का.आ. 2904(अ).- केन्द्रीय सरकार ने, भारतीय राष्ट्रीय राजमार्ग प्राधिकरण अधिनियम , 1988 (1988 का 68) की धारा 11 के अधीन जारी की गई भारत सरकार के तत्कालीन भूतल परिवहन मंत्रालय ( सड़क खंड ) की अधिसूचना संख्या का. आ. 78 (अ ) , तारीख 4 फरवरी 1999 द्वारा उड़ीसा राज्य में राष्ट्रीय राजमार्ग सं . 5 के 233.000 कि.मी. से 418.000 कि.मी. तक ( आंध्रप्रदेश / उड़ीसा बोर्डर से भुवनेश्वर सेक्शन ) , 0.000 कि.मी से 27.800 कि.मी और 61.000 कि.मी से 200.000 ( भुवनेश्वर से बालासोर सेक्शन ) और 27.800 कि.मी से 61.000 कि.मी ( जगतपुर से चांदीकोल सेक्शन ) का खण्ड भारतीय राष्ट्रीय राजमार्ग प्राधिकरण (जिसे इसमें इसके पश्चात् "प्राधिकरण " कहा गया है ) को सौंपा है ;
और, केन्द्रीय सरकार, राष्ट्रीय राजमार्ग ( राष्ट्रीय राजमार्ग खंड और स्थायी पुल के उपयोग के लिए फीस लोक वित्तपोषित परियोजना) नियम, 1997 के नियम 3, नियम 5 और नियम 11 तथा राष्ट्रीय राजमार्ग ( फीस की दर) नियम, 1997 के नियम 3 के उपनियम (2) के साथ पठित राष्ट्रीय राजमार्ग अधिनियम, 1956 (1956 का 48) की धारा 7 के द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , भारत सरकार के तत्कालीन पोत परिवहन सड़क परिवहन और राजमार्ग मंत्रालय ( सड़क परिवहन और राजमार्ग विभाग ) की अधिसूचना संख्यांक का.आ. 1527 (अ) तारीख 13 सितम्बर 2006 के द्वारा उड़ीसा राज्य में राष्ट्रीय राजमार्ग सं. 5 पर 337.010 कि.मी. से 402.010 कि.मी. ( नया चैनेज 362.000 कि.मी से 297.000 कि.मी. ) ( जिसे इसमें इसके पश्चात् उक्त खंड कहा गया है ) सुनाखाला से भुवनेश्वर सेक्शन के चार लेन के भूखंड के उपयोग हेतु अनुसूची में विनिर्दिष्ट फीस को भारतीय राष्ट्रीय राजमार्ग प्राधिकरण को संगृहीत करने के लिए प्राधिकृत किया था।

वर्तमान में फीस का संग्रहण 75.990 कि.मी के लिए केवल 337.010 कि.मी. से 413.000 कि.मी के लिए निम्नलिखित दरों पर किया जा रहा है :

