का.आ. 2884(अ).- भारत सरकार के रेल मंत्रालय (रेल बोर्ड) की अधिसूचना संख्यांक का.आ. 1641 (अ) , तारीख 11 जुलाई, 2012 जो भारत के राजपत्र , असाधारण , भाग 2 , खंड 3 , उपखंड (ii ) तारीख 20 जुलाई, 2012 में प्रकाशित की गई थी और, केन्द्रीय सरकार द्वारा रेल अधिनियम, 1989 ( 1989 का 24) (जिसे इसमें इसके पश्चात् उक्त अधिनियम कहा गया है) की धारा 20 क की उपधारा ( 1 ) के अधीन जारी की गई थी, जिसके द्वारा केन्द्रीय सरकार ने उक्त अधिसूचना से उपाबद्ध अनुसूची में विनिर्दिष्ट भूमि को, राजस्थान राज्य में विशेष रेल परियोजना, अर्थात्, वेस्टर्न डेडीकेटेड फ्रेट कोरीडोर के निष्पादन, अनुरक्षण , प्रबंध और प्रचालन के लिए अर्जित करने के अपने आशय की घोषणा की थी;
और, उक्त अधिसूचना का सार उक्त अधिनियम की धारा 20 क की उपधारा (4 ) के अधीन दैनिक स्थानीय समाचार पत्रों, अर्थात् "राजस्थान पत्रिका", तारीख 29 अंगस्त, 2012 और " दैनिक भास्कर " , तारीख 29 अगस्त, 2012 में प्रकाशित किया गया था;
और, सक्षम प्राधिकारी द्वारा कोई आक्षेप प्राप्त नहीं किया गया है ;
और, सक्षम प्राधिकारी ने उक्त अधिनियम की धारा 20ङ की उपधारा ( 1 ) के अनुसरण में, अपनी रिपोर्ट केन्द्रीय सरकार को सौप दी है;
अतः, अब, केन्द्रीय सरकार, सक्षम प्राधिकारी से उक्त रिपोर्ट के प्राप्त होने पर और उक्त अधिनियम, की धारा 20ङ की उपधारा (1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , यह घोषणा करती है कि इससे उपाबद्ध अनुसूची में विनिर्दिष्ट भूमि पूर्वोक्त प्रयोजन के लिए अर्जित की जाएगी;

यह और कि, उक्त अधिनियम की धारा 20ङ की उपधारा (2 ) के अनुसरण में केन्द्रीय सरकार यह घोषणा करती है कि इस अधिसूचना के राजपत्र में प्रकाशित होने पर , इससे उपाबद्ध अनुसूची में विनिर्दिष्ट भूमि सभी विल्लंगमों से मुक्त होकर केन्द्रीय सरकार में आत्यंतिक रूप से निहित हो जाएगी ।

NOTIFICATION
New Delhi , the 12th December, 2012
S.O. 2884 (E) -Whereas , by the notification of the Government of India in the Ministry of Railways ( Railway Board ) , number S.O. 1641 ( E ) , dated the 11th July, 2012 , published inthe Gazette of India , Extraordinary , Part II , Section 3 , Sub -section (ii ) , dated the 20st July, 2012 and issued under sub- section ( 1 ) of section 20A of the Railways Act , 1989 (24 of 1989) ( hereinafter referred to as the said Act) , the Central Government declared its intention to acquire the land specified in the Schedule annexed to the said notification for the public purpose of execution of the Special Railway Project, namely, WesternDedicated Freight Corridor in the State of Rajasthan;
And , whereas , the substance of the said notification has been published in daily local newspapers , namely , Rajasthan Patrika , dated the 29th August , 2012 and Dainik Bhaskar, dated the 29th August, 2012 under sub-section (4) of section 20A of the said Act;

And, whereas , no objection has been received by the competent authority;
And, whereas , in pursuance of sub-section ( 1 ) of section 20E of the said Act, the competent authority has submitted its report to the Central Government;
Now, therefore , upon receipt of the said report of the competent authority and in exercise of the powers conferred by sub- section ( 1 ) of section 20E of the said Act, the Central Government hereby declares that the lands specified in the Schedule annexed hereto shall be acquired for the aforesaid purpose;
And, further , in pursuance of sub-section (2) of section 20E of the said Act, the Central Government hereby declares that on publication of this notification in the Official Gazette, the land specified in the Schedule annexed hereto shall vest absolutely in the Central Government free from all encumbrances .
