का.आ. 130(अ).-केन्द्रीय सरकार ने , भारतीय राष्ट्रीय राजमार्ग प्राधिकरण अधिनियम , 1988 ( 1988 का 68 ) की ध ारा 11 के अधीन जारी की गई भारत सरकार के तत्कालीन सड़क परिवहन और राजमार्ग मंत्रालय की अधिसूचना संख्या का.आ. 78 (अ) , तारीख 4 फरवरी , 1999 , द्वारा उत्तर प्रदेश राज्य में राष्ट्रीय राजमार्ग संख्या 02 के 93.000 कि.मी. से 479.000 कि.मी. ( हरियाणा/उत्तर प्रदेश सीमा से कानपुर सेक्शन ) और 0.00 कि.मी. से 334.0 ( कानपुर से वाराणसी सेक्शन ) तक का खण्ड भारतीय राष्ट्रीय राजमार्ग प्राधिकरण ( जिसे इसमें इसके पश्चात् " प्राधिकरण " संदर्भित किया गया है ) को सौंपा है ;
अतः अब , केन्द्रीय सरकार , राष्ट्रीय राजमार्ग शुल्क ( दरों का अवधारण एवं संग्रहण ) नियम , 2008 के साथ पठित राष्ट्रीय राजमार्ग अधिनियम , 1956 ( 1956 का 48 ) की धारा 7 द्वारा प्रदत्त शक्तियों का उपयोग करते हुए , भारत सरकार के सड़क परिवहन और राजमार्ग मंत्रालय की अधिसूचना संख्या का.आ. 2864 ( अ ) , तारीख 10 दिसम्बर, 2012 और का. आ. संख्या 2764 ( अ ) , तारीख 22 नवम्बर , 2012 द्वारा उत्तर प्रदेश राज्य में राष्ट्रीय राजमार्ग संख्या 2 के 321.000 कि.मी. से 396.177 कि.मी. और 396.177 कि. मी. से 457.377 कि.मी. तक के चार लेन के खण्ड के उपयोग के लिए यांत्रिक वाहनों पर शुल्क लगाने और संग्रहीत करने हेतु भारतीय राष्ट्रीय राजमार्ग प्राधिकरण को प्राधिकृत किया था ।
और , भारतीय राष्ट्रीय राजमार्ग प्राधिकरण अधिनियम , 1988 ( 1988 का 68 ) की धारा 14 के प्रावधान के अनुसरण में प्राधिकरण ने राज्य में डिजाइन , निर्माण , वित्त , प्रचालन और हस्तांतरण (डी बी एफ ओ टी ) आधार पर उत्तर प्रदेश राज्य में राष्ट्रीय राजमार्ग संख्या 2 के इटावा- चकेरी सेक्शन के 323.475 कि.मी. से 483.687 कि.मी. तक के खण्ड ( जिसे इसमें इसके पश्चात् " उक्त खण्ड " संदर्भित किया गया है ) के विकास हेतु 29-9-2011 को प्रस्तुत बोलियों के सफल बोलीदाता मैसर्स इटावा- चकेरी ( कानपुर ) हाइवे प्राइवेट लिमिटेड, जिसका पंजीकृत कार्यालय 21/48 , कमर्शियल कम्पलेक्स, मालचा मार्ग , डिप्लोमेटिक एन्कलेव , नई दिल्ली-110021 , दिल्ली भारत में है ( जिसे इसमें इसके पश्चात् " रियायतग्राही " संदर्भित किया गया है ) के साथ 5-3-2012 को एक करार किया है ( जिसे इसमें इसके पश्चात् उक्त करार संदर्भित किया गया है )
अतः अब, केन्द्रीय सरकार , राष्ट्रीय राजमार्ग शुल्क ( दरों का अवधारण एवं संग्रहण ) नियम , 2008 यथासंशोधित ( जिसे इसमें इसके पश्चात् " नियम " कहा गया है ) के नियम 3 के साथ पठित राष्ट्रीय राजमार्ग प्राधिकरण अधिनियम , 1956 ( 1956 का 48 ) की धारा 8 क द्वारा प्रदत्त शक्तियों का उपयोग करते हुए , अधिसूचना संख्या का.आ. 2764 ( अ ) , तारीख 22-11-2012 और का.आ. संख्या 2864 ( अ ) तारीख 10-12-2012 का अधिक्रमण करते हुए, सिवाए उन बातों के बारे में जो ऐसे अधिक्रमण से पहले कर ली गई हैं या करने से लोप करा दी गई हैं , उक्त खण्ड के निर्माण , अनुरक्षण , प्रबंध और प्रचालन,

