विषय: " ताईवान , तुर्की और यू एस ए के मूल के अथवा वहां से निर्याति " "पेरोक्सोसल्फेट्स " ( जिसे " परसल्फेट्स " के रूप में भी जाना जाता है ) के आयातों से संबंधित पाटनरोधी जांच की शुरूआत ।
सं. 14/9/2012- डीजीएडी. अधिसूचना सं. 14/9/2012 - डीजीएडी के तहत दिनांक 28 सितम्बर, 2012 को जारी उक्त अधिसूचना में एतद्वारा निम्नलिखित संशोधन समाविष्ट किए जाते हैं ।
2. पैरा 4 में संशोधन किया जाएगा जिसे निम्नानुसार पढ़ा जाए :
पैरा 4 की प्रथम पंक्ति में "मूल " को "वर्तमान " पढ़ा जाए ; " था " को "है" पढ़ा जाए ।
पैरा 4 की दूसरी - तीसरी पंक्ति (दूसरा वाक्य) , जो निम्नानुसार है, को हटा दिया जाए ।
"यह निर्णायक समीक्षा जांच होने के कारण " इस जांच में वही उत्पाद शामिल होगा जो मूल जांच में कवर किया गया था ।

3. " घरेलू उद्योग भी समान गुणधर्मों और विनिर्देशनों युक्त "परसल्फेट्स " का उत्पादन करता है । पिछली जांच में विचाराधीन उत्पाद और समान वस्तु के संबंध में किसी भी हितबद्ध पक्षकार ने

कोई तर्क नहीं दिया था । वर्तमान जांच पहले अधिरोपित पाटनरोधी शुल्क की निर्णायक समीक्षा जांच है इसलिए प्राधिकारी विचार करते हैं कि घरेलू उद्योग द्वारा विनिर्मित किया जा रहा उत्पाद पाटनरोधी नियमावली के अनुरूप "समान वस्तु" है । "
को निम्नानुसार पढ़ा जाए
"आवेदक ने दावा किया है कि उसके द्वारा उत्पादित वस्तु संबद्ध देशों के मूल की या वहां से निर्यातित वस्तु के " समान वस्तु" है । यह दावा किया गया है कि घरेलू उद्योग द्वारा उत्पादित और संबद्ध देशों से आयातित संबद्ध वस्तु तुलनीय है, भौतिक, तकनीकी विशेषताओं, कार्यों या अंतिम प्रयोगों के संबंध में तकनीकी तथा वाणिज्यिक रूप से प्रतिस्थापनीय है । अतः वर्तमान जांच के प्रयोजनार्थ आवेदक कंपनियों द्वारा उत्पादित पैरोक्सोसल्फेट्स को पाटनरोधी नियमों के अर्थ के भीतर संबद्ध देशों से आयातित पैरोक्सोसल्फेट्स के समान वस्तु माना जा रहा है" ।
4. पैरा 15 में " समीक्षा " शब्द को "जांच " पढ़ा जाए ।

सभी हितबद्ध पक्षकारों को एतद्द्वारा सलाह दी जाती है कि वे प्रस्तुत मामले में अपने हित (हित की प्रवृत्ति सहित) के बारे में सूचित करें और अपनी-अपनी प्रश्नावलियों के प्रत्युत्तर दायर करें तथा पाटनरोधी उपायों को जारी रखने अथवा नहीं जारी रखने की आवश्यकता के बारे में घरेलू उद्योग के आवेदन पर अपनी टिप्पणियां इस जांच के शुरू होने की तारीख से चालीस (40) दिनों के अंदर प्रस्तुत करें ।

"सभी हितबद्ध पक्षकारों को एतद्वारा सलाह दी जाती है कि वे संबद्ध जांच में अपने हित (हित की प्रकृति सहित) के बारे में सूचना प्रस्तुत करें और प्रश्नावली के अपने उत्तर दायर करें एवं इस जांच की शुरुआत की तारीख से 40 दिनों के भीतर घरेलू उद्योग के आवेदन पर अपनी टिप्पणियां प्रस्तुत करें"

CORRIGENDUM
New Delhi , the 7th February, 2013
Subject : Initiation of anti - dumping investigation on imports of ' Peroxosulphates ' ( also known as ' Persulphates ' ) originating in or exported from 'Taiwan ' , Turkey and USA .
No. 14/9/ 2012-DGAD .- The following amendments are hereby incorporated in the said notification issued on 28th September, 2012 vide notification No. 14/9/2012 - DGAD .

2. Para 4 shall be amended to read as follow:
In the first line of para 4 ' original' to read as ' present ' ; ' was' to read as ' is' .
The second-third line of para 4 ( the second sentence) as mentioned below is deleted.
' This being a Sunset review investigation ' therefore , the investigation covers the same product, as was covered in the original investigation.
In Para 7

' The domestic industry also products 'Persulphates ' having similar characteristics and specifications . No argument has been extended, by any interested party in the previous investigation, on the issue of product under consideration or like article. The present investigation is a Sunset review of the anti dumping duty earlier imposed. Therefore, the Authority considers that the products being manufactured by the domestic industry is ' like article ' to the product under consideration as per the AD Rules' .

' The applicant has claimed that the goods produced by them are " like articles " to the goods originating in or exported from the subject countries . It has been claimed that the subject goods produced by the domestic industry and imports from subject countries are comparable , technically and commercially substitutable in terms of physical , technical specifications , functions or end- uses . Therefore, for the purpose of present investigation, Peroxosulphates produced by the applicant companies is being treated as like articles of Peroxosulphates imported from subject countries within the meaning of the Anti Dumping Rules ' .
4. In para 15 the word ' review ' is to read as ' investigation' .

'All the interested parties are hereby advised their interest ( including the nature of interest) in the instant and file their questionnaire's responses and offer their comments to the domestic industry's application regarding the need to continue or otherwise the AD measures within the 40 days from the date of initiation of this investigation' .
