सा.का.नि. 943(अ) . केन्द्रीय मोटर यान नियम, 1989 का और संशोधन करने के लिए मोटर यान अधिनियम, 1988 ( 1988 का 59) की धारा 212 की उपधारा ( 1 ) द्वारा यथापेक्षित नियमों का प्रारूप भारत सरकार के सड़क परिवहन और राजमार्ग मंत्रालय की अधिसूचना सं . सा.का.नि. 631 (अ) तारीख 19 अगस्त, 2011 द्वारा भारत के राजपत्र, असाधारण , भाग 2 , खंड 3 , उपखंड ( i ) , तारीख 19 अगस्त, 2011 द्वारा प्रकाशित किया गया था । उनसे प्रभावित होने की संभावना वाले सभी व्यक्तियों से उस तारीख से पैंतालीस दिनों की अवधि के भीतर जिसको उस राजपत्र की प्रतियां जिसमें यह अधिसूचना प्रकाशित की गई है, जनता को उपलब्ध करा दी जाती हैं, आक्षेप और सुझाव आमंत्रित किए गए थे ;
और उक्त राजपत्र अधिसूचना की प्रतियां जनता को 19 अगस्त, 2011 को उपलब्ध करा दी गई थीं ;
और केन्द्रीय सरकार ने उक्त प्रारूप नियमों की बाबत जनता से प्राप्त आक्षेपों और सुझावों पर विचार कर लिया है ;
अतः अब केन्द्रीय सरकार मोटर यान अधिनियम, 1988 ( 1988 का 59) की धारा 110 की उपधारा (1 ) के खंड ( च) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए केन्द्रीय मोटर यान नियम, 1989 का और संशोधन करने के लिए निम्नलिखित नियम बनाती है, अर्थात् : -

1. ( 1 ) इन नियमों का संक्षिप्त नाम केन्द्रीय मोटर यान (चौथा संशोधन) नियम, 2012 है ।
(2) ये 1 अप्रैल, 2014 से प्रवृत्त होंगे ।
2. केन्द्रीय मोटर यान नियम , 1989 के नियम 118 के स्थान पर निम्नलिखित नियम रखा जाएगा, अर्थात् : -
" 118. स्पीड गवर्नर ( 1 ) इसमें अन्यथा उपबंधित के सिवाए मोटर यान अधिनियम , 1988 (1988 का 59) की धारा 41 की उपधारा (4) के अधीन अधिसूचित सभी किस्म के और 1 अप्रैल, 2014 से विनिर्मित सभी परिवहन यानों को स्पीड गवर्नर से सुसज्जित किया जाएगा या उसमें स्पीड गवर्नर लगाया जाएगा ( स्पीड सीमित करने की युक्ति या स्पीड सीमित करने का कृत्य) जिसकी पूर्व में वाहन विनिर्माता द्वारा विनिर्माण के प्रक्रम पर या डिलरशिप प्रक्रम पर समय - समय पर यथासंशोधित एआईएस: 018/2001 मानक के अनुसार सेट की गई 80 किलोमीटर प्रतिघंटा की गति होगी:
परंतु यह कि उपनियम (1 ) में यथाविनिर्दिष्ट तारीख से पूर्व रजिस्ट्रीकृत और राजपत्र में राज्य सरकार द्वारा अधिसूचित किए गए परिवहन यान , जिनमें स्पीड सीमित करने की युक्ति या स्पीड सीमित करने का कृत्य नहीं लगाया गया है को ऐसे परिवहन यान के प्रचालक द्वारा ऐसे स्पीड गवर्नर या स्पीड सीमित करने के कृत्य से सुसज्जित किया जाएगा जिसकी समय - समय पर यथासंशोधित एआईएस : 018/2001 मानक के अनुसार 80 किलोमीटर प्रतिघंटा की गति होगी :
परंतु यह और कि ऐसे यान जो निम्नलिखित परिवहन प्रवर्ग के हैं, -
(i) दोपहिया ;
(ii ) तिपहिया ;
(iii) कम से कम चार पहियों वाले ऐसे यान जिनका उपयोग यात्रियों और उनके सामान को ले जाने के लिए किया जाता है जिनका सकल यान भार 3500 किलोग्राम से अधिक नहीं है ;
(iv) जब तक भारतीय मानक ब्यूरो अधिनियम , 1986 (1986 का 63) के अधीन तत्स्थानी बीआईएस मानकों को अधिसूचित नहीं किया जाता है, कम से कम चार पहियों वाले यान जिनका उपयोग माल के परिवहन के लिए किया जाता है जो समय - समय पर यथासंशोधित एआईएस 053-2005 के पैरा 3.2 में विनिर्दिष्ट शर्तों के अधीन रहते हुए माल के अतिरिक्त व्यक्तियों को भी ले जा सकते हैं जिनका सकल यान भार 3500 किलोग्राम से अधिक नहीं है ;
(v) अग्निशामक ;
(vi) एम्बुलेंस ;
(vii) पुलिस यान ;

