सा.का.नि. 900 (अ). केंद्रीय सरकार, पौधा किस्म और कृषक अधिकार संरक्षण अधिनियम, 2001 ( 2001 का 53 ) की धारा 96 की उप - धारा ( 2 ) के खंड ( 7 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , पौधा किस्म और कृषक अधिकार नियम , 2003 का और संशोधन करने के लिए निम्नलिखित नियम बनाती है , अर्थात्:-
1. संक्षिप्त नाम और प्रारंभ. ( 1 ) इन नियमों का संक्षिप्त नाम पौधा किस्म और कृषक अधिकार संरक्षण ( दूसरा संशोधन ) नियम , 2012है ।
(2 ) ये उनके राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।
2. पौधा किस्म और कृषक अधिकार संरक्षणे नियम , 2003 के नियम 36 के पश्चात् निम्नलिखित नियम अंतःस्थापित किया जाएगा , अर्थात्:-
" 36. क- धारा 8 की उप- धारा ( 2 ) के खंड ( ड. ) के अधीन रजिस्ट्रीकृत किस्म के बीजों के उत्पादन और बिक्री का प्रबंध करने की रीति ( 1 ) इस अधिनियम के अधीन किसी रजिस्ट्रीकृत किस्म के बीजों का उत्पादन , विपणन और बिक्री करने का हकदार अभिजनक या अन्य व्यक्ति:-
(क) रजिस्ट्रीकृत किस्म की सामग्री के बीज या प्रचार सामग्री कृषकों को समयबद्ध रूप से उपलब्ध कराएगा जिससे उनकी समुचित आवश्यकताओं की पूर्ति हो सके; या
( ख ) ऐसी रजिस्ट्रीकृत किस्म की सामग्री के उत्पादन, विपणन और बीजों की बिक्री या प्रचार सामग्री कृषकों को समुचित कीमत पर उपलब्ध कराने का प्रबंध करेगा " ।

NOTIFICATION
New Delhi , the 17th December, 2012
GS.R. 900 (E ) .- In exercise of the powers conferred by clause (vii) of sub-section 2 of section 96 of the Protection of Plant Varieties and Farmers' Rights Act , 2001 (53 of 2001 ) the Central Government hereby makes the following Rules further to amend the Protection of Plant Varieties and Farmers' Rights Rules , 2003 namely :-
1. Short title and commencement.-( 1 ) These Rules may be called Protection of Plant Varieties and Farmers ' Rights (SecondAmendment) Rules , 2012 .
(2) They shall come into force on the date of their publication in the Official Gazette .
2. In the Protection ofPlant Varieties and Farmers ' Rights Rules , 2003 ,after rule 36, the following rule shall be inserted namely:-
" 36A Manner for arranging production and sale of seeds of registered variety under clause ( e) of sub - section 2 of section 8-( 1 ) The breeder of a registered variety or any person entitled to produce , market and sell the seeds of a registered variety under this Act shall :-

( a) provide the seeds or propagating material of the registered variety to the farmers in a timely manner, so asto satisfy their reasonable requirements ; or
(b) arrange for production , marketing and sale of seeds or propagating material of such registered variety to the farmers at a reasonable market price" .