और केन्द्रीय सरकार, ने राष्ट्रीय राजमार्ग अधिनियम 1956 (1956 का 48) की धारा 9 द्वारा प्रदत शक्तियों का उपयोग करते हुए राष्ट्रीय राजमार्ग ( अस्थाई पुल ) नियम 1964, राष्ट्रीय राजमार्ग (किसी व्यक्ति द्वारा राष्ट्रीय राजमार्ग सेक्शन / राष्ट्रीय राजमार्गो पर निर्मित स्थायी पुलों/ अस्थाई पुलों के उपयोग के लिए फीस वसूल करना ) नियम 1997, राष्ट्रीय राजमार्ग ( राष्ट्रीय राजमार्ग खंड और स्थायी पुल के उपयोग के लिए शुल्क लोक वित्त पोषित परियोजना ) नियम 1997 और राष्ट्रीय राजमार्ग ( फीस की दर ) नियम 1997 को उन बातों के सिवाय अधिक्रांत करते हुए , जिन्हे ऐसे अधिक्रमण से पूर्व किया गया है या करने का लोप किया गया है, राष्ट्रीय राजमार्गों के सेक्शनों, स्थायी पुलों, उपमार्गों और सुरंगों के उपयोग के लिए फीस के संग्रहण हेतु राष्ट्रीय राजमार्ग शुल्क (दरों का अवधारण और संग्रहण) नियम, 2008 बनाया है जो कि सा.का.नि. 838 (अ) में तारीख 5 दिसम्बर 2008 को प्रकाशित हुआ है ।
अतः अब, केन्द्रीय सरकार राष्ट्रीय राजमार्ग शुल्क (दरों का अवधारण और संग्रहण) नियम, 2008 और समय समय पर हुए संशोधनों ( जिसे इसमें इसके पश्चात् " उक्त नियम " कहा गया है) के नियम 3 के साथ पठित राष्ट्रीय राजमार्ग अधिनियम, 1956 ( 1956 का 48) की धारा 7 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , और भारत सरकार के तत्कालीन पोत परिवहन, सड़क परिवहन और राजमार्ग मंत्रालय (सड़क परिवहन और राजमार्ग विभाग ) की अधिसूचना संख्यांक का.आ 1527 (अ), तारीख 13 सितम्बर 2006 को , उन बातों के सिवाय अधिक्रांत करते हुये जिन्हें ऐसे अधिक्रमण से पहले किया गया है या करने का लोप किया गया है , 76.665 कि.मी. लम्बाई के खंड के उपयोग के लिए , राष्ट्रीय राजमार्ग सं . 5 पर 337.010 कि.मी से 413.000 कि.मी. चार लेन के उपयोग के लिए उड़ीसा राज्य में , नीचे सारणी 2 के स्तंभ (1 ) में विनिर्दिष्ट प्रकार के वाहनों पर चार और अधिक लेन के खण्डों के उपयोग हेतु, सारणी 2 के स्तंभ (2) में विनिर्दिष्ट दर पर शुल्क ( जिसे इसमें इसके पश्चात् " आधार दर" कहा गया है) उदगृहीत करती है , और प्राधिकरण को अपने अधिकारियों के माध्यम से अथवा संविदाकार के माध्यम से उक्त शुल्क का संग्रह करने हेतु प्राधिकृत करती है, अर्थात्: - 3

टिप्पणियां:
1. नीचे उद्गृहीत तथा संग्रहीत शुल्क ऐसे टोल प्लाजा के लिए निर्दिष्ट सड़क की निवल लम्बाई हेतु निम्नलिखित टोल प्लाजा पर शोध्य और संदेय होगा :

2. जिस व्यक्ति का अपना यांत्रिक वाहन गैर वाणिज्यिक प्रयोजनों के लिए पंजीकृत हुआ हो और वह टोल प्लाजा से 20 कि.मी. के भीतर में रहता हो तो उसके लिए वर्ष 2012-13 के लिए, मासिक पास की दर 200.00 रूपए (दो सौ रुपए मात्र) प्रतिमाह होगी और राष्ट्रीय राजमार्ग फीस (दरों का अवधारण औरं संग्रहण) नियम, 2008 के उपबंधों के अनुसार, उसमें प्रत्येक वर्ष संशोधन किया जायेगा ।
3. राजमार्ग सेक्शन पर बहुयात्राओं हेतु पास निम्नलिखित दरों पर प्रदान किया जायेगा अर्थात्

4. जिस जिले में शुल्क प्लाजा पड़ता है उस जिले में पंजीकृत वाणिज्यिक यान ( राष्ट्रीय परमिट के अधीन चल रहे वाहनों को छोड़कर) के लिए शुल्क उस श्रेणी के यान के लिए निर्धारित THE GAZETTE OF INDIA : EXTRAORDINARY

