का.आ. 4(अ).-केन्द्रीय सरकार ने, भारतीय राष्ट्रीय राजमार्ग प्राधिकरण अधिनियम, 1988(1988 का 68) की धारा 11 के अधीन जारी की गई भारत सरकार के तत्कालीन भूतल परिवहन मंत्रालय ( सड़क खंड ) की अधिसूचना संख्या का. आ. 78 (अ) , तारीख 4 फरवरी , 1999, का.आ.सं. 1192 (अ) , तारीख 3 दिसम्बर, 2001 और का.आ.सं. 920 (अ) , तारीख 28 अगस्त, 2002 द्वारा राजस्थान राज्य में राष्ट्रीय राजमार्ग संख्या 8 के 0.000 कि.मी. से 388.000 कि.मी. ( अजमेर से राजस्थान / गुजरात सीमा ) तक , गुजरात राज्य में राष्ट्रीय राजमार्ग संख्या 8 के 388.000 कि.मी से 516.000 कि.मी ( राजस्थान / गुजरात सीमा से अहमदाबाद ) तक राजस्थान राज्य में राष्ट्रीय राजमार्ग संख्या - 76 के 114.000 कि.मी से 220.000 कि.मी. ( चितौडगढ़ से उदयपुर ) तक और राष्ट्रीय राजमार्ग संख्या - 76 के 6.000 कि.मी. से 17.000 कि.मी. ( उदयपुर बाईपास ) तक राजस्थान राज्य में क्रमशः राष्ट्रीय राजमार्ग संख्या 79 और राष्ट्रीय राजमार्ग संख्या 79 ए के 14.000 कि.मी. से 182.000 कि.मी. तक ( नसीराबाद से चितौडगढ़ ) तक का खण्ड भारतीय राष्ट्रीय राजमार्ग प्राधिकरण ( जिसे इसमें इसके पश्चात् "प्राधिकरण " संदर्भित किया गया है ) को सौंपा है ;
और , केन्द्रीय सरकार ने , राष्ट्रीय राजमार्ग ( राष्ट्रीय राजमार्गों के खंडों और स्थायी पुल के उपयोग के लिए शुल्क - सार्वजनिक वित्तपोषित परियोजनाए) नियम, 1997, राष्ट्रीय राजमार्ग ( शुल्क की दर) नियम , 1997 और राष्ट्रीय राजमार्ग शुल्क (दरों का अवधारण और संग्रहण) नियम, 2008 के साथ पठित राष्ट्रीय राजमार्ग अधिनियम, 1956(1956 का 48) की धारा 7 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए भारत सरकार की अधिसूचना द्वारा प्राधिकरण को इन खण्डों के उपयोग के लिए यांत्रिक वाहनों पर , निम्न प्रकार से, शुल्क उद्ग्रहीत करने एवं संग्रहीत करने के लिए प्राधिकृत किया है ;

(i) राष्ट्रीय राजमार्ग संख्या- 79 के का.आ.सं. 2049 (अ) , तारीख राजस्थान राज्य में राष्ट्रीय राजमार्ग संख्या 79 ए पर 0.000 कि.मी से 35.000 कि.मी और 15.000 कि.मी से 81.000 कि.मी तक के खण्ड हेतु 23 अगस्त 2012 द्वारा

