का.आ. 365 (अ).- केन्द्रीय सरकार ने, भारतीय राष्ट्रीय राजमार्ग प्राधिकरण अधिनियम, 1988 (1988 का 68 ) की धारा ।। के अधीन जारी की गई भारत सरकार के तत्कालीन सड़क परिवहन और राजमार्ग मंत्रालय अधिसूचना संख्या क का.आ. 1035 ( अ ) , तारीख 07/05/2010 द्वारा राजस्थान राज्य में राष्ट्रीय राजमार्ग संख्या 12 के जयपुर-टोंक-दयोली- कोटा खण्ड में राष्ट्रीय राजमार्ग -76 में कोटा बाईपास के 18.700 कि.मी. से 165.000 कि.मी. से जक्शन तक के खण्ड को भारतीय राष्ट्रीय राजमार्ग प्राधिकरण ( जिसे इसमें इसके पश्चात् " प्राधिकरण " कहा गया है ) को सौंपा है;
और प्राधिकरण ने धारा 14 द्वारा प्रदत्त शक्तियों के अनुसरण में, मैसर्स जीवीके दयोंली कोटा एक्सप्रेसवे प्रा . लिमिटेड, जो 25.03.2010 को प्रस्तुत की गई बोलियों का सफल बोलीदाता है , और जिसका रजिस्ट्रीकृत कार्यालय "पाइगा हाउस " , 156-159 , सरदार पटेल रोड़ सिकन्दराबाद -500 003 , आन्ध्रप्रदेश, भारत (जिसे इसमें इसके बाद " रियायतग्राही " कहा गया है ) , के साथ राष्ट्रीय राजमार्ग सं. - 12 के जयपुर-टोंक-दयोली- कोटा खण्ड में राष्ट्रीय राजमार्ग -76 में कोटा बाईपास के 18.700 कि.मी. से 165.000 कि.मी. से जक्शन तक के खण्ड (जिसे इसमें इसके पश्चात् उक्त खण्ड कहा गया है ) को चार लेन का बनाने प्रचालन और अनुरक्षण के लिए करार ( जिसे इसमें इसके पश्चात् उक्त करार कहा गया है ) किया है ।

अतः अब, केन्द्रीय सरकार , राष्ट्रीय राजमार्ग फीस ( दरों का अवधारण और संग्रहण ) नियम, 2008 (जिसे इसमें इसके पश्चात् " नियम " कहा गया है ) के नियम 3 के साथ पठित राष्ट्रीय राजमार्ग अधिनियम , 1956 ( 1956 का 48 ) की धारा 8 क द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , उक्त खण्ड के निर्माण, अनुरक्षण , प्रबंध और प्रचालन, निवेशित पूंजी पर ब्याज , युक्ति यक्त रिटर्न, यातायात का परिमाण तथा प्राधिकरण और रियायतग्राही के बीच हुए करार में निहित अवधि को ध्यान में रखते हुए , एतद्वारा यह अधिसूचित करती है कि उक्त खण्ड के उपयोग के लिए यांत्रिक यानों पर चार लेन के खण्डों के उपयोग हेतु निवल सड़क खंड के लिए सारणी 1 के स्तंभ ( 2 ) में निर्दिष्ट दर पर फीस उद्ग्रहीत और संग्रहीत की जाएगी और पुलों / संरचना, जिनकी लागत पचास करोड़ या अधिक है, का उपयोग करने वाले नीचे सारणी 1 और 2 में विनिर्दिष्ट प्रकार के वाहनों पर सारणी सं. 2 में निर्दिष्ट आधार दरों पर फीस उद्ग्रहीत और संग्रहीत की जाएगी और वाणिज्यिक प्रचालन या इस अधिसूचना के राजपत्र में प्रकाशन की तारीख को या उस तारीख को या उस तारीख से, जो भी पश्चात्वर्ती हो , करार में निर्दिष्ट समापन की तारीख तक फीस का संग्रहण करने तथा उसे प्रतिधारित के लिए उक्त रियायतग्राही को प्राधिकृत करती है ;

150.00/ - रूपए ( एक सौ पचास रूपए मात्र ) है जो , राष्ट्रीय राजमार्ग फीस (दरों का अवधारण और संग्रहण ) नियम , 2008 के उपबंधों के अनुसार, प्रत्येक वर्ष पुनरीक्षण के अध्यधीन है।

