का.आ. 42(अ).-वाणिज्यिक पोत परिवहन अधिनियम , 1958 (1958 का 44) की धारा 150 द्वारा प्रदत्त शक्तियों का उपयोग करते हुए और भारतीय नौवहन निगम बनाम फारवर्ड सीमैन्स यूनियन ऑफ इंडिया ( एफ एस यू आई ) तथा अन्य के मामले में वर्ष 2012 की रिट याचिका सं. 576 में बंबई स्थित न्यायालय , माननीय उच्च न्यायालय द्वारा पारित किए गए फैसले के अनुसरण में , केन्द्र सरकार एतद्वारा पोत स्वामियों और एफ एस यू आई ट्रिब्यूनल के बीच निम्नलिखित विवाद के निपटारे के लिए एक ट्रिब्यूनल का गठन करती है :-
S.O. 42 (E ). In exercise of the powers conferred by Section 150 of the Merchant Shipping Act , 1958 ( 44 of 1958) and in pursuance of the Judgment passed by the Hon'ble High Court of Judicature at Bombay in W.P. No. 576 of2012 in the matter of Shipping Corporation of India V/sForward Seamen's Union of India (FSUI) and others , the Central Government hereby constitutes a Tribunal for referring the following dispute between the Ship owners and FSUI :-
( i ) क्या इंडियन नैशनल शिपओनर्स एसोसिएशन ( आई एन एस ए ) और नैशनल यूनियन ऑफ सीफेयरर्स ऑफ इंडिया ( एन यू एस आई ) के बीच राष्ट्रीय समुद्री बोर्ड ( एन एम बी ) प्लेटफॉर्म पर 24/02/2012 को हुआ समझौता , जिसे एन एम बी प्लेटफॉर्म के अध ीन रहने का दावा किया गया है , एफ एस यू आई के सदस्यों सहित सभी कामगारों पर बाध्यकारी होगा ।
( ii ) यदि हाँ, तो ट्रिब्यूनल द्वारा क्या आदेश किया जाना है ?
( iii ) यदि नहीं , तो क्या एफ एस यू आई की दिनांक 28-4-2010 को की गई माँग न्यायोचित और उचित है और क्या उसे मान लिया जाना चाहिए ?
(i) whether the settlement dated 24/02/2012 reached between Indian National Ship - owners' Association (INSA) and National Union of Seafarers of India (NUSI ) on National Maritime Board (NMB) platform, which is claimed to have been under the NMB platform is binding on all workmen including members of FSUI ?

(ii) ifyes , what order is to be made by the Tribunal ?
( iii) ifno , whether demands of FSUI dated 28-4-2010 is just and proper and should be granted ?
3. The tribunal shall dispose of the reference expeditiously and submit its award to the Central Government within 3 months from the date of issue of notification of this Order,
