का.नि.आ. १(अ). फिरोजपुर छावनी चुंगी उप- नियम , 1950 का संशोधन करने के लिए चुंगी उप- नियम का एक प्रारूप छावनी अधिनियम, 2006 (2006 का 41 ) की धारा 350 की उप- धारा ( 1 ) द्वारा यथा अपेक्षित छावनी बोर्ड सूचना सं. सी बी एफ/चुंगी/596 , तारीख6 मार्च, 2012 द्वारा प्रकाशित किया गया था जिसमें उससे प्रभावित होने वाले सभी संभावित व्यक्तियों से उक्त सूचना के प्रकाशन की तारीख से तीस दिन की अवधि की समाप्ति तक आक्षेप तथा सुझाव आमंत्रित किए गए थे;
और उक्त सूचना 16 मार्च , 2012 को जनता को उपलब्ध करवा दी गई थी;
और उक्त सूचना के प्रकाशन की तारीख से तीस दिन के भीतर उक्त प्रारूप के बारे में साधारण जनता से कोई भी आक्षेप अथवा सुझाव प्राप्त नहीं हुए थे;
अतः , अब, केन्द्रीय सरकार , छावनी अधिनियम, 2006 (2006 का 41 ) की धारा 350 की उप - धारा ( 1 ) के साथ पठित धारा 348 के खंड 3 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए फिरोजपुर छावनी चुंगी उप - नियम में और संशोधन करने के लिए निम्नलिखित उप-नियम बनाती है , अर्थात्:-

1. ( 1 ) इन उप-नियमों का संक्षिप्त नाम फिरोजपुर छावनी चुंगी (संशोधन ) उप-नियम , 2012 है ।

होंगे । (2) ये राजपत्र में इनके अंतिम प्रकाशन की तारीख को प्रवृत्त
2. फिरोजपुर छावनी चुंगी उप- नियम, 1950 में उप- नियम 31 के पश्चात्निम्नलिखित उप- नियम अंतःस्थापित किया जाएगा , अर्थात्:-
" 31क. माल पर चुंगी के संग्रहण का निलम्बन.-इन उप- नियमों में अंतर्विष्ट किसी बात के होते हुए भी, बोर्ड केन्द्रीय सरकार की पूर्व अनुमति से फिरोजपुर छावनी की सीमाओं में प्रवेश करने वाली अथवा पारगमन होने वाली विद्युत , पैट्रोल , डीजल या लिकर को छोड़कर माल पर चुंगी एकत्रित करने को निलंबित रखने के लिए पंजाब की राज्य सरकार से ऐसी अवधि के लिए जिस पर सहमत हुआ जासके तथा उस सरकार द्वारा की जाने वाली क्षतिपूर्ति की सीमा तक एक करार करेगा । "

जी विजया भास्कर , मुख्य अधिशासी अधिकारी फिरोजपुर छावनी टिप्पण : मूल उप- नियम भारत के राजपत्र , भाग III , खंड 4 में का.नि.आ. सं. 506 , तारीख 25 मार्च , 1950 द्वारा प्रकाशित हुए थे तथा तदुपरान्त निम्नलिखित अधिसूचनाओं द्वारा इनमें संशोधन किए गए, अर्थात्:-
1. भारत के राजपत्र , भाग III , खंड 4 , तारीख 14 फरवरी , 1998 में प्रकाशित का.नि.आ. सं. सी बी एफ/11/ 1/5/ 154, तारीख 28 जनवरी , 1998 ।
2. भारत के राजपत्र , भाग III , खंड़ 4 तारीख 1 मई , 1999 में प्रकाशित का.नि.आ. सं. सी बी एफ/ ओ सी एस , तारीख 1 मार्च , 1999 ।

2. In the Ferozepur Cantonment Octroi Bye -laws , 1950 , after bye - law 31 , the following bye- law shall be inserted , namely:-
NOTIFICATION

S.R.O. 9(E) .- Whereas a draft Octroi Bye - lawsto amend the Ferozepur Cantonment Octroi Bye - laws 1950, was published vide Cantonment Board Notice No. CBF/ Octroi /596, dated 6th March, 2012 as required by sub- section ( 1 ) of Section 350 of the Cantonments Act, 2006 (41 of2006) for inviting objections and suggestions from all persons likely to be affected thereby, till the expiry of period of thirty days from the date of publication of the said notice;
"31 A. Suspension of collection of octroi on . goods. Notwithstanding anything contained in these bye- laws , the Board may, with the prior approval of the Central Government , enter into an agreement with the State Government of Punjab , to suspend the collection of octroi on goods , except on electricity, petrol , diesel or liquor, entering within or transiting through the limits of Ferozepur Cántonment, for such period as may be agreed upon and to the extent compensated by that Government . " And, whereas the said notice was made available to the public on the 16th March, 2012;

Note: The Principal Bye - laws were published in the Gazette ofIndia, Part III , Section 4 vide S.R.O. No. 506 , dated 25th March, 1950 and subsequently amended vide notifications namely:-
And, whereas no objections or suggestions were received from the general public on the said draft within thirty days fromthe date of publication of the said notice; Now, therefore, in exercise of the powers conferred by clause (3 ) of Section 348 , read with sub- section ( 1 ) of Section 350 of the Cantonments Act, 2006 (41 of2006) , the Central Government, hereby makes the following bye -laws further to amend the Ferozepur Cantonment Octroi Bye- laws , namely:-

1. S.R.O. No. CBF/ 11 / 1 / 5 / 154, dated 28th January, 1998, published in Gazette of India, Part III, Section 4, dated 14th February, 1998.
1. ( 1 ) These bye - laws maybe called the Ferozepur Cantonment Octroi (Amendment) Bye- laws , 2012.
(2) They shall come into force on the date of their final publication in the Official Gazette.
2. S.R.O. No. CBF/ OCS , dated the 1st March , 1999 , published inGazette of India , Part III , Section 4 dated 1st May, 1999 .
