भारतीय राष्ट्रीय राजमार्ग प्राधिकरण ( भर्ती , वरिष्ठता और प्रोन्नति) संशोधन विनियम , 2013
संख्या भाराराप्रा/ 11011 /17/2012- एचआर 1 /( खण्ड IX).-भारतीय राष्ट्रीय राजमार्ग प्राधिकरण अधिनियम , 1988 ( 1988 का 68 ) की धारा 9 के साथ पठित धारा 35 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , भारतीय राष्ट्रीय राजमार्ग प्राधिकरण , भारतीय राष्ट्रीय राजमार्ग प्राधिकरण ( भर्ती, वरिष्ठता और प्रोन्नति ) विनियम , 1996 में आगे और संशोधन करने के लिए एतद्दद्वारा निम्नलिखित विनियम बनाता है , अर्थात्:-
1. संक्षिप्त नाम एवं प्रारम्भ ( 1 ) ये विनियम भारतीय राष्ट्रीय राजमार्ग प्राधिकरण ( भर्ती , वरिष्ठता और प्रोन्नति) संशोधन विनियम , 2013 कहलाएंगे ।
(2) ये राजपत्र में इनके प्रकाशन की तारीख से प्रवृत्त होंगे ।
2.. भारतीय राष्ट्रीय राजमार्ग प्राधिकरण ( भर्ती , वरिष्ठता और प्रोन्नति ) विनियम , 1996 ( जिसे इसमें इसके पश्चात् मूल विनियम संदर्भित किया गया है ) की अनुसूची में, नोट-1 के बाद निम्नलिखित नोट अन्तःस्थापित किया जाएगा , अर्थात्: -
"टिप्पणी 2:-जहाँ कहीं भी तकनीकी पदों के लिए अनुसूची के कॉलम 5 और/अथवा 8 में प्रोन्नति को भर्ती की पद्धति के

रूप में निर्धारित किया जाता है वहां संविलयित अधिकारियों की प्रोन्नति पर विचार करते समय प्रतिनियुक्ति पर आने वाले अधिकारियों की तुलना में कुछ हद तक समता बनाई रखी जाए । अगले उच्च पदों पर आंतरिक संविलयित अधिकारियों की प्रोन्नति पर विचार करते समय सड़क परिवहन और राजमार्ग मंत्रालय में तदनुरूपी समकक्ष अधिकारियों द्वारा अपनी विशिष्ट श्रेणी में की गई सेवा के वर्षों को प्रोन्नति की पात्रता के लिए बैंचमार्क रखा जाए ।

पाद टिप्पण. मूल विनियमावली अधिसूचना संख्या एनएचएआर -12011/ 1/95 - प्रशा. , तारीख 11 मार्च, 1996 द्वारा भारत के राजपत्र , असाधारण , भाग III , खण्ड 4 , तारीख 11 मार्च, 1996 में प्रकाशित की गई थी और उसमें गत संशोधन अधिसूचना संख्या एनएचएआई/ 11011/17/ 2012- एचआर -1 ( खण्ड- V) , तारीख 22 नवम्बर , 2012 द्वारा किया गया था , जिसे भारत के राजपत्र, असाधारण , भाग III खण्ड 4 , तारीख 23 नवम्बर , 2012 , में प्रकाशित किया गया था ।
स्पष्टीकरण ज्ञापन
इस संशोधन की अधिसूचना से पहले कर ली गई अथवा करने से लोप करा दी गई किसी बात पर इस संशोधन के प्रख्यापन से कोई प्रभाव नहीं पड़ेगा ।

The National Highways Authority of India (Recruitment, Seniority and Promotion) Amendment Regulations ,
2013
"Note 2 :-Wherever the promotion is prescribed as a mode of recruitment in Column 5 and/ or 8 of the schedule for the technical posts , a certain degree of parity be maintained while considering the absorbed officials for promotion vis - a- vis officials who may come on deputation . While considering promotion of internal/absorbed candidates for next higher posts , number of years being put by the corresponding equivalent officers in MoRT& H for promotion in their particular category may be kept as a benchmark for eligibility for promotion . "

III/IV/ 122/ 12/Exty.] No. NHAI / 11011 / 17 / 2012 - HR.I ( Vol.IX ) .-In exercise ofthe powers conferred by Section 35 , read with Section 9 , of the National Highways Authority of India Act, 1988 (68 of 1988 ), the National Highways Authority of India hereby makes the following regulations further to amend the National Highways Authority of India (Recruitment, Seniority and Promotion ) Regulations , 1996, namely:-
1. Short title and commencement .-( 1 ) These regulations may be called the National Highways Authority ofIndia (Recruitment , Seniority and Promotion) Amendment Regulations , 2013.
(2) They shall come into force on the date of their publication in the Official Gazette .
Foot Note. The principal regulations were published vide notification No. NHAR - 12011 / 1 / 95 - Admn . , dated 11th March, 1996 , in the Gazette of India , Extraordinary, Part III , Section 4, dated the 11th March , 1996 and last amended vide notification No. NHAI/ 11011 / 17 /2012- HR.I (Vol.V) , dated 22nd November , 2012 , published in the Gazette of India, Extraordinary, Part III- Section 4, dated the 23rdNovember, 2012.
Explanatory Memorandum
2. In the Schedule to the National Highways Authority of India ( Recruitment, Seniority and Promotion) Regulations , 1996 (hereinafter referred to as the principal regulations ) , after Note 1 , the following note shall be inserted, namely :-
Anything done or omitted to be done prior to notification of this amendment shall not be affected by promulgation ofthis amendment .