5. जो यांत्रिक यान नियमों के अधीन इसके प्रवर्ग के लिए विनिर्दिष्ट अनुज्ञेय भार की अपेक्षा अधिक भार से लदे हुए होंगे उन्हें उन दरों पर फीस का संदाय करना होगा जो उनसे अगले उच्च प्रवर्ग के यानों के लिए लागू होता है और उन्हें तब तक राजमार्ग खंड का उपयोग करने का अधिकार नहीं होगा जब तक कि ऐसे यांत्रिक यान से अधिक भार को हटा न दिया जाए।
6. यांत्रिक यानों के प्रवर्ग , उनके लिए अनुज्ञेय भार , छूटप्राप्त यानों के प्रवर्ग , सर्विस रोड़, वैकल्पिक सड़क आदि सहित सभी परिभाषाएं नियमों में विनिर्दिष्ट परिभाषाओं के अनुसार होंगी।
7. उक्त नियम के नियम 12 के अनुसार उपभोक्ताओं की जानकारी के लिए फीस की दरों को प्रदर्शित किया जाएगा ।
8. फीस की दरों में पुनरीक्षण उक्त नियमों के नियम 5 के अनुसार वार्षिक रूप से किया जाएगा परंतु छः मास की अवधि के भीतर कोई पुनरीक्षण नहीं किया जायेगा।

NOTIFICATION
New Delhi, the 14th February, 2013
S.O. 365(E).---Whereas by notification of the Government of India in the erstwhile Ministry of Road Transport and Highways number S.O. 1035 (E) , dated 07/05/2010 issued under section 11 of the National Highways Authority of India Act, 1988 (68 of 1988 ) for entrustment to NHAI , the Central Government has entrusted the stretch from kilometer 18.700 to kilometer 165.000 to junction of Kota Bypass on NH- 76 of Jaipur - Tonk - Deoli Kota section of National Highway No. 12 in the State of Rajasthan to the National Highways Authority of India (hereinafter referred to as the " Authority " ) ;
And whereas , pursuant to the provision of section 14, the Authority has entered into an Agreement (hereinafter referred to as said agreement) with GVK Deoli Kota Expressway Pvt . Ltd. having its registered office "PAIGAH HOUSE" , 156-159, Sardar Patel Road, Secunderabad 500 003 , Andhra Pradesh, India (hereinafter referred to as the "Concessionaire " ) , the successful bidder for bids submitted on 25/03/2010 for the development of Deoli Kota section from km 165.000 to junction of NH- 76 on Kota Bypass on National Highway No. 12 (hereinafter referred to as the " said section " ) to four lane standards and operation and maintenance of the said section on Design, Build, Finance, Operate and Transfer ( DBFOT) basis .
Now, therefore, in exercise of the powers conferred by section 8A of the National Highways Act, 1956 (48 of 1956) , read with rule 3 of the National Highways Fee (Determination of Rates and Collection) Rules, 2008 (hereinafter referred to as the " Rules ") , the Central Government, having regard to the expenditure involved in building, maintenance, management and operation of the said section , interest on the capital invested, reasonable return, the volume of traffic and the period of the agreement entered into between the authority and the concessionaire, hereby notifies that there shall be levied and collected fees on mechanical vehicles for the use of the said section at the rate specified in columns (2) of the Table 1 for net road section length for use of the four and more lane sections ( hereinafter referred to as " base rate " ) and at the base rates specified in the Table No.2 for bridges /structures costing Rupees Fifty Crore or more on the Type of Vehicles specified in Table 1 and 2 below , and authorizes the said Concessionaire to collect and retain the fee on and from the date of commercial operation or publication of this notification in the Official Gazette, whichever is later , till the termination date as specified in the agreement;

3. The rate of monthly pass for local personal traffic is Rs . 150.000 (Rs . One Hundred and Fifty Only) for the year 2007-08 which is subject to revision every year as per the provisions of the National Highways Fee (Determination of Rates and Collection) Rules , 2008 .
4. For multiple journey on the highway section , passes shall be issued at the following rates , namely:

5. Mechanical vehicles which is loaded in excess of permissible load specified for its category under the Rules , shall be liable to pay fee at such rates which is applicable for the next higher category of the vehicles and shall not be entitled to make use of the highway sectión unless the excess load has been removed from such mechanical vehicle .
6. All definitions including category of mechanical vehicles , its permissible load , category of exempted vehicles , service road , alternative road etc. shall be as per definitions specified in the Rules .
7. The fee rates shall be displayed for information of the users in accordance with rules 12 of the said Rules .
8. The fee rates shall be revised annually in accordance with the Rule 5 of the said rules provided that no revision shall be effected within six months .