निवेशित पूंजी पर ब्याज , उचित लाभ , यातायात का परिमाण तथा प्राधिकरण और रियायतग्राही के बीच हुए करार में निहित अवधि को ध्यान में रखतें हुए यह अधिसूचित करती है कि उक्त खण्ड के उपयोग के लिए यांत्रिक वाहनों पर चार या अधिक लेन के खण्ड़ों के उपयोग हेतु सड़क खंड की निवल लम्बाई 137.045 कि.मी. के लिए नीचे सारणी 1 के स्तम्भ ( 2 ) में विनिर्दिष्ट दर पर शुल्क( जिसे इसमें इसके पश्चात् " आधार दर " कहा गया है ) और पुलों संरचनाओं जिनकी लागत पचास करोड़ रुपए या अधिक है का उपयोग करने वाले के लिए नीचे सारणी 1 और 2 में विनिर्दिष्ट प्रकार के वाहनों पर सारणी संख्या 2 में विनिर्दिष्ट आधार दरों पर शुल्क उद्गृहीत और संग्रहीत किया जाएगा और वाणिज्यिक प्रचालन की तारीख या इस अधिसूचना के राजपत्र में प्रकाशन की तारीख से जो भी पश्चातवर्ती हो , करार में विनिर्दिष्ट अवसान की तारीख तक, शुल्क का संग्रहण करने तथा उसे प्रतिधारित करने के लिए उक्त रियायतग्राही को प्राधिकृत करती है ;

1. नीचे उद्ग्रहीत तथा संग्रहीत शुल्क ऐसे टोल प्लाजा ( प्लाजाओं ) हेतु निर्दिष्ट दूरी के लिए निम्नलिखित टोल प्लाजा पर शोध्य और संदेय होगा :

3. जिस व्यक्ति का अपना यांत्रिक वाहन गैर वाणिज्यिक प्रयोजनों के लिए पंजीकृत हुआ हो और वह टोल प्लाजा से 20 कि.मी. के भीतर रहता हो उसके लिए वर्ष 2012-13 के लिए मासिक पास की दर 200.00 रूपए (दो सौ रुपए मात्र) प्रतिमाह होगी और राष्ट्रीय राजमार्ग शुल्क (दरों का अवधारण औरं संग्रहण) नियम, 2008 के उपबंधों के अनुसार, उसमें प्रत्येक वर्ष संशोधन किया जायेगा ।
4. राजमार्ग खंड पर बहुयात्राओं के लिए पास निम्नलिखित दरों पर प्रदान किये जाएंगे , अर्थात्:-

5. जिस जिले में शुल्क प्लाजा पड़ता है उस जिले में पंजीकृत वाणिज्यिक वाहन (राष्ट्रीय परमिट के अधीन चल रहे वाहनों को छोड़कर) के लिए शुल्क उस श्रेणी के वाहन के लिए निर्धारित शुल्क का 50% होगा बशर्ते कि ऐसे वाणिज्यिक वाहनों के उपयोग के लिए कोई सर्विस रोड अथवा वैकल्पिक सड़क मार्ग उपलब्ध न हो ।
6. जो यांत्रिक वाहन नियमों के अधीन अपने प्रवर्ग के लिए निर्धारित अनुज्ञेय भार की अपेक्षा अधिक भार से लदे हुए होंगे उन्हें उन दरों पर शुल्क का संदाय करना होगा जो उनसे अगली उच्च श्रेणी के वाहनों के लिए लागू होता है और उन्हें तब तक राजमार्ग खण्ड का उपयोग करने का अधिकार नहीं होगा जब तक कि ऐसे यांत्रिक वाहन से अधिक भार को हटा न दिया जाए ।
7. यांत्रिक वाहनों के प्रवर्ग, उनके लिए अनुज्ञेय भार, छूट प्राप्त वाहनों के प्रवर्ग, सर्विस रोड, वैकल्पिक सड़क आदि सहित सभी परिभाषाएं नियमों में विनिर्दिष्ट परिभाषाओं के अनुसार होंगी ।
8. उक्त नियमों के नियम 12 के अनुसार, उपयोगकर्ताओं की जानकारी के लिए शुल्क की दरों को प्रदर्शित किया जाएगा ।
9. ऊपर सारणी 1 और 2 में यथा उल्लेखित आधार वर्ष 2007-08 के लिए प्रति कि.मी. की आधार दरों के आधार पर , यांत्रिक वाहनों से लिए जानेवाले वास्तविक शुल्क और कटौतियों की गणना प्राधिकरण द्वारा की जाएगी और उसमें उक्त नियमों के नियम 5 के अनुसार वार्षिक आधार पर संशोधन किया जायेगा परन्तु शर्त यह है कि छह महीने के अन्दर कोई संशोधन नहीं किया जाएगा तथा उसे तदनुसार, कम-से-कम अंग्रेजी और स्थानीय भाषा के एक- एक समाचारपत्र में प्रकाशित किया जाएगा ।,

