सा.का.नि. 43(अ) . ओषधि और प्रसाधन सामग्री नियम, 1945 का और संशोधन करने के लिए निम्नलिखित प्रारूप नियम, जिनको केन्द्रीय सरकार, ओषधि और प्रसाधन अधिनियम, 1940 (1940 का 23) की धारा 12 और धारा 33 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , ओषधि तकनीकी सलाहकार बोर्ड से परामर्श करने के पश्चात्, बनाने का प्रस्ताव करती है, उन सभी व्यक्तियों की जानकारी के लिए प्रकाशित किया जाता है, जिनके उससे प्रभावित होने की संभावना है और यह सूचना दी जाती है कि उक्त प्रारूप नियमों पर उस तारीख से, जिसको उस राजपत्र की प्रतियां , जिसमें यह अधिसूचना प्रकाशित की जाती है, जनता को उपलब्ध करा दी जाती है, पैंतालीस दिन की अवधि की समाप्ति के पश्चात् विचार किया जाएगा ;
प्रस्तावित प्रारूप नियमों पर आक्षेप या सुझाव करने का इच्छुक व्यक्ति, यथाविनिर्दिष्ट अवधि के भीतर केन्द्रीय सरकार के विचारार्थ डाक द्वारा सचिव, स्वास्थ्य और परिवार कल्याण मंत्रालय, भारत सरकार, निर्माण भवन, नई दिल्ली-110011 को भेज सकेगा ।
प्रारूप नियम
1. (1 ) इन नियमों का संक्षिप्त नाम ओषधि और प्रसाधन सामग्री ( प्रथम संशोधन ) नियम, 2013 है । है ।
(2) ये राजपत्र में अंतिम प्रकाशन की तारीख को प्रवृत्त होंगे ।
ओषधि और प्रसाधन सामग्री नियम, 1945 में, -
2. (क) नियम 69 क के उपनियम ( 1 ) के पहले परंतुक के पश्चात् स्पष्टीकरण के स्थान पर
निम्नलिखित स्पष्टीकरण रखा जाएगा: -

" स्पष्टीकरण, - इस नियम के प्रयोजन के लिए किसी उधार अनुज्ञप्ति से ऐसी अनुज्ञप्ति अभिप्रेत है जो किसी अनुज्ञप्ति प्राधिकारी द्वारा किसी आवेदक को जारी की जा सके जो प्ररूप 25 में किसी अनुज्ञप्तिधारी द्वारा रखी गई विनिर्माण सुविधाओं का उपभोग करने का आशय रखता है । " ;
(ख) नियम 75क के उपनियम ( 1 ) के पहले परंतुक के पश्चात् स्पष्टीकरण के स्थान पर निम्नलिखित स्पष्टीकरण रखा जाएगा: -
" स्पष्टीकरण, - इस नियम के प्रयोजन के लिए किसी उधार अनुज्ञप्ति से ऐसी अनुज्ञप्ति अभिप्रेत है जो किसी अनुज्ञप्ति प्राधिकारी द्वारा किसी आवेदक को जारी की जा सके जो प्ररूप 28 में किसी अनुज्ञप्तिधारी द्वारा रखी गई विनिर्माण सुविधाओं का उपभोग करने का आशय रखता है । " ;
(ग) नियम 122ङ के खंड ( ग) के पश्चात् " स्पष्टीकरण " के मद संख्यांक ( ii) में, " या भारतीय फार्माकोपियर में इसे सम्मिलित करना , इसमें से जो भी पूर्वतर हो " शब्दों का लोप किया जाएगा;
(घ) अनुसूची ( घ ) में क्रम संख्यांक 1 के सामने ' छूट का विस्तार और शर्तें ' स्तंभ शीर्षक के अंतर्गत, " या वाणिज्यिक क्वालिटी की है " शब्दों के पश्चात् " और नियम 21 के खंड (ख ) में यथा परिभाषित अनुज्ञप्ति प्राधिकारी से बिना रजिस्ट्रीकरण और अनुज्ञप्ति लाइसेंस के बिना गैर चिकित्सीय उपयोग के लिए पदार्थों को आयात करने के लिए अनुज्ञा प्राप्त कर ली है ।" शब्दों को अंतःस्थापित किया जाएगा;
(ङ) अनुसूची ज में प्रविष्टि " 269. कैटामाइन हाइड्रोक्लोराइड" का लोप किया जाएगा;
(च) अनुसूची ध में क्रम संख्यांक 29 और उससे संबंधित प्रविष्टियों के पश्चात् निम्नलिखित क्रम संख्यांक और प्रविष्टि अंतःस्थापित की जाएगी, अर्थात्ः-
" 30 सिंदूर भा.मा.: 14649: 1999" ;
(छ) अनुभूची भ में मद ग्लूटैथीमाइड के पश्चात् निम्नलिखित मद अंतःस्थापित की जाएगी , अर्थात्ः-
" 269. कैटामाइन हाइड्रोक्लोराइड"

G.S.R. 43 (E) .-The following draft rules further to amend the Drugs and Cosmetics Rules , 1945 , which the Central Government proposes to make , in exercise of the powers conferred by section 12 and section 33 of the Drugs and Cosmetics Act , 1940 (23 of 1940) , after consultation with the Drugs Technical Advisory Board , is hereby published for the information of all persons likely to be affected thereby, and the notice is hereby given that the said draft rules shall be taken into consideration on or after the expiry of a period of forty- five days from the date on which the copies of the Gazette of India containing these draft rules are made available to the public;
Any person interested in making any objection or suggestion on the proposed draft rules may do so in writing for consideration of the Central Government within the period so specified through post to the Secretary, Ministry of Health and Family Welfare , Government ofIndia , Nirman Bhawan , New Delhi- 110108 .
DRAFT RULES
1. (1 ) These rules may be called the Drugs and Cosmetics ( 1stAmendment) Rules , 2013 (2) They shall come into force on the date of their final publication in the Official Gazette .
2. In the Drugs and Cosmetics Rules , 1945;
(a) in rule 69A , in sub - rule ( 1 ) , after the proviso, for the ' Explanation', the following ' Explanation ' shall be substituted , namely:-
"Explanation . - For the purpose of this rule a loan licence means a licence which a licensing authority may issue to an applicant who intends to avail the manufacturing facilities owned by a licensee in Form 25." ;
(b) in rule 75A, in sub- rule ( 1 ), after the proviso , for the ' Explanation' , the following 'Explanation ' shall be substituted , namely: - 4

[PART II-SEC . 3 (i) ] "Explanation. - For the purpose of this rule a loan licence means a licence which a licensing authority may issue to an applicant who intends to avail the manufacturing facilities owned by a licensee in Form 28." ;
(c) in rule 122 E , after clause (c) , in the " Explanation " , in item (ii ) , the words "or its inclusion in the Indian Pharmacopoeia , whichever is earlier " shall be omitted ;
( d) in Schedule D , against serial number 1 , under the column heading 'Extent and conditions of exemption ' , after the words " or is of commercial quality. " , the words, " Further , permission from licensing authority as defined in clause ( b) of rule 21 has been obtained for import of the substance for non- medicinal use without registration and import licence . " shall be inserted;
(e) in Schedule H , the entry " 269. Ketamine Hydrochloride " shall be omitted;
(f) in Schedule S , after serial number 29 and the entries relating thereto, the following serial number and entry shall be inserted , namely: -
" 30. Sindoor IS : 14649 : 1999 " ;
(g) inSchedule X, after the item 'Glutethimide' , the following item shall be inserted , namely: -
"Ketamine hydrochloride" .