(iv) राजस्थान राज्य में राष्ट्रीय राजमार्ग संख्या 76 पर 113.830 कि.मी. से 213.000 कि.मी. तक के खण्ड हेतु का.आ.सं. 1930 (अ) , तारीख 21 अगस्त 2012 द्वारा
(v) राजस्थान राज्य में राष्ट्रीय राजमार्ग संख्या 8 पर 278.000 कि.मी. से 348.000 कि.मी. तक के खण्ड हेतु का.आ.सं. 1714 (अ) , तारीख 26 जुलाई 2012 द्वारा
(vi) राजस्थान और गुजरात राज्य में राष्ट्रीय राजमार्ग संख्या 8 पर 348.00 कि.मी से 388.180 कि.मी. तक के खण्ड हेतु का.आ.सं. 2623 (अ ), तारीख 30 अक्तूबर 2012 द्वारा
(vii ) गुजरात राज्य में राष्ट्रीय राजमार्ग संख्या 8 पर 388.180 कि.मी से 443.000 कि.मी. तक के खण्ड हेतु का.आ.सं. 2922 (अ) , तारीख 17 दिसम्बर 2012 द्वारा
(viii) गुजरात राज्य में राष्ट्रीय राजमार्ग संख्या 8 पर 443.000 कि.मी से 495.000 कि.मी. तक के खण्ड हेतु का.आ.सं. 2923 (अ) , तारीख 17 दिसम्बर 2012 द्वारा
और , भारतीय राष्ट्रीय राजमार्ग प्राधिकरण अधिनियम, 1988 (1988 का 68) की धारा 14 के गुजरात राज्य में डिजाईन, निर्माण, वित्त, प्रचालन ए के 0.830 कि.मी. (डिजाईन चैनेज 0.000 कि.मी. ( डिजाईन चैनेज 555.480 कि.मी ) तक प्रावधान के अनुसरण में प्राधिकरण ने राजस्थान और हस्तांतरण आधार पर राष्ट्रीय राजमार्ग संख्या 79 कि.मी ) से राष्ट्रीय राजमार्ग संख्या 8 के 509.295 किशनगढ़ - उदयपुर अहमदाबाद खण्ड (जिसे इसमें इसके पश्चात् " उक्त खण्ड " कहा गया है) का छह लेन में विकास करने हेतु 29 जुलाई 2011 में प्रस्तुत बोलियों के सफल बोलीदाता मैसर्स जीएमआर किशनगढ़ - उदयपुर अहमदाबाद एक्सप्रेसवे लिमिटेड , जिसका पंजीकृत कार्यालय चौथा तल , बिरला टावर , 25 बाराखम्भा रोड , नई दिल्ली 110001 में है (जिसे इसमें इसके पश्चात् "रियायतग्राही " कहा गया है ) के साथ एक करार (जिसे इसमें इसके पश्चात् उक्त करार कहा गया है) किया है ;
अतः अब, केन्द्रीय सरकार, राष्ट्रीय राजमार्ग शुल्क (दरों का अवधारण एवं संग्रहण) नियम , 2008 जिसे सा.का.नि. संख्या 838 (अ ) , दिनांक 5 दिसम्बर 2008 के तहत प्रकाशित किया गया था और जिसे सा.का.नि.. 950 (अ) दिनांक 3 दिसम्बर 2010, सा.का.नि. 15 (अ) , दिनांक 12 जनवरी 2011 और सा.का.नि.. 756 (अ) , दिनांक 12 अक्टूबर 2011 द्वारा संशोधित किया गया था ( जिसे इसमें इसके पश्चात् "नियम " संदर्भित किया गया है ) के नियम 3 के साथ पठित राष्ट्रीय राजमार्ग अधिनियम, 1956 (1956 का 48) की धारा 8 क द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और अधिसूचना संख्या का.आ. 2049 (अ) , तारीख 23.08.2012 का.आ.1783 (अ) , तारीख 09.08.2012, का.आ. 3289 (अ) , तारीख 24.12.2009 , का.आ. 1930 (अ), तारीख 21.08.2012 , का.आ. 1714 (अ) , तारीख 26.07.2012 , [ भाम II-खण्ड 3 (ii ) ]

का.आ.2623 (अ) , तारीख 30.10.2012 , का.आ.2922 (अ) , तारीख 17.12.2012 और का.आ.2923 (अ) , तारीख 17.12.2012 का अधिक्रमण करते हुए , सिवाए उन बातों के जो ऐसे अधिक्रमण से पहले कर ली गई हैं या करने से लोप करा दी गई हैं, उक्त खंड के निर्माण , अनुरक्षण , प्रचालन में व्यय विनिहित पूंजी पर ब्याज, युक्तियुक्त प्रत्यागम , यातायात परिमाण तथा प्राधिकरण और रियायतग्राही के बीच हुए ऐसे करार की अवधि को ध्यान में रखतें हुए एतत्द्वारा अधिसूचित करती है कि राष्ट्रीय राजमार्ग 79ए के 0.830 कि.मी. से 36.100 कि.मी. राष्ट्रीय राजमार्ग 79के 15.000 कि.मी. से 164.000 कि.मी. ( विद्यमान चितौड़गढ़ बाइपास का प्रारम्भ ( 29,600 कि.मी. ) राष्ट्रीय राजमार्ग 76 के 213.000 कि.मी (चितौड़गढ़ बाइपास की समाप्ति ) से 117.500 कि.मी. ( प्रस्तावित उदयपुर बाईपास की समाप्ति ) से अहमदाबाद के निकट राष्ट्रीय राजमार्ग 8 का 509.295 कि.मी. ( विद्यमान चैनेज ) अर्थात् 0.000 कि.मी. से डिजाईन चैनेज के 555.480 कि.मी तक सड़क खण्ड की निवल लम्बाई 531.66 कि.मी. के लिए नीचे सारणी 1 और 2 में निर्दिष्ट प्रकार के वाहनों पर पचास करोड़ रुपए या अधिक की लागत वाले पुलों/ संरचनाओं पर सारणी 1 के स्तंभ (2) में निर्दिष्ट दरों पर ( जिसे इसमें इसके पश्चात् " आधार दर " संदर्भित किया गया है ) और 10 करोड़ या अधिक की लागत वाले बाइपासों पर चार या अधिक लेन के खण्डों के उपयोग के लिए आधार दर के डेढ़ गुना की दर पर शुल्क लगाया और संग्रहीत किया जाएगा और उक्त रियायतग्राही को वाणिज्यिक प्रचालन की तारीख या इस अधिसूचना के राजपत्र में प्रकाशन की तारीख से , जो भी बाद में हो , करार में निर्दिष्ट समापन की तारीख तक, शुल्क संग्रहीत तथा प्रतिधारित करने के लिए प्राधिकृत करती है ;

