का.आ. 2978(अ).-केन्द्रीय सरकार, कंपनी अधिनियम , 1956 ( 1956 का 1 ) की धारा 637 की उप - धारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, बैंककारी विनियमन अधिनियम , 1949 (1949 का 10 ) के कार्यक्षेत्र में आने वाली बैंककारी कंपनियों के संबंध में , भारतीय रिजर्व बैंक को , इस शर्त के अध्यधीन रखते हुए कि केन्द्रीय सरकार शक्तियों के ऐसे प्रत्यायोजन को प्रतिसंहृत कर सकेगी , या निम्नलिखित धाराओं के अधीन , स्वयं शक्तियों का प्रयोग कर सकेगी , यदि उसकी राय में लोकहित में ऐसी कार्यवाही आवश्यक हो, उक्त अधिनियम की धारा 338 ख , धारा 338 ग और धारा 338ङ के अधीन उसमें निहित शक्तियों का प्रत्यायोजन करती है ।

New Delhi , the 21st December, 2012
S.O. 2978 (E). In exercise of the powers conferred by sub - section ( 1) of Section 637 of the Companies Act, 1956 (1 of 1956), the Central Government hereby delegates its powers under Sections 388B, 388C and 388E of the said Act in relation to banking companies falling within the purview ofthe Banking Regulation Act, 1949 ( 10 of 1949), to the Reserve Bank of India subject to condition that the CentralGovernment may revoke such delegation ofpowers ormay itself exercise the powers under the said sections , if, in its opinion , such a course of action is necessary in the public interest.
2. This notification shall come into force on the date of its publication in the Official Gazette.
