का.आ. 193(अ).- केन्द्रीय सरकार ने भारतीय राष्ट्रीय राजमार्ग प्राधिकरण अधिनियम , 1988 (1988 का 68) की धारा 11 के अधीन जारी की गई भारत सरकार के तत्कालीन भूतल परिवहन मंत्रालय ( सड़क खंड ) की अधिसूचना संख्या का.आ. 78 (अ) , तारीख 4 फरवरी , 1999 द्वारा आंध्रप्रदेश राज्य में राष्ट्रीय राजमार्ग सं . 5 के 75.000 कि.मी. से 395.870 कि.मी. तक ( विजयवाड़ा - विशाखापट्नम सेक्शन ) तक के खण्ड को भारतीय राष्ट्रीय राजमार्ग प्राधिकरण (जिसे इसमें इसके पश्चात् "प्राधिकरण " कहा गया है ) को सौंपा है ;
और प्राधिकरण ने भारतीय राष्ट्रीय राजमार्ग अधिनियम, 1988 ( 1988 का 68 ) की धारा 14 के प्रावधान के अनुसरण में मैसर्स आईवीआरसीएल गुंडुगोलानु राजामुंदरी टोलवेस लिमिडेट जो 30.03.2012 को प्रस्तुत की गई बोलियों का सफल बोलीदाता है , और जिसका रजिस्ट्रीकृत कार्यालय एमआईएचआईआर 8-2-350/5/ ए/24/1-बी और 2, रोड नम्बर 2 , बंजारा हिल्स , हैदराबाद 500034 ( जिसे इसमें इसके पश्चात् "रियायतग्राही " कहा गया है ) , के साथ राष्ट्रीय राजमार्ग सं . 5 के 1022.494 कि.मी. ( पुराना चैनेज 81.600 ) से 901.753 ( पुराना चैनेज 200.00 ) तक ( जिसे इसमें इसके पश्चात् " उक्त खण्ड " कहा गया है ) गुंडुगोलानू राजामुंदरी सेक्शन का छः लेन के विभाजित कैरिएजवे के रूप में विकास तथा प्रचालन और अनुरक्षण के लिए करार किया है ( जिसे इसमें इसके पश्चात् " उक्त करार " कहा गया है ) ।
अतः अब, केन्द्रीय सरकार, राष्ट्रीय राजमार्ग शुल्क ( दरों का अवधारण और संग्रहण ) नियम, 2008, और समय - समय पर हुए संशोधनों ( जिसे इसमें इसके पश्चात् "नियम" कहा गया है ) के नियम 3 के साथ पठित राष्ट्रीय राजमार्ग अधिनियम, 1956 ( 1956 का 48 ) की धारा 8 क द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और सड़क परिवहन और राजमार्ग मंत्रालय की अधिसूचना संख्या का.आ. 1712 (अ) , दिनांक 26 जुलाई 2012 और अधिसूचना संख्या का.आ. 2673 (अ), दिनांक 2 नवम्बर 2012 को उन बातो के सिवाय 263 G1/ 2013

अधिक्रांत करते हुए , जिन्हे ऐसे अधिक्रमण से पहले किया गया है या करने का लोप किया गया है , उक्त खण्ड के निर्माण, अनुरक्षण , प्रबंध और प्रचालन, निवेशित पूंजी पर ब्याज, उचित लाभ, यातायात का परिमाण तथा प्राधिकरण और रियायतग्राही के बीच हुए करार में निहित अवधि को ध्यान में रखते हुए , यह अधिसूचित करती है कि उक्त खण्ड के उपयोग के लिए यांत्रिक यानों पर चार या अधिक लेन के खण्डों के उपयोग हेतु निवल सड़क खण्ड की लम्बाई के लिए सारणी 1 के स्तंभ (2) में निर्दिष्ट दर पर शुल्क ( जिसे इसमें इसके बाद "आधार दर " कहा गया है ) उद्गृहीत और संग्रहीत किया जाएगा और वाणिज्यिक प्रचालन या इस अधिसूचना के राजपत्र में प्रकाशन की तारीख से , जो भी पश्चात्वर्ती हो, करार में निर्दिष्ट अवसान की तारीख तक शुल्क का संग्रहण करने तथा उसे प्रतिधारित के लिए उक्त रियायतग्राही को प्राधिकृत करती है ;

