सा.का.नि. 910(अ).- केन्द्रीय सरकार , सशस्त्र सीमा बल अधिनियम, 2007 (2007 का 53) की धारा 155 की उपधारा 2 के खंड (क) और खंड ( ग) के साथ पठित उप - धारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और सशस्त्र सीमा बल समूह 'क' योधक (राजपत्रित ) अनुसचिवीय और निजी सचिव काडर पद भर्ती नियम, 2010 को , उन बातों के सिवाय अधिक्रांत करते हुए जिन्हें ऐसे अधिक्रमण से पहले किया गया है या करने का लोप किया गया है, गृह मंत्रालय के अधीन सशस्त्र सीमा बल , समूह ' क' योधक (राजपत्रित) अनुसचिवीय और निजी सचिव काडर पद पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनातें हैं , अर्थातः- 1. संक्षिप्त नाम और प्रारंभ. (1 ) इन नियमों का संक्षिप्त नाम सशस्त्र सीमा बल समूह ' क' योधक (राजपत्रित) अनुसचिवीय और निजी सचिव काडर पद भर्ती नियम , 2012 है ।
(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।
2. लागू होना.- ये नियम इन नियमों से उपाबद्ध अनुसूची के स्तंभ ( 1 ) में विनिर्दिष्ट पदों को लागू होंगे।
3. पद संख्या, वर्गीकरण, वेतन बैंड और ग्रेड वेतन या वेतनमान. उक्त पद संख्या , उसका वर्गीकरण , उनके वेतन बैंड और ग्रेड वेतन या वेतनमान वह होगा, जो इन नियमों से उपाबद्ध अनुसूची के स्तंभ (2 ) से स्तंभ (4) में विनिर्दिष्ट हैं ।
4. भर्ती की पद्धति, आयु- सीमा , अर्हताएं आदि. उक्त पदों पर भर्ती की पद्धति, आयु सीमा , अर्हताएं और उनसे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तंभ (5 ) से स्तंभ ( 13 ) में विनिर्दिष्ट हैं ।
5. प्रोन्नति पूर्व पाठ्यक्रम. पोषक पंक्ति में कार्मिक को उनकी अपनी ज्येष्ठता के क्रम में अगली उच्चतर पंक्ति में प्रोन्नति के लिए , सेवा पात्रता अवधि पूरा करने से पूर्व अर्हक पाठ्यक्रमों को सफलतापूर्वक उत्तीर्ण करने के लिए 4719 GI/ 2012

भेजा जाएगा और बल के ऐसे प्रत्येक सदस्य को किसी प्रोन्नति से पूर्व इससे उपाबद्ध अनुसूची में यथा विहित प्रोन्नति पूर्व पाठ्यक्रम या पाठ्यक्रमों को सफलता पूर्वक पूरा करना होगा ।
6. निरर्हता.- वह व्यक्ति, -
(क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है , विवाह किया है , या
(ख) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है, उक्त पद पर नियुक्ति का पात्र नहीं होगाः
परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह , ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को , इस नियम के प्रवर्तन से छूट दे सकेगी ।
7. चिकित्सक दृष्टया योग्यता. इन नियमों में किसी बात के होते हुए भी , केवल वे व्यक्ति जो चिकित्सा प्रवर्ग शेप-1 में हैं, इन नियमों के उपबंधों के अधीन नियुक्ति के लिए पात्र होंगे ।
स्पष्टीकरणः इस नियम के प्रयोजन के लिए, " शेप 1 " चिकित्सा प्रवर्ग से अभिप्रेत है जो निम्नलिखित परिभाषित हैः-
( i ) कोड अक्षर शेप एस एच ए पी ई , जो निम्नलिखित कृत्य का प्रतिनिधित्व करते हैं , द्वारा उपदर्शित निम्नलिखित कारक के अधीन अधिकारी की उपयुक्तता निर्धारित करने के पश्चात् चिकित्सा अधिकारी द्वारा किया गया चिकित्सा वर्गीकरण:-
एस - मनोवैज्ञानिक
एच- श्रवण शक्ति
ए उपांग (अपैन्डेजेस)
पी - शारीरिक क्षमता
ई - दृष्टि शक्ति
(ii ) प्रत्येक कारक के अधीन किसी अधिकारी की कार्यात्मक क्षमता प्रत्येक कोड अक्षर के सामने अंक 1 से 5 द्वारा कम होती हुई कार्यक्षमता उपदर्शित करते हुए दर्शाई जाएगी और कोड अक्षर के पश्चात् अंक लिखे जाएंगे सिवाय उसके जहां कोई अधिकारी सभी घटकों में श्रेणी-1 में है वहां उसका प्रवर्ग एस 1 एच 1 ए 1 पी 1 ई 1 लिखने के बजाय शेप -1 लिखकर दर्शाया जा सकेगा , इन अंकों का साधारण मूल्यांकन निम्नानुसार है: -
(क) कहीं भी सभी कर्तव्यों के लिए उपयुक्त।
(ख) सभी कर्तव्यों के लिए योग्य किन्तु क्या कर्तव्यों में तीव्र कठिनाई या दोनों कानों या आँखों को श्रवण शक्ति/ दृष्टि की तीक्ष्णता की मांग अन्तर्ग्रस्त है या नहीं, पर निर्भर करते हुए कर्तव्यों के प्रकार और नियोजन योग्यता क्षेत्रों के अनुसार परिसीमाएं हो सकती हैं ।