शुल्क का 50 % होगा बशर्ते कि ऐसे वाणिज्यिक यानों के उपयोग के लिए कोई सर्विस रोड अंथवा वैकल्पिक रोड उपलब्ध न हो ।
5. जो यांत्रिक यान नियमों के अधीन अपने प्रवर्ग के लिए निर्धारित अनुज्ञेय भार की अपेक्षा अधिक भार से लदे हुए होंगे उन्हें उन दरों पर शुल्क का संदाय करना होगा जो उनसे अगली उच्च श्रेणी के यानों के लिए लागू होता है और उन्हें तब तक राजमार्ग खण्ड का उपयोग करने का अधिकार नहीं होगा जब तक कि ऐसे यांत्रिक यान से अधिक भार को हटा न दिया जाए ।
6. यांत्रिक यानों के प्रवर्ग , उनके लिए अनुज्ञेय भार, छूटप्राप्त यानों के प्रवर्ग , सर्विस रोड, वैकल्पिक सड़क आदि सहित सभी परिभाषाएं नियमों में विनिर्दिष्ट परिभाषाओं के अनुसार होंगी ।
7. उक्त नियमों के नियम 12 के अनुसार, उपयोगकर्ताओं की जानकारी के लिए शुल्क की दरों को प्रदर्शित किया जाएगा ।
8. ऊपर सारणी 2 में यथा उल्लिखित , आधार वर्ष 2007-08 के लिए प्रति कि.मी. की आधार दरों के आधार पर , यांत्रिक वाहनों से लिए जानेवाले वास्तविक शुल्क और कटौतियों की गणना प्राधिकरण द्वारा की जाएगी और उसमें उक्त नियमों के नियम 5 के अनुसार वार्षिक तौर पर संशोधन किया जायेगा तथा तदनुसार कम से कम अंग्रेजी और स्थानीय भाषा के एक एक समाचारपत्र में प्रकाशित किया जाएगा।
9. परियोजना की अनुमानित पूंजीगत लागत 244.18 करोड़ रूपए है । प्राधिकरण द्वारा उपयोगकर्ताओं से वसूल किए गए शुल्क के जरिए पूंजीगत लागत की वसूली का रिकार्ड रखा जाएगा और पूंजीगत लागत की वसूली हो जाने के बाद लगाए गए शुल्क की दरों को घटाकर 40 % कर दिया जाएगा । 31.03.2012 तक कुल 43.24 करोड़ रूपए उपयोगकर्ताओं से वसूल किए गए ।
10. शुल्क की दरों में वृद्धि किसी भी हालत में इससे ठीक पहले के वर्ष में लागू शुल्क की दरों से पच्चीस प्रतिशत से अधिक नहीं होगी।

NOTIFICATION
New Delhi , the 14th December, 2012
S.O. 2904 (E ) .- Whereas by notification of the Government of India in the erstwhile Ministry of Surface Transport ( Roads Wing ) number S.O. 78 ( E) , dated the 4th February , 1999 and S.O. 267 (E) , dated the 30th March 1998 , issued under section 11 of the National Highways Authority of India Act, 1988 (68 of 1988 ) , the Central Government has entrusted the stretch from Km 233.000 to Km 418.000 ( AP / Orissa Border to Bhubaneshwar section ) , Km 0.000 to Km 27.800 & Km 61.000 to Km 200.000 (Bhubaneshwar to Balasore section) and Km 27.800 to Km 61.000 (Jagatpur to Chandikol section) of National Highway No. 5 in the State of Orissa to the National Highways Authority of India ( hereinafter referred to as the "Authority" );
And whereas , in exercise of the powers conferred by section 7 of the National Highways Act 1956 ( 48 of 1956) read with rules 3, 5 and 11 of the National Highways (Fees for the Use of National Highways Section and Permanent Bridge Public Funded Project) Rules , 1997 and sub- rule 2 of rule 3 of the National Highways ( Rate of Fee ) Rules , 1997, the Central Government by notification of the Government of India in the erstwhile Ministry of Shipping , Road Transport and Highways ( Department of Road Transport and Highways) number S.O. 1527 (E) dated 13th September , 2006, authorized the National Highways Authority of India for levying and collecting fee on mechanical vehicles for the use of four- laned stretch from Km 337.010 to Km 402.010 (new chainage Km 362.000 to Km 297.000) Sunakhala to Bhubaneshwar section of National Highway number 5 in the State of Orissa at the rates specified in its schedule .
And whereas , presently , fee collection is going on for 75.990 kms only from Km 337.010 - Km 413.000 at the following rates:

And whereas, the Central Government in exercise of the powers conferred by section 9 of the National Highways Act 1956 (48 of 1956) and in supersession of the National Highways (Temporary Bridges) Rules, 1964, the National Highways ( Collection of Fees by any person for the Use of Section of National Highways / Permanent Bridge/ Temporary Bridge on National Highways ) Rules , 1997, the National Highways (Fees for the Use of National Highways Section and Permanent Bridge - Public Funded Project) Rules , 1997 and the National Highways ( Rate of Fee) Rules , 1997, has framed the National Highways Fee (Determination of Rates and collection) Rules , 2008, vide G.S.R. 838 (E) dated the 5th Dec, 2008 for collection of fee for use of sections of national highways , permanent bridges , bypasses and tunnels .
Now, therefore, in exercise of the powers conferred by section 7 of the National Highways Act , 1956 (48 of 1956) , read with rule 3 of the National Highways Fee (Determination of Rates and Collection) Rules, 2008 and amended from time to time (hereinafter referred to as the " said Rules " ) , and in supersession of the notification of the Government of India in the erstwhile Ministry of Shipping, Road Transport and Highways (Department of Road Transport and Highways ) number S.O. 1527 ( E) dated 13th September , 2006 except as respects things done or omitted to be done before such suppression, the Central Government hereby levying fee at the base rate specified in column (2) of the Table 2 for net road section length of 76.665 km ( hereinafter referred to as " base rate " ) for use of the four lane sections from km 337.010 to km 413.000 of National Highway No.5 (hereinafter referred to as the " said stretch " ) in the State of Orissa on the type of Vehicles specified in column (1 ) ofTable 2 for the use of the " said stretch" and authorized the Authority to collect , either through its officials or through a contractor , the said fee namely: -

2. The rate of monthly pass for a person who owns a mechanical vehicle registered for non- commercial purposes and resides within a distance of twenty kilometers from the toll plaza is Rs . 200.00 ( rupees Two Hundred only) for the year 2012-13 and is subject to revision every year as per the provisions of the National Highways Fee (Determination of Rates and Collection) Rules, 2008 .
3. For multiple journeys on the highway section , passes shall be issued at the following rates, namely .

4. Fee for commercial vehicle ( excluding vehicles plying under National permit) registered in the district where the fee plaza falls shall be 50 % of the prescribed rate for that category of vehicle provided no service road or alternative road is available for use of such commercial vehicles .
5. Mechanical vehicles which is loaded in excess of permissible load specified for its category under the rules , shall be liable to pay fee at such rates which is applicable for the next higher category of the vehicles and shall not be entitled to make use of the highway section unless the excess load has been removed from such mechanical vehicle.
6. All definitions including category of mechanical vehicles , its permissible load, category of exempted vehicles , service road , alternative road etc. shall be as per definitions specified in the rules .
7. The fee rates shall be displayed for information of the users in accordance with rules 12 of the said rules .
8. Based on the base rate of fee per km for the base year 2007-08 as mentioned in Table 2 the actual amount of fee to be charged from the mechanical vehicles and the discounts will be calculated by the authority and revised annually in accordance with the rule 5 of the said rules and the same shall be published in at least one newspaper, each in English and vernacular language accordingly .
9. The capital cost of the project is Rupees 244.18 crores . The Authority shall maintain a record of the recovery of capital cost through user fee realised and after recovery of the capital cost, the fee leviable shall be reduced to 40% of the rates and shall be revised annually in accordance with the said rules . A total of Rs . 43.24 Crores has been recovered from the users fee realized till 31.03.2012 .

10. The increase in the rates of fee shall in no case be more than twenty - five percent of the rates of fee applicable in the immediately preceding year .
