का.आ. 2921 (अ).-केन्द्रीय सरकार ने , भारतीय राष्ट्रीय राजमार्ग प्राधिकरण अधिनियम , 1988 ( 1988 का 68 ) की धारा 11 के अधीन जारी की गई भारत सरकार के तत्कालीन भूतल परिवहन मंत्रालय ( सड़क खंड ) की अधिसूचना संख्या का.आ. 78 ( अ ) , तारीख 4 फरवरी , 1999 , द्वारा गुजरात राज्य में राष्ट्रीय राजमार्ग सं. 8 के 0.000 कि.मी. से 381.600 कि.मी. तक ( अहमदाबाद - गुजरात/महाराष्ट्र सीमा खंड ) का खण्ड भारतीय राष्ट्रीय राजमार्ग प्राधिकरण ( जिसे इसमें इसके पश्चात् ' प्राधिकरण ' कहा गया है ) को सौंपा है;
और केन्द्रीय सरकार ने , भारतीय राष्ट्रीय राजमार्ग प्राधिकरण अधिनियम , 1988 ( 1988 का 68 ) की धारा ।। के अधीन जारी की गई भारत सरकार के तत्कालीन भूतल परिवहन मंत्रालय ( सड़क खंड ) की अधिसूचना संख्या का.आ. 1025 ( अ ), तारीख 1 दिसम्बर , 1998 , द्वारा गुजरात राज्य में राष्ट्रीय राजमार्ग सं. एन ई 1 के 0.000 कि.मी. से 93.302 कि.मी. तक का खण्ड भारतीय राष्ट्रीय राजमार्ग प्राधिकरण को सौंपा है ;
और भारतीय राष्ट्रीय राजमार्ग प्राधिकरण अधिनियम , 1988 ( 1988 का 68 ) की धारा 14 के प्रावधान के अनुसरण में प्राधिकरण ने गुजरात राज्य में राष्ट्रीय राजमार्ग विकास परियोजना चरण- V डिजाईन , निर्माण , वित्त , प्रचालन , हस्तांतरण (डी बी एफ् ओटी ) टोल आधार पर राष्ट्रीय राजमार्ग संख्या 8 के 6.400 कि.मी. से 108.700 कि.मी. तक ( लम्बाई 102.3 कि.मी. ) अहमदाबाद - वड़ोदरा खण्ड ( जिसे इसमें इसके पश्चात् उक्त खण्ड । संदर्भित किया गया है ) के विकास और एन ई 1 के 0.000 कि.मी. से 93.302 कि.मी. तक ( लम्बाई 93.302 कि.मी. ) मौजुदा अहमदाबाद- वड़ोदरा एक्सप्रेसवे ( जिसे इसमें इसके पश्चात् उक्त खण्ड 2 संदर्भित किया गया है ) के सुधार के लिए मैसर्स आई आर बी अहमदाबाद वर्डोदरा सुपर एक्सप्रेसवे टोलवे प्राइवेट लिमिटेड, और जिसका पंजीकृत कार्यालय आई आर बी काम्प्लेक्स , चांदीवली फार्म, चांदीवली गांव, अंधेरी ( पूर्व ) मुम्बई-400072 , महाराष्ट्र भारत में है ( जिसे इसमें इसके पश्चात् " रियायतग्राही " संदर्भित किया गया है ) , के साथ एक करार किया है (जिसे इसमें इसके पश्चात् उक्त करार संदर्भित किया गया है ) ।

अतः अब , केन्द्रीय सरकार , राष्ट्रीय राजमार्ग शुल्क ( दरों का अवधारण एवं संग्रहण ) नियम , 2008 जिसे संख्या सा.का.नि. 838 ( अ ) , दिनांक 5 दिसम्बर , 2008 के तहत प्रकाशित किया गया था और सा.का.नि. 950 ( अ ) , दिनांक 3 दिसम्बर 2010 , सा.का. नि. 15( अ ) , दिनांक 12 जनवरी, 2011 और सा.का. नि. 756 ( अ ) , दिनांक 12 अक्तूबर , 201। द्वारा संशोधित किया गया था ( जिसे इसमें इसके पश्चात् " उक्त नियम " संदर्भित किया गया है ) के नियम 3 के साथ पठित राष्ट्रीय राजमार्ग अधिनियम , 1956 ( 1956 का 48 ) की धारा 8 क द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और भारत सरकार के तत्कालीन (1) :

