का.आ. 288(अ).- केन्द्रीय सरकार ने, भारतीय राष्ट्रीय राजमार्ग प्राधिकरण अधिनियम , 1988 ( 1988 का 68 ) की धारा ।। के अधीन जारी की गई भारत सरकार के तत्कालीन भूतल परिवहन मंत्रालय ( सड़क खण्ड ) की अधिसूचना संख्या का.आ. 78 ( अ ) , तारीख 4 फरवरी , 1999 , द्वारा उत्तर प्रदेश राज्य में राष्ट्रीय राजमार्ग सं. 2 के 93.000 कि.मी. से 479.000 कि.मी. ( हरियाणा/ उत्तर प्रदेश सीमा कानपुर सेक्शन ) और 0.000 कि.मी. से 334.000 कि.मी. ( कानपुर- वाराणासी सेक्शन ) तक का खण्ड भारतीय राष्ट्रीय राजमार्ग प्राधिकरण ( जिसे इसमें इसके पश्चात् 'प्राधिकरण ' संदर्भित किया गया है ) को सौंपा है ;
और, केन्द्रीय सरकार ने , राष्ट्रीय राजमार्ग शुल्क (दरों का अवधारण एवं संग्रहण ) नियम , 2008 के साथ पठित राष्ट्रीय राजमार्ग अधिनियम , 1956 ( 1956 का 48 ) की धारा 7 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , भारत सरकार के तत्कालीन पोत परिवहन , सड़क परिवहन और राजमार्ग मंत्रालय ( सड़क परिवहन और राजमार्ग विभाग ) की अधिसूचना संख्या का.आ. 893 (अ ) , तारीख 31 मार्च , 2009 द्वारा उत्तर प्रदेश राज्य में राष्ट्रीय राजमार्ग सं. 2 के 470.00 कि.मी. से 38.00 कि.मी. ( नया चैनेज 457.377 कि.मी. से 508.877 कि.मी. ) तक के खण्ड (जिसे इसमें इसके पश्चात् 'उक्त खण्ड' संदर्भित किया गया है ) के चार लेन के खण्ड के उपयोग के लिए यांत्रिक वाहनों पर शुल्क लगाने और संग्रहीत करने हेतु भारतीय राष्ट्रीय राजमार्ग प्राधिकरण को प्राधिकृत किया था ।

कि.मी. से 483.687 कि.मी. तक इटावा- चकेरी सेक्शन के उक्त खण्ड का डिजाइन , निर्माण, वित्त, प्रचालन और हस्तांतरण (डीबीएफओटी ) आधार पर विकास करने हेतु 05/03/2012 को मैसर्स इटावा- चकोरी ( कानपुर ) हाइवे प्राइवेट लिमिटेड, जिसका पंजीकृत कार्यालय 21/48 , कमर्शियल कम्लेक्स, मालचा मार्ग , डिप्लोमेटिक एन्क्लेव , नई दिल्ली 110021 में है, के साथ एक करार किया है ।
और मैसर्स इटावा-चकेरी ( कानपुर ) हाइवे प्राइवेट लिमिटेड को अधिसूचना सं . का. आ. 130 (अ ) , तारीख 11 जनवरी , 2013 के द्वारा वाणिज्यिक प्रचालन की तारीख से राष्ट्रीय राजमार्ग सं. 2 के 323.475 कि.मी. से 483.687 कि.मी. तक के खण्ड के उपयोग के लिए यांत्रिक वाहनों पर शुल्क उद्ग्रहीत और संग्रहीत करने हेतू प्राधिकृत किया गया है ।
और , मैसर्स इटावा-चकेरी ( कानपुर ) हाइवे प्राइवेट लिमिटेड के लिए वाणिज्यिक प्रचालन की तारीख प्राधिकरण द्वारा अभी घोषित की जानी है ।
अतः अब, केन्द्रीय सरकार, समय - समय पर यथासंशोधित, राष्ट्रीय राजमार्ग शुल्क ( दरों का अवधारण और संग्रहण ) नियम, 2008 (जिसे इसमें पश्चात् 'उक्त नियम' कहा गया है ) , के नियम 3 के साथ पठित राष्ट्रीय राजमार्ग अधिनियम , 1956 ( 1956 का 48 ) की धारा 7 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , और अधिसूचना संख्या का.आ. 893 (अ ) , तारीख 31 मार्च, 2008 का अधिक्रमण करते हुए उत्तर प्रदेश राज्य में राष्ट्रीय राजमार्ग सं. 2 पर 470.00 कि.मी. से 38.00 कि.मी. तक ( नया चैनेज 457.377 कि.मी. से 508.877 कि.मी. ) ( भौन्ती- फतेहपुर सेक्शन ) के उपयोग हेतु नीचे सारणी 1 और 2 में निर्दिष्ट प्रकार के वाहनों पर चार या अधिक लेन के खण्डों पर सड़क खण्ड की निवल लम्बाई 28.333 कि.मी. के लिए सारणी 1 के स्तम्भ (2 ) में निर्दिष्ट आधार दरों पर तथा पचास करोड़ रूपए या अधिक की लागतवाली संरचनाओं के लिए पर सारणी 2 में निर्दिष्ट आधार दरों पर शुल्क उद्ग्रहीत करती है और प्राधिकरण को अपने अधिकारियों के माध्यम से अथवा संविदाकार के माध्यम से उक्त शुल्क का संग्रहण करने हेतु प्राधिकृत करती है , अर्थात्: -

