अधिसूचना नई दिल्ली, 20 दिसम्बर, 2012 सं. 5/2012- सीमा शुल्क ( एस.जी. )
सा.का.नि. 912 (अ).- जहां कि, सीमा शुल्क टैरिफ अधिनियम, 1975 ( 1975 का 51 ) (एतश्मिन् पश्चात जिसे उक्त अधिनियम से संदर्भित किया गया है) की प्रथम अनुसूची के टैरिफ शीर्ष 8546 के अतंर्गत आने वाले इलेक्ट्रिकल इंसुलेटर्स के आयात के मामले में, महानिदेशक (रक्षोपाय) ने अपने अंतिम निष्कर्ष, जिसे सा.का.नि 729(अ ), दिनांक 27 सितंबर 2012 के तहत भारत के राजपत्र, असाधारण, के भाग ॥ , खण्ड 3 उपखण्ड (i ) में प्रकाशित किया गया था, में इस निर्णय पर पहुंचते हैं कि:-
क. चीन जनवादी गणतंत्र से इलेक्ट्रिक इंसुलेटरों के बढ़ते आयात से इलेक्ट्रिक इंसुलेटरों के घरेलू उद्योग / उत्पादकों को नुकसान पहुंचा है और आगे भी नुकसान पहुंचने का खतरा पैदा हो गया है;
ख. इस बढ़ते आयात और बाजार व्यवधान / बाजार व्यवधान के खतरे के बीच एक अकस्मात संबंध देखने में आता है;
ग. यह बात जनहित में होगी कि चीन जनवादी गणतंत्र से इलेक्ट्रिक इंसुलेटरों के होने वाले आयात पर रक्षोपाय शुल्क लगाया जाए,
और जबकि महानिदेशक (रक्षोपाय) ने अपने अंतिम निष्कर्ष में सिफारिश की है कि चीन जनवादी गणतंत्र से आयात किए गए इलैक्ट्रिकल इंसुलेटरों के आयात पर दो वर्षों की अवधि के लिए रक्षोपाय शुल्क लगाया जाए।

अतः अब उक्त अधिनियम की धारा 8 ग की उपधारा (i ) के तहत प्रदत्त शक्तियों का प्रयोग करते हुए, और सीमा शुल्क टैरिफ ( पारगमन उत्पाद विशिष्ट रक्षोपाय शुल्क) नियमावली, 2002के नियम 12 और 14 के अनुसार, केंद्र सरकार, महानिदेशक( रक्षोपाय) के उक्त निष्कर्षों पर विचार करने के पश्चात एतद्वारा, निम्न सारणी के कॉलम (3) में वर्णित विषयगत माल , जो कि उक्त सीमा शुल्क टैरिफ अधिनियम की प्रथम अनुसूची के उपशीर्ष के अतंर्गत आते हैं, जैसा कि कॉलम (2) में तत्सबंधी प्रविष्ट में विनिर्दिष्ट है, पर , जब भारत में उनका आयात किया जा रहा हो , कॉलम (4) में तत्संबंधी प्रवष्टि में निर्देशित दर से, मूल्यानुसार , रक्षोपाय शुल्क लगाती है.

स्पष्टीकरण: तालिका में प्रथम वर्ष से अभिप्राय इस प्रस्तावित अधिसूचना के जारी होने की तारीख से लेकर एक वर्ष के पूरे होने तक की अवधि से है तथा द्वितीय वर्ष से अभिप्राय उक्त एक वर्ष की अवधि की समाप्ति की तारीख से लेकर 31 दिसम्बर, 2013 तक की अवधि से है ।

NOTIFICATION
New Delhi , the 20th December, 2012
No. 5/2012- Customs (SG)
GS.R. 912(E) -WHEREAS , in the matter of import of electrical insulators , falling under tariff heading 8546 of the First Schedule to the Customs Tariff Act, 1975 ( 51 of 1975 ) (hereinafter referred to as the said Act) , the Director General (Safeguard), in its final findings published in the Gazette of India, Extraordinary, Part II , Section 3 , Sub - section ( i ), vide notification number G.S.R. 729 (E ), dated the 27th September , 2012, had come to the conclusion that:
(a) increased imports of electrical insulators from the People's Republic of China have : caused and threatened to cause market disruption to the domestic industry and producers of electrical insulators ;
(b) a causal link exists between the increased imports and market disruption and threat of market disruption ; and
(c) it will be in the public interest to impose Safeguard duty on import of electrical insulators from People's Republic of China;
AND WHEREAS , the Director General (Safeguard) in its final findings has recommended that the safeguard duty be imposed on imports of electrical insulators imported from the People's Republic of China for a period of two years ;
NOW , THEREFORE, in exercise of the powers conferred by sub - section ( 1 ) of section 8C of the Customs Tariff Act, 1975 (51 of 1975) read with the rules 12 and 14 of the Customs Tariff (Transitional Product Specific Safeguard Duty) Rules, 2002, the Central Government, after considering the aforesaid findings of the Director General (Safeguard), hereby imposes on the goods of description specified in column (3 ) of the Table below, falling under sub - heading of the First Schedule to the said Customs Tariff Act as specified in the corresponding entry in column (2) , when imported into India from the People's Republic of China, a safeguard duty at the rate indicated in the corresponding entry in column (4) ad valorem.