सड़क परिवहन और राजमार्ग मंत्रालय की अधिसूचना संख्या का.आ. 881 (अ) , दिनांक 19 अप्रैल 2010; तत्कालीन सड़क परिवहन और राजमार्ग मंत्रालय की अधिसूचना संख्या का.आ. 92 (अ), दिनांक 16 जनवरी , 2004 का अतिक्रमण करते हुए ( एन ई 1 के 0.000 कि.मी से 93.02 कि.मी. तक संपूर्ण खंड की प्रस्तावित नियत तिथि से अधिक्रमण प्रभावित ) और तत्कालीन सड़क परिवहन और राजमार्ग मंत्रालय की अधिसूचना संख्या का.आ. 1036 (अ) , दिनांक 23 सितम्बर 2004 का अतिक्रमण करते हुए ( एन ई -1 के 0.000 कि.मी से 93.02 कि.मी. तक संपूर्ण खंड की प्रस्तावित नियत तिथि से अधिक्रमण प्रभावी ) , उक्त खण्ड 1 और 2 के निर्माण, अनुरक्षण , प्रबंधन और प्रचालन, निवेशित पूंजी पर ब्याज, युक्तियुक्त प्रत्यागम यातायात परिमाण तथा प्राधिकरण तथा रियायतग्राही के बीच हुए की अवधि को ध्यान में रखतें हुए एतत्द्वारा यह अधिसूचित करती है कि चार या अधिक लेन के खण्डों के उपयोग के लिए सड़क खण्ड की निवल लम्बाई हेतु सारणी 1 के स्तंभ (2) में निर्दिष्ट आधार दरों पर नीचे सारणी 1 और 2 में निर्दिष्ट प्रकार के वाहनों पर पचास करोड़ या अधिक की लागत वाले पुलों/अवसंरचनाओं के उपयोग के लिए सारणी 2 में निर्दिष्ट आधार दरों पर शुल्क लगाया और संग्रहीत किया जाएगा और उक्त रियायतग्राही को वाणिज्यिक प्रचालन की दिनांक से , जो भी बाद में हो , इस करार में यथा निर्दिष्ट समापन की दिनांक तक, शुल्क संग्रहीत तथा प्रतिधारित करने के लिए प्राधिकृत करती है ;

1 . लगाये गये शुल्क का उद्ग्रहण और संग्रहण निम्नलिखित पथकर प्लाजा पर ऐसे पथकर प्लाजा के लिए विनिर्दिष्ट दूरी के लिए शोध्य और संदेय होगा ।

दर 200.00 रूपए (दो सौ रुपए मात्र) प्रतिमाह होगी और राष्ट्रीय राजमार्ग फीस (दरों का अवधारण औरं संग्रहण) नियम, 2008 के उपबंधों के अनुसार, उसमें प्रत्येक वर्ष संशोधन किया जायेगा ।
4. राजमार्ग खंड पर बहुयात्राओं के लिए पास निम्नलिखित दरों पर प्रदान किये जाएंगे , अर्थात्: -

5. जिस जिले में शुल्क प्लाजा पड़ता है उस जिले में पंजीकृत वाणिज्यिक वाहन (राष्ट्रीय परमिट के अधीन चल रहे वाहनों को छोड़कर) के लिए शुल्क उस श्रेणी के वाहन के लिए निर्धारित शुल्क का 50 % होगा बशर्ते कि ऐसे वाणिज्यिक वाहनों के उपयोग के लिए कोई सर्विस रोड अथवा वैकल्पिक सड़क मार्ग उपलब्ध न हो ।
6. जो यांत्रिक वाहन नियमों के अधीन अपने प्रवर्ग के लिए निर्धारित अनुज्ञेय भार की अपेक्षा अधिक भार से लदे हुए होंगे उन्हें उन दरों पर शुल्क का संदाय करना होगा जो उनसे अगली उच्च श्रेणी के वाहनों के लिए लागू होता है और उन्हें तब तक राजमार्ग खण्ड का उपयोग करने का अधिकार नहीं होगा जब तक कि ऐसे यांत्रिक वाहन से अधिक भार को हटा न दिया जाए ।
7. यांत्रिक वाहनों के प्रवर्ग , उनके लिए अनुज्ञेय भार, छूट प्राप्त वाहनों के प्रवर्ग , सर्विस रोड, वैकल्पिक सड़क आदि सहित सभी परिभाषाएं नियमों में विनिर्दिष्ट परिभाषाओं के अनुसार होंगी ।
8. उक्त नियमों के नियम 12 के अनुसार, उपयोगकर्ताओं की जानकारी के लिए शुल्क की दरों को प्रदर्शित किया जाएगा ।
9. ऊपर सारणी 1 और 2 में यथा उल्लेखित आधार वर्ष 2007-08 के लिए प्रति कि.मी. की आधार दरों के आधार पर , यांत्रिक वाहनों से लिए जानेवाले वास्तविक शुल्क और कटौतियों की गणना प्राधिकरण द्वारा की जाएगी और उसमें उक्त नियमों के नियम 5 के अनुसार वार्षिक आधार पर संशोधन किया जायेगा परन्तु शर्त यह है कि छह महीने के अन्दर कोई संशोधन नहीं किया जाएगा तथा उसे तदनुसार, कम-से-कम अंग्रेजी और स्थानीय भाषा के एक- एक समाचारपत्र में प्रकाशित किया जाएगा ।