1. नीचे लगाए गए शुल्क का उद्ग्रह एवं संग्रहण निम्नलिखित टोल प्लाजा पर ऐसे टोल प्लाजा के लिए विनिर्दिष्ट सड़क की लम्बाई के लिए शोध्य और संदेय होगा :
(क ) मैसर्स इटावा-चकेरी (कानपुर ) हाइवे प्राइवेट लिमिटेड के लिए वाणिज्यिक प्रचालन की तारीख की घोषणा से पहले

(क) मैसर्स इटावा-चकेरी ( कानपुर ) हाइवे प्राइवेट लिमिटेड के लिए वाणिज्यिक प्रचालन की तारीख की घोषणा से पहले

जिस व्यक्ति का अपना यांत्रिक वाहन गैर - वाणिज्यिक प्रयोजनों के लिए पंजीकृत हुआ हो और वह टोल प्लाजा से बीस कि.मी. तक की दूरी में ही रहा हो उसके लिए वर्ष 2012- 13 के लिए मासिक पास की दर 200.00 रूपए (दो सौ रूपए मात्र ) प्रतिमाह होगी और राष्ट्रीय राजमार्ग शुल्क ( दरो का अवधारण और संग्रहण ) नियम , 2008 के उपबंधों के अनुसार , उसमें प्रत्येक वर्ष संशोधन किया जाएगा ।
4. राजमार्ग खण्ड पर बहुयात्राओं हेतु पास निम्नलिखित दरों पर प्रदान किए जाएंगे, अर्थात्ः [ भाग II-खण्ड 3 (ii ) ]

5. जिस जिले में शुल्क प्लाजा पड़ता है उस जिले में पंजीकृत वाणिज्यिक वाहन ( राष्ट्रीय परमिट के अधीन चल रहे वाहनों को छोड़कर ) के लिए शुल्क उस श्रेणी के वाहन के लिए निर्धारित शुल्क का 50 % होगा बशर्ते के ऐसे वाणिज्यिक वाहनों के उपयोग के लिए कोई सर्विस रोड अथवा वैकल्पिक सड़क उपलब्ध न हो ।
6. जो यांत्रिक वाहन नियमों के अधीन अपने प्रवर्ग के लिए निर्धारित अनुज्ञेय भार की अपेक्षा अधिक भार से लदे हुए होंगे उन्हें उन दरों पर शुल्क का संदाय करना होगा जो उनसे अगली उच्च श्रेणी के वाहनों के लिए लागू होता है और उन्हें तब तक राजमार्ग खण्ड का उपयोग करने का अधिकार नहीं होगा जब तक कि ऐसे यांत्रिक वाहन से अधिक भार को हटा न दिया जाए ।
7. यांत्रिक वाहनों के प्रवर्ग , उनके लिए अनुज्ञेय भार , छूटप्राप्त वाहनों के प्रवर्ग , सर्विस रोड, वैकल्पिक सड़क आदि सहित सभी परिभाषाएं नियमों में विनिर्दिष्ट परिभाषाओं के अनुसार होगी ।
8. उक्त नियमों के नियम 12 के अनुसार, उपयोगकर्ताओं की जानकारी के लिए शुल्क की दरों को प्रदर्शित किया जाएगा ।
9. उक्त नियमों के नियम 5 के अनुसार शुल्क की दरों में वार्षिक तौर पर संशोधन किया जाएगा ।
10. परियोजना की अनुमानित पूंजीगत लागत 605.41 करोड़ रूपए है । प्राधिकरण द्वारा उपयोगकर्ताओं से वसूल किए गए शुल्क के जरिए पूंजीगत लागत की वसूली का रिकार्ड रखा जाएगा और पूंजीगत लागत की वसूली हो जाने के बाद, लगाए गए शुल्क की दरों को घटाकर 40% कर दिया जाएगा और इनमें उक्त नियमों के अनुसार वार्षिक तौर पर संशोधन किया जाएगा । 31.03.2012 तक की गई उगाही से उपयोगकर्ताओं से कुल 66.86 करोड़ रूपए वसूल किए गए ।

