आ.अ. 83 (अ)...यतः , महाराष्ट्र राज्य की विधान सभा के निर्वाचित सदस्यों द्वारा निर्वाचित श्री देशमुख , विलासराव दागदोजी का स्थान , उनकी पदावधि जो 2 अप्रैल , 2018 को सम्मिलित करते हुए , उस तारीख तक थी , के समाप्त होने से पूर्व उनकी मृत्यु के कारण 14 अगस्त, 2012 को रिक्त हो गया है; और
यतः , इस प्रकार हुई रिक्ति को भरने के प्रयोजन से उप- निर्वाचन कराना है;
अब, अतः , लोक प्रतिनिधित्व अधिनियम , 1951 ( 1951 का 43 ) की धारा 147 , धारा 39 की उप - धारा ( 1 ) और धारा 56 के अनुसरण में भारत निर्वाचन आयोग एतद्वारा :-
(अ ) महाराष्ट्र राज्य की विधान सभा के निर्वाचित सदस्यों से यह अपेक्षा करता है कि वे 14 जनवरी, 2013 ( सोमवार ) से पूर्व तथा उक्त अधिनियम और तद्दीन बनाए गए नियमों और किए गए आदेशों के उपबन्धों के अनुसार राज्य सभा में उक्त रिक्ति को भरने के प्रयोजन से एक व्यक्ति निर्वाचित कर दें ;
(आ) उक्त निर्वाचन के सम्बन्ध में :-
02जनवरी , 2013 ( बुधवार)
(क) नाम निर्देशन करने की अन्तिम तारीख -
03 जनवरी , 2013 ( गुरुवार )
(ख) नाम निर्देशन की संवीक्षा की तारीख-
05 जनवरी , 2013 ( शनिवार) (ग ) अभ्यर्थिताएं वापस लेने की अन्तिम तारीख-
12जनवरी , 2013 ( शनिवार ) (घ ) वह तारीख , जिसको , यदि आवश्यक हुआ तो मतदान होगा और
14 जनवरी , 2013 ( सोमवार ) (ङ) वह तारीख जिससे पूर्व निर्वाचन सम्पन्न कर लिया जाएगा
नियत करता है; और
(इ ) 9.00 बजे पूर्वाहन से 4.00 बजे अपराह्न तक का समय , ऐसे समय के रूप में नियत करता है जिसके दौरान यदि आवश्यक हुआ है तो , निर्वाचन के लिए उपर्युक्त विनिर्दिष्ट तारीख को मतदान होगा ।

NOTIFICATION
NewDelhi, the 26th December, 2012
Ο.Ν. 83 (E) . Whereas , the seat of Shri Deshmukh , Vilasrao Dagdoji in the Council of States , elected by the elected members of the Legislative Assembly of the State of Maharashtra , has become vacant on 14th August, 2012 by the reason of his death , before the expiration of his term of office which was up to and including the 2nd April , 2018 ; and Whereas , a bye - election is to be held for the purpose of filling the vacancy so caused;
Now therefore, in pursuance of section 147 , sub - section ( 1 ) of Section 39 and Section 56 of the Representation ofthe PeopleAct , 1951 (43 of 1951 ) , the Election Commission of India hereby--
(A) calls upon the elected members of the Legislative Assembly of the State of Maharashtra to elect , before 14th January, 2013 (Monday) , and in accordance with the provisions of the said Act and of the rules and orders made thereunder, a person for the purpose of filling the said vacancy in the Council of States;
(B) appoints , with respect to the said election :-
(a) the 2nd January, 2013 ( Wednesday) , as the last date for making nominations ;
(b) the 3rd January, 2013 ( Thursday), as the date for the scrutiny of the nominations ;
(c) the 5th January, 2013 (Saturday) , as the last date for the withdrawal of candidatures ;
(d) the 12th January, 2013 (Saturday) , as the date on which a poll shall , if necessary, be taken ; and (e) the 14th January, 2013 (Monday ) , as the date before which the election shall be completed; and (C) fixes the hours from 9:00 A.M. to 4:00 P.M. , as the hours during which the poll shall, if necessary , be taken on the date specified above for the election.

आ.अ. 84(अ).-लोक प्रतिनिधित्व अधिनियम , 1951 ( 1951 का 43 ) की धारा 21 के अनुसरण में और धारा 22 की उप - धारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, निर्वाचन आयोग , महाराष्ट्र राज्य सरकार के परामर्श से एतद्वारा तारीख 26 दिसम्बर , 2012 को भारत के राजपत्र में प्रकाशित आयोग की अधिसूचना के अनुसरण में इस राज्य में राज्य सभा के लिए उप-निर्वाचन के संबंध में :
(i ) नीचे की सारणी के स्तम्भ ( 1 ) में विनिर्दिष्ट अधिकारी को रिटर्निंग आफिसर के रूप में पदाभिहित करता है ; और
(ii ) उक्त सारणी के स्तम्भ ( 2 ) में विनिर्दिष्ट अधिकारी को , रिटर्निंग आफिसर की उसके कृत्यों के पालन में सहायता के लिए सहायक रिटर्निंग आफिसर नियुक्त करता है ।

O.N. 84 (E ).- In pursuance of Section 21 , and in exercise of the powers conferred by sub- section ( 1) of Section 22, ofthe Representation of the People Act , 1951 (43 of 1951 ) , the Election Commission of India, in consultation with the Government of the State of Maharashtra, hereby : ---
(1) designates the officer , specified in column ( 1 ) of the Table below, to be the Returning Officer ; and ( ii ) appoints the officer , specified in column (2 ) of the said Table , to be the Assistant Returning Officer to assist the Returning Officer in the performance of his functions;
inrespect of the bye- election to the Council of States, to be held in that State in pursuance of the Commission's Notification,