3. उपर्युक्त के अतिरिक्त, निम्नलिखित पुलों / बाइपास / संरचनाओं के उपयोग हेतु ( बाइपास के पूरा हो जाने के पश्चात् ) जिनकी लागत नीचे निर्दिष्ट की गई है, निम्नलिखित टोल प्लाजा ( प्लाजाओं ) पर निम्नलिखित शुल्क शोध्य और संदेय होगा:
पथकर प्लाजा ( प्लाजाओं ) का स्थान ( चैनेज) पुल/ संरचना, जिसके लिए अतिरिक्त शुल्क संदेय है की लम्बाई (कि.मी. में) और लागत (करोड़ रूपए में)

4. जहां तक क्रमश : 50 करोड़ रुपए या उससे अधिक तथा 10 करोड़ रुपए या उससे अधिक के पुलों और बाइपासों का संबंध है , जैसा कि ऊपर टिप्पणी 2 और 3 में निर्दिष्ट किया गया है, उनपर उदग्रहीत शुल्क ऐसे बाइपासों और संरचनाओं का काम पूरा हो जाने के पश्चात् ही शोध्य और संदेय होगा ।
5. जिस व्यक्ति का अपना यांत्रिक वाहन गैर टोल प्लाजा से 20 कि.मी. के भीतर रहता हो दर 200.00 रूपए (दो सौ रुपए मात्र) प्रतिमाह संग्रहण) नियम, 2008 के उपबंधों के अनुसार, उसमें प्रत्येक वर्ष संशोधन किया जायेगा । वाणिज्यिक प्रयोजनों के लिए पंजीकृत हुआ हो और वह उसके लिए वर्ष 2012-13 के लिए मासिक पास की होगी और राष्ट्रीय राजमार्ग फीस (दरों का अवधारण औरं
6. राजमार्ग खंड पर बहुयात्राओं के लिए पास निम्नलिखित दरों पर प्रदान किये जाएंगे , अर्थात्:-

7. जिस जिले में शुल्क प्लाजा पड़ता है उस जिले में पंजीकृत वाणिज्यिक वाहन (राष्ट्रीय परमिट के अधीन चल रहे वाहनों को छोड़कर) के लिए शुल्क उस श्रेणी के वाहन के लिए निर्धारित शुल्क का 50% होगा बशर्ते कि ऐसे वाणिज्यिक वाहनों के उपयोग के लिए कोई सर्विस रोड अथवा वैकल्पिक सड़क मार्ग उपलब्ध न हो ।

