फा. सं. 4/15015/30/2011 .-- भारतीय खाद्य सुरक्षा और मानक ( विक्रय प्रतिषेध और निर्बंधन ) विनियम, 2011 का और संशोधन करने के लिए कतिपय प्रारूप विनियम खाद्य सुरक्षा और मानक अधिनियम , 2006 ( 2006 का 34 ) की धारा 26 के साथ पठित धारा 92 की उप - धारा ( 2 ) के खण्ड ( ठ ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, भारत के राजपत्र , असाधारण , भाग III , खण्ड 4 के पृष्ठ 1 से 9 में भारत सरकार के भारतीय खाद्य सुरक्षा मानक प्राधिकरण की अधिसूचना फा. सं. 4/15015/30/2011 तारीख 29 दिसम्बर , 2011 में प्रकाशित किया गया था जिसमें उन सभी व्यक्तियों से जिनकी उससे प्रभावित होने की संभावना थी , से उस तारीख से जिसको राजपत्र की प्रतियाँ जिसमें उक्त अधिसूचना प्रकाशित की गई थी , जनता को उपलब्ध करा दी गई थी; से दस दिन की अवधि की समाप्ति तक आक्षेप और सुझाव मांगे गए थे ;
और उक्त भारत के राजपत्र की प्रतियां 2 जनवरी , 2012 को जनता को उपलब्ध करा दी गई थी;
और केन्द्रीय सरकार द्वारा जनता से प्राप्त आक्षेप और सुझावों पर विचार कर लिया गया है ;
अतः , अब , भारतीय खाद्य सुरक्षा मानक प्राधिकरण , खाद्य सुरक्षा और मानक अधिनियम, 2006 (2006 का 34 ) की धारा 92 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , खाद्य सुरक्षा और मानक ( विक्रय प्रतिषेध एवं निर्बंधन ) का और संशोधन करने के लिए निम्नलिखित विनियम बनाता है अर्थात्:-
विनियम
1. संक्षिप्त नाम और प्रारंभ
संशोधन ) विनियम , 2013 है ।
( 1 ) इन नियमों का संक्षिप्त नाम खाद्य सुरक्षा और मानक ( विक्रय प्रतिषेध एवं निर्बंधन ) (
(2) ये राजपत्र में उनके अंतिम प्रकाशन की तारीख को प्रवृत्त होंगे ।
2. खाद्य सुरक्षा और मानक ( विक्रय प्रतिषेध एवं निर्बंधन ) विनियम , 2011 में,-
(क ) प्रस्तावना के आरंभिक भाग में, " धारा 26 के साथ पठित धारा 92 की उप - धारा ( 2 ) के खंड ( ठ ) " शब्दों, कोष्ठकों और अंकों के स्थान पर " धारा 92 " शब्द और अंक रखे जाएंगे ।
(ख) विनियम 21 के उप - विनियम 2.1.1 , में दूसरे परंतुक के स्थान पर निम्नलिखित परंतुक रखा जाएगा , अर्थात्:-
" परंतु यह और कि उप - विनियम 2.1.1 के खण्ड ( 8 ) और खंड ( 10 ) से संबंधित खाद्य सुरक्षा और मानक ( विक्रय प्रतिषेध एवं निर्बंधन ) विनियम , 2011 के उप- विनियम 2.12.1 में यथा परिभाषित सांपतिक खाद्य वस्तुओं को इन विनियमों के प्रचालन से छूट प्राप्त होगी । "

NOTIFICATION
New Delhi , the 8th February, 2013
F. No. 4/15015/30/2011 . Whereas certain draft regulations further to amend the Food Safety and Standards (Prohibition and Restrictions on Sales ) Regulations , 2011 , were published in exercise of the powers conferred clause (1 ) of sub- section (2) of Section 92 read with Section 26 of the Food Safety and Standards Act, 2006 (34 of 2006 ) , in the notification of Government of India in the Food Safety and Standards Authority of India File No. 4/15015/30/2011 dated the 29th December, 2011 in the Gazette of India, Extraordinary, Part III , Section 4 at pages 1 to 2, inviting objections or suggestion from the persons likely to be affected thereby, till the expiry of a period of ten days from the date on which copies of the Gazette of India in which the said notification was published were made available to the public;
And whereas the copies of the said Gazette of India were made available to the public on the 2nd January, 2012;
And whereas the objections and suggestions received from the public have been duly considered by the Central Government;
Now, therefore , in exercise of the powers conferred by Section 92 of the Food Safety and Standards Act , 2006 (34 of 2006), the Food Safety and Standards Authority of India hereby makes the following regulations further to amend the Food Safety and Standards ( Prohibition and Restrictions on Sales ) Regulations , 2011 , namely:-
REGULATIONS
1. Short title and commencement.-
( 1 ) These regulations may be called the Food Safety and Standards (Prohibition and Restrictions on sales ) (Amendment) Regulations , 2013 .
(2) They shall come into force on the date of their final publication in the Official Gazette.
2. In the Food Safety and Standards ( Prohibition and Restrictions on Sales) Regulations , 2011 ,
(a) in the opening portion of the preamble , for the words, brackets and figures " clause ( 1 ) of sub - section (2 ) of section 92 read with section 26 " the word and figures " section 92 " shall be substituted,
(b) in regulation 2.1 , in sub -regulation 2.1.1 , for the second proviso , the following proviso shall be substituted , namely:-
"Provided further that the proprietary food articles , as defined in sub - regulation 2.12.1 of the Food Safety and Standards (Food Product Standards and Food Additives) Regulations , 2011 , relating to clauses (8 ) and ( 10 ) of sub -regulation 2.1.1 shall be exempted from the operation of these regulations" .
