सं. टीएएमपी/47/2011-वीपीटी. महापत्तन न्यास अधिनियम , 1963 ( 1963 का 38 ) की धारा 48 एवं 49 द्वारा प्रदत्त शक्तियों का उपयोग करते हुए महापत्तन न्यास प्राधिकरण , एतद्वारा विशाखापत्तनम पत्तन न्यास के आउटर हार्बर पर जनरल कार्गो बर्थ ( जीसीबी ) के निर्माण चरण में अबाधित प्रचालन प्रदान करने हेतु ओबी-1 पर कोकिंग कोल और स्टीम कोल के लिए प्रचलित प्रहस्तन प्रभार की वैधता को इसके साथ संलग्न आदेशानुसार विस्तार प्रदान करता है ।

इस प्राधिकरण ने, वीपीटी के जनरल कार्गो बर्थ ( जीसीबी) पर कोकिंग कोल और स्टीम कोल के मशीनों द्वारा प्रहस्तन के लिए अपफ्रंट प्रशुल्क निर्धारित करने हेतु विशाखापत्तनम् पत्तन न्यास ( वीपीटी) से प्राप्त प्रस्ताव को निपटाते हुए अपने आदेश सं.टीएएमपीट/58/ 2008-वीपीटी दिनांक 27 नवम्बर 2009 के माध्यम से एक आदेश पारित किया था ।
1.2. इस संदर्भ में, वीपीटी ने बताया है कि उसने जून 2010 में सुविधाभोगी के साथ सुविधा करार किया है । कार्गो का अबाधित प्रचालन प्रदान करने और जीसीबी के निर्माण चरण के दौरान नज़दीक के पत्तनों को अन्यथा चले गये कार्गो को वापिस प्राप्त करने के लिए वीपीटी और सुविधाभोगी , जीसीबी के चरणबद्ध रूप से सुदृढ़ीकरण के दौरान ओबी-1 पर कार्गो के प्रहस्तन हेतु सुविधाभोगी की लागत पर ओर बर्थ -1 ( ओबी -1 ) पर एक कन्वेयर सिस्टम निर्माण करने के लिए परस्पर सहमति हो चुके हैं । तद्नुसार, वीपीटी, जीसीबी का निर्माण पूरा होने के समय तक कोकिंग कोल और स्टीम कोल के वीपीटी द्वारा अस्थायी आधार पर प्रहस्तन के लिए दर प्रदान करने हेतु वीपीटी एक प्रस्ताव लेकर आया था ।

2.1 इस संबंध में , इस प्राधिकरण ने, विशाखापत्तनम् पत्तन न्यास के आउटर हार्बर पर जनरल कार्गो बर्थ ( जीसीबी) के निर्माण चरण के दौरान अस्थाई व्यवस्था के रूप में, अबाधित प्रचालनों की सुविधा हेतु ओबी-1 पर कोकिंग कोल और स्टीम कोल के लिए प्रहस्तन प्रभार तय करने के लिए वीपीटी के प्रस्ताव को अनुमोदित करते हुए एक आदेश सं. टीएएमपी/ 47/ 2011-वीपीटी दिनांक 8 अगस्त 2012 पारित किया है । यह आदेश भारत का राजपत्र, असाधारण ( भाग- III खंड़ 4 ) में राजपत्र सं . 183 के द्वारा 29अगस्त 2012 को अधिसूचित किया गया है ।
2.2 चूंकि पत्तन ने सूचित किया था कि जीसीबी के जुलाई / अगस्त 2012 तक पुनः प्रचालित किए जाने की संभावना है, ओबी-1 पर कोकिंग कोल और स्टीम कोल प्रहस्तन के लिए प्रदत्त प्रहस्तन सुविधा के लिए रू. 10.53 प्रति टन की दर की वैधता 31 अगस्त 2012 तक प्रदान की गई थी । इस आशय की सशर्तता वीपीटी के दरमान में शामिल की गई है ।
3. इस पृष्ठभूमि में, वीपीटी ने दिनांक 16 अक्तूबर 2012 के अपने पत्र के माध्यम से बताया है कि चूंकि जीसीबी परियोजना कीसमग्र भौतिक प्रगति 90% है, दिनांक 8 अगस्त 2012 के आदेश की वैधता 30 अप्रैल 2013 तक बढ़ायी जा सकती है । चूंकि जनरल कार्गो बर्थ ( जीसीबी ) का निर्माण चरण अभी तक पूरा नहीं हुआ है । चूंकि जनरल कार्गो बर्थ ( जीसीबी) का निर्माण चरण अभी तक पूरा नहीं हुआ है और इस स्थिति को ध्यान में रखते हुए कि जीसीबी के निर्माण चरण के दौरान अबाधित प्रचालनों की सुविधा हेतु आउटर बर्थ 1 ( ओबी-1 ) के प्रचालन को जारी रखना पड़ सकता है , यह प्राधिकरण, दिनांक 8 अगस्त 2012 के आदेश कीवैधता 30 अप्रैल 2013 तक विस्तारित करने हेतु वीपीटी के अनुरोध को स्वीकार करना चाहती है ।
4. वीपीटी को सलाह दी जाती है कि वह ओबी 1 पर 11 अगस्त 2011 से 31 अगस्त 2012 तक और 1 सितम्बर 2012 से 30अप्रैल 2013 तक की अवधि के बीच चलाए गए प्रचालन को अलग - अलग दर्शाने हेतु सुविधा की लागत विवरणी प्रस्तुत करे । ओबी-1 पर 11 अगस्त 2011 से 31 अगस्त 2012 की प्रचालन अवधि में वीपीटी के पास यदि कोई अतिरिक्त अधिशेष जमा हुआ' होगा तो उसकी मात्रा सुनिश्चित की जाएगी और उसे प्रशुल्क मार्गदर्शियों की धारा 2.13 के अनुसार समायोजित किया जाएगा और वीपीटीके पास 1 सितम्बर 2012 से 30 अप्रैल 2013 के बीच जमा होने वाले अतिरिक्त अधिशेष की मात्रा सुनिश्चित की जाएगी और वीपीटी के प्रशुल्क की अगली समीक्षा के दौरान जो अप्रैल 2013 में अपेक्षित समग्र रूप से पत्तन की लागत स्थिति का विश्लेषण करते समय उसे पूरा- पूरा समायोजित किया जाएगा ।
5. यह नोट किया जाये कि यदि 30 अप्रैल 2013 के आगे जीसीबी परियोजना प्रारंभ करने में देरी होती है तो , अधिकतम 31 जनवरी 2013 तक वीपीटी से, ओबी 1 पर संचालित प्रचालनों की लागत स्थिति दर्शाने वाला भली भांति विश्लेषित प्रस्ताव नहीं मिल जाता, 30 अप्रैल 2013 से आगे दरों की वैधता के विस्तार हेतु किसी अनुरोध पर विचार नहीं किया जाएगा ।