(ग) " एस" कारक को छोड़कर नेमी या निष्क्रिय कर्तव्यों के लिए योग्य किन्तु उच्च स्थान (2700 मीटर से अधिक) अत्यधिक ठंडे क्षेत्रों या पहाड़ी क्षेत्रों पर और लंबे कर्तव्य भारों के लिए नियोजन योग्यता की परिसीमाएं हो सकती है ।
(घ) अस्पताल में भर्ती या बीमारी की छुट्टी के कारण कर्तव्यों के लिए अस्थायी रूप से अयोग्य।
(इ) कर्तव्यों के लिए स्थायी रूप से अयोग्य।
8. अधिवर्षिता. - इन नियमों के अधीन नियुक्त किया गया कोई कार्मिक उस मास के, जिसमें वह सत्तावन वर्ष की आयु प्राप्त कर रहा है अंतिम दिन के अपराह्न में सेवानिवृत्त होगाः
परंतु ऐसा व्यक्ति जिसके जन्म की तारीख किसी मास का पहला दिन है , सत्तावन वर्ष की आयु पूरी करने पर पूर्ववर्ती मास के अंतिम दिन के अपराह्न में सेवानिवृत्त होगा।
9. सेवा का दायित्व. इन नियमों के अधीन उक्त पदों पर नियुक्त कोई भी व्यक्ति भारत में कहीं भी या विदेश में सेवा करने का दायी होगा और जब तक पद धारण करेगा उसे सौंपे गये कार्य और कर्तव्यों का पालन करेगा।
10. अन्यदेशीय अपात्रता. कोई व्यक्ति, जो भारत का नागरिक नहीं है, केन्द्रीय सरकार की लिखित पूर्व अनुमति के सिवाय, इन नियमों के अधीन नियुक्त नहीं किया जाएगा।
परन्तु इस नियम की कोई बात नेपाल या भूटान के नागरिक को बल में नियुक्ति या नियोजन पर प्रभाव नहीं डालेगी ।
11. शिथिल करने की शक्ति. जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत , आदेश द्वारा शिथिल कर सकेगी।
12. व्यावृत्ति. इन नियमों की कोई बात, ऐसे आरक्षणों , आयु- सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी , जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय- समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, अन्य पिछड़ें वर्गों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।
13. निर्वचन. इन नियमों के निर्वचन के संबंध में यदि कोई प्रश्न उठता है तो उसका विनिश्चय केन्द्रीय सरकार द्वारा किया जाएगा।