NOTIFICATION
New Delhi , the 11th January, 2013
S.O. 130 (E) .- Whereas by notification of the Government of India in the erstwhile Ministry of Road Transport and Highways number S.O.78 (E) , dated 04/02/1999 issued under section 11 of the National Highways Authority of India, Act 1988 (68 of 1988) , the Central Government has entrusted the stretch from kilometer 93.000 to kilometer 479.000 ( Haryana/Uttar Pradesh Border to Kanpur section) and from kilometer 0.00 to km 334.0 ( Kanpur to Varanasi section) of National Highway No. 02, in the State of Uttar Pradesh to the National Highways Authority of India (hereinafter referred to as the "Authority " ) ;
And whereas , in exercise of the powers conferred by section 7 of the National Highway Act 1956 (48 of 1956) and read with National Highways Fee (Determination of Rates and Collection) Rules , 2008, the Central Government by notification of the Government of India in the Ministry of Road Transport and Highways number S.O. 2864 (E) dated 10th December, 2012 and S.O. 2764 ( E ) dated 22nd November , 2012 authorised the Authority for levying and collecting fee on mechanical vehicles for the use of four - laned stretch from km 321.100 to km 396.177 and from km . 396.177 to km. 457.377 of National Highway No. 2 in the State of Uttar Pradesh at the rates specified in their schedules .
And whereas, pursuant to the provision of section 14 of the National Highways Authority of India Act , 1988 (68 of 1988), the Authority has entered into an Agreement on 05/03/2012 (hereinafter referred to as said agreement) with M/s Etawah - Chakeri (Kanpur ) Highway Private Limited having its registered office at 21/48 , Commercial Complex , Malcha Marg, Diplomatic Enclave, New Delhi- 110021 , Delhi , India (hereinafter referred to as the " Concessionaire " ), the successful bidder for bids submitted on 29/09/2011 for the development of Etawah -Chakeri section from Km 323.475 to Km 483.687 on National Highway No. 02 (hereinafter referred to as the " said section " ) in the state of Uttar Pradesh on Design, Build , Finance , Operate and Transfer (DBFOT) basis of the said section.
Now, therefore, in exercise of the powers conferred by section 8A of the National Highways Act, 1956 (48 of 1956) , read with rule 3 of the National Highways Fee (Determination of Rates and Collection) Rules , 2008 as amended ( hereinafter referred to as the "Rules ") , and in supersession of the notification bearing No. S.O. 2764 (E) dated 22.11.2012 and S.O. 2864(E) dated 10.12.2012, except as respects things done or omitted to be done before such supersession, the Central Government, having regard to the expenditure involved in building, maintenance, management and operation of the said section , interest on the capital invested, reasonable return, the volume of traffic and the period of the agreement entered into between the authority and the concessionaire, hereby notifies that there shall be levied and collected fees on mechanical vehicles for the use of the said section at the rate specified in columns (2) of the Table 1 for net road section length Km. 137.045 for use of the four and more lane sections ( hereinafter referred to as " base rate " ) and at the base rates specified in the Table No.2 for bridges/structures costing Rupees Fifty crore or more on the Type of Vehicles specified in Table 1 and 2 below, and authorizes the said Concessionaire to collect and retain the fee on and from the date of commercial operation or publication of this notification in the Official Gazette, whichever is later , till the termination date as specified in the agreement.

2. In addition to above, the following fee shall also be due and payable for the use of the bridge (s) /structure (s) , cost of which is specified hereunder, at the following Toll Plaza(s) :

3. The rate of monthly pass for a person who owns a mechanical vehicle registered for non- commercial purposes and resides within a distance of twenty kilometers from the toll plaza is Rs. 200.00 ( Two hundred Rupees) for the year 2012-13 which is subject to revision every year as per the provisions of the National Highways Fee (Determination of Rates and Collection) Rules, 2008
4. For multiple journeys on the highway section, passes shall be issued at the following rates, namely.

5. Fee for commercial vehicle (excluding vehicles plying under national permit, registered in the district where the fee plaza falls shall be 50% of the prescribed rate for that category of vehicle provided no service road or alternative road is available for use of such commercial vehicles .
6. Mechanical vehicle which is loaded in excess of permissible load specified for its category under the Rules , shall be liable to pay fee at such rates which is applicable for the next higher category of the vehicle and shall not be entitled to make use of the highway section unless the excess load has been removed from such mechanical vehicle .
7. All definitions including category of mechanical vehicles , its permissible load, category of exempted vehicles , service road, alternative road etc. shall be as per definitions specified in the Rules .
8. The fee rates shall be displayed for information of the users in accordance with rules 12 of the said Rules .

9. Based on the Base rate of fee per km for the base year 2007-08 as mentioned in Table- 1 & 2, the actual amount of fee to be charged from the mechanical vehicles and the discounts will be calculated by the Authority and revised annually in accordance with the rule 5 of the said rules provided that no revision shall be effected within six months and the same shall be published in at least one newspaper , each in English and vernacular language accordingly .
