सा.का.नि. 50(अ) .- केन्द्रीय सरकार, सूचना प्रौद्योगिकी अधिनियम, 2000 (2000 का 21 ) की धारा 87 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए साइबर अपील अधिकरण ( अध्यक्ष और सदस्यों का वेतन, भत्ते और सेवा के अन्य निबंधन और शर्तें) नियम, 2009 का संशोधन करने के लिए निम्नलिखित नियम बनाती है, अर्थात:-
1. (1 ) इन नियमों का संक्षिप्त नाम साइबर अपील अधिकरण ( अध्यक्ष और सदस्यों का वेतन, भत्ते और सेवा के अन्य निबंधन और शर्तें) संशोधन नियम , 2012 है ।
(2) ये राजपत्र में प्रकाशन की तारीख से प्रवृत्त होंगे ।
2. साइबर अपील अधिकरण ( अध्यक्ष और सदस्यों का वेतन , भत्ते और सेवा के अन्य निबंधन और शर्तें) नियम, 2009 में नियम 3 के स्थान पर निम्नलिखित नियम रखा जाएगा , अर्थात्: -
"3. वेतन और भत्ते - ( 1 ) अध्यक्ष और सदस्य को उन सभी अभिलाभों सहित सचिव, भारत सरकार को लागू वेतन और भत्तों का संदाय किया जाएगा, जिनका सचिव, भारत सरकार पात्र है ।

(2) अध्यक्ष के रूप में किसी ऐसे व्यक्ति की नियुक्ति के मामले में जो उच्चतम न्यायालय या किसी उच्च न्यायालय से न्यायाधीश के रूप में सेवानिवृत्त हुआ है और जो पेंशन , उपदान, अंशदायी भविष्य निधि में नियोक्ता का अंशदान या किसी अन्य प्रकार का सेवनिवृत्ति लाभ प्राप्त कर रहा है, अथवा प्राप्त किया है , या प्राप्त करने के लिए हकदार हो गया है, ऐसे अध्यक्ष के वेतन को उसके द्वारा ली गयी या ली जाने वाली पेंशन की सकल राशि या अंशदायी भविष्य निधि में नियोक्ता के अंशदान या किसी अन्य रूप में सेवानिवृत्ति लाभों, यदि कोई है, से घटा दिया जाएगा ।
परन्तुअध्यक्ष के रूप में उच्चतम न्यायालय या किसी उच्च न्यायालय के सेवानिवृत्त न्यायाधीश की नियुक्ति के मामले में, ऐसे अध्यक्ष की सेवा के निबंधन और शर्तें वित्त मंत्रालय द्वारा विभिन्न अधिकरणों में न्यायाधीशों की नियुक्ति के संबंध में और उस मंत्रालय के परामर्श से जारी अनुदेशों के अनुसार होगी ।
(3 ) सदस्य के तौर पर किसी ऐसे व्यक्ति जो केन्द्र या राज्य सरकार की सेवा से सेवानिवृत्त हुआ है और जो पेंशन , अंशदायी भविष्य निधि में नियोक्ता के अंशदान या किसी अन्य प्रकार का लाभ प्राप्त कर रहा है अथवा प्राप्त किया है या प्राप्त करने के लिए पात्र हो गया है, के चयन के मामले में, ऐसे सदस्य के वेतन को उसके द्वारा ली गयी या ली जाने वाली पेंशन की सकल राशि या अंशदायी भविष्य निधि में नियोक्ता के अंशदान या किसी अन्य रूप में सेवानिवृत्ति लाभों, यदि कोई है, से घटा दिया जाएगा ।

NOTIFICATION
New Delhi , the 24th January, 2013
G.S.R. 50 ( E ) .In exercise of the powers conferred by sub section ( 1 ) of section 87 of the Information Technology Act , 2000 (21 of 2000) , the Central Government hereby makes the following rules to amend the Cyber Appellate Tribunal ( Salary, Allowances and Other Terms and Conditions of Service of Chairperson and Members ) Rules , 2009 , namely: - 3

