सा.का.नि. 29(अ).-केन्द्रीय सरकार, पेटेंट (बौद्धिक संपदा अपील बोर्ड को आवेदन और अपील) नियम, 2011 का संशोधन करने के लिए , निम्नलिखित प्रारूप नियम, पेटेंट अधिनियम, 1970 (1970 का 39) की धारा 159 की अपेक्षानुसार उक्त अधिनियम की धारा 157 की उपधारा (3) की अपेक्षानुसार उन सभी व्यक्तियों की जानकारी के लिए जिनके उससे प्रभावित होने की संभावना है, प्रकाशित किया जाता है ; और यह सूचना दी जाती है कि उक्त प्रारूप नियमों पर उस तारीख से, जिसको इस अधिसूचना से युक्त भारत के राजपत्र की प्रतियां जनता को उपलब्ध करा दी जाती हैं, पैंतालीस दिन की अवधि की समाप्ति के पश्चात् विचार किया जाएगा ;

ऐसे किन्ही आक्षेपों और सुझावों पर, जो ऐसी विनिर्दिष्ट अवधि के भीतर उक्त प्रारूप नियमों की बाबत किसी व्यक्ति से प्राप्त हो सकेंगे , केन्द्रीय सरकार द्वारा विचार किया जाएगा ;

आक्षेप या सुझावों, यदि कोई हों, संयुक्त सचिव (आईपीआर-1 अनुभाग) , औद्योगिक नीति और संवर्धन विभाग, वाणिज्य और उद्योग मंत्रालय, उद्योग भवन, नई दिल्ली 110011 को भेजे जा सकेंगे ;

G.S.R. 29(E).- The following draft rules to amend the Patents (Applications and Appeals to theIntellectual Property Appellate Board) Rules, 2011, which the Central Government proposes tomake under section 159 of the Patents Act, 1970 ( 39 of 1970) , Is hereby published as required by sub-section (3) of section 157 of the said Act, for information of all persons likely to be affected thereby; and notice is hereby given that the said draft rules shall be taken into consideration after the expiry of a period of forty- five days from the date on which the Gazette of India in which this notification is published , are made available to the public;

Any Objection or suggestion which maybe received from any person with respect to the said draft rule within the period so specified shall be considered by the Central Government;

Theobjections or suggestions , if any maybe forwarded to the Joint Secretary, ( IPR-I Section), Department of Industrial Policy and Promotion , Ministry of Commerce and Industry, Udyog Bhawan, New Delhi- 110011 .

1. (1) These rules may be called the Patents (Applications and Appeals to the Intellectual Property Appellate Board) Amendment Rules, 2013.

(2) They shall come into force on the date of their final publication in the Official Gazette.

The following draft rules to amend the Trade Marks Applications and Appeals to the Intellectual property Appellate Board ) Rules, 2003, which the Central Government proposes to make under section 157 of the Trade Marks Act, 1999 (47 of1900), hereby published as required under the sub-section ( 1) of section 157 of the said Act fer information of all persons likely to be affected thereby; and notice is hereby given that the said draft rules shall be taken into consideration after the expiry of a period of forty-five days from thedate on which the Gazette of India in which this notification is published , are made audie to the public;

Any objection or suggestion which may be neceived from any querson with respect to the draft rule within the period so specified shallbe considered by the Central Government;

Theobjections or suggestions, if any, may the forwarded to the Joint Secretary PR- I Section), Department of Industrial Policy and Promotion , Ministry of Commerce and industry, Udyog Bhawan -110011 .

1. (1) These rules maybe called the Trade Marks Applications and Appeals to the Intellectual PropertyAppellate Board) Amendment Rules, 2013.

(2) They shall come into force on the date of their final publication in the Micial Guestie.

NOTIFICATION

New Delhi , the 21st January, 2013

G.S.R. 31 (E ). The following draft rules which the Central Government proposes to make under section 87 of the Geographical Indications of Goods ( Registration and Protection ) Act , 1999 (48 of 1999) , is hereby published as required by sub-section (1) of the section 87 of the said Act, for information of all persons likely to be affected thereby; and notice is hereby given that the said draft rules shall be taken into consideration after the expiry of a period of forty- five days from the date on which the Gazette of India in which this notification is published , are made available to the public;

Any objection or suggestion which may be received from any person with respect to the said draft rule within the period so specified shall be considered by the Central Government ;

The objections or suggestions, if any may be forwarded to the Joint Secretary ( IPR- I Section ) , Department of Industrial Policy and Promotion , Ministry of Commerce and Industry, Udyog Bhawan - 110011 .

DRAFT RULES

1.Short title and commencement - ( 1) These rules may be called the Geographical Indications of Goods (Applications and Appeals to the Intellectual Property Appellate Board) Rules, 2013.

(2) They shall come into force on the date of their final publication in the Official Gazette.

2.Applications and appeals . The manner of making applications and appeal and the forms of applications and appeals to the Intellectual Property Appellate Board and the manner of verification thereof shall be as provided in the First Schedule to these rules .

3. Fees . The fees for filing applications and appeals before the Intellectual Property Appellate Board shall be as specified in the Second Schedule to these rules which shall be paid by way of bank draft payable at Chennai drawn in favour of the Deputy Registrar, Intellectual Property AppellateBoard .
