का.आ. 2980(अ) .- केन्द्रीय सरकार ने, भारतीय राष्ट्रीय राजमार्ग प्राधिकरण अधिनियम 1988 (1988 का 68) जिसे इसके पश्चात् उक्त अधिनियम कहा गया है, की धारा 11 के अधीन जारी की गई भारत सरकार के तत्कालीन भूतल परिवहन और राजमार्ग मंत्रालय (सडक खंड) की अधिसूचना संख्या का. आ. 78 (अ) तारीख 4 फरवरी 1999, और पोत परिवहन, सडक परिवहन और राजमार्ग मंत्रालय (सडक परिवहन और राजमार्ग विभाग ) द्वारा गुजरात राज्य में राष्ट्रीय राजमार्ग संख्या 8 के किमी 0.00 से किमी 381.600 (अहमदाबाद से गुजरात / महाराश्ट्र बॉर्डर खण्ड) तक के भूखंड को भारतीय राष्ट्रीय राजमार्ग प्राधिकरण (जिसे इसमें इसके पश्चात् प्राधिकरण कहा गया है) को सौंपा गया था ।
अतः अब केन्द्रीय सरकार, राष्ट्रीय राजमार्ग अधिनियम 1956 (1956 का 48) की धारा 7 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, केन्द्रीय सरकार के सडक परिवहन एवं राजमार्ग मंत्रालय के भारत के राजपत्र में प्रकाशित अधिसूचना संख्या का. आ. 735 (अ) तारीख 4 अप्रेल 2012 में मूल अधिसूचना संख्या का. आ. 1009 (अ) तारीख 10 नम्वबर 2000 द्वारा मेसर्स नर्मदा इन्फ्रास्ट्रक्चर कन्स्ट्रकशन एन्टरप्राइजेज लिमिटेड, चेन्नई को यांत्रिक यानों पर फीस का संग्रहण करने हेतु नर्मदा नदी पर पुराने तथा नये पर राष्ट्रीय राजमार्ग सं. 8 के किमी 192.000 से किमी 198.000 अनुसार दिनांक 10. 11.2000 से 20.12.2012 तक अधिकृत किया गया था ।
और प्राधिकरण ने राष्ट्रीय राजमार्ग प्राधिकरण अधिनियम 1988 (1988 का 68) की धारा 14 द्वारा प्रदत्त शक्तियों के अनुसरण में राष्ट्रीय राजमार्ग सं. 8 पर गुजरात राज्य में किंमी 192.000 से किमी 198.000 के बीच वडोदरा- सुरत सेक्शन पर नर्मदा नदी के उपर चारमार्गीय अतिरिक्त डोज पुल का निर्माण एवं वर्तमान चारमार्गीय मार्ग का छह मार्गीयकरण डीबीएफओटी (टोल ) के तहत मेसर्स नर्मदा ब्रिज टोलवे लिमिटेड, मुम्बई के साथ करार जिसे इसमें इसके पश्चात् उक्त करार कहा गया है, किया है ।

अतः अब केन्द्रीय सरकार, राष्ट्रीय राजमार्ग अधिनियम 1956 (1956 का 48) की धारा 8 अ द्वारा प्रदत्त भाक्तियों का प्रयोग करते हुए, प्रकाशन क्र. जी.एस.आर 838 (अ) दिनांक 5 दिसंबर 2008 जो कि समय - समय पर बदलता है (जिसे कि इसके पश्चात् "नियम" कहा गया है) जिसे कि राष्ट्रीय राजमार्ग फीस (दर एवं संग्रहण का निर्धारण) नियम के साथ पढते हुए, केन्द्रीय सरकार नर्मदा ब्रिज एवं उसके पहुँच मार्ग के अनुरक्षण, प्रबंधन और प्रचालन में अंतर्ग्रस्त व्यय, विनिधात पुंजी पर ब्याज, युक्तियुक्त प्रत्याग , यातायात परिमाण और करार की अवधि को ध्यान में रखते हुए यह अधिसूचित करती है कि उक्त अनुसुची के कॉलम (2) में विनिर्दिष्ट वाहनों पर उक्त अनुसुची के कॉलम (3 ) में विनिर्दिष्ट संबंधित दरों पर केंद्र सरकार की ओर से भारतीय राष्ट्रीय राजमार्ग प्राधिकरण द्वारा विभाग तौर पर अथवा प्रतियोगी निविदा के आधार पर निजी ठेकेदारों के माध्यम से फीस उदग्रहीत और संग्रहीत की जायेगी । यह फीस इस अधिसूचना के सरकारी राजपत्र में प्रकाशन की दिनांक से अथवा उक्त खंड को यातायात के लिए खोले जाने की दिनांक से, जो भी बाद में हो, स्थायी रुप से संग्रहीत की जाएगी ।