1. ( 1 ) These rules may be called the Cyber Appellate Tribunal ( Salary, Allowances and Other Terms and Conditions of Service of Chairperson and Members ) AmendmentRules , 2012.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. In the Cyber Appellate Tribunal ( Salary, Allowances and Other Terms and Conditions of Service of Chairperson and Members ) Rules , 2009 , for rule 3 , the following shall be substituted , namely : --
" 3. Salary and allowances.- ( 1 ) The Chairperson and the Member shall be paid such salary and allowances , as are admissible to a Secretary to the Government of India , including all the benefits that a Secretary is entitled to.
(2) In the case of appointment of a person as the Chairperson, who has retired as a Judge of the Supreme Court or a High Court and who is in receipt of, or has received , or has become entitled to receive any retirement benefits by way of pension , gratuity , employer's contribution to Contributory Provident Fund or other forms of retirement benefits, the pay of such Chairperson shall be reduced by the gross amount of pension or employer's contribution to the Contributory Provident Fund or any other form of retirement benefit , if any, drawn or to be drawn by him:
Provided that in case a retired Judge of a Supreme Court or a High Court is appointed as the Chairperson , the terms and conditions of service of such Chairperson shall be in accordance with the instructions issued by the Ministry of Finance in respect of appointment of Judges to various Tribunals and in consultation with that Ministry .
(3) In the case of appointment of a person as Member who has retired from service under the Central Government or a State Government and who is in receipt of , or has received , or has become entitled to receive any retirement benefits by way of pension , gratuity, THE GAZETTE OF INDIA : EXTRAORDINARY

सा.का.नि. 51 (अ).- केन्द्रीय सरकार, सूचना प्रौद्योगिकी अधिनियम, 2000 ( 2000 का 21 ) की धारा 70 ख की उप-धारा (3 ) के साथ पठित धारा 87 की उप धारा (2) के खण्ड ( यङ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए संचार और सूचना प्रौद्योगिकी मंत्रालय, इलेक्ट्रॉनिकी और सूचना प्रौद्योगिकी विभाग , महानिदेशक ( भारतीय कंप्यूटर आपात अनुक्रिया दल) समूह 'क' पद भर्ती नियम , 2009 के अधिक्रमण में सिवाए ऐसे अधिक्रमण से पूर्व किए गए अथवा किए जाने से लोप किए गए कार्यों के महानिदेशक, भारतीय कंप्यूटर आपात अनुक्रिया दल की अर्हताओं, अनुभव और सेवा की अन्य शर्तों और निबंधनों का विनियमन करने के लिए निम्नलिखित नियम बनाती है, अर्थात:-
1. संक्षिप्त नाम और प्रारम्भ -( 1 ) इन नियमों का संक्षिप्त नाम सूचना प्रौद्योगिकी (महानिदेशक, भारतीय कंप्यूटर आपात अनुक्रिया दल का वेतन भत्ते और सेवा के अन्य निबंधन और शर्तें) नियम, 2012 हैं ।
(2) ये राजपत्र में प्रकाशन की तारीख से प्रवृत्त होंगे ।
2. परिभाषाएं: इन नियमों में जब तक कि संदर्भ में अन्यथा आवश्यक न हो: -
(क) " अधिनियम" से सूचना प्रौद्योगिकी अधिनियम , 2000 (2000 का 21 ) अभिप्रेत है ।
(ख) "महानिदेशक" से अधिनियम की धारा 70 (ख) की उप- धारा (2) के अधीन नियुक्त महानिदेशक अभिप्रेत है ।
(ग) " आईसीईआरटी" से अधिनियम की धारा 70 (ख) की उप- धारा (i ) के अधीन अधिसूचित भारतीय कंप्यूटर आपात अनुक्रिया दल अभिप्रेत है ।

