का.आ. 339(अ).-यतः , मै. इम्पेट्स इन्फोटेक ( इण्डिया ) प्राइवेट लिमिटेड , जो मध्य प्रदेश राज्य के ग्राम बड़ियाकिमा , जिला इन्दौर में आईटी/आईटीईएस क्षेत्र के लिए एक क्षेत्र विशिष्ट विशेष आर्थिक जोन की स्थापना हेतु विशेष आर्थिक जोन अधिनियम , 2005 ( 2005 का 28 ) ( जिसे एतद्दश्चात् उक्त अधिनियम कहा गया है ) की धारा 3 के अन्तर्गत प्रस्ताव किया था;
और यतः , केन्द्र सरकार इस बात से संतुष्ट होने के बाद कि उक्त अधिनियम की धारा 3 की उप- धारा ( 8 ) के अन्तर्गत अपेक्षाओं तथा अन्य संबंधित अपेक्षाओं को पूरा कर लिया गया है और उसने उपर्युक्त विशेष आर्थिक जोन के विकास , प्रचालन एवं रखरखाव हेतु उक्त अधिनियम की धारा 3 की उप- धारा ( 10 ) के अन्तर्गत दिनांक 5 दिसम्बर , 2012 को अनुमोदन पत्र प्रदान कर दिया था;
अतः , अब , विशेष आर्थिक जोन अधिनियम , 2005 की धारा 4 की उप - धारा ( 1 ) के दूसरे परंतुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और विशेष आर्थिक जोन नियमावली, 2006 के नियम 8 के अनुसरण में , केन्द्र सरकार एतद्वारा निम्नलिखित क्षेत्र को उक्त विशेष आर्थिक जोन के भाग के रूप में अधिसूचित करती है, जो निम्नलिखित तालिका में उल्लिखित सर्वेक्षण संख्याए और क्षेत्र शामिल है अर्थात्

और इसलिये , केन्द्रीय सरकार विशेष आर्थिक जोन अधिनियम, की धारा 13 की उप - धारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए विशेष आर्थिक जोन अधिनियम , 2005 ( 2005 का 28 ) एतद्वारा उक्त अधिनियम की धारा 14 की प्रयोजनार्थ उपर्युक्त विशेष आर्थिक जोन के लिए एक समिति जिसे अनुमोदन समिति कहा जाएगा , गठित करती है, जिसके अध्यक्ष और सदस्य निम्नानुसार हैं, अर्थात्:-
-अध्यक्ष , पदेन 1. विशेष आर्थिक जोन का विकास आयुक्त
सदस्य , पदेन 2. निदेशक अथवा उप - सचिव, भारत सरकार , वाणिज्य एवं उद्योग मंत्रालय , वाणिज्य विभाग या उसका नामिती जिसका स्तर अवर सचिव, भारत सरकार से कम नहीं होगा
-सदस्य, पदेन 3. विशेष आर्थिक जोन पर भू- भागीय क्षेत्राधिकार रखने वाला क्षेत्रीय संयुक्त विदेश व्यापार महानिदेशक
-सदस्य, पदेन 4. विशेष आर्थिक जोन पर भू- भागीय क्षेत्राधिकार रखने वाले सीमा शुल्क आयुक्त या केन्द्रीय उत्पाद शुल्क आयुक्त अथवा उनका नामिती जिसका स्तर संयुक्त आयुक्त से कम नहीं होगा

And, therefore, the Central Government, in exercise ofthe powers conferred by sub - section ( 1 ) of Section 13 of the Special Economic Zones Act , 2005 (28 of2005 ) , hereby constitutes a Committee to be called the Approval Committee for the above Special Economic Zone for the purposes of Section 14 of the said Act consisting of the following Chairperson and Members , namely :--

-Chairperson -Member, ex-officio और इसलिये , केन्द्रीय सरकार विशेष आर्थिक जोन अधिनियम , की धारा 53 की उप - धारा ( 2 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए विशेष आर्थिक जोन अधिनियम , 2005 (2005 का 28 ) एतद्वारा , दिनांक 5 फरवरी , 2013 को उस तारीख के रूप में निर्धारित करती है जिस तारीख से उक्त क्षेत्र विशिष्ट विशेष जोन को सीमा शुल्क अधिनियम , 1962 ( 1962 का 52) की धारा 7 के अंतर्गत अंतर्देशीय कंटेनर डिपो माना जाएगा ।

Impetus Infotech (India) Private Limited has proposed under Section 3 of the Special Economic Zones Act, 2005 ( 28 of 2005), (hereinafter referred to as the said Act) , to set up a sector specific Special Economic Zone for Information technology and information technology enabled services at Village Badiyakima , District , Indore in the State of Madhya Pradesh;

-Special Invitee And whereas, the Central Government is satisfied that requirements under sub- section ( 8) of Section 3 of the said Act , and other related requirements are fulfilled and ithas granted letter of approval under sub - section ( 10) of Section 3 of the said Act for development, operation and maintenance of the above sector specific Special Economic Zone on 5th December , 2012 ;
And , therefore , the Central Government , in exercise of the powers conferred by sub - section (2 ) of Section 53 of the Special Economic Zones Act, 2005 (28 of 2005 ), hereby appoints the 5th day of February, 2013 as the date from which the above Special Economic Zone shall be deemed to be Inland Container Depot under Section 7 of the Customs Act , 1962 (52 of 1962) .
Now, therefore , the Central Government, in exercise ofthe powers conferred by sub- section ( 1 ) of Section 4 of the Special Economic Zones Act , 2005 and in pursuance ofrule 8 ofthe Special Economic Zones Rules , 2006, hereby notifies the following area at above location with survey numbers given below in the Table , as a Special Economic Zone, namely:-
