का.आ. 175(अ). केंद्रीय सरकार , ने भूमिगत रेल ( संकर्म सन्निर्माण ) अधिनियम , 1978 ( 1978 का 33 ) की धारा 7 की उप - धारा ( 1 ) के अधीन जारी भारत सरकार के रेल मंत्रालय की अधिसूचना सं. का. आ. 158 ( अ ) , तारीख 25 जनवरी , 2012 , जो भारत के राजपत्र , असाधारण , भाग II खंड 3 , उप - खंड ( ii ) , तारीख 25 जनवरी , 2012 को प्रकाशित की गई थी , द्वारा पश्चिमी बंगाल राज्य के कोलकाता महानगर में टॉलीगंज से न्यू गडिया तक मेट्रो रेल के निर्माण और उससे संबंधित अन्य संकर्मों के प्रयोजन के लिए उक्त अधिसूचना से संलग्न अनुसूची में विनिर्दिष्ट भूमियों , भवनों , पथों , सड़कों रास्तों या उनमें उपयोग के अधिकार या सुखाचार का अर्जन करने के अपने आशय की घोषणा की थी;
और केंद्रीय सरकार , का सक्षम प्राधिकारी की रिपोर्ट के आधार पर , यह समाधान हो गया है कि उक्त अधिसूचना से संलग्न अनुसूची में विनिर्दिष्ट भूमियों , भवनों, पथों, सड़कों रास्तों या उनमें उपयोग के अधिकारं या सुखाचार उक्त प्रयोजन के लिए अपेक्षित हैं ;
अंतः , अब केंद्रीय सरकार, उक्त अधिनियम , 1978 की धारा 10 की उप - धारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , निम्न अनुसूची में यथा - विनिर्दिष्ट भूमियों, भवनों , पथों, सड़कों , रास्तों या उनमें उपयोग के अधिकार या सुखाचार को अर्जित करती है;
अनुसूची में विनिर्दिष्ट क्षेत्रों जिनका अर्जन किया गया है , का रेखांक सक्षम प्राधिकारी के कार्यालय अर्थात , श्री दीनानाथ प्रसाद, सक्षम प्राधिकारी मेट्रो रेल 39/1 , रास बिहारी एवेन्यू, ( प्रथम तल ) कोलकाता-700026 में निरीक्षण के लिए उपलब्ध है ।

NOTIFICATION
New Delhi , the 16th January, 2013
S.O. 175 ( E) . Whereas by the notification of the Government of India, in the Ministry of Railways number S.O. 158 (E) , dated the 25th January , 2012 , issued under sub - section ( 1 ) of section 7 of the Metro Railways ( Construction of Works ) Act, 1978 (33 of 1978 ) , published in Part II , Section 3 , Sub - section (ii ) of the Gazette of India , Extraordinary , dated the 25th January , 2012 , the Central Government gave notice of its intention to acquire lands , buildings , streets , roads , passages or the right of users or easement therein , specified in the Schedule appended to the said notification , for the purpose of construction of Metro Railway from Tollygunge to New Garia and other works connected therewith in the metropolitan City of Kolkata in the State of West Bengal;
And whereas , the Central Government, on the report of the Competent Authority is satisfied that the lands , buildings , streets , roads , passages or the right of users or easement therein , specified in the Schedule appended to the said notification , are required for the above said purpose ;
Now, therefore , in exercise of the powers conferred by sub- section ( 1 ) of section 10 of the said Act, 1978 , the Central Government do hereby acquires the lands , buildings , streets , roads , passages or the right of users or easement therein, as specified in the Schedule below;
The plan of the areas , specified in the Schedule which are acquired , is available for inspection in the office of the Competent Authority namely , Shri Dinanath Prasad , Competent Authority, Metro Railway , at 39/1 , Rash Behari Avenue, ( 1st Floor) , Kolkata - 700026.