1. फीस का उद्ग्रहण और संग्रहण निम्नलिखित टोल प्लाजाओं पर ऐसे टोल प्लाजाओं के लिए निर्दिष्ट दूरी के लिए निर्माण अवधि के दौरान , शोध्य और संदेय किया जायेगा

2. जिस व्यक्ति का अपना यांत्रिक वाहन गैर वाणिज्यिक प्रयोजनों के लिए पंजीकृत हुआ हो और वह टोल प्लाजा से 20 कि.मी. के भीतर रहता हो तो उसके लिए वर्ष 2012-13 के लिए, मासिक पास की दर 200.00 रूपए (दो सौ रुपए मात्र) प्रतिमाह होगी और राष्ट्रीय राजमार्ग फीस (दरों का अवधारण औरं संग्रहण) नियम , 2008 के उपबंधों के अनुसार, उसमें प्रत्येक वर्ष संशोधन किया जायेगा ।

3. राजमार्ग खंड पर बहुयात्राओं के लिए पास निम्नलिखित दरों पर प्रदान किये जाएंगे , अर्थात्: -

4. जिस जिले में शुल्क प्लाजा पड़ता है उस जिले में पंजीकृत वाणिज्यिक वाहन ( राष्ट्रीय परमिट के अधीन चल रहे वाहनों को छोड़कर) के लिए शुल्क उस श्रेणी के वाहन के लिए निर्धारित शुल्क का 50 % होगा बशर्ते कि ऐसे वाणिज्यिक वाहनों के उपयोग के लिए कोई सर्विस रोड अथवा वैकल्पिक सड़क मार्ग उपलब्ध न हो ।
5. जो यांत्रिक वाहन नियमों के अधीन अपने प्रवर्ग के लिए निर्धारित अनुज्ञेय भार की अपेक्षा अधिक भार से लदे हुए होंगे उन्हें उन दरों पर शुल्क का संदाय करना होगा जो उनसे अगली उच्च श्रेणी के वाहनों के लिए लागू होता है और उन्हें तब तक राजमार्ग खण्ड का उपयोग करने का अधिकार नहीं होगा जब तक कि ऐसे यांत्रिक वाहन से अधिक भार को हटा न दिया जाए ।
6. यांत्रिक वाहनों के प्रवर्ग , उनके लिए अनुज्ञेय भार, छूट प्राप्त वाहनों के प्रवर्ग, सर्विस रोड, वैकल्पिक सड़क आदि सहित सभी परिभाषाएं नियमों में विनिर्दिष्ट परिभाषाओं के अनुसार होंगी ।
7. उक्त नियमों के नियम 12 के अनुसार, उपयोगकर्ताओं की जानकारी के लिए शुल्क की दरों को प्रदर्शित किया जाएगा ।
8. ऊपर सारणी 1 और 2 में यथा उल्लेखित आधार वर्ष 2007-08 के लिए प्रति कि.मी. की आधार दरों के आधार पर , यांत्रिक वाहनों से लिए जानेवाले वास्तविक शुल्क और कटौतियों की गणना प्राधिकरण द्वारा की जाएगी और उसमें उक्त नियमों के नियम 5 के अनुसार वार्षिक आधार पर संशोधन किया जायेगा परन्तु शर्त यह है कि छह महीने के अन्दर कोई संशोधन नहीं किया जाएगा तथा उसे तदनुसार, कम- से- कम अंग्रेजी और स्थानीय भाषा के एक- एक समाचारपत्र में प्रकाशित किया जाएगा।

