" परंतु ये नियम अधिकरण के अध्यक्ष या सदस्य के रूप में नियुक्त उच्च न्यायालय के आसीन न्यायाधीश पर लागू नहीं होंगे और ऐसा अध्यक्ष या सदस्य संविधान के अनुच्छेद 217 के उपबंधों द्वारा तब तक शासित होता रहेगा जब तक वह उच्च न्यायालय के न्यायाधीश का पद धारण करता रहेगा ।"
4. मूल नियम के नियम 3 के उप- नियम ( 1 ) में ,
सा.का.नि. 2 (अ).-केंद्रीय सरकार , प्रशासनिक अधिकरण , 1985 ( 1985 का 13 ) की धारा 35 की उप- धारा ( 1 ) और उप- धारा ( 2 ) के खंड 9 ( ख ) के साथ पठित धारा 9 की उप - धारा ( 3 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , प्रशासनिक अधिकरण (अध्यक्ष, उपाध्यक्ष और अन्य सदस्यों के कदाचार या असमर्थता के अन्वेषण के लिए प्रक्रिया ) नियम , 2000 का और संशोधन करने के लिए निम्नलिखित नियम बनाती है , अर्थात :-
(क) खंड ( ग ) में , " उपाध्यक्ष " शब्दके स्थान पर , " सदस्य" शब्द रखा जाएगा;
( ख ) खंड ( च) में , " या उपाध्यक्ष " शब्दों का लोप किया जाएगा;
1. संक्षिप्त नाम इन नियमों का नाम प्रशासनिक अधिकरण (अध्यक्ष और अन्य सदस्यों के कदाचार या असमर्थता के अन्वेषण के लिए प्रक्रिया ) संशोधन नियम , 2013 है ।
(ग) खंड ( छ ) में, " और उपाध्यक्ष " शब्दों का लोप किया जाएगा;
2. प्रशासनिक अधिकरण ( अध्यक्ष , उपाध्यक्ष और अन्य सदस्यों के कदाचार या असमर्थता के अन्वेषण के लिए प्रक्रिया) . नियम , 2000 ( जिसे इसमें इसके पश्चात् मूल नियम कहा गया है ) के नियम 1 के उपनियम ( 1 ) में " उपाध्यक्ष " शब्द का लोप किया जाएगा ।
(घ) खंड ( ञ ) का लोप किया जाएगा । [फा. सं. ए-11013/8/2012 - ए.टी . ] मनोज जोशी , संयुक्त सचिव 3. मूल नियम के नियम 2 में, -
(क) " उपाध्यक्ष" शब्द का लोप किया जाएगा; और

NOTIFICATION
New Delhi , the 1st January, 2013
G.S.R. 2(E) . In exercise of powers conferred by sub- section (3 ) of Section 9 read with sub- section (1) and clause (b ) of sub - section (2) of Section 35 of theAdministrative Tribunals Act, 1985 ( 13 of 1985), the Central Government hereby makes the following rules further to amend the Administrative Tribunals (Procedure for investigation of misbehaviour or incapacity of Chairmen, Vice-Chairmen and other Members) Rules , 2000 namely:--
1. Short title . These rules may be called the Administrative Tribunals ( Procedure for investigation of misbehaviour or incapacity of Chairmen and other Members ) Amendment Rules, 2013 .
2. In the Administrative Tribunals ( Procedure for investigation of misbehaviour or incapacity of Chairmen , Vice-Chairmen and other Members ) Rules, 2000 ( hereinafter referred to as the principal rules) , in sub -rule ( 1 ) of rule 1 , the word "Vice-Chairmen " shall be omitted.
3. Inthe principal rules , in rule 2,-
(a) the word "Vice-Chairman " shall be omitted; and
(b) the following proviso shall be inserted , namely:-
"Provided that these rules will not apply to sitting judge of the High Court appointed as Chairman or Member of the Tribunal and such Chairman or Member would continue to be governed by the provisions of article 217 of the Constitution till he would have held the officeof Judge of the High Court . "
4. In the Principal rules , in rule 3, in sub-rule ( 1 ) .-
(a) in clause (c) , for the word "Vice-Chairman" , theword "Member " shall be substituted;
(b) in clause ( f) , the words " or a Vice- Chairman" , shall be omitted ;
(c) in clause ( g ) , the words " and a Vice- Chairman" shall be omitted;
(d) clause(j ) , shall be omitted .