8. जो यांत्रिक वाहन नियमों के अधीन अपने प्रवर्ग के लिए निर्धारित अनुज्ञेय भार की अपेक्षा अधिक भार से लदे हुए होंगे उन्हें उन दरों पर शुल्क का संदाय करना होगा जो उनसे अगली उच्च श्रेणी के वाहनों के लिए लागू होता है और उन्हें तब तक राजमार्ग खण्ड का उपयोग करने का अधिकार नहीं होगा जब तक कि ऐसे यांत्रिक वाहन से अधिक भार को हटा न दिया जाए ।
9. यांत्रिक वाहनों के प्रवर्ग , उनके लिए अनुज्ञेय भार छूट प्राप्त वाहनों के प्रवर्ग , सर्विस रोड, वैकल्पिक सड़क आदि सहित सभी परिभाषाएं नियमों में विनिर्दिष्ट परिभाषाओं के अनुसार होंगी ।
10. उक्त नियमों के नियम 12 के अनुसार, उपयोगकर्ताओं की जानकारी के लिए शुल्क की दरों को प्रदर्शित किया जाएगा ।
11. ऊपर सारणी 1 और 2 में यथा उल्लेखित आधार वर्ष 2007-08 के लिए प्रति कि.मी. की आधार दरों के आधार पर , यांत्रिक वाहनों से लिए जानेवाले वास्तविक शुल्क और कटौतियों की गणना प्राधिकरण द्वारा की जाएगी और उसमें उक्त नियमों के नियम 5 के. अनुसार वार्षिक आधार पर संशोधन किया जायेगा परन्तु शर्त यह है कि छह महीने के अन्दर कोई संशोधन नहीं किया जाएगा तथा उसे तदनुसार कम-से-कम अंग्रेजी और स्थानीय भाषा के एक- एक समाचारपत्र में प्रकाशित किया जाएगा ।

S.O. 4(E) .- Whereas by notification of the Government of India in the erstwhile Ministry of Shipping Road Transport and Highway number S.O. 78 (E) , dated the 4th February , 1999, S.O. 1192 (E) , dated the 3rd December, 2001 and S.O. 920 ( E) , dated the 28th August, 2002 issued under section 11 of the National Highways Authority of India Act , 1988 ( 68 of 1988) , the Central Government has entrusted the stretch from kilometer 0.000 to kilometer 388.000 (Ajmer to Rajasthan / Gujarat Border) of National Highway Number 8 in the State of Rajasthan , from kilometer 388.000 to kilometer 516.000 ( Rajasthan / Gujarat Border to Ahmedabad) of National Highway Number 8 in the State of Gujarat ; from kilometer 114.000 to kilometer 220.000 ( Chittorgarh to Udaipur) of National Highway Number 76 and from kilometer 6.000 to kilometer 17.000 ( Udaipur Bypass) of National Highway Number 76 in the State of Rajasthan , from kilometer 14.000 to kilometer 182.000 (Nasirabad to Chittorgarh) of National Highway Number 79 in the State of Rajasthan and National Highway Number - 79A respectively to the National Highways Authority of India ( hereinafter referred to as the " Authority" ) ;
And whereas , in exercise of the powers conferred by section 7 of the National Highway Act 1956 ( 48 of 1956) read with National Highways ( Fees for the Use of National Highways Section and Permanent Bridge Public Funded Project ) Rules , 1997, National Highways ( Rate of Fee) Rules , 1997 and National Highway Fee (Determination of Rates and Collection) Rules 2008 , the Central Government by notification of the Government of India authorized Authority for levying and collecting fee on mechanical vehicles for the use of stretches as follows :
(i) Vide S.O. No. 2049 (E) dated 23rd August , 2012 for the stretch from km. 0.000 to km . 35.000 on NH - 79A and section from km . 15.000 to km . 81.000 on the NH-79 in the State of Rajasthan.

(ii) Vide S.O. No. 1783 (E) dated 9th August, 2012 for the stretch from km. 81.000 to km . 163.900 on NH - 79 in the State of Rajasthan .
( iii) Vide S.O. No. 3289 (E) dated 24th December, 2009 for the stretch from km. 159.000 to km 168.500 of NH - 79 , taking off at km 168.500 of NH - 79 and merging at km 213.000 of NH - 76 in the State of Rajasthan.

