का.आ. 166(अ).- जबकि बंबई डॉक लेबर बोर्ड पिछले कई वर्षों से वित्तीय तंगी का सामना कर रहा था और वह अपने कर्मचारियों तथा रजिस्ट्रीकृत कर्मकारों को मज़दूरी का भुगतान करने में असमर्थ था;
और जबकि विभिन्न पहलुओं पर विचार करने के पश्चात् , केन्द्रीय सरकार की यह राय थी कि गंभीर वित्तीय विद्यमान थी , जिसके कारण उपर्युक्त बोर्ड अपने कृत्यों का निर्वहन करने में असमर्थ थाः
और जबकि उक्त बोर्ड को , केन्द्रीय सरकार द्वारा , डॉक कर्मकार (नियोजन का विनियमन) अधिनियम , 1948 ( 1948 का 9 ) की धारा 6ख की उपधारा ( 1 ) के खंड (क) द्वारा प्रदत्त अधिकारों का प्रयोग करते हुए , केन्द्र सरकार ने तत्कालीन भूतल परिवहन मंत्रालय में भारत सरकार की दिनांक 25 फरवरी , 1994 संख्या का. आ. 204 (अ) की अधिसूचना द्वारा एक वर्ष की अवधि के लिए अधिक्रांत कर दिया गया था और अधिक्रमण की इस अवधि के दौरान उक्त बोर्ड के अधिकार और कृत्य अध्यक्ष , मुंबई पत्तन न्यास को दिए गए थे :
और जबकि केन्द्रीय सरकार ने उपर्युक्त अधिक्रमण की अवधि, भारत सरकार की निम्नलिखित अधिसूचनाओं द्वारा एक वर्ष की अवधि के लिए बढ़ाई -

और जबकि इस प्रकार बढ़ाई गई अधिक्रमण की अवधि 31 दिसंबर , 2012 को समाप्त हो रही है ।
और जबकि केन्द्र सरकार अधिक्रमण की अवधि को आगे एक वर्ष की अवधि के लिए बढ़ाना आवश्यक समझती है;
2. अब , इसलिए , उक्त अधिनियम की धारा 6ख की उपधारा (3 ) के खंड (क) द्वारा प्रदत्त अधिकारों का प्रयोग करते हुए , केन्द्र सरकार एतद्वारा उक्त बोर्ड के अधिक्रमण की अवधि को 1 जनवरी 2013 से 31 दिसंबर , 2013 तक अथवा बांबे डॉक लेबर बोर्ड के मुंबई पत्तन न्यास में विलयन के लागू होने की तारीख तक, जो भी पहले हो , बढ़ाती है और तब तक , उक्त बोर्ड द्वारा उपयोग किए जाने वाले अधिकार अथवा किए जाने वाले कार्यकलाप अध्यक्ष , मुंबई पत्तन न्यास , मुंबई द्वारा प्रयोग अथवा निष्पादित किए जाएंगे ।

NOTIFICATION
New Delhi , the 1st January, 2013
S.O. 166(E).-Whereas the Bombay Dock Labour Board was facing financial stringency for the last several years and was unable to pay wages to its employees and registered workers ;
And whereas after considering various aspects , the Central Government was of the opinion that a grave financial emergency existed due to which the Board was unable to perform its function;
And whereas in exercise of the power conferred under by clause ( a ) of sub- section (1) of section 6B of the Dock workers ( Regulation of Employment ) Act, 1948 (9 of 1948 ) , the Central Government superseded the said Board for a period of one year , vide the notification of the Government of India in the erstwhile Ministry of Surface Transport number S.O. 204 ( E ) dated 25th February, 1994 and during the period of supersession , the powers and functions of the said Board were vested in the Chairman , Mumbai Port Trust ;
And Whereas the Central Government has from time to time , extended the period of supersession for a period of one year vide notification of the Government of India in the-
( i) Erstwhile Ministry of Surface Transport, number S.O.113 ( E ) dated 2nd September, 1995 ; number S.O.892 ( E ) dated 23rd December, 1996; number S.O. 925 dated 30th December , 1997 ; number S.O. 1114 ( E ) dated 24th December , 1998 and number S.O.1252 ( E ) dated 20th December , 1999;
(ii) . Erstwhile Ministry of Shipping, number S.O. ( E ) 1161 dated 26th December , 2000; number S.O 4( E ) dated 31st December , 2001; number S.O. 1392 ( E ) dated 31st December , 2002 and number S.O. 1467 ( E ) dated 26th December , 2003 ;

(iii) Ministry of Shipping , Road Transport and Highways , Number S.O.1374 ( E ) dated 13th December , 2004 ; number S.O. 1819 ( E ) , dated 27th December , 2005 ; number S.O.2150 ( E ) dated 26th December, 2006; number S.O. 2188 ( E ) dated 27th December , 2007 ; and number S.O.2980 ( E ) , dated 24th December , 2008. And number S.O. 3308 ( E ) dated 30th December , 2009 and number S.O. 3053 ( E ) 28th December, 2010.

And whereas the period of supersession so extended expires on the 31st December, 2012 .
And whereas the Central Government considers it necessary to extend the period of supersession for a further period one year;
2. Now, therefore , in exercise of the powers conferred by clause ( a ) of sub- section ( 3) of section 6B of the said Act , the Central Government hereby further extends the period of supersession of the Board with effect from 1st Januray , 2013 to 31st December , 2013 or the date of coming into force of the merger of Bombay Dock Labour Board with Mumbai Port Trust, whichever is earlier , and till such time, all the powers and functions that may be exercised or performed by the said Board shall be exercised or performed by the Chairman , Mumbai Port Trust, Mumbai .