In exercise of the powers conferred by sub- section ( 1 ) read with clauses (a) and (c) of sub -section 2 of section 155 of the Sashastra Seema Bal Act, 2007 ( 53 of 2007) and in supersession of the Sashastra Seema Bal Group 'A' Combatised ( Gazetted) Ministerial and Private Secretary Cadre Post Recruitment Rules, 2010 , except as respect things done or omitted to be done before such supersession the Central Govemment hereby makes the following rules to regulate the method of recruitment to Group ' A' Combatised (Gazetted) Ministerial and Private Secretary Cadre post in the Sashastra Seema Bal , under the Ministry of Home Affairs , namely: -
1. Short title and commencement.- ( 1 ) These rules may be called the Sashastra Seema Bal Group 'A' Combatised ( Gazetted) Ministerial and Private Secretary Cadre Post Recruitment Rules, 2012.
(2) They shall come into force on the date of their publication in the Official Gazette.
Application.- These rules shall apply to the posts specified in column ( 1 ) of the Schedule annexed to these rules . 2.
3. Number of post , classification , pay hand and grade pay or pay scale. The number of posts , their classification , the pay band and grade pay or pay scale attached thereto shall be as specified in columns (2 ) to (4) of the Schedule annexed to these rules .
4. Method of recruitment , age limit , qualifications etc. The method of recruitment of the said posts , age limit , qualifications and other matters relating thereto shall be as specified in columns (5) to ( 13 ) of the said Schedule .
5. Pre-promotional courses . The personnel in the feeder rank shall be detailed to undergo qualifying courses before completing service eligibility period for promotion to the next higher rank in order of their seniority and every such member of the Force shall , before any promotion , should have successfully completed pre- promotional course or courses as prescribed in the said Schedule .
6 Disqualification.- No person , -
(a) who has entered into or contracted a marriage with a person having a spouse living; or
(b) person, who , having a spouse living, has entered into or contracted a marriage with any [ भाग II- खण्ड 3 (i ) ]

shall be eligible for appointment to the said posts:
Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.
7. Medical fitness.- Notwithstanding anything contained in these rules, only those persons who are in medical category SHAPE - I , shall be eligible for appointment under the provisions ofthese rules .
Explanation.- For the purpose of this rule, " SHAPE - I " means medical Category defined as under: -
(i) Medical classification done by Medical Officer after assessing fitness of the officer under givenfactors indicated by the code letters SHAPE , which represent the following function: -

(ii) Functional capacity of an officer under each factor shall be denoted by numeral 1 to 5 against each code letter , indicating declining functional efficiency and the numerals will be written next to the code letter , except that where an officer is in Grade - I in all factors, his category may be denoted by writing SHAPE - I instead of writing SIHIAIPIEL and the general evaluation of these numerals are as under: -
(a) Fitfor all duties anywhere .
(b) Fitfor all duties but may have limitations as to type of duties and area of employability depending on whether the duties involve severe stress or demand acuity of hearing/vision of both ears or eyes .
(c) Excepting " S " factor , fit for routine or sedentary duties but may have limitations of employability at high altitude (above 2,700 meters ) extreme cold areas or hilly terrain and for long assignments .
(d) Temporarily unfit for duties on account of hospitalization or sick leave .
(e) Permanently unfit for duties.
8. Superannuation.- A personnel appointed under these rules shall retire from service on the afternoon of the last day of the month in which he attains the age of fifty seven years :

Provided that the person whose date of birth is the first day of a month shall retire from service on the afternoon of the last day of the preceding month on attaining the age of fifty seven years .
9. Liability of service.- Any person appointed to the said posts under these rules shall be liable to serve anywhere in India or abroad and perform any work and duty assigned to him there-so.
10. Ineligibility of non - citizens of India . No person who is not a citizen of India shall , except with the prior permission of the Central Government in writing, be appointed under these rules:
Provided that nothing contained in this rule shall bar the appointment or employment of a subject of Nepal or Bhutan in the Force.
11. Power to relax.- Where the Central Government is of the opinion that it is necessary or expedient to do so , it may, by order , for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons .
12. Saving.- Nothing in these rules shall affect reservations , relaxation of age limit and other concessions required to be provided for the Scheduled Castes , the Scheduled Tribes , Other Backward Classes , Ex - Servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.
13. Interpretation.- If any question relating to the interpretation of these rules arises , it shall be decided by the Central Government .