3. शैक्षिक अर्हताएं एवं अनुभव : किसी व्यक्ति को तब तक महानिदेशक नियुक्त नहीं किया जाएगा जब तक वह निम्नलिखित अर्हताएं न रखता हो:-
(i ) (क) विज्ञान/ इंजीनियरी में डॉक्ट्रेट की उपाधि और 15 वर्ष का अनुभव जिसमें से सूचना प्रौद्योगिकी ( आईटी) या संबंधित क्षेत्रों में वरिष्ठ प्रबंधक स्तर पर 5 वर्ष का अनुभव होना चाहिए ; अथवा
(ख ) विज्ञान अथवा इंजीनियरी अथवा प्रौद्योगिकी में स्नातकोत्तर उपाधि और 18 वर्ष का अनुभव जिसमें से 5 वर्ष का अनुभव सूचना प्रौद्योगिकी ( आईटी) या संबंधित क्षेत्रों में वरिष्ठ प्रबंधन स्तर पर होना चाहिए; अथवा
(ग) इंजीनियरी अथवा प्रौद्योगिकी में स्नातक डिग्री और 20 वर्ष का अनुभव जिसमें से सूचना प्रौद्योगिकी (आईटी) या संबंधित क्षेत्रों में वरिष्ठ प्रबंधन स्तर पर 5 वर्ष का अनुभव होना चाहिए ;और
(ii ) साइबर सुरक्षा, साइबर सुरक्षा घटनाओं से निपटने में दलों का मार्गदर्शन , सूचना सुरक्षा परीक्षकों एवं अन्य सुरक्षा अभिकरणों के साथ समन्वयन के क्षेत्र में कम से कम दो वर्ष का अनुभव ।
4. महानिदेशक की सेवा के निबंधन और शर्तें:महानिदेशक 5 वर्ष की अवधि के लिए पद धारण करेगा और पुनर्नियुक्ति का पात्र होगा ।
परन्तुयह कि कोई भी व्यक्ति 65 वर्ष की आयु के पश्चात पद धारण नहीं करेगा ।
5. वेतन एवं भत्ते -:महानिदेशक अपर सचिव, भारत सरकार को अनुज्ञेय लागू वेतन एवं भत्ते संदत्त किए जाएंगे जिसमें वे सभी अभिलाभ शामिल हैं जिनके लिए अपर सचिव हकदार है :
परन्तु यह कि ऐसे महानिदेशक के वेतन एवं भत्तों से पेंशन की सकल राशि और उपदान के समतुल्य पेंशन राशि अथवा अंशदायी भविष्य निधि में नियोक्ता के अंशदान अथवा उनके द्वारा आहरित किसी भी प्रकार के अन्य सेवानिवृत्ति लाभों यदि कोई हैं, घटादिया जाएगा ।
6. भविष्य निधि: महानिदेशक, भारतीय कम्प्यूटर आपात अनुक्रिया दल को अंशदायी भविष्य निधि ( भारत) नियम 1962 के उपबंध लागू होंगे और वे सामान्य भविष्य निधि में अंशदान करने के लिए हकदार नहीं है ।

