का.आ. 352 (अ).- चूँकि केन्द्र सरकार को तम्बाकू बोर्ड द्वारा यह सूचना दी गयी है कि कर्नाटक राज्य में बडी संख्या में पंजीकृत उत्पादकों द्वारा फ्लू क्योर्ड वर्जीनिया तम्बाकू की अधिकृत मात्रा से अधिक खेती की गयी है तथा अपंजीकृत उत्पादकों ने भी अनधिकृत फ्लू क्योर्ड वर्जीनिया तम्बाकू की खेती की है, जिससे मांग तथा आपूर्ति की स्थिति में असंतुलन आ गया है;
और चूँकि केन्द्र सरकार इस बात से संतुष्ट है कि फ्लू क्योर्ड वर्जीनिया तम्बाकू की खरीद की अनुमति देने के लिए तम्बाकू बोर्ड को प्राधिकृत करना आवश्यक एवं समीचीन है और वह कर्नाटक राज्य में तम्बाकू बोर्ड के निर्दिष्ट नीलामी मंचों पर पंजीकृत उत्पादकों की फ्लू क्योर्ड वर्जीनिया तम्बाकू की अतिरिक्त फसल तथा अपंजीकृत उत्पादकों की फ्लूक्योर्ड वर्जीनिया तम्बाकू की फसल का निपटान करना उचित समझती है;
इसलिए , अब, तम्बाकू बोर्ड अधिनियम, 1975 (1975 का 4) की धारा 8 की उपधारा (2) के खंड (छ) के साथ पठित धारा 20क द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए केन्द्रीय सरकार एतद्वारा तम्बाकू बोर्ड को सरकारी राजपत्र में इस अधिसूचना के प्रकाशन की तारीख से 31 मई, 2013 तक की अवधि के लिए यह प्राधिकार देती है कि वह कर्नाटक में अपने नीलागी मंचों पर कर्नाटक राज्य में पंजीकृत किसानों द्वारा उगाए गए अतिरिक्त फ्लू कयोर्ड वर्जीनिया तम्बाकू तथा अपंजीकृत उत्पादकों द्वारा उगाए गए फ्लू कयोर्ड वर्जीनिया तम्बाकू की खरीद करने के लिए तम्बाकू बोर्ड के पंजीकृत व्यापारियों तथा डीलरों को निम्नलिखित शर्तों के अधीन अनुमति प्रदान करे; अर्थात
(क) वर्ष 2012-13 के फसली मौसम के लिए प्रत्येक पंजीकृत उत्पादक द्वारा उत्पादित अतिरिक्त फ्लू क्योर्ड वर्जीनिया तम्बाकू के लिए 2 रूपए प्रति कि.ग्रा. तथा बिक्री आय के 7.5 % (उत्पादकों द्वारा देय आय के 1 % का एक सामान्य सेवा शुल्क सहित) को तम्बाकू निधि में जमा किया जाएगा;

(ख) वर्ष 2012-13 के फसली मौसम के लिए प्रत्येक अपंजीकृत उत्पादक द्वारा उत्पादित फ्लू क्योर्ड वर्जीनिया तम्बाकू के लिए दो रूपए प्रति कि.ग्रा . तथा तथा बिक्री आय के 15 % ( उत्पादकों द्वारा देय आय के 1 % का एक सामान्य सेवा शुल्क सहित) को तम्बाकू निधि में जमा किया जाएगा ; और
(14) वर्ष 2011 के लिए तम्बाकू की फसल के संबंध में अधिकारों के रिकार्ड की एक प्रति प्रस्तुत है ।