NOTIFICATION
New Delhi , the 18th January, 2013
S.O. 193( E)-Whereas by notification of the Government of India in the erstwhile Ministry of Surface Transport (Roads Wing) number S.O. 78 ( E ) , dated the 4th February , 1999 , issued under section 11 of the National Highways Authority of India Act , 1988 ( 68 of 1988 ) , the Central Government has entrusted the stretch from kilometer 75.000 to kilometer 395.870 (Vijayawada Vishakhapatnam section) of National Highway No. 5 in the State of Andhra Pradesh to the National Highways Authority of India ( hereinafter referred to as the "Authority");
500 034 And whereas, pursuant to the provision of section 14 of the National Highways Authority of India Act, 1988 ( 68 of 1988 ) , the Authority has entered into an Agreement (hereinafter referred to as said agreement) with M/ s IVRCL Gundugolanu Rajahmundry Tollways Ltd. , having its registered office at MIHIR , 8-2-350/5 /A/24/1 - B & 2, Road No. 2, Banjara Hills , Hyderabad (hereinafter referred to as the " Concessionaire ") , the successful bidder for bids submitted on 30.03.2012 for the development of Gundugolanu Rajahmundry section from Km 1022.494 ( old chainage Km 81.600) to Km 901.753 ( old chainage Km 200.00 ) on National Highway No. 5 (hereinafter referred to as the " said section " ) to six lane divided carriageway and operation and maintenance of the said section .
Now, therefore , in exercise of the powers conferred by section 8A of the National Highways Act, 1956 (48 of 1956) , read with rule 3 of the National Highways Fee (Determination of Rates and Collection ) Rules , 2008 and amended from time to time ( hereinafter referred to as the "Rules ") , and in supersession of the notifications of the Government of India in, the Ministry of Road Transport and Highways number S.O. 1712 ( E) dated the 26th July, 2012 and S.O. 2673 ( E) , dated the 2nd November , 2012 except as respect things done or omitted to be done before such supersession , the Central Government , having regard to the expenditure involved in building , maintenance , management and operation of the said section , interest on the capital invested , reasonable return , the volume of traffic and the period of the agreement entered into between the authority and the concessionaire, hereby notifies that there shallbe levied and collected fees on mechanical vehicles for the use of the said section at the rate specified in columns (2) of the Table 1 for net road section length for use of the four and more lane sections ( hereinafter referred to as " base rate ") on the Type of Vehides specified in Table 1 below , and authorizes the said Concessionaire to collect and retain the fee on and from the date of commercial operation or publication of this notification in the Official Gazette , whichever is later , till the termination date as specified in the agreement;

2. The rate of monthly pass for a person who owns a mechanical vehicle registered for non- commercial purposes and resides within a distance of twenty kilometers from the toll plaza is Rs . 200.00 ( rupees Two Hundred only) for the year 2012-13 and is subject to revision every year as per the provisions of the National Highways Fee (Determination of Rates and Collection) Rules , 2008.
3. For multiple journey on the highway section, passes shall be issued at the following rates , namely .

4. Fee for commercial vehicle (excluding vehicles plying under National permit) registered in the district where the fee plaza falls shall be 50% of the prescribed rate for that category of vehicle provided no service road or alternative road is available for use of such commercial vehicle .
5. Mechanical vehicles which is loaded in excess of permissible load specified for its category under the Rules, shall be liable to pay fee at such rates which is applicable for the next higher category of the vehicles and shall not be entitled to make use of the highway section unless the excess load has been removed from such mechanical vehicle,
6. All definitions including category of mechanical vehicles , its permissible load , category of exempted vehicles , service road , alternative road etc. shall be as per definitions specified in the said Rules .
7. The amount of fee to be charged from the mechanical vehicles shall be displayed for information of the users in accordance with rules 12 of the said Rules .
8. Based on the base rate of fee per km for the base year 2007-08 as mentioned in Table -1 , the actual amount of fee to be charged from the mechanical vehicles and the discounts will be calculated by the authority and revised annually in accordance with the rule 5 of the said rules provided that no revision shall be effected within six months and the same shall be published in at least one newspaper , each in English and vernacular language accordingly.