टिप्पणी
1. निम्नलिखित प्रकार के यानों को अनुसूची में उपर विनिर्दिष्ट फीस से छुट प्रदान की गई है ।
i. अति महत्वपूर्ण व्यक्ति प्रतीक वाले यान
ii . पुलिस यान (कानून प्रवर्तन एजेन्सी ):
प्रकल्प के प्रयोक्ता के वाहन, प्रयोक्ता के कर्मचारी , प्रोजेक्ट के अभिकर्ता, अधीकृत यंत्री एवं प्रोजेक्ट प्रशासन स्टाफ
iv. अग्निशमन यान
V. एम्बुलेंस

निम्नलिखित यान, अति महत्त्वपुर्ण प्रत्तीक वाले यान समझे जायेंगे
i . भारत के राष्ट्रपति

5. यह अधिसूचना सरकारी राजपत्र में प्रकाशान की दिनांक 21 दिसंबर 2012 से प्रभावित मानी जाएगी ।

NOTIFICATION
New Delhi , the 21st December, 2012
S.O. 2980 ( E ) . WHEREAS, by the notification of the Government of India in the erstwhile Ministry of Surface Transport (Roads Wing) , number S.O. 78 (E) , dated 4th February, 1999 issued under section 11 of the National Highways Authority of India Act, 1988, ( 68 of 1988 ) , the Central Government entrusted the stretch from Km 0.00 to km 381.600 (Ahmedabad to Gujarat/ Maharashtra border Section) of National Highway No. 8 in the State of Gujarat to the National Highways Authority of India ( hereinafter referred to as the Authority) ;
And Whereas, in the exercise of the powers conferred by Section 7 of the National Highways Act, 1956 (48 of 1956) , the Central Government by notification of the Government of India in the Ministry of Road Transport and Highways number S.O. 735 ( E) dated 4th April , 2012 with principal notification bearing S.O. No. 1009 ( E) dated 10th November , 2000 , authorized M/s Narmada . Infrastructure Construction Enterprise Ltd. , Chennai for levying and collecting fee on mechanical vehicles for the use of existing and new bridges across river Narmada at Zadeshwar in concession area from kim 192.000 to km 198.000 of National Highway No. 8 at the rates specified in its Schedule from 10.11.2000 to 20.12.2012 .
And whereas , pursuant to the provision of section - 14 of the National Highways Authority of India Act (68 of 1988) the Authority has entered into an Agreement (hereinafter referred to as said agreement ) with M/s Narmada Bridge Tollway Limited, Mumbai for the project of Six laning of km 192.000 to km 198.000 between Vadodara - Surai Şection of NH - 8 including construction of new four lane extra dozed bridge across River Narmada in the State of Gujarat on DBFOT (TOLL ) basis under NHDP -V.
Now, therefore , in exercise of the powers conferred by section 8A of the National Highways Act, 1956 (48 of 1956) , read with National Highways Fee (Determination of Rates and Collection) Rules , 2008 published vide G.S.R. 838 (E) dated 5th December , 2008 and amended from time to time (hereinafter referred to as the "Rules " ) , the Central Government , having regard to the expenditure involved in maintenance , management and operation of Narmada Bridges and its approaches , hereby notifies that there shall be levied and collected fees on mechanical vehicles for the use of the said section at the rates specified in the Schedule below on the Type of Vehicles specified in the Schedule and authorizes the Authority to collect , either through its officials or through a contractor , the said fee, namely:-

Notes:
1. Following types of vehicles are exempted from the tolls and the Concession Company shall allow them to use the facility freely:
(i) Vehicles with VIP symbols .
(ii ) Police Vehicles ( Law enforcement agencies) .
(iii) Project Vehicles of Employer, Employers Agent and Engineer - in -charge and his authorized project establishment staff. (iv) Fire Fighting Vehicles .
(v) Ambulances .
2. The Vehicles officially belonging to the following shall be deemed to be Vehicles having VIP Symbols ; namely ;
(i) President of India
(ii) Vise- President of India
(iii ) Central and State Ministers
(iv) Leaders of Opposition in Lok Shabha/Rajya Sabha
(v) Governors
(vi) State Legislators having status of Cabinet Ministers

(vii ) Executive Councilors
(viii ) Speakers/ Chairman of Central and State Legislatures
(ix) Foreign Dignitaries on State visit to India
(x) Foreign Diplomats stationed in India using cars with CD symbols
3. The above mentioned rate/s shall be displayed on board/s in the vicinity of the bridge approach road.
4. The fee shall be collected at one place within the stretch from Km..192.00 to Km . 198.00 ofNH8 .
5. The Notification shall come into force from 21.12.2012 .