(viii) राज्य परमिट या राष्ट्रीय माल परमिट या अखिल भारतीय पर्यटक परमिट पर प्रचालन कर रहे यान ; और
(ix) वे परिवहन यान जिनकी अधिकतम तय की गई स्पीड 80 किलोमीटर प्रतिघंटा की पूर्व सेट की गई स्पीड से अधिक नहीं है,
से ऐसे स्पीड गवर्नर प्रतिष्ठापित करने की अपेक्षा नहीं है (स्पीड सीमित करने की युक्ति या स्पीड सीमित करने का कृत्य) ।
(2) लागू होने वाले सभी यानों पर स्पीड सीमित करने की युक्ति, यथास्थिति, विनिर्माता या डीलर या प्रचालक द्वारा ऐसी रीति में लगाई जाएगी जिससे उक्त युक्ति को राज्य परिवहन प्राधिकरण या किसी प्रादेशिक परिवहन प्राधिकरण द्वारा शासकीय मुद्रा से उसे सील किया जा सके जिससे उसे हटाया या उसे तोड़े बिना उससे छेड़छाड़ न की जा सके :
परंतु यह कि ऐसे परिवहन यान जो स्पीड सीमित करने के कृत्य से सुसज्जित हैं या उसमें स्पीड सीमित करने का कृत्य है जैसा कि एआईएस 018/2001 के खंड 3.4 में विनिर्दिष्ट हैं, जो एक इलैक्ट्रानिकी नियंत्रण इकाई के माध्यम से स्पीड को नियंत्रित करता है, को सील करने की अपेक्षा नहीं है ।
(3) स्पीड गवर्नर ( स्पीड सीमित करने की युक्ति या स्पीड सीमित करने का कृत्य) को ऐसे सेट किया जाएगा जिससे यान, यान की पूर्व सेट की गई अधिकतम स्पीड से अधिक पर चालन में अक्षम हो सिवाए -
(i) ढाल पर नीचे की ओर ; या
( ii) एआईएस 018/2001 के खंड 5.7.3.4.2 में यथाविनिर्दिष्ट ।
स्पष्टीकरण. - इस नियम के प्रयोजन के लिए यह स्पष्ट किया जाता है कि केन्द्रीय मोटरयान (चौथा संशोधन) नियम 2012 के प्रारंभ होने की तारीख से ही यह नियम राज्य सरकारों द्वारा स्पीड गवर्नरों के संबंध में जारी राज्य सरकारों के द्वारा जारी अधिसूचनाओं पर अभिभावी होगा ।