7. पेंशन-: महानिदेशक को भारतीय कम्प्यूटर आपात अनुक्रिया दल में क्रमशः नियुक्ति के पश्चात पदभार ग्रहण करने पर सरकारी सेवा से सेवानिवृत्त हुआ माना जाएगा और वे भारतीय कम्प्यूटर आपात अनुक्रिया दल में की गई सेवा के लिए कोई भी पेंशन तथा उपदान प्राप्त करने के लिए हकदार नहीं है ।
8. मंहगाई भत्ता: महानिदेशक, केंद्र सरकार में समतुल्य वेतन आहरित करने वाले अधिकारियों के लिए लागू दर से मंहगाई भत्ते के लिए हकदार होगा ।
9. छुट्टी यात्रा रियायत , यात्रा भत्ता और दौरे पर होने पर मंहगाई भत्ता : महानिदेशक को दौरे के दौरान यात्रा भत्ते तथा दैनिक भत्ते का भुगतान समान मूल वेतन आहरित करने वाले केंद्र सरकार के कर्मचारियों के लिए यथा लागू भत्तों के अनुसार किया जाएगा । वे बाह्य स्थानों पर समतुल्य वेतन आहरित करने वाले सरकारी कर्मचारियों की पात्रता के अनुसार उस श्रेणी के सामान्य किराए का भुगतान करने पर केंद्र सरकार के नियंत्रणाधीन अतिथि गृह अथवा निरीक्षण बंगले में अस्थाई सरकारी आवास की सुविधा, जहां कहीं लागू है, के लिए पात्र हैं ।
10. विदेशी दौरे: - महानिदेशक द्वारा विदेशी दौरे भारत सरकार में समतुल्य श्रेणी के अधिकारियों के लिए यथा लागू सरकारी आदेशों के अनुसार ही किए जाएंगे । विदेश में सरकारी प्रतिनिधिमण्डल , जिसमें सचिव, इलेक्ट्रॉनिकी और सूचना प्रौद्योगिकी विभाग तथा महानिदेशक, शामिल हैं, में प्रतिनिधिमण्डल का नेतृत्व सचिव द्वारा किया जाएगा । स्वदेशी दौरों के संबंध में महानिदेशक सचिव , इलेक्ट्रॉनिकी और सूचना प्रौद्योगिकी विभाग को अपने दौरा कार्यक्रम के बारे में सूचित रखेंगे ।
11. आवास: दिल्ली अथवा इससे संलग्न कस्बों में रहने वाले महानिदेशक को आहरित मूल वेतन के 30 % की दर से मकान किराया भत्ते के लिए दावा करने का विकल्प दिया जाएगा और वे केंद्र सरकार द्वारा मकान आवंटन अथवा भारतीय कम्प्यूटर आपात अनुक्रिया दल द्वारा किराए पर लिए गए किसी मकान के लिए पात्र नहीं होंगे ।
12. चिकित्सा सुविधाएं : महानिदेशक सेवानिवृत्त सरकारी कर्मचारियों के लिए केंद्रीय सरकारी स्वास्थ्य सेवा योजना में किए गए उपबंधों के अनुसार चिकित्सा उपचार और अस्पताल सुविधाओं के लिए पात्र होगा । ऐसे स्थान जहां केंद्रीय सरकारी स्वास्थ्य योजना प्रचालन में नहीं है, में महानिदेशक, जो सरकारी कर्मचारी नहीं है । केंद्रीय सेवा (चिकित्सा परिचर) नियम में किए गए उपबंधों के अनुसार चिकित्सा सुविधाओं के लिए पात्र होगा ।

13. अवकाश-: महानिदेशक प्रत्येक सेवा वर्ष के लिए 30 दिनों के अर्जित अवकाश का हकदार होगा । अवकाश के दौरान अवकाश वेतन का भुगतान केन्द्रीय सिविल सेवा (अवकाश) नियम, 1972 के नियम 40 द्वारा विनियमित किया जायेगा । वह अपने खाते में किसी भी समय अपने 50 % अर्जित अवकाश के नकदीकरण के लिए हकदार होगा ।
14. प्रशासनिक एवं अन्य मामले- भारतीय कम्प्यूटर आपात अनुक्रिया दल के प्रचालनों से संबंधित प्रशासनिक मामलों या महानिदेशक की सेवा संबंधी निबंधन और शर्तें, जिनके संबंध में इन अनुदेशों में कोई अभिव्यक्त उपबंध नहीं किया गया है, को प्रत्येक मामले में विनिश्चय के लिए केंद्र सरकार को निर्दिष्ट किया जाएगा और उस पर केंद्र सरकार का विनिश्चय भारतीय कम्प्यूटर आपात अनुक्रिया दल पर बाध्यकर होगा ।

NOTIFICATION

G.S.R. 51 ( E) . In exercise of the powers conferred by clause (ze ) of sub- section (2) of section 87, read with sub- section ( 3 ) of section 70B of the Information Technology Act 2000 (21 of 2000) , and in supersession of the Ministry of Communications and Information Technology, Department of Information Technology , Director General ( Indian Computer Emergency Response Team ) Group ' A' post Recruitment Rules , 2009 , except as respects things done or omitted to be done before such supersession , the Central Government hereby makes the following rules regulating the qualifications , experience and other terms and condition of service of the Director General , Indian Computer Emergency Response Team , namely:-
1. Short title and commencement .- ( 1 ) These rules may be called the Information Technology (Salary , Allowances and Terms and Conditions of Service of the Director General , Indian Computer Emergency Response Team ) Rules , 2012 .
(2) They shall come into force on the date of their publication in the Official Gazette .
2. Definitions.- In these rules , unless the context otherwise requires, -
(a) "Act " means the Information Technology Act , 2000 ( 21 of 2000 ) ;