NOTIFICATION
New Delhi , the 11th February, 2013
S.O.352 ( E) .- WHEREAS , the Central Government has been informed by the Tobacco Board that a large number of registered growers have cultivated flue cured virginia tobacco in excess of the authorized quantity and unregistered growers have also resorted to unauthorised flue cured virginia tobacco cultivation in the State of Karnataka, causing a mismatch between the demand and supply position;
AND, whereas , the Central Government is satisfied that it is necessary and expedient to authorize Tobacco Board to allow the purchase of flue cured virginia tobacco and considers it appropriate to dispose of the excess flue cured virginia tobacco crop of the registered growers and the flue cured virginia tobacco crop of the unregistered growers at the designated auction platforms of the Tobacco Board in the State of Karnataka ;
NOW, therefore, in exercise of the powers conferred by section 20A read with clause ( g) of sub- section (2) of section 8 of the Tobacco Board Act, 1975 (4 of 1975 ) , the Central Government hereby authorises the Tobacco Board to admit, from the date of publication of this notification in the Official Gazette and upto the 31st May, 2013 , the registered traders and dealers of the Tobacco Board to purchase, at its auction platforms in the State of Karnataka , the excess flue cured virginia tobacco produced by the registered growers and flue cured virginia tobacco produced by unregistered growers in the State of Karnataka, subject to the following conditions , namely: -
(a) an amount of Rs . 2 per kg. , and 7.5 per cent. of the proceeds of the sale (including a normal service charge of 1 % of proceeds payable by growers) shall be contributed to the Tobacco Fund by every registered grower for the excess flue cured virginia tobacco produced by them for 2012-13 crop season ;
(b) an amount of Rs . 2 per kg . , and 15 per cent . of the proceeds of the sale ( including a normal [ भाग II-खण्ड 3 (ii) ]

service charge of 1% of proceeds payable by growers ) shall be contributed to the Tobacco Fund by every unregistered grower for the flue cured virginia tobacco produced by him /her for 2012-13 crop season;
(c) a copy of the Record of Rights in respect of tobacco crop for the year 2011 is furnished .

का.आ. 353(अ). चूँकि केन्द्र सरकार इस बात से संतुष्ट है कि ऐसी परिस्थितियां उत्पन्न हो गई हैं जिनके कारण जनहित में यह आवश्यक हो गया है कि तम्बाकू बोर्ड अधिनियम 1975 (1975 का 4) द्वारा लगाए गए प्रतिबंधों में ढील प्रदान की जाए ।
और चूँकि केन्द्र सरकार ने यह आवश्यक समझा है कि पंजीकृत उत्पादकों की बेशी फ्लू क्योर्ड वर्जीनिया तम्बाकू तथा अपंजीकृत उत्पादकों द्वारा उत्पादित फ्लू क्योर्ड वर्जीनिया की बिक्री कर्नाटक राज्य में तम्बाकू बोर्ड के निर्दिष्ट नीलामी मंचों से की जाए;
इसलिए , अब, तम्बाकू बोर्ड अधिनियम, 1975 ( 1975 का 4) की धारा 8 की उपधारा (2) के खंड (छ) के साथ पठित धारा 30 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए केन्द्रीय सरकार एतद्वारा कर्नाटक राज्य में उक्त अधिनियम की धारा 10 के साथ पठित धारा 14 - क (1 ) की उप- धारा 1 में इस अधिसूचना के राजपत्र में प्रकाशित होने की तारीख से शुरू होकर 31 मई, 2013 को समाप्त होने वाली अवधि के लिए ढील प्रदान करती है तथा पंजीकृत उत्पादकों की अतिरिक्त फ्लू क्योर्ड वर्जीनिया तम्बाकू फसल तथा अपंजीकृत उत्पादकों की फ्लू क्योर्ड वर्जीनिया तम्बाकू फसल की बिक्री तम्बाकू बोर्ड द्वारा अधिकृत नीलामी मंचों पर करने की अनुमति प्रदान करती है ।

S.O. 353 (E) . WHEREAS , the Central Government is satisfied that circumstances have arisen rendering it necessary in the public interest, to relax the restrictions imposed by the Tobacco Board Act, 1975 (4 of 1975) ;
AND , whereas , the Central Government considers it necessary to dispose of the excess fiue cured virginia tobacco of the registered growers and flue cured virginia tobacco of THE GAZETTE OF INDIA : EXTRAORDINARY

unregistered growers at the designated auction platforms of the Tobacco Board in the State of Karnataka .
NOW, therefore , in exercise of the powers conferred by sub section ( 1 ) of section 30 read with clause (g ) of sub-section (2) of section 8 of the Tobacco Board Act , 1975 (4 of 1975) , the Central Government hereby relaxes the operation of the provisions of section 10 read with sub section 1 of 14-A of the said Act in the State of Karnataka for the period commencing from the date of publication of this notification in the Official Gazette and ending upto the 31st May, 2013 and permits the sale of excess flue cured virginia tobacco crop of the registered growers and flue cured virginia tobacco crop of the unregistered growers at the auction platforms authorised by the Tobacco Board.