(vi) Vide S.O. No. 2623 ( E) dated 30th October , 2012 for the stretch from km. 348.00 to km. 388.180 on NH - 8 in the States of Rajasthan and Gujarat .
(vii) Vide S.O. No. 2922 ( E) dated 17th December, 2012 for the stretch from km. 388.180 to km . 443.000 on NH - 8 in the State of Gujarat .
(viii) Vide S.O. No. 2923 (E) dated 17th December , 2012 for the stretch from km. 443.000 to km . 495.000 on NH - 8 in the State of Gujarat .
And whereas , pursuant to the provision of section - 14 of the National Highways Authority of India Act ( 68 of 1988) the Authority has entered into an Agreement (hereinafter referred to as said Agreement) with M/ s GMR Kishangarh Udaipur Ahmedabad Expressways Limited, having its registered office at 4th Floor, Birla Tower , 25, Barakhamba Road , New Delhi 11001 , India ( hereinafter referred to as the " Concessionaire " ) , the successful bidder for bids submitted on 29th July, 2011 for the development of six laning of Kishangarh Udaipur Ahmedabad Section from kilometer 0.830 of NH- 79A ( Design Chainage- 0.000 ) to kilometer 509.295 of NH -8 ( Design Chainage -555.480 ) ( hereinafter referred to as the " said section") in the state of Rajasthan and Gujarat on Design , Build , Finance , Operate and Transfer (DBFOT) basis ;
Now, therefore , in exercise of the powers conferred by section 8A of the National Highways Act, 1956 (48 of 1956) , read with rule 3 of the National Highways Fee (Determination of Rates and Collection ) Rules , 2008 published vide G.S.R 838 ( E) dated 5th December, 2008 and amended vide G.S.R 950 ( E) dated 3rd December , 2010 , G.S.R 15(E) dated 12th January, 2011 ( hereinafter referred to as the " Rules" ) , and in supersession of the notification bearing No. S.O. 2049 (E) dated 23.08.2012 , S.O. 1783 ( E) dated 09.08.2012 , S.O. 3289 ( E) dated 24.12.2009 , S.O. 1930 (E) dated 21.08.2012 , S.O. 1714 (E) dated 26.07.2012 , S.O. 2623 (E) dated 30.10.2012 , S.O. 2922( E) dated 17.12.2012 , and S.O. 2923( E) dated 17.12.2012 except as respects things done or omitted to be done before such supersession , the Central Government , having regard to the expenditure involved in building , maintenance , management and operation of the said section , interest on the capital invested , reasonable return , the volume of traffic and the period of the Agreement entered into between the Authority and the Concessionaire , hereby notifies that there shall be levied and collected fees on mechanical vehicles for the use of the section from km . 0.830 to km . 36.100 of NH - 79A, from km . 15.000 to km 164.000 ( start of existing Chittorgarh bypass ) , existing Chittorgarh bypass (29.600 km) of NH - 79 , from km 213.000 of NH- 76 (end of existing Chittorgarh bypass ) to km 117.500 ( start of proposed Udaipur bypass ) , proposed Udaipur bypass (24.500 km) of NH - 76 and from km 287.000 (end of proposed Udaipur bypass ) to km 509.295 ( existing Chainage) of NH- 8 near Ahmedabad i.e. from km . 0.000 to km. 555.480 of the design chainage at the rate specified in columns (2) of the Table 1 for net road section 531.66 km for use of the four and more lane sections ( hereinafter referred to as " base rate " ) and at the base rates specified in the Table No.2 for bridges/ structures costing Rupees 9

Fifty Crore or more and at one and half times the base rate for bypasses costing Rupees ten crore or more on the Type of Vehicles specified in Table 1 and 2 below and authorizes the said Concessionaire to collect and retain the fee on and from the date of commercial operation or publication of this notification in the Official Gazette , whichever is later , till the termination date as specified in the agreement .

4. As regards bridges and bypasses costing Rs . 50 crore or more and costing Rs . 10 crore or more respectively as specified in Note 2 and 3 above , the fee levied shall be due and payable only after completion of such bypasses and structures .

5. The rate of monthly pass for a person who owns a mechanical vehicle registered for non- commercial purposes and resides within a distance of twenty kilometers from the toll plaza is Rs . 200.00 (Rupees Two Hundred only) for the year 2012-13 which is subject to revision every year as per the provisions of the National Highways Fee (Determination of Rates and Collection ) Rules , 2008.
6. For multiple journeys on the highway section , passes shall be issued at the following rates , namely .

7. Fee for commercial vehicle (excluding vehicles plying under national permit ) registered in the district where the fee plaza falls shall be 50% of the prescribed rate for that category of vehicle provided no service road or alternative road is available for use of such commercial vehicles .
8. Mechanical vehicles which is loaded in excess of permissible load specified for its category under the Rules , shall be liable to pay fee at such rates which is applicable for the next higher category of the vehicles and shall not be entitled to make use of the highway section unless the excess load has been removed from such mechanical vehicle .
9. All definitions including category of mechanical vehicles , its permissible load, category of exempted vehicles , service road , alternative road etc. shall be as per definitions specified in the Rules .
10. The fee rates shall be displayed for information of the users in accordance with rules 12 of the said Rules .
11. Based on the Base rate of fee per km for the base year 2007-08 as mentioned in Table- 1 & 2 , the actual amount of fee to be charged from the mechanical vehicles and the discounts will be calculated by the Authority and revised annually in accordance with the rule 5 of the said rules provided that no revision shall be effected within six months and the same shall be published in at least one newspaper , each in English and vernacular language accordingly .