NOTIFICATION
New Delhi , the 31st December , 2012
G.S.R. 943(E ) .- Whereas the draft rules further to amend the Central Motor Vehicles Rules, 1989 were published , as required under sub- section (1 ) of section 212 of the Motor Vehicles Act, 1988 ( 59 of 1988 ) , vide notification of the Government of India in the Ministry of Road Transport and Highways number G.S.R € 31 ( E ) , dated the 19th August, 2011 in the Gazette of India , Extraordinary, Part II , section (3 ), Sub- section (i ) , inviting objections and suggestions from all persons likely to be affected thereby before the expiry of the period of forty five days from the date on which copies of the Gazette containing the said notification were made available to the public;
And, whereas , copies of the said Gazette notification were made available to the public on the 19th August , 2011 ;
And whereas , the objections and suggestions received from the public in respect of the said draft rules have been considered by the Central Government;
Now, therefore, in exercise of the powers conferred by clause ( f) of sub-section (1) of section 110 of the Motor Vehicles Act, 1988 (59 of 1988) , the Central Government hereby makes the following rules further to amend the Central Motor Vehicles Rules, 1989, namely: -
1. (1 ) These rules may be called the Central Motor Vehicles ( Fourth Amendment ) Rules , 2012.
(2) They shall come into force with effect from the 1st day of April , 2014.

2. In the Central Motor Vehicles Rules , 1989, for rule 118, the following ruleshall be substituted, namely: -
"118.Speed governor.- ( 1 ) All types of transport vehicles notified by the Central Government under sub- section (4) of section 41 of the Motor Vehicles Act, 1988 (59 of 1988) save as provided herein , and manufactured with effect from the 1st April , 2014 shall be equipped or fitted with a speed governor ( speed limiting device or speed limiting function) with a maximum pre- set speed of 80 kilometer per hour by the vehicle manufacturer in the manufacturing stage or at the dealership stage, conforming to the Standard AIS: 018/2001, as amended from time to time:
Provided that the transport vehicles registered prior to. the date specified in sub - rule (1) and as may be notified by the State Governments in their Official Gazette, if not already. fitted with a speed limiting device or speed limiting function , shall be equipped, or fitted by the operator of such transport vehicle with a speed governor or speed limiting function having maximum pre - set speed of 80 kilometer per hour , conforming to the Standard AIS : 018/2001 , as amended from time to time:
Provided further that transport category vehicles that are,
(i) two wheelers;
( ii) three wheelers;
( iii ) vehicles with at least four wheels used for the carriage of passengers and their luggage, not exceeding 3500 kilogram gross vehicle weight;
( iv) vehicles with at least four wheels used for carrying goods which may also carry persons in addition to the goods subject to the conditions specified in para 3.2 of 4864 95712-2 [PART II-SEC . 3 (i) ]

AIS 053-2005 , as amended from time to time , till the corresponding BIS specifications are notified under the Bureau of Indian Standards Act, 1986 (63 of 1986) not exceeding 3500 kg gross vehicle weight;
(v) firetenders;
(vi ) ambulances;
(vii ) police vehicles ;
(viii ) vehicles operating on State permit or National ,Goods Permit of All India Tourist Permit; and
(xi ) those transport vehicles whose maximum rated speed does not exceed the pre- set speed of 80 kilometer perhour,
need not require installation of such speed governor ( speed limiting deviceor speed limiting function ) .
(2) The speed limiting device on all applicable vehicles shall be fitted by the manufacturer or the dealer or the operator , as the case may be , in such a manner that the said device can be sealed with an official seal of the State Transport Authority or a Regional Transport Authority so that it cannot be removed or tampered with without breaking the seal:
Provided that the transport vehicles which are equipped or fitted with a speed limiting function , as specified in clause 3.4 ofAIS 018/2001, which controls the speed of vehicles by an electronic control unit, shall not require to be sealed.
(3) The speed governor (speed limiting device or speed limiting function ) shall be so set that the vehicle is incapable of being driven at a speed inexcess of the maximum pre - set speed of the vehicle, except -

( ii) asspecified in clause 5.7.3.4.2 of AIS 018/2001 .
Explanation.- For the purpose of this rule , it is clarified that on and from the date of commencement of the Central Motor Vehicles ( Fourth Amendment ) Rules, 2012, this rule shall prevail over all notifications issued by the State Governments in respect of speed governors ."