New Delhi , the 29th January, 2013
S.O. 288 (E ) -Whereas by notification of the Government of India in the erstwhile Ministry of Surface Transport (Roads Wing ) number S.O 78 ( E ) dated 4th February , 1999 , issued under section 11 of the National Highways Authority of India Act, 1988 (68 of 1988 ) , the Central Government entrusted the stretch from kilometer 93.000 to kilometer 479.000 (Haryana /Uttar Pradesh Border Kanpur section) and from kilometer 0.000 to kilometer 334.000 (Kanpur - Varanasi section ) of National Highway No. 2 in the State of Uttar Pradesh to the National Highways Authority of India ( hereinafter referred to as the " Authority" ) ;
And whereas , in exercise of the powers conferred by section 7 of the National Highway Act 1956 (48 of 1956) read with National Highways Fee ( Determination of Rates and Collection) Rules , 2008 , the Central Government by notification of the Government of India in the erstwhile Ministry of Shipping , Road Transport and Highways (Department of Road Transport and Highways ) number S.O. 893 (E) dated 31st March, 2009 , authorized Authority for levying and collecting fee on mechanical vehicles for the use of four - laned stretch from kilometer 470.00 to kilometer 38.00 ( new chainage km 457.377 to km 508.877) ofNational Highway No. 2 ( hereinafter referred to as the " said stretch " ) in the State of Uttar Pradesh at the rates and category of vehicles specified in its schedule.
And whereas , pursuant to the provision of section 14 of the National Highways Authority of India Act, 1988 (68 of 1988 ) , the Authority has entered into an Agreement on 05/03/2012 with M/s Etawah- Chakeri ( Kanpur) Highway Private Limited having its registered office at 21/48 , Commercial Complex , Malcha Marg, Diplomatic Enclave , New Delhi - 110021 , for the development of Etawah- Chakeri section from Km 323.475 to Km 483.687 on National Highway No. 02 in the state of Uttar Pradesh on Design, Build, Finance , Operate and Transfer (DBFOT) basis of the said section .
And whereas , M/ s Etawah-Chakeri ( Kanpur) Highway Private Limited has been authorized for leving and collecting fee on mechanical vehicles for the use of the stretch from Km 323.475 to Km. 483.687 of National Highway No. 2 from the date of commercial operation vide notification bearing S.O. No. 130 (E) dated 11th January, 2013.
And whereas , the commercial operation date for M/ s Etawah- Chakeri ( Kanpur) Highway Private Limited is yet to be declared by the Authority .
Now, therefore , in exercise of the powers conferred by section 7 of the National Highways Act, 1956 (48 of 1956 ) , read with Rule 3 of the National Highways Fee (Determination of Rates and Collection) Rules , 2008 and amended from time to time (hereinafter referred to as the " said Rules " ) , and in supersession of the notification bearing no. S.O. 893 ( E ) dated 31st March, 2009 , the Central Government hereby levies the fee at the base rates specified in columns (2) of the Table 1 for net road section length of 28.333 Km for use of the four and more lane sections and at the base rates specified in Table 2 for structures costing Rupees Fifty crore or more on the Type of Vehicles specified in Table 1 and 2 below, for the use of the section from kilometer 470.00 to kilometer 38.00 ( new chaninage Km 457.377 to Km 508.877) (Bhaunti Fatehpur Section) on the National भारत का राजपत्र असाधारण

3 . The rate of monthly pass for a person who owns a mechanical vehicle registered for non- commercial purposes and resides within a distance of twenty kilometers from the toll plaza is Rs . 200.00 ( Rupees Two Hundred only) for the year 2012-13 and is subject to revision every year as per the provisions of the National Highways Fee (Determination of Rates and Collection) Rules , 2008 .
4. Formultiple journey on the highway section, passes shall be issued at the following rates , namely :

5. Fee for commercial vehicle (excluding vehicles plying under National permit ) registered in the district where the fee plaza falls shall be 50% of the prescribed rate for that category of vehicle provided no service road or alternative road is available for use of such commercial vehicles .

Mechanical vehicles which is loaded in excess of permissible load specified for its category under the rules , shall be liable to pay fee at such rates which is applicable for the next higher category of the vehicles and shall not be entitled to make use of the highway section unless the excess load has been removed from such mechanical vehicle .

7. . All definitions including category of mechanical vehicles , its permissible load , category of exempted vehicles , service road, alternative road etc. shall be as per definitions specified in the rules.
8. The fee rates shall be displayed for information of the users in accordance with rules 12 of the said rules .
9. The fee rates shall be revised annually in accordance with the rule 5 of the said rules .
10 . The estimated capital cost of the project is Rupees 605.41 crores . The Authority shall maintain a record of the recovery of capital cost through user fee realised and after recovery of the capital cost , the fee leviable shall be reduced to 40% of the rates and shall be revised annually in accordance with the said rules . A total of Rs . 66.86 crores has been recovered from the user fee realized till 31.03.2012 .