(b) " Director General " means the Director General appointed under sub- section (2) of section 70B of the Act ;
(c) " ICERT" means Indian Computer Emergency Response Team notified under sub- section ( 1 ) of section 70B of the Act .
3. Educational qualifications and experience.- No person shall be appointed as a Director General unless he has , -
(i ) (a) Doctorate in Science/Engineering and fifteen years' experience out of which five years should be at senior management level in Information Technology ( IT) or related sectors; or
(b) Master's Degree in Science or Engineering or Technology and eighteen years' experience out of which five years should be at senior management level in Information Technology ( IT) or related sectors; or
(c ) Bachelor's Degree in Engineering or Technology and twenty years' experience out of which five years should be at senior management level in Information Technology ( IT) or related sectors; and
(ii) a minimum of two years' experience in the area of cyber security , guiding teams in handling cyber security incidents , interface with information security auditors and other security agencies .
4. Terms and conditions of service of the Director General.- The Director General shall hold office for a period of five years , and shall be eligible for re - appointment:
Provided that no person shall hold office beyond the age of 65 years .
5. Pay and allowances.- The Director General shall be paid the pay and allowances as admissible to an Additional Secretary to the Government of India including all the benefits that an Additional Secretary is entitled to:

Provided that the pay and allowances of such a Director General shall be reduced by gross amount of pension and pension equivalent of gratuity or employer's contribution to the Contributory Provident Fund or any other form of retirement benefits , if any, drawn by him.
6. Provident Fund.- The Director General , Indian Computer Emergency Response Team shall be governed by the provision of the Contributory Provident Fund ( India) Rules , 1962 and is not entitled to subscribe under General Provident Fund.
7. Pension.- The Director General shall be deemed to have retired from Government Service upon taking up respective appointment in the Indian Computer Emergency Response Team and not entitled for any pension and gratuity for the service rendered in the Indian Computer Emergency Response Team .
8. Dearness Allowance .- The Director General shall be entitled to Dearness Allowance at the rate admissible to the officers of equivalent pay in the Central Government .
9. Leave Travel Concession , Travelling Allowance and Dearness Allowance on tour.- Travelling Allowance and Daily Allowance on tour shall be paid to the Director General as applicable to Central Government servants drawing same basic pay . They would also be entitled to facility of temporary Government accommodation in Guest House or Inspection Bungalows under the control of the Central Government , wherever applicable , on payment of normal rent at out- stations , of the class to which Government Servants of equivalent pay are eligible .
10. Visits abroad .- Official visits abroad by the Director General would be undertaken only in accordance with the Government orders as applicable to officers of equivalent grade in Government of India . in regard to official delegations abroad in which both the Secretary , Department of Electronics and Information Technology and the Director General are included , the Secretary would lead the delegation . For domestic tours the Director General would keep the Secretary , Department of Electronics and Information Technology informed about the tour programme .

11. Accommodation.- The Director General located in Delhi or in one of its satellite towns would be given the option of claiming House Rent Allowance @ 30 % of the basic pay drawn and not entitled for any house allotmentby the Central Government or any house hired by the Indian Computer Emergency Response Team.
12. Medical Facilities .- The Director General shall be entitled to Medical treatment and Hospital facilities as provided in the Central Government Health Service Scheme for retired Government Servants . At places where the Central Government Health Scheme is not in operation , Director General , who is not a Government Servants shall be entitled to the facilities as provided in the Central Service ( Medical Attendance) Rules.
13. Leave . Director General would be entitled to thirty days of Earned Leave for every year of service. The payment of leave salary during leave shall be governed by Rule 40 of Central Civil Service ( Leave) Rules , 1972. He would be entitled to encashment of fifty percent of Earned Leave to his credit at any time.
14. Administrative and other residuary matters.- Administrative matters relating to the operations of Indian Computer Emergency Response Team or the conditions of service of the Director General , with respect to which no express provision has been made in these instructions , shall be referred in each case to the Central Government for its decision and the decision of the Central Government thereon shall be binding onthe Indian Computer Emergency Response Team.