NOTIFICATION
New Delhi , the 17th December , 2012
S.O. 2921 (E ) . Whereas by notification of the Government of India in the erstwhile Ministry of Surface Transport (Roads Wing) number S.O. 78 (E) , dated 4th February, 1999 , issued under section 11 of the National Highways Authority of India Act, 1988 (68 of 1988) , the Central Government entrusted the stretch from kilometer 0.000 to kilometer 381.600 (Ahmedabad - Gujarat / Maharashtra Border Section ) of National Highway Number - 8 in the state of Gujarat to the National Highways Authority of India ( hereinafter referred to as the "Authority") .
And whereas by notification of the Government of India in the erstwhile Ministry of Surface Transport ( Roads Wing) number S.O. 1025 (E) , dated 1st December , 1998 , issued under section 11 of the National Highways Authority of India Act , 1988 ( 68 of 1988 ) , the Central Government entrusted the stretch from kilometer 0.000 to kilometer 93.302 of National Highway Number N.E.1 in the state of Gujarat to the National Highways Authority of India.
And whereas, pursuant to the provision of section - 14 of the National Highways Authority of India Act (68 of 1988 ) the Authority has entered into an Agreement (hereinafter referred to as said agreement) with M/ s IRB Ahmedabad Vadodara Super Express Tollway Private Limited , having its registered office at IRB Complex, Chandivali Farm , Chandivali Village , Andheri ( East) , Mumbai 400072 , Maharashtra, India ( hereinafter referred to as the " Concessionaire " ) , for the development of the Ahmedabad - Vadodara Section from Km 6.400 to Km 108.700 ( Length 102.3 Km ) on National Highway No. 8 ( hereinafter referred to as the " said section 1 " ) and Improvement of existing Ahmedabad Vadodara Expressway from Km 0.000 to Km 93.302 ( Length 93.302 Km) of N.E.1 ( hereinafter referred to as the " said section 2" ) in the State of Gujarat under NHDP Phase V on Design , Build , Finance , Operate Transfer ( DBFOT) Toll Basis .
Now, therefore , in exercise of the powers conferred by section 8A of the National Highways Act , 1956 (48 of 1956 ) , read with rule 3 of the National Highways Fee (Determination of Rates and Collection) Rules , 2008 published vide G.S.R. 838 (E) dated 5th December, 2008 and amended vide G.S.R.950 ( E ) dated 3rd December , 2010 ; G.S.R. 15 (E) dated 12th January, 2011 and G.S.R. 756 (E ) dated 12th October , 2011 (hereinafter referred to as the " said Rules" ) , and in supersession of the notifications of the Government of India, in erstwhile Ministry of Road Transport and Highways No. S.0.881 ( E) dated 19th April , 2010 ; erstwhile Ministry of Road Transport and Highways No. S.O.92 ( E) dated 16th January, 2004 (supersession effective from the proposed appointed date of the complete stretch from km 0.000 to km 93.302 of NE -1 ) and erstwhile Ministry of Shipping, Road Transport and Highways No. S.O.1036 (E) dated 23rd September , 2004 ( supersession effective from the proposed appointed date of the complete stretch from km 0.000 to km 93.302 of NE - 1 ) , the Central Government , having regard to the expenditure involved in building , maintenance, management and operation of the said sections 1 & 2, interest on the capital invested , reasonable return , the volume of traffic and the period of the agreement entered into between the authority and the concessionaire , hereby notifies that there shall be levied and collected fees on mechanical vehicles for the use of the said sections at the base rates specified in columns ( 2) of the Table 1 for net road section lengths for use of the four and more lane sections and at the base rates specified in the Table No.2 for the use of

bridges/ structures costing Rupees Fifty crore or more on the Type of Vehicles specified in Table 1 and 2 below, and authorizes the said Concessionaire to collect and retain the fee on and from the date of commercial operation or publication of this notification in the Official Gazette, whichever is later , till the termination date as specified in the agreement ;

3. The rate of monthly pass for a person who owns a mechanical vehicle registered for non- commercial purposes and resides within a distance of twenty kilometers from the toll plaza is Rs . 200.00 ( Rupees Two Hundred only) for the year 2012-13 and is subject to revision every year as per the provisions of the National Highways Fee (Determination of Rates and Collection) Rules , 2008 .
4. For multiple journeys on the highway section , passes shall be issued at the following rates , namely .

5.Fee for commercial vehicle (excluding vehicles plying under national permit ) registered in the district where the fee plaza falls shall be 50% of the prescribed rate for that category of vehicle provided no service road or alternative road is available for use of such commercial vehicles .
6. Mechanical vehicle which is loaded in excess of permissible load specified for its category under the Rules , shall be liable to pay fee at such rates which is applicable for the next higher category of the vehicles and shall not be entitled to make use of the highway section unless the excess load has been removed from such mechanical vehicle .
7. All definitions including category of mechanical vehicles , its permissible load , category of exempted vehicles , service road , alternative road etc. shall be as per definitions specified in the said Rules .
8. The amount of fee to be charged from the mechanical vehicles shall be displayed for information of the users in accordance with rule 12 of the said Rules .
9. Based on the base rates of fee per km for the Base Year 2007-2008 as mentioned in Table. 1 & 2 above , the actual amount of fee to be charged from the mechanical vehicles and the discounts will be calculated by the Authority and revised annually in accordance with the rule 5 of the said Rules provided that no revision shall be effected within six months and the same shall be published in at least one newspaper , each in English and vernacular language accordingly.
