का.आ. 347(अ).- जबकि मैसर्स जिन्दल पावर लिमिटेड ( जेपीएल ) , आवेदक, जिसका पंजीकृत कार्यालय तमनार -496107 , जिला रायगढ़ , छत्तीसगढ़ ( भारत ) में है , ने जेपीएल- रायगढ़ ( तमनार ) 400 केवी 2× डी/सी ( क्वाड ) समर्पित पारेषण लाइन के निर्माण के संबंध में विद्युत अधिनियम , 2003 की धारा 164 के अंतर्गत अनुमोदन के लिए आवेदन किया है ।
और, जबकि, भारत सरकार, विद्युत मंत्रालय ने दिनांक 22-9-2011 के पत्र सं. 11 /2/2011 - पीजी ( जिंदल ) के तहत , विद्युत अधिनियम , 2003 की धारा 68 के अंतर्गत मैसर्स जिंदल पावर लिमिटेड को जेपीएल के 4 × 600 मेगावाट संयंत्र के स्विचयार्ड से पीजीसीआईएल के रायगढ़ पूलिंग केन्द्र ( तमनार के निकट ) तक 400 केवी डी/सी ( क्वाड ) की 2 पारेषण लाइनों के निर्माण के लिए अनुमोदन प्रदान कर दिया था ।
और, जबकि, आवेदक ने अब विद्युत अधिनियम , 2003 की धारा 164 के अंतर्गत वे सभी शक्तियां उसे प्रदान किए जाने का अनुरोध किया है जो सरकार द्वारा स्थापित अथवा रख - रखाव करने अथवा कार्यों के लिए स्थापित अथवा रख - रखाव किए जाने वाले टेलिग्राम के उद्देश्य से टेलीग्राफ लाइनें तथा खंभे लगाने के सबंध में, भारतीय टेलीग्राफ अधिनियम , 1885 के अंतर्गत टेलीग्राफ प्राधिकरण के पास हैं । स्कीम के अंतर्गत शामिल 10.5 कि.मी. की पारेषण लाइन निम्नलिखित गांवों , नगरों और शहरों में से , उनके ऊपर से , आस - पास से तथा बीच में से होकर गुजरेगी :-

इसलिए , अब , सावधानीपूर्वक विचार करने के पश्चात्, विद्युत मंत्रालय , भारत सरकार, विद्युत अधिनियम, 2003 की धारा 164 के अंतर्गत, अंतर - राज्यीय विद्युत पारेषण के लिए, अंतर्राज्यीय पारेषण लाइनों हेतु उपर्युक्त उल्लिखित संस्थापना के लिए निम्नलिखित शर्तों एवं निबंधनों के अधीन , सरकार द्वारा स्थापित या देख - रेख या इस प्रकार स्थापित या देख - रेख किए जाने वाले टेलिग्राफ के उद्देश्य से टेलिग्राफ लाइनों और खंबे लगाने के संबंध में भारतीय टेलिग्राफ अधिनियम , 1885 के अंतर्गत टेलिग्राफ प्राधिकरण के पास जो शक्तियां हैं , उन सभी शक्तियों को आवेदक को प्रदान करता है , अर्थात्:-
( i ) अनुमोदन 25 वर्ष के लिए प्रदान किया जाता है;
( ii ) आवेदक को प्रस्तावित लाइनों के निर्माण से पूर्व , संबंधित प्राधिकरणों अर्थात् स्थानीय निकायों , रेलवे, राष्ट्रीय राजमार्ग, राज्य राजमार्ग आदि की सहमति प्राप्त करनी होगी;
(iii ) आवेदक को पारेषण , ओ एंड एम , खुली पहुँच आदि के संबंध में उपयुक्त आयोग के विनियमों/संहिताओं का पालन करना होगा;
(iv ) आवेदक को जेपीएल- रायगढ़ ( तमनार ) 400 केवी 2 ×डी/सी समर्पित पारेषण लाइनों के निर्माण की जिम्मेदारी सौंपी गई है ।
लाइन के विवरण 7-1-2012 के भारत के राजपत्र में प्रकाशित हुए हैं ।
( v ) आवेदक संबंधित राज्यों के मुख्य वैद्युत निरीक्षक के अनुमोदन के पश्चात् लाइनों का प्रचालन करेगा;
( vi ) यह अनुमोदन विद्युत अधिनियम , 2003 के प्रावधानों और उसके अंतर्गत बनाई गई नियमावली की अपेक्षाओं का आवेदक द्वारा अनुपालन किए जाने के अधीन है ।

S.O. 347 (E) . Whereas M/s . Jindal Power Limited ( JPL) , the applicant with its Registered Office at Tamnar - 496107 , District Raigarh , Chhattisgarh (India) has applied for approval under Section 164 of the Electricity Act , 2003, in respect of construction of JPL - Raigarh (Tamnar) 400kV2 × D/C ( Quad) dedicated Transmission line.
Andwhereas Government of India, Ministry of Power vide letter No. 11 /2/2011 - PG-(Jindal ) dated 22-09-2011 had granted approval under Section 68 of the Electricity Act , 2003 to M/ s . Jindal Power Limited for construction of 2 nos . of 400 kV D/ C (Quad) transmission lines from switchyard of 4 × 600 MW Plant of JPL to Raigarh (near Tamnar) pooling station ofPGCIL .
And whereas the applicant has now requested to confer upon him all the powers under Section 164 of the Electricity Act , 2003 which telegraph authority possess under the Indian Telegraph Act, 1885 with respect to the placing of telegraph lines and posts for the purposes of a telegraph established or maintained, by the Government or to be so established or maintained for the works . The transmission line of 10.5 kms covered under the scheme will pass through, over, around and between the following villages , towns and cities :-

Now, therefore, after careful consideration , Government of India , Ministry ofPower, confers , under Section 164 of the Electricity Act , 2003 , all the powers on the applicant which telegraph authority possesses under the Indian Telegraph Act, 1885 with respect to the placing of telegraph lines and posts for the purposes of a telegraph established or maintained, 3

bythe Government or to be so established or maintained subject to following terms and conditions for installing the above mentioned inter - state transmission lines for inter - state transmission of electricity, namely :-
(i) the approval is granted for 25 years ;
(ii) the Applicant shall have to seek the consent of the concerned authorities i.e. local bodies , Railways , National Highways , State Highways etc. before erection of proposed lines ;
(iii) the Applicant shall have to follow regulations/ codes of the appropriate commission regrarding transmission , O & M , open access etc;
(iv) the Applicant has been entrusted with the responsibility for construction of JPL - Raigarh ( Tammar) 400 kV 2 × D/Cdedicated Transmission line . The details ofthe works are published in the Gazette of India of07-01-2012;
(v) theApplicant shall operate the lines after approval of Chief Electrical Inspector of respective States ;
(vi) the apporval is subject to compliance by the Applicant to the requirement of the provisions of The Electricity Act, 2003 and the rules made thereunder.
