का.आ. 285(अ) .- जबकि मैसर्स एस्सार पावर ( झारखण्ड ) लिमिटेड ( ईपीजेएल ) , आवेदक जिनका पंजीकृत कार्यालय प्रकाशदीप 10वां तल , 7 , टॉलस्टाय मार्ग , नई दिल्ली -110001 में है , ने ईपीजेएल टीपीएस ( 2 × 600 मेगावाट ) से 400 केवी झारखण्ड पूलिंग स्टेशन ( पीजीसीआईएल ) क्वाड मूस डी/ सी लाइन तक समर्पित 400 केवी पारेषण लाइन के निर्माण के लिए विद्युत अधिनियम , 2003 की धारा 164 के अंतर्गत अनुमोदन के लिए आवेदन किया है ।
और जबकि भारत सरकार विद्युत मंत्रालय ने दिनांक 09.06.2011 के पत्र संख्या 11/2/2011 पीजी (एस्सार ) के माध्यम से झारखण्ड में 1200 मेगावाट ( 2×600 मेगावाट) एस्सार विद्युत परियोजना से सम्बद्ध पारेषण की ओवरहेड लाइनों की संस्थापना हेतु विद्युत अधिनियम , 2003 की धारा 68 के अंतर्गत मैसर्स एस्सार पावर (झारखण्ड) लिमिटेड को अनुमोदन प्रदान किया था।
और जबकि आवेदक ने अब विद्युत अधिनियम , 2003 का धारा 164 के अंतर्गत सभी शक्तियां प्रदान करने का अनुरोध किया है जो कार्यों के लिए सरकार द्वारा स्थापित अथवा रख - रखाव किए गए टेलीग्राफ या इस प्रकार स्थापित अथवा रख - रखाव किए जाने वाले टेलीग्राफ के उद्देश्यों हेतु टेलीग्राफ लाइनें और खम्बे लगाने के संबंध में भारतीय टेलीग्राफ अधिनियम , 1885. के अतंर्गत टेलीग्राफ प्राधिकरण के पास होती है । स्कीम के अंतर्गत शामिल 1.6 किलोमीटर की पारेषण लाइन निम्नलिखित गांवों, नगरों और शहरों से, उनके ऊपर से, उनके आसपास से तथा उनके बीच से गुजरेंगीः-

इसलिए अब सावधानीपूर्वक विचार करने के पश्चात् भारत सरकार , विद्युत मंत्रालय , विद्युत अधिनियम, 2003 की धारा 164 के अंतर्गत आवेदक को वे सभी शक्तियां प्रदान करती है जो विद्युत के अन्तर्राज्यीय पारेषण हेतु उपरोक्त वर्णित अन्तर्राज्यीय पारेषण लाइनों की संस्थापना के लिए निम्नलिखित निबंधन एवं शर्तों के अधीन सरकार द्वारा स्थापित अथवा रख - रखाव किए गए टेलीग्राफ या इस प्रकार स्थापित अथवा रख- रखाव किए जाने वाले टेलीग्राफ के उद्देश्यों हेतु टेलीग्राफ लाइनें और खम्बे लगाने के संबंध में भारतीय टेलीग्राफ अधिनियम, 1885 के अंतर्गत टेलीग्राफ प्राधिकरण के पास होती है । अर्थातः-
i . अनुमोदन 25 वर्ष के लिए प्रदान किया जाता है।
ii . आवेदक को प्रस्तावित लाइनों के निर्माण से पूर्व संबंधित प्राधिकरणों अर्थात स्थानीय निकायों, रेलवे , राष्ट्रीय राजमार्गों, राज्य राजमार्गों आदि की सहमति प्राप्त करनी होगी।

आवेदक को पारेषण , ओएंडएम , खुली पहुँच आदि के संबंध में उपयुक्त आयोग के निम्नलिखित विनियमों/संहिताओं का पालन करना होगा ।
iv. आवेदक को ईपीजेएल टीपीएस (2× 600 मेगावाट) से 400 केवी झारखण्ड पूलिंग स्टेशन (पीजीसीआईएल ) क्वाड मूस डी/सी लाइन तक समर्पित 400 केवी पारेषण लाइन के निर्माण का दायित्व सौंपा गया है। कार्यों का ब्यौरा अक्टूबर, 1-7, 2011 के भारत के राजपत्र में प्रकाशित किया गया है ।
V. आवेदक संबंधित राज्यों के मुख्य वैद्युत निरीक्षक के अनुमोदन के पश्चात् लाइनों का प्रचालन करेगा।
vi . यह अनुमोदन विद्युत अधिनियम, 2003 के प्रावधानों और उसके अंतर्गत बनाए गए नियमों की मांग का आवेदक द्वारा अनुपालना किए जाने के अधीन है ।

S.O. 285 ( E ) .- Whereas M / s Essar Power ( Jharkhand) Limited (EPJL) , the applicant with its Registered Office at Prakash Deep , 10th Floor , 7 , Tolstoy Marg , New Delhi 110001 has applied for approval under Section 164 of the Electricity Act , 2003 for construction of dedicated 400 kV transmission line from EPJL TPS ( 2x600MW) to 400 kV Jharkhand pooling station ( PGCIL) Quad Moose D /C Line .
And whereas Government of India , Ministry of Power vide letter No. 11 / 2 / 2011 - PG ( Essar ) dated 09.06.2011 had granted to M / s Essar Power ( Jharkhand) Limited approval under section 68 of the Electricity Act, 2003 for installation of overhead lines of the associated transmission of 1200 MW ( 2x600 MW) Essar Power Project in Jharkhand .

And whereas the applicant has now requested to confer upon him all the powers under section 164 of the Electricity Act , 2003 which telegraph authority possess under the Indian Telegraph Act , 1885 with respect to the placing of telegraph lines and posts for the purposes of a telegraph established or maintained , by the Government or to be so established or maintained for the works . The transmission line of 1.6 km covered under the scheme will pass through , over , around and between the following villages , towns and cities : -
State :
Jharkhand
District : Latehar
Tehsil : Chandwa
Villages : Angarha, Chatro & Ambadohar
Now, therefore , after careful consideration , Government of India, Ministry of Power , confers , under section 164 of the Electricity Act , 2003, all the powers on the applicant which telegraph authority possesses under the Indian Telegraph Act, 1885 with respect to the placing of telegraph lines and posts for the purposes of a telegraph established or maintained , by the Government or to be so established or maintained subject to following terms and conditions for installing the above mentioned interstate transmission lines for inter- state transmission of electricity , namely: -
(i) the approval is granted for 25 years ;
(ii) the Applicant shall have to seek the consent of the concerned authorities i.e. local bodies , Railways , National Highways , State Highways etc. before erection of proposed lines;
(iii) the Applicant shall have to follow regulations / codes of the appropriate commission regarding transmission , O & M , open access etc;
(iv) the Applicant has been entrusted with the responsibility for Construction of dedicated 400 kV transmission line from EPJL TPS ( 2x600MW) to 400 kV Jharkhand pooling station (PGCIL) Quad Moose D/ C Line . The details of the works are published in the Gazette of India of October 17 , 2011
(v) the Applicant shall operate the lines after approval of ChiefElectrical Inspector of respective States ;
(vi ) the approval is subject to compliance by the Applicant to the requirement of the provisions of The Electricity Act, 2003 and the rules made thereunder .