No. TAMP /47 / 2011 - VPT.--In exercise of the powers conferred under Sections 48 and 49 of the Major Port Trusts Act , 1963 ( 38 of 1963 ), the TariffAuthority for Major Ports hereby extends the validity of theexisting handling charge for Coking Coal and Steam Coal at OB 1 to facilitate uninterrupted operations during construction phase of General Cargo Berth (GCB ) at Outer Harbour of Visakhapatnam Port Trust as in the Order appended hereto.

ThisAuthority vide its Order no.TAMP/ 58 /2008 - VPT dated 27 November 2009 has passed an Order disposing the proposal received from the Visakhapatnam Port Trust ( VPT) to fix upfront tariff for the mechanised handling of coking coal and steam coal at its General Cargo Berth (GCB) ofVPT.

1.2. In this context, the VPT has reported to have entered into Concession Agreement with the Concessionaire in June 2010. To facilitate uninterrupted operation of cargo and to retain the cargo, thatmay otherwise get diverted to nearby ports during the construction phase of GCB , the VPT and the Concessionaire have mutually agreed to construct a Conveyor system at Ore Berth - 1 ( OB - 1 ) at the cost of the Concessionaire to handle cargo at OB- 1 during the phase wise strengthening of GCB . Accordingly, the VPT had come up with a proposal for prescription of rate for handling coking coal and steam coal by the VPT on a temporary basis, till the time the construction of GCB is completed.
2.1. In this connection , this Authority has passed an Order No.TAMP/47 /2011 -VPT dated 8August 2012 approving the proposal of VPT to fix handling charge for Coking Coal and Steam Coal at OB1 to facilitate uninterrupted operations during construction phase of General Cargo Berth (GCB) at Outer Harbour of Visakhapatnam Port Trust as a temporary arrangement . This Order has been notified inthe Gazette of India Extraordinary ( Part III Section 4) on 29 August 2012 vide Gazette No.183 .
2.2. Since the port had reported that the GCB is likely to be re- commissioned by July/ August 2012, the validity of the rate of 10.53 per tonne for handling facility provided at OB-I for handling Coking Coal and Steam Coal was prescribed till 31 August 2012. Conditionality to this effect has been inserted in the Scale of Rates of VPT.
3. In this backdrop, the VPT vide its letter dated 16 October 2012 has stated that since the overall physical progress of the GCB project is 90% , the validity of the Order dated 8 August 2012 may be extended till 30 April 2013. Since the construction phase of General Cargo Berth ( GCB) is not yet over and keeping in view the position that the operation of Outer Berth 1 (OB - 1 ) may have to be continued to facilitate uninterrupted operations during the construction phase of GCB , this Authority is inclined to accede to the request of the VPT to extend the validity of the Order dated 8 August 2012 till 30April2013.
4. TheVPT is advised to furnish a Cost statement for the facility to reflect the operation carried out at OB- 1 separately from 11 August 2011 till 31 August 2012 and for the period from 1 September 2012 to 30 April 2013. Additional surplus , if any , accrued to VPT during the period of operation at OB -1 from 11 August 2011 to 31 August 2012 wouldbe quantified and adjusted as per clause 2.13 of the tariff guidelines and the additional surplus accruing to the VPT for the period from 1 September 2012 to 30 April 2013 wouldbe quantified and adjusted fully while analysing the Cost position for the port as a whole during the next review of tariff of VPT, which is due in April 2013.
5. Itmay be noted that no further request for extension of validity of the rate beyond 30 April 2013 would be entertained , unless a well analysed proposal reflecting the cost position for the operations carried out at OB- I is received from VPT latest by 31 January 2013 in the event of delay in thecommencing of GCB project beyond 30 April 2013 .
