प्रकाशित किया जाता है और यह सूचना दी जाती है कि उक्त प्रारूप पर उस तारीख से, जिसको इस अधिसूचना की राजपत्र की प्रतियां जनता को उपलब्ध करा दी जाती है , तीस दिन की अवधि के अबसान के पश्चात् विचार किया जाएगा ;
उक्त प्रारूप विनियम की बाबत यदि किसी व्यक्ति से कोई आक्षेप या सुझाव प्राप्त होते हैं, उन पर प्राधिकरण द्वारा विनिर्दिष्ट अवधि के भीतर विचार किया जाएगा ;
आक्षेप या सुझाव, यदि कोई हो , उन्हें मुख्य कार्यपालक अधिकारी, भारतीय खाद्य सुरक्षा और मानक प्राधिकरण , एफडीए भवन, कोटला रोड, नई दिल्ली-110002 को भेजे जा सकते हैं ।
प्रारूप विनियम
(1 ) इन विनियमों का संक्षिप्त नाम खाद्य सुरक्षा और मानक (खाद्य उत्पाद मानक और खाद्य सहयोज्य) ( दूसरा संशोधन) विनियम , 2012 है ।
(2) ये राजपत्र में उनके अंतिम प्रकाशन की तारीख को प्रवृत्त होंगे ।
2. खाद्य सुरक्षा और मानक (खाद्य उत्पाद मानक और खाद्य सहयोज्य) विनियम, 2011 में , " वसा तेल और वसा मिश्रण " से संबंधित विनियम 2.2 में, -

(क) "अंतः एस्टरित वनस्पति वसा " से संबंधित उप विनियम 2.2.2 में "आवश्यक रूप से उदासीन खाद्य तेल या वसा एकल या मिश्रित रूप में अंतःस्टरण प्रक्रिया द्वारा " शब्दों के पश्चात् " एंजेमेटिक प्रक्रिया या " शब्द अंतःस्थापित किए जाएंगे ;
(ख) " हाइड्रोजनीकृत वनस्पति तेल " से संबंधित उप विनियम 2.2.2 में, -
(i) खंड (1 ) में, -
(अ) " किसी भी रूप में हाइड्रोजनीकरण की प्रक्रिया से" शब्दों के पश्चात् " भौतिक, रसायन या एंजेमेटिक अंतः एस्टरण " शब्द अंतःस्थापित किए जाएंगे ;
(आ) मद (प) के पश्चात् निम्नलिखित अंतःस्थापित किया जाएगा,
अर्थात् : --
" (प) ताड़ स्टेरिन" ;
(इ) उपखंड ( vii) में, मद (ख) और उससे संबंधित प्रविष्टियों के स्थान पर निम्नलिखित मद और प्रविष्टि रखी जाएगी, अर्थात् :--
" (ख) पार वसीय अम्ल, भार के अनुसार दस प्रतिशत से
अधिक नहीं" ;
( ii ) खंड (2) में उपखंड ( क) और उससे संबंधित प्रविष्टियों के स्थान पर निम्नलिखित उपखंड और प्रविष्टि रखी जाएगी, अर्थात्:--
"(क) पार वसीय अम्ल, भार के अनुसार दस प्रतिशत से अधिक
नहीं";
(ग) " मारगारीन और वसा स्प्रेड" से संबंधित उपविनियम 2.2.5 के खंड (2) के उपखंड ( ii ) और उससे संबंधित प्रविष्टियों के स्थान पर निम्नलिखित उपखंड और प्रविष्टि रखी जाएगी , अर्थात्: --
"(ख) पार वसीय अम्ल, भार के अनुसार दस प्रतिशत से अधिक नहीं" ।

NOTIFICATION
New Delhi , the 29th November , 2012
F. No. P. 15014/ 1 /2011 - PFA/FSSAI.- The following draft of certain regulation further to amend the Food Safety and Standards (Food Products Standards and Food Additives ) Regulations, 2011 , which the Food Safety and Standards Authority of India , with previous approval of Central Government , proposes to make , in exercise of the powers conferred by clause ( e) of sub- section (2) of section 92 of Food Safety and Standards Act , 2006 (34 of 2006) is hereby published as required by the said sub -section ( 1 ) of section 92 , for the information of all persons likely to be affected thereby; and notice is hereby given that the said draft regulation shall be taken into consideration after the expiry of a period of thirty days from the date on which copies of the Official Gazette in which this notification is published, are made available to the public;
Any objections or suggestions which may be received from any person with respect to the said draft regulation within the period specified above shall be considered by the Authority;
Objections or suggestions , if any , may be addressed to the Chief Executive Officer , Food Safety and Standards Authority of India , FDA Bhawan , Kotla Road , New Delhi - 110 002.
Draft Regulations
1 . ( 1 ) These regulations may be called the Food Safety and Standards (Food Products Standards and Food Additives ) ( Second Amendment ) Regulations 2012 .
(2) They shall come into force from the date of their final publication in the Official Gazette.
2. in the Food Safety and Standards (Food Products Standards and Food Additives) Regulations , 2011 , in regulation 2.2 relating to " FATS , OILS AND FAT EMULSIONS " , -
(a) in sub - regulation 2.2.2 relating to ' Interesterified Vegetable Fat ' , after the words "interesterification of the essentially neutral edible oil or fat , singly or in mixtures generally through " , the words " enzymatic process or " shall be inserted ;
(b) in sub - regulation 2.2.6 relating to HYDROGENATED VEGETABLE OILS , (i) in clause ( 1) , -
(A) after the words " a process of hydrogenation in any form " , the words " or physical , chemical or enzymatic interesterification" shall be inserted;

(B) after the item ( u) , the following shall be inserted , namely: -
"(v) . Palm Stearin";
(C) in sub - clause ( vii ) for item ( b ) and entry relating thereto , the following item and entry shall be substituted , namely: -
" (b) Trans fatty acids , not more than ten per cent. by weight";
(ii) in clause (2) , for sub -clause ( a) and the entries relating thereto , the following sub - clause and entry shall be substituted , namely: -
"(a) Trans fatty acids , not more than ten per cent . by weight " ;
(c) in sub - regulation 2.2.5 relating to MARGARINE AND FAT SPREADS , in clause (2) , for sub - clause ( ii ) and the entries relating thereto , the following sub- clause and entries shall be substituted, namely:-
" ( ii) Trans fatty acids , not more than ten per cent. by weight" .
